In What We Owe to Each Other, T.M. Scanlon formulated a new version of the ethical theory called contractualism. This theory took reasons considerations that count in favour of judgment-sensitive attitudes to be the fundamental normative notion. It then used normative reasons to first account for evaluative properties. For an object to be valuable, on this view, is for it to have properties that provide reasons to have favourable attitudes towards the bearer of value. Scanlon also used reasons to account for moral wrongness. His contractualism claims that an act is morally wrong if it is forbidden by any set of moral principles that no one could reasonably reject. My thesis consists of five previously published articles which attempt to clarify Scanlon s theory and to defend it against its critics. The first article defends the idea that normative reason-relations are fundamental against Joshua Gert. Gert argues that rationality is a more basic notion than reasons and that reasons can be analysed in terms of their rationally requiring and justifying dimensions. The second article explores the relationship between value and reasons. It defends Scanlon s view according to which reasons are the more basic than value against those who think that reasons are based on the evaluative realm. The last three articles defend Scanlon s views about moral wrongness. The first one of them discusses a classic objection to contractualist theories. This objection is that principles which no one could reasonably reject are redundant in accounting for wrongness. This is because we need a prior notion of wrongness to select those principles and because such principles are not required to make actions wrong or to provide reasons against wrong actions. The fourth article explores the distinctive reasons which contractualists claim there are for avoiding the wrong actions. The last article argues against the critics of contractualism who claim that contractualism has implausible normative consequences for situations related to the treatment of different-sized groups of people.

Within the context of heightened perceptions of risk within thehigher education sector worldwide, responsibility for outcomes isincreasingly required not only of universities but, also, ofindividual academics. In turn, contracts have become a key formof governance for institutions in mediating and modulating thisrisk and responsibility. While much writing around the use ofcontracts in higher education has focused on market-based,competitive neoliberal conceptions of contractualism, thisarticle argues that there are, in fact, two largely antagonisticnew modes of contractualism – market contractualism andrelational contractualism – and a third, residual mode, paternalcontractualism. These three modes of contractualism coexistwithin universities, in tension. The article draws on two Australianexemplars to highlight how these tensions play out and tohighlight the potential for contractualism to create spaces forshared goals and projects and shared risks resulting from theways in which responsibility and individual agency are negotiated.

David Hume belonged to the consecuencialist philosophical tendency, in which is included utilitarianism. This tendency was opposed to the normativism philosophy, in which is enrolled contractualism. This article analyzes the critique made by David Hume, from the utilitarianism perspective, against contractualism. The major philosophers of contractualism are Thomas Hobbes, John Locke and Jean Jacques Rousseau. Hume implemented three arguments in opposition to them: 1) historic: the social contract does not have any practical testing. Therefore it could not be presented as the foundation of the state; 2) philosophical: it is not the duty, but the interest that moves men to seek the formation of the political authority; 3) social: in the consciousness of the people, there is no trace of the social contract.Utilitarianism was one of the philosophical tendencies that finished the theoretical hegemony that contractualism had during the XVII and the XVIII centuries. Nonetheless from the historical and social point of view, the liberalization movements in many parts of the world, at that time, were inspired by contractualism. It means that from the theoretical point of view, utilitarianism, certainly, stressed the empirical origins of the state but not the rational justification of the political Authority. Hume was unable to understand the normative force that contractualism owns, which inspires human action.

In this paper, we interrogate the way that narratives about the unfolding of settler colonialism through time are encoded in recent Australian Indigenous policy frameworks. We argue that the postcolonial image of a single transformative moment of radical political break is embedded in Australian policy frameworks, but is deployed in ways that fuse this idea with the moment of colonial completion and in so doing assist the colonial project. By merging the moment of decolonisation and the moment of colonial completion, temporal narratives mobilise conservative and progressive settler voices towards colonial goals. We identify three recent policy approaches: reconciliation, neoliberal contractualism and intervention, and interrogate the narratives of the present and future that they reflect and deploy. We argue these unacknowledged stories of the colonial future must be contested, so that debates about how settler and Indigenous people might live together differently across time are not foreclosed.

Resumen: El presente discurso aborda los elementos constitutivos de la tradición jurídica occidental tales como el concepto de derecho como “la misma cosa justa”, la relación entre derecho positivo y natural, como así también la importancia del derecho de gentes. Luego analiza cómo se han ido desnaturalizando principalmente a través del subjetivismo y voluntarismo jurídicos que han desembocado en el contractualismo político, fundamento del orden jurídico moderno.

The “crisis of the social issue” in the EU has led to a certain consensus in the need to renew the organizational and institutional model of public administration. The core of the reform implies important administrative changes in most of the European welfare states. Those changes are inspired on theories such as the new public management, management by objectives or partnership. Such changes involve both semantic (“sharing responsibilities”, “effective costs”, or the substitution of “citizen under an administration” by “consumer”) and political (predominance of scattered forms of power and the individualization of responsibilities) transformations which operate in the framework of individuals and State relations. The paradigms of activation and flexicurity have been central in this public administration modernization project. This commitment with new forms of governance of social issues has important consequences for the political and moral foundations of social cohesion, and the Spanish case is not an exception. This paper aims at looking at those representations of “modernization” (as they appear in debates about the employment services restructuring policies) in detail as well as providing references to the trajectory of such reforms of public services since the early eighties to the beginning of the crisis.

A tese tem como foco quatro eixos centrais: o ensino superior, a sociedade civil, a cidadania e a hegemonia. Na primeira parte da tese, estes eixos teórico-conceptuais são explanados numa perspectiva da promoção de uma compreensão mais ampla da sociedade civil e do estado, nomeadamente o contratualismo, o liberalismo, o materialismo e o neoliberalismo. Um protagonismo fundamental é atribuído às concepções de Antonio Gramsci de sociedade civil, cidadania e estado aplicadas no ensino superior no Sul da Amazónia brasileira. A segunda parte da tese concentra-se num estudo de caso com três premissas de análise: a fragmentação do ensino superior brasileiro; a reconfiguração da cidadania e hegemonia; e o ensino superior no contexto do Amazonas. O ensino superior no Brasil teve início com as escolas jesuíticas, que, depois de encerradas pelo Marquês de Pombal não tiveram sucessoras em solo brasileiro, ao nível do que poderia ter sido o embrião de um sistema de ensino superior. A chegada da Corte Imperial Portuguesa, em 1808, permite reinstalar novos cursos. A primeira unidade de ensino superior no Amazonas surge apenas no princípio do século XX. Um século depois, tem início o processo de expansão com a implantação de unidades no interior do estado. O ensino superior no Brasil, nas últimas décadas, assumiu um caráter híbrido e de massificação. A massificação, no entanto, ainda é uma realidade a ser alcançada. Apesar dos avanços realizados na última década, ainda subsiste ainda uma forte exclusão de estudantes. O enfoque sobre o ensino superior e a cidadania, no contexto do Amazonas, surge na articulação de um conjunto de informação empírica, extraída de entrevistas realizadas com atores chave locais, com as categorias de pensamento de Antonio Gramsci, que sustentam teoricamente o estudo. Esta articulação tem no ensino superior a possibilidade de desenvolver a cidadania como o princípio organizador e fim último deste nível de ensino. Neste sentido, a hegemonia ganha um estatuto de orientação e direção que permite aos sujeitos envolvidos no ensino superior maior possibilidade de autonomia, liberdade, justiça social, empregabilidade e desenvolvimento social. O modelo de universidade para a cidadania apresenta-se como uma possibilidade de mudanças no horizonte social, económico e também político, no interior da própria universidade. O ensino superior, perspectivado como um instrumento essencial para a cidadania, tem como objetivo primordial a qualificação de professores para a educação de base, Reflexivamente, esta qualificação não deixará potencialmente de produzir retornos positivos na própria expansão e abrangência numérica e educativa do próprio ensino superior. Desta forma, a cidadania no ensino superior é perspectivada neste estudo como um deslocamento de lógicas de compreensão individual e de individualização elitista dos benefícios para lógicas assentes em construções mais coletivas, portadoras de benefícios sociais. A interiorização do ensino superior no Amazonas é assumida no estudo como uma possibilidade de formação académica para o desenvolvimento de práticas pedagógicas e científicas críticas e mais conscientes, constituindo um horizonte determinante para a ativação de processos de integração regional e nacional. Em suma, os pontos de confluência entre o ensino superior, a sociedade civil, a cidadania e as propostas de Gramsci, estão relacionados com a formação, a conscientização política, e o bem-estar económico e social.

En este documento se quiere demostrar que una teoría que pretenda fundamentar la política social que no permita las comparaciones interpersonales es inadecuada. Por esta razón, el punto de partida es una crítica a la economía normativa neoclásica. Esta crítica consiste, en últimas, en una crítica al concepto de bienestar de los utilitaristas. Se plantea que el bienestar entendido como utilidad excluye información relevante para juzgar el bienestar de las personas, y se propone que el concepto de bienestar del profesor Amartya Sen es adecuado como base de una teoría para la política social.

In this paper, I seek to undermine G.A. Cohen’s polemical use of a metaethical claim he makes in his article, ‘Facts and Principles’, by arguing that that use requires an unsustainable equivocation between epistemic and logical grounding. I begin by distinguishing three theses that Cohen has offered during the course of his critique of Rawls and contractualism more generally, the foundationalism about grounding thesis, the justice as non-regulative thesis, and the justice as all-encompassing thesis, and briefly argue that they are analytically independent of each other. I then offer an outline of the foundationalism about grounding thesis, characterising it, as Cohen does, as a demand of logic. That thesis claims that whenever a normative principle is dependent on a fact, it is so dependent in virtue of some other principle. I then argue that although this is true as a matter of logic, it, as Cohen admits, cannot be true of actual justifications, since logic cannot tell us anything about the truth as opposed to the validity of arguments. Facts about a justification cannot then be decisive for whether or not a given argument violates the foundationalism about grounding thesis. As long as, independently of actual justifications, theorists can point to plausible logically grounding principles, as I argue contractualists can, Cohen’s thesis lacks critical bite.

This study investigates accounting students’ ethical decision-making judgments and behavioral intentions. The Multidimensional Ethics Scale (MES) was used to measure the extent to which a hypothetical behavior was consistent with three moral criteria (Moral Equity, Relativism and Contractualism). The study specifically tests the differences in ethical decision-making between students who have been exposed to a dedicated ethics unit of study compared with students who have not studied ethics. The influences of culture and gender on students’ ethical decision-making are also addressed in the study. Ethical decision-making was assessed via three case studies describing moral dilemmas that an individual, business or professional person might face. The results provide support for the MES and the value added from incorporating a dedicated ethical decision-making unit in the accounting curriculum. The results also support prior evidence of gender bias and the impact of cultural differences on ethical decision-making.
