Christine Riefa is a lecturer in Consumer Law and Intellectual Property Law at Brunel University in the UK. She is an elected board member of the International Association of Consumer Law and an academic correspondent to the Euro-American Chair for the legal protection of consumers (University of Cantabria, Spain). In 2009-2010, Dr Riefa is a Fulbright EU Scholar-in-Residence at Cleveland-Marshall College of Law, Ohio USA. A first version of this article was presented at the Summer School in Consumer Law, organised by the GREDICC (Groupe de recherche en droit international et comparé de la consummation), UQAM, Montréal, 29th June – 4th July 2009.

This thesis studies how commercial practice is developing with artificial intelligence (AI) technologies and discusses some normative concepts in EU consumer law. The author analyses the phenomenon of 'algorithmic business', which defines the increasing use of data-driven AI in marketing organisations for the optimisation of a range of consumer-related tasks. The phenomenon is orienting business-consumer relations towards some general trends that influence power and behaviors of consumers. These developments are not taking place in a legal vacuum, but against the background of a normative system aimed at maintaining fairness and balance in market transactions. The author assesses current developments in commercial practices in the context of EU consumer law, which is specifically aimed at regulating commercial practices. The analysis is critical by design and without neglecting concrete practices tries to look at the big picture. The thesis consists of nine chapters divided in three thematic parts. The first part discusses the deployment of AI in marketing organisations, a brief history, the technical foundations, and their modes of integration in business organisations. In the second part, a selected number of socio-technical developments in commercial practice are analysed. The following are addressed: the monitoring and analysis of consumers’ behaviour based on data; the personalisation of commercial offers and customer experience; the use of information on consumers’ psychology and emotions, the mediation through marketing conversational applications. The third part assesses these developments in the context of EU consumer law and of the broader policy debate concerning consumer protection in the algorithmic society. In particular, two normative concepts underlying the EU fairness standard are analysed: manipulation, as a substantive regulatory standard that limits commercial behaviours in order to protect consumers’ informed and free choices and vulnerability, as a concept of social policy that portrays people who are more exposed to marketing practices.

In Consumer Law there is a special concern to protect the consumer, who is the weaker party in the legal relationship. With this thesis we intend to show that the professional sometimes needs protection against abusive conducts from consumers. The thesis describes the different categories of abuse of rights and explains some types of consumer contracts. After examining some of the consumer’s rights, we list some situations where the consumer acts frequently with abuse of rights, by analyzing judicial decisions. We conclude that it is not possible which conducts may involve an abuse of right in an abstract manner. Only by analyzing every case and its characteristics individually can one decide where there is an abuse of right.

The scope of the present work is to study the legal protection conferred upon the consumer in Angola, especially as regards electronic communication agreements. Its purpose is to promote consumers’ rights and contribute to its defence given the relatively privileged position of professionals in their relationship with consumers. With this in mind, we have made a description of the Consumer Law in Angola based on the Angolan Constitution (as the law that establishes the fundamental rights and guarantees of citizens) and on the Consumer’s Defence Law, which, as the basic law regarding consumers’ rights, provides the framework for this dissertation. We have analysed several aspects relating to consumer relationships, starting from its concept and rights of consumers and covering the legal and contractual mechanisms put in place for their protection. We have also analysed the Advertising Law with a view to better understand consumer’s rights before advertising campaigns carried out by professionals whilst promoting their goods and services and, additionally, to understand the duties and principles that shall be complied with in such campaigns with the purpose to protect the rights and interests of consumers. From a criminal point of view, we have briefly covered the crimes against consumers provided for in the Penal Code and the Law of Infractions against the Economy. In the second part of this work, we have summarised the institutions that protect the rights and interests of consumers, which include the Public Prosecutor Office, the National Institute for the Defence of the Consumers and the Consumers’ Associations. The third and last part of this work covers electronic communications agreements. Given the fact that there is no specific legislation in this matter, our analysis was based on the Civil Code – specifically the part relating to contracts – the Law on General Contractual Terms and Conditions and the Consumer’s Defence Law. We have analysed the formation of contracts, compliance and consumers’ rights resulting from contract breach. We further have appealed to the Angolan legislator to legislate certain aspects of consumer relationships, especially those where breach of consumers’ rights are blatant and facilitated by the lack of specific laws addressing such cases.

L'agriculture biologique est issue d'une longue lutte du consommateur et du citoyen pour connaître et contrôler la qualité de son alimentation. Sa popularité montante confirme que la disponibilité de l'information sur l'offre joue un rôle économique et social central auprès de la demande. Cette tendance appuie l'émergence d'un nouvel élément au sein du corpus des droits de la personne : le droit à l'information. Cette étude aborde les étapes de sa formation et prend pour exemple la filière agroalimentaire biologique. Elle représente un modèle avant-gardiste de l'hybridation entre le droit privé et le droit public. Nous examinons en premier lieu comment l'activité des secteurs agroalimentaires civils et privés a contribué à fomenter le désir d'information du consommateur, pour ensuite le mettre en péril. Parallèlement à cela, nous proposons d'analyser les effets et l'influence du corpus de droits et de principes du développement durable sur la filière biologique, mais surtout sur la reconnaissance du besoin d'information pour le consommateur. Enfin, nous faisons un tour d'horizon de la réglementation publique de l'appellation biologique, de son label et de son étiquette. Pour cela, nous évaluons les mesures en place selon les critères de la véracité, de l'accessibilité et de l'exhaustivité de l'information divulguée au consommateur. À la lumière de notre analyse, le consommateur peut tirer ses propres conclusions sur les meilleures réponses normatives à ses besoins. Quelles mesures entre le droit transnational, le droit international et le droit national offrent le meilleur résultat? Laquelle de ces formes juridiques s'avère en mesure de promouvoir une consommation responsable où le consommateur ne fait plus face aux obstacles à son choix éclairé?

Il n’existe présentement aucun code de la consommation dans la législation de la République Démocratique du Congo. Au vu de ce manque d’intérêt du législateur congolais pour les droits des citoyens consommateurs, il ne faut pas s’étonner du mutisme des deux textes réglementaires y régissant le secteur informatique quant à la protection des consommateurs internautes. Le citoyen congolais désireux de faire respecter les droits que lui a conférés un contrat conclu par voie électronique devra s’astreindre (lui ou son procureur) à colliger un certain nombre de textes éparpillés dans la législation de ce pays. La protection juridique accordée au consommateur congolais traditionnel (acheteur de biens matériels en général) se limite en ce moment à quelques dispositions législatives traitant de la publicité dans le secteur pharmaceutique, de l’affichage des prix, de l’interdiction de refuser de vendre un produit une fois que celui-ci a fait l’objet d’une offre et que les conditions de la vente ont été réunies, et de l’interdiction également de refuser de fournir une prestation de services une fois que celle-ci est devenue exigible. À certains égards, et prises dans leur ensemble, les normes éparses relatives à la consommation que la législation congolaise comporte protègent. mais de façon très partielle, les intérêts des consommateurs. Elles sont tout à fait inadéquates quant à la protection des intérêts des « cyberconsommateurs ». La solution à ce vide législatif consiste évidemment à faire adopter une loi en la matière, mais il s’agit là d’une solution imparfaite à cause de son aspect sectoriel. Une solution définitive, à nos yeux, devrait nécessairement être de nature internationale.

La ley 1480 de 2011 conocida también como Estatuto del Consumidor, es una norma creada para proteger en la mayor medida posible a los consumidores en Colombia en todos los sectores de la economía nacional, como regla general. A pesar de esto, fue expedida la Ley 1558 de 2011 que busca reformar la Ley del Turismo, la cual dispone que en materia de servicios de transporte aéreo, el Estatuto del Consumidor se encuentra excluido. En consecuencia los consumidores de este sector económico se encuentran protegidos exclusivamente por las normas especiales que menciona dicha ley, las cuales al ser analizadas y confrontadas con las disposiciones del Estatuto del Consumidor, se evidencia una precariedad en los derechos de protección que otorga la ley especial frente a la ley general. Por lo tanto se concluye que los usuarios de los servicios de transporta aéreo se encuentran desprotegidos en sus derechos como consumidores, al ser la norma especial significativamente menos proteccionista que la norma general. La Tesis de grado analiza la situación descrita, haciendo un análisis comparativo del régimen especial que busca proteger a los usuarios de servicios de transporte aéreo, con la norma general que aplica para el resto de consumidores en Colombia; Ley 1480 de 2011. Así mismo realiza un examen de constitucionalidad de la norma especial, para determinar la violación de las disposiciones Constitucionales, que la ley 1558 de 2012 causa, especialmente respecto del derecho a la igualdad y al derecho a la protección de los consumidores de el sector económico en mención.

O Brasil possui uma rigorosa legislação no que consiste ao controle das relações de consumo. No entanto, ainda não parece possível perceber que a vulnerabilidade natural do consumidor, em relação ao fornecedor, conseguiu ser efetivamente minimizada. No entanto, alguns instrumentos, como a Ação Civil Pública, o Inquérito Civil e o Compromisso de Ajustamente de Conduta, da forma como foram constituídos, teoricamente, podem contribuir significativamente para o alcance de uma maior eficácia jurídica da legislação consumerista e, consequentemente, para a efetividade social dos direitos dos consumidores, ainda que, na prática, alguns desafios precisem ser enfrentados.
