Taking the South African experience as an example, this article considers the interpretive benefits to be reaped from having access to bi- and multilingual versions of a statutory text. The discussion takes place against the backdrop of a history of statutory bi- and multilingualism in the said jurisdiction as well as, at present, constitutional guarantees of language rights and the “parity of esteem” of eleven official languages. It is argued that, if invoked with due discretion and in a non-rigid way, statutory multilingualism can be a boon to statutory and constitutional interpretation. The South African courts – whose traditional approach to statutory inter-pretation has tended to be literalist, formalistic and formulaic – are, generally speaking, to be commended for their supple use of bilingualism as an aid to interpretation over the years. The advent of constitutional multilingualism and the (potential) availability of statutory texts (and the Constitution) in more than two languages, have moreover created conditions conducive to the further development and refinement of reliance on multilingualism in statutory and constitutional interpretation – certain challenges notwithstanding.

More than a century ago in their definitive work “The Right to Privacy” Samuel D. Warren and Louis D. Brandeis highlighted the challenges posed to individual privacy by advancing technology. Today’s workplace is characterised by its reliance on computer technology, particularly the use of email and the Internet to perform critical business functions. Increasingly these and other workplace activities are the focus of monitoring by employers. There is little formal regulation of electronic monitoring in Australian or United States workplaces. Without reasonable limits or controls, this has the potential to adversely affect employees’ privacy rights. Australia has a history of legislating to protect privacy rights, whereas the United States has relied on a combination of constitutional guarantees, federal and state statutes, and the common law. This thesis examines a number of existing and proposed statutory and other workplace privacy laws in Australia and the United States. The analysis demonstrates that existing measures fail to adequately regulate monitoring or provide employees with suitable remedies where unjustifiable intrusions occur. The thesis ultimately supports the view that enacting uniform legislation at the national level provides a more effective and comprehensive solution for both employers and employees. Chapter One provides a general introduction and briefly discusses issues relevant to electronic monitoring in the workplace. Chapter Two contains an overview of privacy law as it relates to electronic monitoring in Australian and United States workplaces. In Chapter Three there is an examination of the complaint process and remedies available to a hypothetical employee (Mary) who is concerned about protecting her privacy rights at work. Chapter Four provides an analysis of the major themes emerging from the research, and also discusses the draft national uniform legislation. Chapter Five details the proposed legislation in the form of the Workplace Surveillance and Monitoring Act, and Chapter Six contains the conclusion.

Neste trabalho, analisa-se a segurança jurídica decorrente da coisa julgada e sua importância para a legitimação do discurso jurídico, assim como a ação rescisória e os meios transrescisórios, enquadrados pela doutrina e pela jurisprudência como meios que possibilitam a desconsideração da coisa julgada. Critica-se, além disso, as teorias que buscam permitir a desconsideração da coisa julgada por meio de mero juízo de ponderação exercido pelo magistrado em cada caso concreto. Inclui-se, ainda, um estudo sobre a maneira como esses institutos vêm sendo compreendidos diariamente nos tribunais, levando em conta, especialmente, a perspectiva constitucional do processo e o momento de fragilidade no tratamento da coisa julgada no cenário jurídico pátrio contemporâneo. No que tange especificamente à ação rescisória, são debatidos temas pontuais que se relacionam com a origem do instituto e também com sua aplicação prática. Um estudo de Direito Comparado é levado a cabo com a análise dos instrumentos de rescisão previstos na Itália, Espanha, Alemanha e Portugal, para que se tenha uma noção parcial do estágio de desenvolvimento do ordenamento jurídico brasileiro no que se refere ao tema objeto deste estudo.

Dans ce mémoire, nous examinons le fichage de la délinquance sexuelle dont les divers régimes juridiques reposent sur l’idée que ces contrevenants présentent un risque réel de récidive criminelle. Les données scientifiques sur la délinquance sexuelle relativisent ce risque et attestent qu’il est quasi absent dans un très grand nombre de cas. Il existe donc une dichotomie entre les prémisses du droit et les connaissances issues des sciences sociales et humaines sur cette question. Le fichage de cette délinquance au Canada donne lieu à des mécanismes administratifs provinciaux en plus d’un régime fédéral contenu au Code criminel. Nous émettons l’hypothèse que le fichage provincial emporte de véritables conséquences pénales sur les délinquants sexuels, affectent leurs droits en vertu de l’article 7 de la Charte et contrecarre des principes de justice fondamentale. Ensuite, nous examinons le régime fédéral intégré au Code criminel et nous argumentons que ce mécanisme juridique crée une mesure punitive de la nature d’une peine. Par conséquent, le fichage fédéral devrait être aménagé de façon à satisfaire aux garanties constitutionnelles propres à la peine et aux principes généraux de la détermination de la peine en vertu de la Partie XXIII du Code criminel. Nous concluons que les législateurs successifs ont créé des régimes juridiques régissant le fichage de la délinquance sexuelle en écartant les principes fondamentaux administratifs, criminels et constitutionnels qui devraient présider à l’élaboration des règles concernant ce stigmate de la criminalité. Les tribunaux, par leur interprétation, ont également déqualifié cette stigmatisation de la criminalité sexuelle à titre de peine. Le droit relatif au fichage de la délinquance sexuelle donne donc lieu à une érosion des principes fondamentaux de la justice criminelle et punitive.

With security being viewed as ensuring protection from physical and mental harm, freedom from want and fear, human security has moved to the centre stage of the global development agenda. This paper argues that even with low income, one can achieve higher human development like higher life expectancy, lower fertility and high literacy. Amartya Sen, Nobel Laureate of India, has characterised it as “development as freedom”. Lack of substantive freedom is inexorably linked to economic poverty and backwardness. Nearly all States in India have succeeded in reducing poverty, but those States with better human development have fared better. The trickle-down alone will not spread the benefits of reform. Measured State intervention and adequate provision of safety nets for the vulnerable sections of people are needed to make development more sustainable. Democracy and development go hand in hand. The democratic, accountable and transparent governance is the best insurance against poverty and marginalisation. The test of good governance must be premised on how the State and civil society negotiate differences via constitutional guarantees and political institutions. Good governance is the key to equitable growth.-----Con la visión de la seguridad como la garantía de protección contra daños físicos y mentales, de estar liberados de necesidades y temores, la seguridad humana ha pasado a ser la estrella central del programa del desarrollo global. En este trabajo se argumenta que, incluso con ingresos bajos, uno puede lograr un mayor desarrollo humano, como una esperanza de vida más larga, una menor fertilidad y una mejor educación. Amartya Sen, Premio Nobel de India, lo ha caracterizado como “el desarrollo como libertad”. La falta de libertad fundamental está vinculada inexorablemente a la pobreza económica y el retraso. Casi todos los Estados de la India han reducido la pobreza con éxito, pero aquellos que tienen un mejor desarrollo humano han salido mejor. Tan solo esta reducción paulatina no va a difundir los beneficios de la reforma. La intervención medida del Estado y su adecuado suministro de redes de seguridad para los sectores vulnerables de la población son necesarios para hacer más sostenible el desarrollo. La democracia y el desarrollo van de la mano. El gobierno democrático, responsable y transparente es el mejor seguro contra la pobreza y la marginalización. La prueba del buen gobierno debe tener como premisa la forma en que el Estado y la sociedad civil negocien las diferencias a través de garantías constitucionales e instituciones políticas. El buen gobierno es la clave para el crecimiento justo.

Las causas por las cuales se puede decretar el estado de emergencia han variado en el tiempo según las circunstancias de cada época y de cada país. Dichas situaciones de emergencia pueden obedecer a causas naturales o humanas. Pueden producirse por fenómenos físicos o climatológicos, por conmociones interiores, ataques exteriores, o incluso por desequilibrios económicos o sociales sectoriales o generales. Y, para hacer frente a estos estados excepcionales, el derecho internacional ha delimitado una serie de principios que deben ser respetados por los gobiernos locales.

Esta dissertação de mestrado tem o objetivo de estudar o efeito suspensivo do recurso de apelação e seus reflexos no sistema jurídico brasileiro. Com efeito, busca-se analisar as possíveis consequências da supressão do próprio efeito suspensivo sobre o tempo de duração dos processos e quanto a possível insegurança jurídica causada pela ausência da suspensão dos julgados de primeira instância. Sustenta-se neste trabalho que a supressão do efeito suspensivo pode ser uma proposta para aumentar a celeridade na tramitação dos processos no Brasil, sem causar problemas de segurança jurídica. Em primeiro lugar, descreve-se o problema de investigação e suas proposições. O primeiro capítulo apresenta a judicialização das relações sociais e, por conseguinte, a multiplicação do número de ações distribuídas e a crescente exigência pela efetividade da prestação jurisdicional. Neste mesmo capítulo o trabalho se ocupa em apreciar dos dados obtidos junto ao Tribunal de Justiça do Rio de Janeiro e com a análise qualitativa de casos típicos que demonstram o uso do efeito suspensivo tão somente para procrastinar o tempo de duração do processo bem como para barganhar um possível acordo vantajoso para o devedor. Em seguida, apreciamos os Princípios constitucionais da Segurança Jurídica e da Efetividade e Celeridade da Prestação Jurisdicional indicando o marco teórico de cada princípio. O segundo capítulo descreve conceito de sentença e seus efeitos, levando-se em consideração as últimas reformas processuais. Após, estuda-se a suposta estabilidade do sistema jurídico com a aplicação do efeito suspensivo, abordando o duplo grau de jurisdição como garantia constitucional. Posteriormente, indicamos a utilização estratégica do efeito suspensivo pelos atores (réus) do processo. O terceiro capítulo destina-se a apontar a legislação estrangeira e seus respectivos fundamentos jurídicos que influenciaram o nosso ordenamento jurídico, bem como a colaboração do autor em sugerir uma nova proposta de lei. Aproveitamos a oportunidade para trazer á baila as possíveis alterações oriundas do projeto do novo Código de Processo Civil e suas aspirações para dirimir os obstáculos que causam o longo tempo de duração dos processos. Por fim, apresentamos as considerações finais sobre a hipótese de supressão do efeito suspensivo como meio de alcançar a redução do tempo de duração do processo mantendo-se as garantias constitucionais da ampla defesa e do devido processo legal. Com efeito, demonstra-se que não há qualquer violação ao Princípio da Segurança Jurídica.

Este estudo aborda a viabilidade de enfrentamento, pela autoridade julgadora em processo administrativo fiscal, do argumento de inconstitucionalidade da lei que determina a exigência do tributo. Procede-se a uma análise crítica, a partir de precedentes dos Conselhos de Contribuintes do Ministério da Fazenda, da solução usualmente adotada, de não-conhecimento da irresignação do contribuinte, sob o fundamento da reserva de jurisdição. A proposta defende a possibilidade de pronunciamento do julgador administrativo, com efeitos para o caso concreto, além de sustentar a hipótese como um direito do contribuinte, à luz da garantia constitucional do devido processo legal e dos princípios da legalidade, da moralidade e da eficiência.

The journalists, as occupants of a enlarged spectrum concerning of right of the inform, have responsibility for the information they disseminate, devoir that puts on the basis of the constitutional right to be informed. This duty is divided with journalistic companies, when them realized. In the research, examined the existence of constitutional guarantees the right to be informed. To answer the question, realized research to support bibliographical and documentary. The guaranty is a empirical preoccupation coated with legality, since lends itself effect concretize a right. Traced so a panel of guarantees of institutional imprint, substantive and procedural. Treating of the institutional guarantees the right to information, it would refer to true institutions (as the free press) and may begin subjective rights. In the case of substantial guarantees, we would have access to information, the confidentiality of the fonts and the incensurable feature of journalistic information. A guarantee peculiar would be constitution of bodies responsible for monitoring the quality of the vehicles of communication. The criminal responsibility of the media is analyzed when the criteria for production of news and events involving public safety are produced without considering the technical, legal and ethical practice of journalism in the media factors. Freedom of speech, expression of thought, necessary for professional qualifications and constitutional limits, reaching criminal constitutional principles and the possibilities of criminal liability for offenses practiced in the media are present as key factors legal dialogue in this work. The judgment of the Supreme Court on the unconstitutionality of Law nº. 5.250/67 called Media Law caused a gap in the national legal system, forcing the use of the criminal code to address issues that involve crimes produced in media professional performance. The presumption of innocence is ignored by the professional media during a police investigation where the information published does not respect, including constitutional guarantees: the right to privacy, honor and image. The right to information and the duty to inform media are worked in its constitutional aspect, considering that the same information should be produced is guided by the quality and guiding principles of truth. The constitutional concept of media is presented as information with the appropriate language of the news media, produced and disseminated through the vehicles of mass media, whether in print or digital platform. The presented model of the legal right to information is outlined from a constitutional hermeneutics, increasing the production of news as a result of the occupation of journalist in different news platforms, guaranteeing the quality of this prolific law. Under the Freedom of professional activity of the journalist, the constitutional limits are addressed in line with the reality of (non) regulation of their profession, considering the constitutional abuses committed in the exercise of that activity linked to communication fences. Jusphilosophic field reaches the limits of the duty of truth in journalism as a tool for spreading news, respect the audience and compatibility with the constitutional state. Using the conceptual and doctrinal aspects, this criminal offense is parsed from the journalistic practice and the publication of news involving public safety, with the hypothetical field consummation of that crime through the eventual intention. As a form of judgment against these crimes produced in honor media presents the court of the jury as a legitimate form of democratic decision

Desde la vigencia de la Constitución del 2008, nuestro país evidencia una serie de cambios significativos, relacionados principalmente con las garantías constitucionales. En la presente monografía se ha realizado un estudio detallado de cada uno de estos mecanismos constitucionales, que garantizan una protección eficiente de los derechos reconocidos en el ordenamiento jurídico interno y en los instrumentos internacionales a favor de las personas. La presente investigación se divide en dos importantes secciones, que son las siguientes: Inicialmente, se presentan los avances en tema de garantías constitucionales establecidas en la Constitución de 2008, en relación a las garantías reguladas en el cuerpo político de 1998; se desarrolla además, un análisis de cada uno de estos mecanismos constitucionales, garantías normativas, institucionales, de políticas públicas, y jurisdiccionales, efectuando una referencia de las instituciones que abarca cada una de ellas.

The focus of this article is on the proposed consumer guarantees component of the Australian Consumer Law. The Productivity Commission (PC), in its review of Australia’s Consumer Policy Framework, noted that it had not ‘undertaken the detailed analysis necessary to reach a judgment on the adequacy or otherwise of the existing regulation in this area, or the merits of alternative models such as those adopted in countries such as New Zealand’. Accordingly, it recommended that: ‘The adequacy of existing legislation related to implied warranties and conditions should be examined as part of the development of the new national generic consumer law’.

Australian Constitutional referendums have been part of the Australian political system since federation. Up to the year 1999 (the time of the last referendum in Australia), constitutional change in Australia does not have a good history of acceptance. Since 1901, there have been 44 proposed constitutional changes with eight gaining the required acceptance according to section 128 of the Australian Constitution. In the modern era since 1967, there have been 20 proposals over seven referendum votes for a total of four changes. Over this same period, there have been 13 federal general elections which have realised change in government just five times. This research examines the electoral behaviour of Australian voters from 1967 to 1999 for each referendum. Party identification has long been a key indicator in general election voting. This research considers whether the dominant theory of voter behaviour in general elections (the Michigan Model) provides a plausible explanation for voting in Australian referendums. In order to explain electoral behaviour in each referendum, this research has utilised available data from the Australian Electoral Commission, the 1996 Australian Bureau of Statistics Census data, and the 1999 Australian Constitutional Referendum Study. This data has provided the necessary variables required to measure the impact of the Michigan Model of voter behaviour. Measurements have been conducted using bivariate and multivariate analyses. Each referendum provides an overview of the events at the time of the referendum as well as the =yes‘ and =no‘ cases at the time each referendum was initiated. Results from this research provide support for the Michigan Model of voter behaviour in Australian referendum voting. This research concludes that party identification, as a key variable of the Michigan Model, shows that voters continue to take their cues for voting from the political party they identify with in Australian referendums. However, the outcome of Australian referendums clearly shows that partisanship is only one of a number of contributory factors in constitutional referendums.
