Les Cris de la Baie James sont parmi les premiers bénéficiaires d'un traité moderne qui prévoit un rôle déterminant pour les Autochtones dans la gestion de l'environnement et du développement des ressources naturelles. À travers la Convention de la Baie James et du Nord québécois, les Cris participent à la gestion de l'environnement et sont assurés d'un droit de regard sur les projets de développement futurs dans l'ensemble de leur partie du territoire conventionné. Cette participation, qui est le fruit d'une intense négociation, est aujourd'hui renforcée, à travers des ententes de coopération subséquentes, grâce notamment, à l'émergence du mouvement écologiste qui a contribué à la reconnaissance d'un rôle particulier pour les Autochtones à l'égard de l'environnement. Par l'examen des mécanismes de protection de l'environnement, notamment le processus d'évaluation environnementale, aux termes du chapitre 22 de la Convention de la Baie James et du Nord québécois, cette étude met en lumière l'importance du processus de négociation et des droits qui en résultent par rapport à ceux reconnus en vertu de la doctrine des droits ancestraux telle que développée récemment par les tribunaux canadiens.

Le jeu a toujours été perçu comme un vice, responsable de nombreux troubles sociaux. Par conséquent, les gouvernements ont adopté divers cadres juridiques pour contrôler et gérer ses conséquences négatives. Malgré qu'il soit omniprésent, le jeu en ligne est illégal au Canada, aux États Unis et dans plusieurs autres pays. La règlementation du jeu en ligne et la gestion de ses troubles sociaux présente un plus grand défi pour les gouvernements, particulièrement en raison de sa nature technologique et extraterritoriale. Ce mémoire identifiera les risques et conséquences liés au jeu, en particulier les problèmes de jeu, ainsi que les cadres juridiques adoptés pour les règlementer et minimiser. Nous examinerons le statut juridique du jeu en ligne dans différentes juridictions, dont le Canada, les États Unis, le Royaume-Uni et ailleurs dans l'Union européenne. Ces cadres juridiques comprennent l'interdiction du jeu en ligne aux États Unis, la légalisation, l’octroi de licences et taxation du jeu en ligne au Royaume Uni et les cadres juridiques employés au Canada et ailleurs, offrant du jeu en ligne exclusivement par l’entremise de monopoles d'état pour contrôler sa disponibilité et minimiser ses conséquences néfastes. Nous tirerons des conclusions quant à l'efficacité relative des différents cadres juridiques adoptées pour règlementer le jeu en ligne.

In the album Journey, Archie Roach -- the Australian Indigenous singer-songwriter hailing from Mooroopna in Victoria - has a melancholy song called ‘Travell’n Bones.' It is about the repatriation of Indigenous ancestral remains to their rightful home. This Chapter considers the legal, ethical, and cultural conflicts over Australian indigenous remains being held in museums, in Australia, the United Kingdom, the European Union, and the United States. James Nason comments: ‘The explosion of legal and extra legal attention on issues of cultural property and heritage was born of the frustration and anger of indigenous peoples whose rights and perspectives about cultural property and heritage issues had been largely absent and essentially unwanted by the museum of community.' Part I focuses upon disputes in Australia involving the repatriation of Indigenous Australian remains. In Bropho v HREOC, there was controversy over a cartoon, mocking the repatriation of the remains of Yagan, an Indigenous warrior, to Western Australia. There was a discussion about the operation of the Racial Discrimination Act 1975 (Cth), and the exemptions available from the operation of the regime. Part II considers the efforts by The Te Papa Tongarewa - the Museum of New Zealand - to repatriate Maori and Moriori ancestral remains to New Zealand, and to iwi communities of origin. The conclusion considers the relevance of the United Nations Declaration on the Rights of Indigenous Persons 2007, and issues raised by ventures such as the Genographic Project.

We examine support for policies affecting indigenous ethnic minorities in Chile. Specifically, we examine the role of national group definitions that include the largest indigenous group—the Mapuche—in different ways. Based on questionnaire data from nonindigenous Chilean students (N = 338), we empirically distinguish iconic inclusion, whereby the Mapuche are seen as an important part of Chile's history and identity on the one hand, from egalitarian inclusion, which represents the Mapuche as citizens of equal importance to the nonindigenous majority on the other. Both forms of inclusion positively predict support for indigenous rights, independent of participants' political affiliation, strength of national identification, and social distance. A second study (N = 277) replicates this finding whilst controlling for right-wing authoritarianism, social dominance orientation, blind patriotism, and constructive patriotism. It also finds iconic inclusion to be predictive of a pro-Mapuche position regarding the unrest over the issue of ancestral land in 2009. We conclude that understanding how national identity affects attitudes about minority rights necessitates appreciating the importance of particular meanings of nationality, and not only the strength of identification.

Esta investigación ofrece un análisis del reconocimiento jurídico a la desagregación territorial. La primera parte de la investigación giro en torno a la necesidad de caracterizar las tensiones emergentes en el territorio ancestral de los pueblos Camëntsá e Inga con el proyecto de la construcción de la variante San Francisco-Mocoa, en el periodo de 1996 al 2011. La segunda parte analizó las acciones reivindicativas empleadas por los pueblos indígenas Camëntsá e Inga en el marco de su interés por el reconocimiento del derecho al territorio; y finalmente se analizaron los marcos institucionales que explican las tensiones respecto al reconocimiento del territorio entre el Gobierno Nacional y las Autoridades Indígenas de los pueblos Camëntsá e Inga en el departamento del Putumayo.

Under the Alien Tort Statute United States of America (“America”) Federal Courts have the jurisdiction to hear claims for civil wrongs, committed against non-American citizens, which were perpetrated outside America’s national borders. The operation of this law has confronted American Federal Courts with difficulties on how to manage conflicts between American executive foreign policy and judicial interpretations of international law. Courts began to pass judgment over conduct which was approved by foreign governments. Then in 2005 the American Supreme Court wound back the scope of the Alien Tort Statute. This article will review the problems with the expansion of the Alien Tort Statute and the reasons for its subsequent narrowing.

The protection of privacy has gained considerable attention recently. In response to this, new privacy protection systems are being introduced. SITDRM is one such system that protects private data through the enforcement of licenses provided by consumers. Prior to supplying data, data owners are expected to construct a detailed license for the potential data users. A license specifies whom, under what conditions, may have what type of access to the protected data. The specification of a license by a data owner binds the enterprise data handling to the consumer’s privacy preferences. However, licenses are very detailed, may reveal the internal structure of the enterprise and need to be kept synchronous with the enterprise privacy policy. To deal with this, we employ the Platform for Privacy Preferences Language (P3P) to communicate enterprise privacy policies to consumers and enable them to easily construct data licenses. A P3P policy is more abstract than a license, allows data owners to specify the purposes for which data are being collected and directly reflects the privacy policy of an enterprise.
