The Tampa decision : refugee rights versus the executive's power to detain and expel unlawful non-citizens

In Ruddock and Others v Vadarlis and Others the Federal Court had to balance two fundamental but competing rights, the right of the state to secure its frontiers and the rights of individuals not to be subjected to unlawful detention - Court's task was hampered by intense public debate over the illegal refugee crisis - in the wake of 11 September 2001 and the Tampa crisis, the Federal Government has rushed through several amendments to migration laws and border protection legislation.

Testosterone is correlated with courtship but not aggression in the tropical buff-banded rail, Gallirallus philippensis

Past studies into the roles of testosterone in birds have focused on species that occur in temperate regions. In such species, plasma testosterone levels are high during the establishment of territories in the spring and are associated with increased aggression. In contrast to most temperate species, tropical birds frequently defend territories year-round, during which time territoriality often occurs in a nonsexual context. The few studies that have been carried out on tropical birds show lower levels of circulating testosterone than occur in their temperate counterparts. In some year-round territorial tropical species, testosterone and aggression are dissociated, while in other species testosterone still plays a role in regulating aggression. This study examined the relationship between aggression and plasma testosterone levels in a year-round territorial, subtropical population of the buff-banded rail with characteristics typical of tropical species. Peak testosterone levels were substantially lower than those found in temperate species. Males displayed a seasonal peak in plasma testosterone level when their partners were most likely to be fertile. At other times, testosterone levels were mostly undetectable, despite year-round territoriality. We found that T levels increased with courtship behavior but showed no relationship with aggression, supporting the hypothesis that dissociation between testosterone and territoriality may be widespread among tropical avian taxa. Patrimônio territorial integrado e espaço cotidiano : o planejamento urbano interativo do centro de Vitória (ES)

O conceito de patrimônio territorial e cultural amplia o conceito tradicional de patrimônio, segundo o qual o monumento se restringe a sua materialidade e permanece isolado de seu território. A ambiência e a vivência desse patrimônio ganham importância visto que são essenciais ao seu reconhecimento e a impressão de pertencimento e de identificação por parte de seus usuários. Tais conceitos vão de encontro à mercantilização do patrimônio e ao seu uso puramente turístico, tão comuns na contemporaneidade. Este trabalho traz estudos e discussões referentes ao tema, que auxiliaram na análise da evolução histórica de Vitória, tendo sua origem na região central. Tais abordagens levaram ao entendimento da construção da cidade e dos resultados encontrados na atualidade decorrentes desse desenvolvimento. O conhecimento sobre a temática do patrimônio territorial e cultural e o entendimento histórico do Centro de Vitória tornaram possíveis algumas avaliações referentes aos procedimentos adotados no Planejamento Urbano Interativo do Centro, um programa elaborado pela prefeitura de Vitória em 2006.

Metodologia de representação identitária do patrimônio territorial : a água como elemento de identidade em Linhares/ES

Apresenta primeiramente o conceito de desenvolvimento local autossustentável dentro do enfoque territorialista. Mostra também o conceito de patrimônio territorial e o de representação identitária do território como instrumento de preservação do patrimônio, neste caso o territorial. O enfoque territorialista é adotado como base teórica para a construção do roteiro metodológico de representação identitária do território com vistas à preservação do patrimônio tendo como objeto empírico o município de Linhares/ES, que passa por um processo de intenso desenvolvimento de seu território e que apresenta um rico patrimônio, no que diz respeito aos recursos naturais, em especial o hídrico. Nos últimos anos tem-se registrado um crescimento forte dos instrumentos disponíveis para a produção de imagens do território, neste caso o uso da tecnologia de Sistemas de Informações Geográficas. Por meio deste recurso, adotado na Escola Territorialista Italiana, representa-se o patrimônio que constitui o território municipal, tendo como produtos finais o Atlas do patrimônio territorial no município de Linhares/ES e o Roteiro metodológico de representação identitária do patrimônio territorial.

O mar territorial brasileiro de 200 milhas: estratégia e soberania, 1970-1982

O artigo procura analisar e identificar o conjunto de forças que contribuíram, decisivamente, no alargamento do mar territorial brasileiro para 200 milhas marítimas, em março de 1970. Procura, ainda, demonstrar a estratégia empreendida pela política externa brasileira, em defesa de seu mar territorial de 200 milhas, durante o período que compreende a extensão marítima, em 1970, até a conclusão dos trabalhos da III Conferência das Nações Unidas sobre o Direito do Mar, em 1982, avaliando a Conferência e seus resultados principais no âmbito dos interesses brasileiros.

Uprootedness and the protection of migrants in the International Law of Human Rights

The article attempt to demonstrate the evolution of international law in connected to the subject of the forced immigrants'. The author supported by several texts, cases and resolutions of the regional level, through interamerican court and European court, and the global level, through the international court. It's shown the evolution that occurred in international law in millennium turn over, which recognize the immigrants' rights. However, it's stressed the necessity of the development of those laws connected to the theme e the recognition, from the States; the importance of law's that effort to ensure the respect to human rights relative to the immigrants and their families.
