O presente trabalho é o resultado de uma pesquisa empírica que buscou reconstruir toda a trajetória percorrida pela política pública que orienta o atual regime de tributação de lucros auferidos no exterior por controladas e coligadas de empresas brasileiras com o objetivo de compreender as razões que levaram o Brasil a adotar uma norma de antidiferimento demasiadamente ampla, quando comparada às normas de natureza similar adotadas na experiência internacional. Além disso, buscamos identificar a real extensão dos efeitos econômicos ensejados pelo regime brasileiro, em especial, frente ao processo de internacionalização produtiva que vem se fazendo cada vez mais presente na realidade de diversas empresas de capital nacional. Partimos da hipótese de que o regime vigente afeta negativamente às empresas que buscam internacionalizar parte da sua atividade produtiva. Os resultados da pesquisa são de grande importância e nos ajudaram a compreender melhor as causas de muitas das questões jurídicas que atualmente ocupam grande parte do debate acadêmico no direito tributário brasileiro. Defendemos a ideia de que, se os efeitos do regime brasileiro afetam negativamente a internacionalização produtiva, o regime poderá afrontar a Ordem Econômica Constitucional.

Este trabalho tem como objetivo investigar as implicações quantitativas do modelo de rigidez de política fiscal desenvolvido por Gonçalves e Guimaraes (2012) e responder se ele é capaz de gerar mais defaults em equilíbrio sem se utilizar de uma forte hipótese ad hoc acerca dos custos em termos do produto de um calote na dívida soberana, a fim de conseguir gerar os resultados desejados de acordo com o que se observa nos dados econômicos, isto é, que os calotes tendem a ocorrer em tempos ruins. A principal hipótese deste modelo é que o Governo não pode se comprometer com um ajuste fiscal para repagar a dívida que está vencendo porque ele escolhe a alíquota de imposto no período anterior. Logo, ao se deparar com um produto baixo em determinado período, o soberano não pode ajustar a arrecadação a fim de fazer frente às suas obrigações e se vê diante da decisão de aumentar o nível do endividamento ou de repudiar sua dívida e não pagá-la. Nos resultados, tem-se que a rigidez fiscal aumenta a ocorrência de defaults em pelo menos uma ordem de magnitude comparado a outros modelos quantitativos de dívida soberana e ajuda a explicar a ocorrência de calotes em períodos de baixo produto na Economia.

In spite of a general agreement over the distortion imposed by the current Brazilian tax system, attempts to reform it during the last decade have faced several restrictions to its implementation. Two of these restrictions were particular binding: a) fiscal adjustment restriction (public sector debt cannot increase), b) fiscal federalist restriction (revenues from individual states and municipalities cannot decrease). This paper focuses on a specific reform that overcomes in principle the fiscal federalist restriction. Using Auerbach and Kotlikoff (1987) model calibrated for the Brazilian economy, I analyze the short and long run macroeconomic effects of this reform subject to the fiscal adjustment restriction. Finally, I look at the redistributive effects of this reform among generations as a way to infer about public opinion’s reaction to the reform. The reform consists basically of replacing indirect taxes on corporate revenues, which I show to be equivalent to a symmetric tax on labor and capital income, by a new federal VAT. The reform presented positive macroeconomic effects both in the short and long run. Despite a substantial increase in the average VAT rate in the first years after the reform, a majority of cohorts experienced an increase in their lifetime welfare, being potentially in favour of the reform.

This paper has two purposes. First, to construct efficiency scores in tax collection for Brazilian municipalities in 2004, taking into consideration two outputs: amount of per capita local tax collected -tax revenue- and the size of local informal economy- tax base. This methodology eliminates the price- effect of tax collection. Second, using the rules established on the Brazilian Constitution in 1988 to transfer unconditional funds among municipalities as instrument, to estimate the relationship between intergovernmental transfers and efficiency in tax collection. We conclude that transfers affect negatively the efficiency in tax collection, leading to a reinterpretation of the flypaper effect.

A common feature in programs of the International Monetary Fund (IMF) is the use of conditionalities, macroeconomic and structural measures that a requesting country should adopt to obtain an assistance package. The objective of this work is to conduct an empirical analysis of the economic and political determinants of such conditionalities. In particular, our main contribution consists in the development of a new measure of conditionality, fiscal adjustment, and its comparison with the most used in the literature, the number of conditions. We choose fiscal adjustment because it is an adequate proxy for program austerity, since its implementation carries economic and political costs. In the empirical exercise, we use data from 184 programs in the period of 1999 and 2012, and estimate how our two measures of conditionalities respond to the economic and political factors. Our results suggest that they are quite different. The main determinant of the number of conditions is the political proximity of the borrowing country to the Fund’s major shareholders, the members of G5. On the other hand, the main determinant of fiscal adjustment is the size of the government fiscal deficit. Finally, we did not find correlation between the size of fiscal adjustment and the number of conditions. These results suggest that the analysis of the content of IMF programs should take into account the different measures of agreed conditionality.

Neste estudo consideramos uma economia onde a determinação das políticas fiscais e monetárias estão sujeitas à restrição orçamentária do governo, visto como um agente consolidado que incorpora o executivo e o banco central. Nós estudamos como mudanças na taxa de crescimento e na composição do passivo governamental (moeda e títulos) afetam preços, juros, e atividade econômica. Estamos particularmente interessados em analisar como estes efeitos são afetados por mudanças na liquidez relativa dos títulos públicos. Um resultado central deste trabalho é que aumentos no grau de liquidez dos títulos públicos afetam positivamente a atividade econômica e o financiamento da dívida pública. Descrevemos este último aspecto com um exemplo refletindo o caso da economia brasileira.

The present paper has aimed the analysis of a real instrument which offers great impact in the ICMS revenue: The Fiscal Voucher Emitting Equipment (ECF). In this sense, the effects of the commercial automation process in Rio Grande do Norte s ICMS revenue between 2000 and 2006 were investigated. Based on this goal, the methodology adopted was characterized as a study of quantitative, exploratory-qualitative nature, through the collecting of secondary data, provided by the State Taxation Bureau (SET). In the absence of a statistic model in the existing literature about the approached theme, we decided for the elaboration of a suitable model, with tables and graphics. As a way to observe the effects of these programs on the revenue, the comparison between the ECF users and non users, in the same period, has proved to be of great importance. We reached the conclusion that even though the growth rates amongst the activities that use the ECF had ascended in tributary revenue in the related years, from 2004 on, with the introduction of TEF, this participation presented a higher growth, which leads us to suppose that the use of this recent instrument provides a significant impact in the State effective revenue. We stand out that the collected amounts could have been even higher, if the level of adhesion to the instrument had not been so low, mainly amongst the minor entrepreneurs, which may mean a rooted defraudation in the system. In short, through the set of data obtained, it is possible to conclude that the ECF and the recent TEF have significantly influenced the ICMS revenue in the entire State all over the period that was analyzed
