Purpose of this paper: International research identifies transgender people as a vulnerable group in prison systems, with basic needs often being denied. This paper outlines Australian contexts of incarceration, and links between institutional responses and the vulnerabilisation of transgender prisoners. Design/methodology/approach: The paper critically analyses Australian prison policies regarding the treatment of transgender prisoners. Findings: The policy analysis illustrates the links between institutional practices and the increased vulnerability of transgender prisoners. The paper argues that policies further criminalise, and potentially doubly punish, transgender prisoners. Research limitations/implications: This paper analyses the publicly available policies on regulating transgender people’s imprisonment. Given the limited Australian research into transgender prisoner’s lived experiences, there is a gap in relation to policies, their perception, and how corrective services personnel enact the limited procedures available to them in managing transgender prisoners. Practical Implications: Current policies and practices significantly enhance the vulnerability of transgender prisoners. This policy analysis highlights the critical importance of policy and practice reform in relation to housing, safety, health and welfare services, and misgendering. What is the original/value of paper: The policy analysis provides practitioners with an outline of critical issues that arise when transgender people are imprisoned and suggests key areas for future research.

This study examined the nature and lifetime prevalence of two types of victimization among Finnish university students: stalking and violence victimization (i.e. general violence). This study was a cross-sectional study using two different datasets of Finnish university students. The stalking data was collected via an electronic questionnaire and the violence victimization data was collected via a postal questionnaire. There were 615 participants in the stalking study (I-III) and 905 participants in the violence victimization study. The thesis consists of four studies. The aims regarding the stalking substudies (Studies I-III) were to examine the lifetime prevalence of stalking among university students and to analyze how stalking is related to victim and stalker characteristics and certain central variables of stalking (victim-stalker relationship, stalking episodes, stalking duration). Specifically, the aim was to identify factors that are associated with stalking violence and to factors contributing to the stalking duration. Furthermore, the aim was also to investigate how university students cope with stalking and whether coping is related to victim and stalker background characteristics and to certain other core variables (victim-stalker relationship, stalking episodes, stalking duration, prior victimization, and stalking violence). The aims for the violence victimization substudy (Study IV) were to examine the prevalence of violence victimization, i.e. general violence (minor and serious physical violence and threats) and how violence victimization is associated with victim/abuser characteristics, symptomology, and the use of student health care services. The present study shows that both stalking and violence victimization (i.e. general violence) are markedly prevalent among Finnish university students. The lifetime prevalence rate for stalking was 48.5% and 46.5% for violence victimization. When the lifetime prevalence rate was restricted to violent stalking and physical violence only, the prevalence decreased to 22% and 42% respectively. The students reported exposure to multiple forms of stalking and violence victimization, demonstrating the diversity of victimization among university students. Stalking victimization was found to be more prevalent among female students, while violence victimization was found to be more prevalent among male students. Most of the victims of stalking knew their stalkers, while the offender in general violence was typically a stranger. Stalking victimization often included violence and continued for a lengthy period. The victim-stalking relationship and stalking behaviors were found to be associated with stalking violence and stalking duration. Based on three identified stalking dimensions (violence, surveillance, contact seeking), the present study found five distinct victim subgroups (classes). Along with the victim-stalker relationship, the victim subgroups emerged as important factors contributing to the stalking duration. Victims of violent stalking did not differ greatly from victims of non-violent stalking in their use of behavioral coping tactics, while exposure to violent stalking had an effect on the use of coping strategies. The victim-offender relationship was also associated to a set of symptoms regarding violence victimization. Furthermore, violence victimization had a significant main effect on specific symptoms (mental health symptoms, alcohol consumption, symptom index), while gender had a significant main effect on most symptoms, yet no interaction effect was found. The present results also show that victims of violence are overrepresented among frequent health care users. The present findings add to the literature on the prevalence and nature of stalking and violence victimization among Finnish university students. Moreover, the present findings stress the importance of violence prevention and intervention in student health care, and may be used as a guideline for policy makers, as well as health care and law enforcement professionals dealing with youth violence prevention.

The sexual abuse of children is, understandably, a key concern for the public. Child sexual abuse can cause long-lasting harms for victims, ranging from relationship difficulties to eating disorders. But misperceptions about those who perpetrate it abound in public debate. Although the terms “paedophile” and “child sex offender” are often used interchangeably, the two are distinct. Paedophiles are sexually attracted to young children. They have either acted on this attraction or fear they might. But not all paedophiles act on their attraction – and this is where support services can help reducing offending. Conversely, not everyone who offends sexually against a child is a paedophile. Some may have a sexual interest in and/or offend against both children and adults. Others do not have a sexual attraction to children but instead act opportunistically...

Purpose This study aims to use opportunity as a theoretical lens to investigate how the spatio-temporal and social dimensions of the consumption environment create perceived opportunities for consumers to misbehave. Design/methodology/approach Drawing on routine activity theory and social impact theory, the authors use two experiments to demonstrate that spatio-temporal and social dimensions can explain consumer theft in retail settings. Findings Study 1 reveals mixed empirical support for the basic dimensions of routine activity theory, which posits that the opportunity to thieve is optimised when a motivated offender, suitable target and the absence of a capable formal guardian transpire in time and space. Extending the notion of guardianship, Study 2 tests social impact theory and shows that informal guardianship impacts the likelihood of theft under optimal routine activity conditions. Originality/value The study findings highlight important implications for academicians and retail managers: rather than focusing on the uncontrollable characteristics of thieving offenders, more controllable spatio-temporal and social factors of the retail environment can be actively monitored and manipulated to reduce perceived opportunities for consumer misbehaviour.

We are pleased to present these selected papers from the proceedings of the 3rd Crime, Justice and Social Democracy International Conference, held in July 2015 in Brisbane, Australia. Over 350 delegates attended the conference from 19 countries. The papers collected here reflect the diversity of topics and themes that were explored over three days. The Crime, Justice and Social Democracy International Conference aims to strengthen the intellectual and policy debates concerning links between justice, social democracy, and the reduction of harm and crime, through building more just and inclusive societies and proposing innovative justice responses. In 2015, attendees discussed these issues as they related to ideas of green criminology; indigenous justice; gender, sex and justice; punishment and society; and the emerging notion of ‘Southern criminology’. The need to build global connections to address these challenges is more evident than ever and the conference and these proceedings reflect a growing attention to interdisciplinary, novel, and interconnected responses to contemporary global challenges. Authors in these conference proceedings engaged with issues of online fraud, queer criminology and law, Indigenous incarceration, youth justice, incarceration in Brazil, and policing in Victoria, Australia, among others. The topics explored speak to the themes of the conference and demonstrate the range of challenges facing researchers of crime, harm, social democracy and social justice and the spaces of possibility that such research opens. Our thanks to the conference convenor, Dr Kelly Richards, for organising such a successful conference, and to all those presenters who subsequently submitted such excellent papers for review here. We would also particularly like to thank Jess Rodgers for their tireless editorial assistance, as well as the panel of international scholars who participated in the review process, often within tight timelines.

Optimal Punishment of Economic Crime: A Study on Bankruptcy Crime This thesis researches whether the punishment practise of bankruptcy crimes is optimal in light of Gary S. Becker’s theory of optimal punishment. According to Becker, a punishment is optimal if it eliminates the expected utility of the crime for the offender and - on the other hand - minimizes the cost of the crime to society. The decision process of the offender is observed through their expected utility of the crime. The expected utility is calculated based on the offender's probability of getting caught, the cost of getting caught and the profit from the crime. All objects including the punishment are measured in cash. The cost of crimes to the society is observed defining the disutility caused by the crime to the society. The disutility is calculated based on the cost of crime prevention, crime damages, punishment execution and the probability of getting caught. If the goal is to minimize the crime profits, the punishments of bankruptcy crimes are not optimal. If the debtors would decide whether or not to commit the crime solely based on economical consideration, the crime rate would be multiple times higher than the current rate is. The prospective offender relies heavily on non-economic aspects in their decision. Most probably social pressure and personal commitment to oblige the laws are major factors in the prospective criminal’s decision-making. The function developed by Becker measuring the cost to society was not useful in the measurement of the optimality of a punishment. The premise of the function that the costs of the society correlate to the costs for the offender from the punishment proves to be unrealistic in observation of the bankruptcy crimes. However, it was observed that majority of the cost of crime for the society are caused by the crime damages. This finding supports the preventive criminal politics.

Human trafficking as a global phenomenon continues to elude accurate quantitative measure, and remains a controversial policy domain significantly influenced by anecdotal evidence. Drawing on the policy analysis framework of Bacchi (1999; 2007) the problem representation of trafficking through narratives can be considered a direct antecedent of contemporary anti-human trafficking policy. This article explores the construction of human trafficking within the Trafficking in Persons Reports, published annually by the United States of America’s Department of State. An examination of the victim and offender narratives contained within the reports published between 2001 and 2012 demonstrates that human trafficking is predominantly represented as a crime committed by ideal offenders against idealized victims, consistent with Christie’s (1986) landmark criteria of ideal victimization. This representation of an ideal prototype has the potential to inform policy that diverts focus from the causative role of global socioeconomic injustice towards criminal justice policies targeting individual offenders.

The purpose of this article is to provide an overview of the various United Nations instruments relevant to juvenile justice and to examine how knowledge of these can assist those interested in the protection and enhancement of young people's rights in the justice system. It is argued that whilst these instruments are variable they are valuable tools for unmasking the discriminatory and unjust treatment of young people who come into contact with the justice system.

El presente ensayo propone un diálogo sobre el perdón con el pensamiento filosófico de H. Arendt y P. Ricoeur y la reflexión bíblico-teológica de C. di Sante y L. Basset. En él se articulan la necesidad del perdón en la vida cotidiana y la seriedad de un perdón “difícil” que respete la verdad y la dignidad del ofendido y del ofensor y se arriesgue a restaurar la relación personal. La novedad de Jesús, ofrecida a partir de su oración y entrega en la cruz (cf. Lc 23,34) y de su resurrección, abre la posibilidad de ir más allá de la cuenta de los males cometidos; más aún, más allá de la culpa, para acceder por amor a una vida digna de ser celebrada con los otros.

[ES]La pena de cárcel, como única respuesta al delito, no constituye ninguna solución para el hecho delincuencial. No es solución para la víctima porque queda en el más profundo de los desamparos. No es solución para el infractor porque la cárcel no sólo no rehabilita sino que puede generar más delincuencia, como lo acredita el alto índice de reincidencia. Finalmente, no es una solución para la Comunidad por los altos costes, no sólo penitenciarios. Sólo integrada con otras respuestas no carcelarias, la respuesta prisional permite un abordaje sensato de la delincuencia. Se aboga, por ello, por una justicia que reconozca la existencia de otras instancias reparadoras como: la mediación, el arbitraje, el diálogo víctima - agresor, etc.

A regulação da propaganda de medicamentos no Brasil incorpora quatro fragilidades: 1. A monitoração, fiscalização e punição de irregularidades são realizadas a posteriori do acometimento da infração (quando a população já foi submetida a risco sanitário); 2. As multas cobradas pela Anvisa têm valor irrisório frente aos investimentos do marketing farmacêutico; 3. Não há mecanismo que impeça que mesmo os valores irrisórios das multas sejam repassados aos preços dos produtos, onerando o consumidor; 4. A frase tida como de alerta - A PERSISTIREM OS SINTOMAS O MÉDICO DEVERÁ SER CONSULTADO - ao invés de conscientizar a população a respeito dos riscos da automedicação, estimula o uso de medicamentos sem receita, aconselhando a busca de um médico apenas no caso da persistência dos sintomas. Segundo dados da Anvisa e de estudos acadêmicos, 90% da publicidade exibida contém irregularidades. Assim, a RDC 102/2000 da Anvisa, que regulamenta o setor, se constitui em um aparente sistema de regulação, que beneficia o infrator e mantém a população sob risco. Este trabalho analisa o conceito e o uso dos mecanismos de marketing na busca de se elevar a comercialização de produtos farmacêuticos (no que se denomina produção de doenças), examina os conceitos de propaganda, medicamento, regulação e manipulação; percorre alguns estatutos internacionais referentes ao setor da publicidade de medicamentos (com foco nas diretivas da União Européia) e expõe a avaliação de organismos europeus de defesa do consumidor sobre o desempenho destas normas. Ao final, este estudo expõe as posições do setor regulado brasileiro (indústria, agências de publicidade e meios de comunicação) frente às posições de órgãos de defesa dos consumidores, da academia e da sociedade organizada no âmbito do SUS, para propor como alternativa um modelo regulador que supere as fragilidades do atual.

[ES]El presente Trabajo de Fin de Grado analiza el tratamiento penal de los sujetos imputables peligrosos que mantienen la peligrosidad criminal tras el cumplimiento de la pena de prisión. De esta manera, se investiga la regulación jurídica española dirigida a este colectivo, poniendo de manifiesto que hasta la entrada en vigor de la Ley Orgánica 5/2010 de reforma del Código Penal no había prevista ninguna medida de seguridad enfocada a este grupo específico y concluyendo que la medida de “libertad vigilada” introducida en dicha reforma no es del todo efectiva para alcanzar la reinserción del reo. Por todo ello, se argumenta que la política criminal llevada a cabo en los últimos años ha llevado la seguridad a un extremo tal que no se han podido garantizar del todo los derechos individuales del colectivo anteriormente mencionado. Asimismo, se investiga la “custodia de seguridad” vigente en la regulación alemana, haciendo notoria la importancia de la seguridad e inocuización. En síntesis, se estudia si el delincuente ha quedado subordinado al orden jurídico y a la seguridad, esclareciendo si han sido respetados los principios y garantías inherentes a un Estado Social y Democrático de Derecho.

Diversos estudos têm apontado os benefícios da habilidade empática. Ela está associada à saúde e bem-estar psicológicos, a relacionamentos mais satisfatórios, a comportamentos pró-sociais e morais, à resiliência etc., ao passo que sua ausência está associada a diversos prejuízos pessoais e interpessoais. Como habilidade social, entende-se que a empatia é um fenômeno multidimensional, com aspectos cognitivos, afetivos e comportamentais. Respectivamente, envolve a capacidade de compreender o ponto de vista do outro, de se interessar genuinamente pelo seu bem-estar, e de expressar, por meio de comportamentos verbais e/ou não verbais, sua compreensão e interesse ao interlocutor, permitindo a este se sentir entendido e validado em suas experiências. Esta habilidade tem sido associada, mais recentemente, por diversos estudos internacionais, à capacidade de perdoar um ofensor por suas transgressões. Com isso, o propósito do presente trabalho foi investigar a influência da habilidade empática sobre o perdão interpessoal, em uma amostra brasileira. O perdão também vem sendo considerado uma experiência multifatorial, com domínios cognitivos, afetivos e comportamentais, que abrangem os pensamentos, as emoções e os comportamentos em relação a um ofensor. Para a realização desta investigação, 172 participantes responderam o Inventário de Empatia (IE), a Escala de Atitudes (o Enright Forgiveness Inventory EFI) e uma ficha sobre dados socidemográficos. O IE apresenta quatro subescalas: Tomada de Perspectiva, Sensibilidade Afetiva, Flexibilidade Interpessoal e Altruísmo. O EFI apresenta uma Escala Global de perdão e três Subescalas: Afetiva, Cognitiva e Comportamental. Testes correlacionais e de regressão foram processados a fim de investigar as relações entre os fatores do IE e do EFI, bem como a predição da empatia sobre o perdão. Os resultados indicaram diversas relações positivas e significativas estatisticamente: a Tomada de Perspectiva se relacionou à Escala Global do perdão e às Subescalas Afetiva e Comportamental; a Sensibilidade Afetiva e o Altruísmo se relacionaram à Escala Global e à Comportamental do perdão; a Flexibilidade Interpessoal foi o único fator empático que não apresentou correlações significativas com o perdão. Com a regressão, constatou-se que: Altruísmo e Tomada de Perspectiva, combinados, ou Tomada de Perspectiva, sozinha, predisseram o Perdão Global; Sensibilidade Afetiva, Tomada de Perspectiva e Altruísmo, combinados ou individualmente, tiveram valor preditivo sobre a Subescala Comportamental do perdão; e apenas a Tomada de Perspectiva, sozinha, predisse a Subescala Afetiva do perdão. Nenhum fator do IE teve valor preditivo sobre a Subescala Cognitiva do perdão e a Flexibilidade Interpessoal não predisse qualquer dimensão do EFI. Os resultados encontrados apoiam pesquisas anteriores, confirmando a importância da empatia para a ocorrência do perdão interpessoal. Contudo, ressalta-se que a Tomada de Perspectiva se destacou como a dimensão empática mais importante, sugerindo a relevância que a capacidade de adotar o ponto de vista do outro tem para que o perdão seja alcançado.

Este estudo, intitulado Adolescente infrator: A mediação prevista na nova Lei do Sistema Nacional de Atendimento Socioeducativo (SINASE) na cidade do Rio de Janeiro trata da mediação na vertente transformativa, com o objetivo de permitir nova ótica sobre a conduta infratora e as consequências dos atos no mundo social. Esta forma de atuação, dentre outros benefícios, pode evitar o desgaste jurisdicional, na medida em que os casos selecionados a partir de suas características passam a ser operados por especialistas em composição pacífica de conflitos, com a perspectiva de seres humanos que necessitam da inter-relação no convívio social. Os mediadores trabalham com os adolescentes em conflito com a lei, seus pais e as vítimas. Destarte, verificando as circunstâncias favoráveis à mediação, passa-se ao diálogo para alcançar um acordo, mantendo-se o centro da intervenção no conflito e na relação dos conflitantes, incentivando a capacitação para a negociação a partir do reconhecimento do direito do outro, produzindo a transformação interna dos litigantes que causará, como efeito desejado, a dissolução do conflito. A princípio os mediadores devem atuar apenas em fatos de menor potencial ofensivo, como agressões leves e outros conflitos entre adolescentes. Com o passar do tempo e o aperfeiçoamento da prática, é possível abarcar outras classes de prática infracional, a exemplo de pequenos furtos. Para tanto, na fase de pesquisa, tentando-se explicar a mediação transformadora a partir das referências teóricas publicadas em livros ou obras congêneres, utilizou-se a técnica bibliográfica; na fase da redação, ordenou-se o material coletado, segundo a lógica necessária à elaboração de um trabalho científico. O método a presidir este estudo foi o dedutivo, na medida em que parte da análise geral das crianças e dos adolescentes, em especial aqueles em conflito com a lei, para depois apresentar a teoria geral da mediação e em seguida, numa abordagem mais particular, enfrentar as questões envolvendo a mediação no Sistema Nacional de Atendimento Socioeducativo (SINASE) para, ao final, defender que é preciso desvendar o marco normativo que autoriza a prática da mediação como instrumento de resolução de questões relacionadas com o adolescente em conflito com a lei, para identificar a natureza jurídica desse modelo de mediação e, ao final, a título de sugestão, desenhar seu procedimento não estabelecido pela lei material que a prevê, qual seja, a Lei n 12.594, de 18 de janeiro de 2012. O grande desafio é establecer a metodologia adequada para que a autocomposição de conflito seja restaurativa ao adolescente infrator e aos integrantes desse conflito instaurado. O resgate do meio social abalado com a prática infracional é tão importante quanto a conscientização do adolescente. A pretensão é sugerir um marco normativo que posicione o procedimento da mediação como instrumento de ligação do indivíduo adolescente infrator, com o ambiente social onde está inserido, e com o formalismo processual que vem afastando o Poder Judiciário de sua função social de dizer o direito e fazer justiça.
