This thesis identifies, examines and problematizes some of the discourses that have so far come to light on the issue of protection for environmental refugees. By analyzing the discourses produced by the United Nations Office of the High Commissioner for Refugees (UNHCR) and two non-governmental organizations - the Environmental Justice Foundation (EJF) and Equity and Justice Working Group Bangladesh (EquityBD), I examine the struggling discourses that have emerged about how protection for environmental refugees has been interpreted. To do this, I rely on Ernesto Laclau and Chantal Mouffe's theory and method of discourse analysis. The results show that responsibilization is the main point of struggle in the discussions on the protection of environmental refugees. As a floating signifier, it was utilized by the discourses produced by the UNCHR and the selected NGOs in contingent ways and with different political objectives. The UNHCR discourse responsibilized both the environmental refugees for their own protection and the individual states. The EJF and EquityBD, by contrast, allocated responsibility for the protection of environmental refugees to the international community. These contingent understandings of responsibilization necessitated different justifications. While the EJF discourse relied on humanitarianism for the assistance of environmental refugees, the EquityBD discourse constructed a rights based, more permanent solution. The humanitarian based discourse of the EJF was found to be inextricably linked with the neoliberal discourse produced by the UNHCR. Both these discourses encouraged environmental refugees to stay in their homelands, undermining the politics of protection. Another way in which protection was undermined was by UNHCR's discourse on securitization. In this context, climate change induced displacement became threat to developed countries, the global economy and transnational classes. The struggling discourses about who/what has been allocated responsibility for the protection of environmental refugees also meant that identities of the displaced be constructed in specific ways. While the UNHCR discourse constructed as voluntary migrants and predators, the EJF and EquityBD discourses portrayed them as victims. However, even though the EJF discourse constructed them as victims, their reliance on humanitarianism could also be interpreted as a way of giving the environmental refugee a predator like identity. These discourses on responsibilization and identity formation clashed with each other in the aim of achieving a hegemonic position in discussions and debates about the protection of environmental refugees.

The study analyses the ambivalent relationship republicanism, as a form of self-government free from domination, had with the ideal of participatory oratory and non-dominated speech on the one hand, and with the danger of unhindered demagogy and its possibly fatal consequences to that form of government on the other. Although previous scholarship has delved deeply into republicanism as well as into rhetoric and public speech, the interplay between those aspects has only gathered scattered interest, and there has been no systematic study considering the variety of republican approaches to rhetoric and public speech in 17th-century England. The rare attempts to do so have been studies in English literature, and they have not analysed the political philosophy of republicanism, as the focus has been on republicanism as a literary culture. This study connects the fields of political theory, political history as well as literature in order to make a multidisciplinary contribution to intellectual history. The study shows that, within the tradition of classical republicanism, individual authors could make different choices when addressing the problematic topics of public speech and rhetoric, and the variety of their conclusions often set the authors against each other, resulting in the development of their theories through internal debates within the republican tradition. The authors under study were chosen to reflect this variety and the connections between them: the similarities between James Harrington and John Streater, and between John Milton and John Hall of Durham are shown, as well the controversies between Harrington and Milton, and Streater and Hall, respectively. In addition, by analysing the writings of Marchamont Nedham the study will show that the choices were not limited to more, or less, democratic brands of republicanism. Most significantly, the study provides a thorough analysis of the political philosophies behind the various brands of republicanism, in addition to describing them. By means of this analysis, the study shows that previous attempts to assess the role of free speech and public debate, through the lenses of modern, rights-based liberal political theory have resulted in an inappropriate framework for understanding early modern English republicanism. By approaching the topics through concepts used by the republicans legitimate authority, leadership by oratory, and republican freedom and through the frames of reference available and familiar to them roles of education and institutions the study presents a thorough and systematic analysis of the role and function of rhetoric and public speech in English republicanism. The findings of this analysis have significant consequences to our current understanding of the history and development of republican political theory, and, more generally, of the connections between democratic theory and free speech.

Excess fishing capacity has been identified as one of the most pernicious problems affecting long-term sustainability and biodiversity of fishery resources and economic viability of fishing operations. Significant economic gains could be achieved by eliminating excess capacity, in addition to attaining objectives of resource sustainability. In this paper, approaches to fishing capacity management are reviewed in the context of Indian fisheries. A rights based regulated access system under a co-management regime based on a strong inclusive cooperative movement of stakeholders with built-in transferable quota system and buy-back or rotational right of entry schemes seems to hold potential for capacity management in the shelf fisheries of Indian states, which need to be implemented in collaboration with the Union Government and the neighboring states with confluent ecosystems and shared fishing grounds. A key advantage of the use of rights based approaches for managing fishing capacity is that they provide a mechanism through which stakeholders can more easily and actively participate in the management process.

Stories are helping us learn more about the livelihoods of the fishers and farmers with whom we work in eastern India. We are engaged with these communities in processes and activities aimed at improving their lives and promoting changes in government policy and service delivery in aquaculture and fisheries. Stories are told in several languages by women and men who fish and farm, about their lives, their livelihoods and significant changes they have experienced. We also record stories as narrated to us by colleague-informants. The written and spoken word, photographs, drawings and films – all are used to document the stories of people’s lives, sometimes prompted by questions as simple as “What do people talk about in the village?” Through the power of language, stories can be an entry point into livelihoods programming, monitoring and evaluation, conflict transformation and ultimately a way of giving life to a rights-based approach to development. Commonly adopted approaches to managing small-scale fisheries (SSFs) in developing countries do not ensure sustainability. Progress is impeded by a gap between innovative SSF research and slower-moving SSF management. The paper aims to bridge the gap by showing that the three primary bases of SSF management--ecosystem, stakeholders’ rights and resilience--are mutually consistent and complementary. It nominates the ecosystem approach as an appropriate starting point because it is established in national and international law and policy. Within this approach, the emerging resilience perspective and associated concepts of adaptive management and institutional learning can move management beyond traditional control and resource-use optimization, which largely ignore the different expectations of stakeholders; the complexity of ecosystem dynamics; and how ecological, social, political and economic subsystems are linked. Integrating a rights-based perspective helps balance the ecological bias of ecosystem-based and resilience approaches. The paper introduces three management implementation frameworks that can lend structure and order to research and management regardless of the management approach chosen. Finally, it outlines possible research approaches to overcome the heretofore limited capacity of fishery research to integrate across ecological, social and economic dimensions and so better serve the management objective of avoiding fishery failure by nurturing and preserving the ecological, social and institutional attributes that enable it to renew and reorganize itself. No contexto de avanço da globalização, o Investimento Estrangeiro Direto (IED) mostra-se como um dos principais veículos para a inserção internacional dos países. Como os objetivos das empresas transnacionais e dos Estados hospedeiros não são os mesmos, há a necessidade de adoção de políticas que levem à convergência. No plano legal, observou-se nas últimas décadas a consolidação do regime internacional dos investimentos, com o crescimento exponencial do número de tratados de investimento e de arbitragens investidor-Estado fundadas nos mesmos. Mas há insatisfações de parte a parte com o sistema. Por um lado, os países tentam limitar o ativismo dos árbitros mediante a revisão de seus tratados. Por outro, tanto os investidores como os Estados começam a perceber que não há vencedores reais na arbitragem, dadas as suas diversas deficiências. Nomeadamente: custos elevados, longa duração, incoerência nas decisões e desgaste para as relações investidor-Estado no longo prazo. Nesse diapasão, surgem propostas de alternativas. Pensadores do sistema, valendo-se do Planejamento de Sistemas de Disputas, têm desenvolvido Políticas de Prevenção de Controvérsias. Tais políticas fundamentam-se nas dinâmicas de busca de soluções baseadas em interesses contrapostas às baseadas na força e nos direitos seguindo processos de administração precoce de conflitos. Diversos países, em diferentes níveis de desenvolvimento, têm tido êxito na implementação dessas políticas. A difusão das melhores práticas, movimento apoiado por organizações internacionais, oferece oportunidades para a melhora da governança, através da promoção de maior coerência e coordenação nas ações do Estado, da transparência e do império da lei. O tema é de interesse para o Brasil, país que, diferentemente dos demais, nunca ratificou um único tratado de investimento. Isso porque já surgem vozes na indústria clamando por uma mudança de posição, diante da emergência do país também como um exportador de capital. Caso tal inflexão se confirme, o Brasil tem a oportunidade de tomar partido das melhores experiências internacionais, usando tais tratados como instrumentos na sua estratégia de desenvolvimento.

O trabalho reflete acerca dos critérios referentes à avaliação psiquiátrica nas internações e tratamento involuntários. A restrição da liberdade é infração aos direitos do homem e, se ela é justificada em nome da patologia mental, qualificá-la é um imperativo legal e ético. Historicamente, a internação crônica em hospitais psiquiátricos levou à exclusão social e rompimento dos laços significativos da vida pessoal. Nos serviços de emergência ela é muitas vezes determinada em nome de um risco. Assim, é proposta uma análise crítica (à semelhança da desconstrução de Derrida e da genealogia de Foucault) do saber médico-psiquiátrico, que é ferramenta essencial do trabalho clínico. Um panorama dos arranjos dos dispositivos públicos de regulação das internações psiquiátricas involuntárias no ocidente mostra a inter-relação de um modelo médico com um modelo legalista (focado nos direitos dos pacientes), cada qual com seus ganhos e dificuldades. A medicalização da vida humana é um fenômeno do mundo moderno, e é vista como um processo dinâmico, onde a apropriação das categorias médicas por parte dos usuários e familiares também gera empoderamento e mudanças. Vemos como, historicamente, o viés moral da práxis realizada no hospital psiquiátrico é indissociável da construção do saber, e a psicopatologia oficial é de uma nosologia descritiva; mas o trabalho clínico permite outras psicopatologias, mais participativas, centradas na relação do sujeito com o mundo, que possam servir a ele como instrumentos de compreensão e ajuda na experiência vivida. Assim, a categoria da vontade em psicopatologia clássica adota a perspectiva aristotélica de uma deliberação racional, mas a leitura filosófica de Arendt destaca a centralidade da liberdade e da espontaneidade inerentes ao conceito. Esta dicotomia entre vontade livre e determinação traz repercussões para a clínica e para a justiça, como nos casos da avaliação da responsabilidade dos pacientes sobre seus atos. Neste campo, assim como na avaliação do juízo crítico, a ciência não garante a objetividade totalizante, deixando sempre a decisão sobre a internação psiquiátrica involuntária na dependência do político, da moral e da ética que constituem a clínica.

O presente trabalho tem o objetivo de desenvolver uma teoria dos direitos sociais, com base na Filosofia e na Economia. São analisadas as teses de autores como Cass Sunstein, Robert Nozick, John Stuart Mill, Michael Sandel, Michael Walzer, John Rawls, Bruce Ackerman e Jürgen Habermas, construindo-se um modelo pautado pela ação comunicativa e pela participação democrática, onde o mínimo existencial ocupa lugar de destaque. São estruturadas pautas interpretativas que podem auxiliar o intérprete no seu mister, indo-se de encontro às teses expansivas que focam na exaustão orçamentária. Deve-se entender que as prestações sociais encartam-se nas complexas relações receita-despesa, o que, no Estado contemporâneo, significa que um conjunto de pessoas contribuirá, involuntariamente, para que o Poder Público aja no sentido de melhorar a situação de outras, independentemente dos motivos que levaram àquele quadro de desigualdade. O ponto é complexo, não podendo ser construído sem considerações de justiça e, particularmente, sem que todos os argumentos sejam acessíveis ao cidadão, base da construção do próprio processo democrático, que move a sociedade.

The central research question that this thesis addresses is whether there is a significant gap between fishery stakeholder values and the principles and policy goals implicit in an Ecosystem Approach to Fisheries Management (EAFM). The implications of such a gap for fisheries governance are explored. Furthermore an assessment is made of what may be practically achievable in the implementation of an EAFM in fisheries in general and in a case study fishery in particular. The research was mainly focused on a particular case study, the Celtic Sea Herring fishery and its management committee, the Celtic Sea Herring Management Advisory Committee (CSHMAC). The Celtic Sea Herring fishery exhibits many aspects of an EAFM and the fish stock has successfully recovered to healthy levels in the past 5 years. However there are increasing levels of governance related conflict within the fishery which threaten the future sustainability of the stock. Previous research on EAFM governance has tended to focus either on higher levels of EAFM governance or on individual behaviour but very little research has attempted to link the two spheres or explore the relationship between them. Two main themes within this study aimed to address this gap. The first was what role governance could play in facilitating EAFM implementation. The second theme concerned the degree of convergence between high-level EAFM goals and stakeholder values. The first method applied was governance benchmarking to analyse systemic risks to EAFM implementation. This found that there are no real EU or national level policies which provide stakeholders or managers with clear targets for EAFM implementation. The second method applied was the use of cognitive mapping to explore stakeholders understandings of the main ecological, economic and institutional driving forces in the Celtic Sea Herring fishery. The main finding from this was that a long-term outlook can and has been incentivised through a combination of policy drivers and participatory management. However the fundamental principle of EAFM, accounting for ecosystem linkages rather than target stocks was not reflected in stakeholders cognitive maps. This was confirmed in a prioritisation of stakeholders management priorities using Analytic Hierarchy Process which found that the overriding concern is for protection of target stock status but that wider ecosystem health was not a priority for most management participants. The conclusion reached is that moving to sustainable fisheries may be a more complex process than envisioned in much of the literature and may consist of two phases. The first phase is a transition to a long-term but still target stock focused approach. This achievable transition is mainly a strategic change, which can be incentivised by policies and supported by stakeholders. In the Celtic Sea Herring fishery, and an increasing number of global and European fisheries, such transitions have contributed to successful stock recoveries. The second phase however, implementation of an ecosystem approach, may present a greater challenge in terms of governability, as this research highlights some fundamental conflicts between stakeholder perceptions and values and those inherent in an EAFM. This phase may involve the setting aside of fish for non-valued ecosystem elements and will require either a pronounced mind-set and value change or some strong top-down policy incentives in order to succeed. Fisheries governance frameworks will need to carefully explore the most effective balance between such endogenous and exogenous solutions. This finding of low prioritisation of wider ecosystem elements has implications for rights based management within an ecosystem approach, regardless of whether those rights are individual or collective.

This research is an exploration of the expression of student voice in Irish post-primary schools and how its affordance could impact on students’ and teachers’ experiences in the classroom, and at whole-school level through a student council. Student voice refers to the inclusion of students in decisions that shape their experiences in classrooms and schools, and is fundamental to a rights-based perspective that facilitates students to have a voice and a say in their education. Student voice is essential to the development of democratic principles, active citizenship, and learning and pedagogy. This qualitative research, based in three post-primary case-study schools, concerns teachers in eighteen classrooms engaging in dialogic consultation with their students over one school year. Teachers considered the students’ commentary and then adjusted their practice. The operation of student councils was also examined through the voices of council members, liaison teachers and school principals. Theorised within socio-cultural (social constructivist), social constructionist and poststructural frames, the complexity of student voice emerges from its conceptualisation and enactment. Affording students a voice in their classroom presented positive findings in the context of relationships, pedagogical change and students’ engagement, participation and achievement. The power and authority of the teacher and discordant student voices, particularly relating to examinations, presented challenges affecting teachers’ practice and students’ expectations. The functional redundancy of the student council as a construct for student voice at whole-school level, and its partial redundancy as a construct to reflect prefigurative democracy and active citizenship also emerge from the research. Current policy initiatives in Irish education situate student voice in pedagogy and as dialogic consultation at classroom and whole-school level. This work endorses the necessity for and benefit of such a positioning with the author further arguing that it should not become the instrumental student voice of data source, accountability and performativity.

Claims of injustice in global forest governance are prolific: assertions of colonization, marginalization and disenfranchisement of forest-dependent people, and privatization of common resources are some of the most severe allegations of injustice resulting from globally-driven forest conservation initiatives. At its core, the debate over the future of the world's forests is fraught with ethical concerns. Policy makers are not only deciding how forests should be governed, but also who will be winners, losers, and who should have a voice in the decision-making processes. For 30 years, policy makers have sought to redress the concerns of the world's 1.6 billion forest-dependent poor by introducing rights-based and participatory approaches to conservation. Despite these efforts, however, claims of injustice persist. This research examines possible explanations for continued claims of injustice by asking: What are the barriers to delivering justice to forest-dependent communities? Using data collected through surveys, interviews, and collaborative event ethnography in Laos and at the Tenth Conference of Parties to the Convention on Biological Diversity, this dissertation examines the pursuit of justice in global forest governance across multiple scales of governance. The findings reveal that particular conceptualizations of justice have become a central part of the metanormative fabric of global environmental governance, inhibiting institutional evolution and therewith perpetuating the justice gap in global forest governance.

The most influential current idea in the theory of conflict management concerns the design features and supposed superior outcomes of conflict management systems combining interest-based and rights-based practices for resolving conflict in organizations. Yet much of the literature in the area is highly prescriptive and draws heavily either on exemplary case studies or descriptive data. Using focus groups of HR practitioners and experts in conflict resolution to develop a questionnaire covering the main conflict management practices associated with the theory of conflict management systems, the study analyzes data from a survey of firms in the Republic of Ireland to examine quantitatively the effects of conflict management systems on organizational outcomes. While proactive line management and supervisory engagement in conflict resolution as a key dimension of conflict management systems is found to be positively associated with a range of organizational outcomes, no evidence is found for the kind of system effects proposed in the theoretical and prescriptive literature. © 2012 Wiley Periodicals, Inc.
