Em maio de 2003 uma grande consulta em âmbito nacional discutia, em Timor-Leste, os termos de um projeto de lei que buscava criar um novo marco legal par o combate à violência doméstica. Desde que as Nações Unidas haviam assumido a administração do território, em Setembro de 1999, várias consultas deste tipo vinham sendo elaboradas. A idéia de que as comunidades precisavam ser consultadas baseava muitos dos projetos de cooperação em curso no país. Um destes, inclusive, um grande projeto do Banco Mundial, intitulado “Community Empowerment Project” (CEP), chegava mesmo a ter como objetivo o fortalecimento das comunidades como instâncias de decisão. Os assim chamados “workshops” com beneficiários de projetos eram uma constante. Neste contexto, não era de surpreender o fato de que, quando o governo timorense apresentou a minuta de um projeto de lei para o combate à violência doméstica – apresentação feita a organizações da sociedade civil timorense em um “workshop”, em novembro de 2002 – de imediato tenha surgido a demanda para que se consultassem as comunidades, solicitação que resultou na ampla consulta realizada entre Maio e Junho de 2003. Desde o início, a proposta de uma consulta acerca do documento de orientação para a futura lei colocava um dilema. Discutir a minuta, elaborada por um comitê de técnicos e especialistas, podia ter diferentes propósitos. Buscava-se verificar em que medida as comunidades concordavam com os valores expressos pelo anteprojeto ou tratava-se apenas de recolher sugestões de como melhor executar os princípios já definidos pelo texto? No caso timorense, este não era um dilema simples, uma vez que os valores expressos na minuta eram muito diferentes daqueles evocados no cotidiano das aldeias timorenses.

The present dissertation, elaborated is based on the deductive method, through the use of the General Theory of Resources concepts, by the main types of judgments existing in the Code of Civil Procedure, the interlocutory judgment and sentence, as well as the features and effects that challenge these decisions, we sought to identify on this theme one of the greatest evils facing the justice system in the world, which is the processing delays. This slowness in adjudication affects seriously the principle of effectiveness, one of the postulates of procedural law and society as a whole. Thus, the use of tort serves to fight the interlocutory decision and appeal which challenges the judge`s ruling. It is a resource for excellence in appellate system as it meets with the most awaited decision of the process. In weighing the importance of the appeal that seeks to oppose the court decision today by the numerous reforms that the procedural system has been through, it has ended up to transform the process ineffective or inconsistent, for it is much easier to have efficacy in a interlocutory decision for preliminary injunction than by judgment on the merits of the judge. This is due to the prevision of the resources and their effect to those decisions. That is, the interlocutory decision involves interlocutory appeal only in the devolved effect, allowing its provisional execution, and the sentence has as recourse to appeal the double effect, remanding and suspension, which necessarily prevents its provisional execution. But it undeniably shows a paradox, because as to give effect to a measure that is based on a mere probability by a summary cognition, partial and superficial, and stop it on a decision by a court that is closer to the truth and sure, for a full and depleting cognition? It is seriously affect the principle of effectiveness. Therefore, starting from this ineffectiveness, sought to defend the solution of this problem with the approval of the bill n. º 3.605/2004 or the new Code of Civil Procedure project that modifies the general rule the effects of appeal. That is, remanding and suspensive, as to merely remanding effect to and thereby enable the provisional execution of the judgment of the court of the first degree of jurisdiction, giving effectiveness and enhancing the decision of the magistrate, making a fair distribution of time in the process and better guaranteed principle of access to justice

The present study was to apprehend the controversies that underlie the political organization of the category nowadays. The research established time frame as the decade from 2003 to 2013, more precisely the situation that opens with Lula's election to the Presidency and its repercussions for the Brazilian left, social movements and for the category. Through documentary research, we studied the professional aspects that are organized politically in different fields , notably the Federal Council of Social Service (CFESS) and the National Federation of Social Workers (FENAS). Seeking to understand their relationship with the Ethical - Political Project of the profession, public documents were analyzed expressing the political positions of these entities, placing the controversies and political differences between them and understanding the political organization as a means to building professionals and corporate projects many.

O propósito deste estudo é o de analisar criticamente o Projeto de Lei n.º 68/XII, relativo à Lei de Bases da Economia Social portuguesa, quanto a um conjunto de questões essenciais dele constante, como sejam: a delimitação do conceito de economia social; a enumeração das entidades que integram o setor; a definição dos seus princípios orientadores; a questão da definição dos mecanismos de promoção e fomento do setor; e a consagração de um regime de concorrência que tenha em conta as especificidades do mesmo. Na decorrência desta análise, apresentam-se propostas de alteração de alguns dos preceitos deste Projeto de Lei de Bases. Este, situando-se num patamar abaixo do constitucional, não poderia ter ignorado o Princípio da proteção previsto na Constituição da República Portuguesa para o setor cooperativo e social, no qual fundamento a defesa da adoção de soluções diferenciadoras para o mesmo setor e que deverão constar expressamente do diploma em análise neste estudo.

This thesis is about arbitration, a form of alternative dispute resolution, as a solution for the slowness of the Brazilian Judiciary. The paper starts with an approach of the fundamental rights, highlighting their positivation, important to distinguish them from human rights, the four dimensions of the fundamental rights and, lastly, the analysis of their features, emphasizing their characters of complementarity and universality. After, it starts to discourse about the “access to Justice”, an important fundamental right, and, to delimitate the role of the Judiciary and the problems related to solve cases in a reasonable amount of time. Next, it exposes other alternative forms of dispute resolutions that, like the arbitration, can help to the concretization of a faster and more effective Justice. Then, it discusses the historical evolution of the arbitration in Brazil, highlighting the contemporary features of the institute, which were more visible with the ratification of the New York Convention and the promulgation of Law nº 9.307/1996. In addition, it analyses the possible changes that will come with the New Brazilian Procedure Law Code and the PL 7.108/2014, intended to change the current Arbitration Law. It also explains the main arbitration attributes, describing the peculiarities of the arbitral convention, the arbitrator role, and the arbitral award aspects. At least, it lists the main reasons someone should choose arbitration instead the Judiciary, considering the Brazilian Courts reality.
