In order to strengthen the constitutional process of appointment of judges in Superior Courts, Bangladesh established a Supreme Judicial Commission in 2008 by promulgating an Ordinance. This Ordinance was neither promulgated in pursuance of any provisions of the Constitution nor by introducing any amendment to the provisions of the Constitution. The recommendations of the Commission were not given binding force on the executive. The power of the executive to accept or reject the candidates recommended by the Supreme Judicial Commission at his pleasure defeated the very objective of establishing the Commission for appointing the most competent and suitable persons as judges of the superior courts in Bangladesh. However, following the general elections held on 29 December 2008, the newly elected Government of Bangladesh Awami League dispensed with the Supreme Judicial Commission by not placing the Supreme Judicial Commission Ordinance before the parliament for its approval. This resulted in restoring the previous system of appointing judges on the satisfaction of the executive, which has resulted in patronage appointments. Thus, the establishment of an independent judicial commission in Bangladesh is an imperative necessity for strengthening the independence and impartiality of the judiciary.

Strengthened protection for well-known trade marks in accordance with the TRIPS Agreement is an important issue for developing countries, which has led to trade pressures from industrialised nations in the past. ‘Trade mark squatting’, referring to the registration in bad faith of foreign well-known marks in order to sell them back to their original owners, is a much discussed phenomenon in this context. This article outlines the history and development of well-known trade marks and the applicable law in China and Indonesia. It looks not just at foreign and international brands subjected to ‘trade mark squatting’, but also at how local enterprises are using the system. Rather remarkably in view of the countries’ turbulent histories, local well-known marks have a long history and are well respected for their range of products. They are not normally affected by the ‘trade mark squatting’ phenomenon and are rarely the subject of disputes. Enhanced protection under the TRIPS Agreement is especially relevant for international brands and the article shows the approaches in the two countries. In China, government incentives assist the proliferation of nationally well-known and locally ‘famous’ marks. In Indonesia, lack of implementing legislation has left the matter of recognition to the discretion of the courts.

Uma metodologia de modelagem para a exploração do espaço de projeto de processadores é apresentada. A exploração do espaço de projeto constitui uma das etapas do fluxo de projeto dos atuais processadores de alto desempenho e de sistemas embarcados, que auxilia os projetistas no tratamento da complexidade inerente ao processo contemporâneo de projeto de sistemas computacionais. A principal característica desta metodologia é um processo de modelagem simples e rápido. Isso é obtido através da disponibilização dos recursos de modelagem em camadas com propósitos e níveis de complexidade de uso diferenciados e da limitação do número de elementos (palavras-chave, classes e métodos) que devem ser conhecidos pelo projetista para o acesso a estes recursos, independentemente da camada na qual eles se encontram. A única exigência para o uso de tais recursos são conhecimentos que estudantes de Computação adquirem ao longo dos seus cursos da área de Computação e Informática. Outras características da metodologia de modelagem incluem: recursos específicos e distintos para a descrição da organização, da arquitetura e de aspectos temporais do processador; um estilo de descrição estrutural de alto nível da organização; a possibilidade de uso de recursos gráficos em tempo de modelagem e em tempo de simulação; e a existência de informações nos modelos que podem ser usadas para a tradução das descrições para uma Hardware Description Language Todas estas características constituem um conjunto de soluções de modelagem e simulação de processadores que não é encontrado em outros ambientes usados na exploração do espaço de projeto, baseados em Architecture Description Languages, Hardware Description Languages e ferramentas de simulação. Além disso, os modelos de processadores, desenvolvidos com esta metodologia, fornecem os recursos para a aceleração do aprendizado de conteúdos de arquitetura de computadores que só são encontrados em simuladores para ensino. Uma infra-estrutura de software que implementa a metodologia de modelagem foi desenvolvida e está disponível. Ela foi usada no ensino e no contexto da pesquisa para a modelagem e simulação de diversos processadores. Uma comparação com a metodologia de modelagem de uma Architecture Description Language demonstra a simplicidade e a rapidez do processo de modelagem previsto na metodologia apresentada.

PURPOSE: To assess the acquisition of suture skills by training on ethylene-vinyl acetate bench model in novice medical students.METHODS: Sixteen medical students without previous surgery experience (novices) were randomly divided into two groups. During one hour group A trained sutures on ethylene-vinyl acetate (EVA) bench model with feedback of instructors, while group B (control) received a faculty-directed training based on books and instructional videos. All students underwent a both pre-and post-tests to perform two-and three-dimensional sutures on ox tongue. All recorded performances were evaluated by two blinded evaluators, using the Global Rating Scale.RESULTS: Although both groups have had a better performance (p<0.05) in the post-test when compared with the pre-test, the analysis of post-test showed that group A (EVA) had a better performance (p<0.05) when compared with group B (control).CONCLUSION: The ethylene vinyl acetate bench model allowed the novice students to acquire suture skills faster when compared to the traditional model of teaching.

OBJETIVO: Embora vários modelos de bancada inanimados tenham sido descritos para o treinamento de habilidades de sutura, até o momento, não existe um método ideal para esse ensino e aprendizagem durante a formação médica. O objetivo foi avaliar se a fidelidade dos modelos de bancada interfere na aquisição de habilidades de sutura em estudantes de medicina iniciantes na prática cirúrgica. MÉTODOS: 36 estudantes de medicina sem exposição prévia a habilidades cirúrgicas foram randomizados em três grupos (n = 12): treinamento de suturas baseado em materiais didáticos (controle); treinamento de suturas em modelo de baixa-fidelidade (modelo de bancada de etileno vinil acetato); ou treinamento de suturas em modelo de alta-fidelidade (modelo de bancada de pele de pata de porco). Foram aplicados pré e pós-testes (realização de pontos simples e pontos subdérmicos invertidos em língua de boi). Três ferramentas (Global Rating Scale com avaliação cega, tamanho do efeito e autopercepção da confiança baseada em uma escala de Likert) foram utilizadas para mensurar todas as performances de sutura. RESULTADOS: A análise após o treinamento demonstrou que os estudantes que treinaram nos modelos tiveram um melhor (p < 0.0000) desempenho na avaliação pela Global Rating Scale, quando comparados com o controle, independente da fidelidade do modelo. A magnitude do efeito (treinamento) foi considerada grande (> 0.80) em todas as mensurações. Após o treinamento os alunos sentiram-se mais confiantes (p < 0.0000) para executarem os dois tipos de suturas. CONCLUSÃO: A aquisição de habilidades de suturas no modelo de baixa fidelidade foi semelhante à prática no modelo de alta fidelidade, sendo que a melhora no desempenho dos participantes que treinaram nesses dois modelos foi superior à aprendizagem baseada em materiais didáticos.

O objetivo deste trabalho foi introduzir a técnica de microfiltração tangencial (MFT) na produção de suco de laranja. O suco microfiltrado (SMFT) foi comparado química e sensorialmente com um suco pasteurizado (testemunha). Utilizou-se um piloto de MFT munido de quatro membranas (0,1, 0,2, 0,8 e 1,4mm) cerâmicas monotubulares dispostas em série, cada uma delas com superfície de 0,005m². Suco de laranja comercial flash pasteurizado foi usado como produto inicial. O trabalho experimental foi dividido em três fases: a) caracterização do piloto de MFT; b) otimização das condições operacionais; c) produção do SMFT. Na fase de otimização, a membrana de 0,8mm apresentou os melhores fluxos de permeado, seguidas pelas de 1,4, 0,1 e 0,2mm. Para garantir a esterilidade do permeado, a membrana de 0,1mm foi escolhida para a terceira fase do trabalho. Na produção do SMFT, o suco de laranja foi peneirado para separar uma parte de sua polpa, sendo em seguida microfiltrado. Depois, a polpa foi misturada ao retentato e a mistura pasteurizada. O SMFT foi obtido adicionando a mistura pasteurizada ao permeado. O SMFT apresentou teor de sólidos solúveis (°Brix), polpa, pH e acidez titulável semelhante ao suco inicial pasteurizado (testemunha); embora, tenha perdido maior quantidade (28%) de vitamina C. de acordo com os provadores do painel, o suco testemunha apresentou melhores características sensoriais em relação ao SMFT, por apresentar maior intensidade de odor e sabor frutoso.

Background: Because of ethical and medico-legal aspects involved in the training of cutaneous surgical skills on living patients, human cadavers and living animals, it is necessary the search for alternative and effective forms of training simulation. Aims: To propose and describe an alternative methodology for teaching and learning the principles of cutaneous surgery in a medical undergraduate program by using a chicken-skin bench model. Materials and Methods: One instructor for every four students, teaching materials on cutaneous surgical skills, chicken trunks, wings, or thighs, a rigid platform support, needled threads, needle holders, surgical blades with scalpel handles, rat-tooth tweezers, scissors, and marking pens were necessary for training simulation. Results: A proposal for simulation-based training on incision, suture, biopsy, and on reconstruction techniques using a chicken-skin bench model distributed in several sessions and with increasing levels of difficultywas structured. Both feedback and objective evaluations always directed to individual students were also outlined. Conclusion: The teaching of a methodology for the principles of cutaneous surgery using a chicken-skin bench model versatile, portable, easy to assemble, and inexpensive is an alternative and complementary option to the armamentarium of methods based on other bench models described. © Indian Journal of Dermatology 2013.

The purpose of this study was to quantify energy expenditure (EE) during multiple sets of leg press (LP) and bench press (BP) exercises in 10 males with at least 1 yr of resistance training (RT). The subjects underwent two sessions to determine 1 repetition maximum (1RM) on the BP and LP and one protocol consisting of a warm up and 4 sets for 10 repetitions at 70% 1RM with a 3-min rest period between sets for each exercise. Energy expenditure was calculated as the sum of oxygen uptake (aerobic component), EPOC, and lactate production (anaerobic component). There were no significant differences in EE between exercises for sets 1 to 4 and the total energy expended. However, statistical analysis revealed a significant difference (P<0.05) between exercises in RT economy (BP, 0.0206 ± 0.0044 kcal·kg-1 vs. LP, 0.0051 ± 0.0015 kcal·kg-1). Within exercise comparison showed set 4 was significantly different from sets 1 and 3 for BP, and for LP a significant difference was found between set 4 and sets 1, 2 and 3. Our results point to an increase in EE during multiple sets at 70% 1RM and show that in spite of the difference in muscle mass involved and total work done during each type of exercise, EE was not different due to greater economy during the LP.

Background: The search for alternative and effective forms of training simulation is needed due to ethical and medico-legal aspects involved in training surgical skills on living patients, human cadavers and living animals. Aims : To evaluate if the bench model fidelity interferes in the acquisition of elliptical excision skills by novice medical students. Materials and Methods: Forty novice medical students were randomly assigned to 5 practice conditions with instructor-directed elliptical excision skills' training (n = 8): didactic materials (control); organic bench model (low-fidelity); ethylene-vinyl acetate bench model (low-fidelity); chicken legs' skin bench model (high-fidelity); or pig foot skin bench model (high-fidelity). Pre- and post-tests were applied. Global rating scale, effect size, and self-perceived confidence based on Likert scale were used to evaluate all elliptical excision performances. Results : The analysis showed that after training, the students practicing on bench models had better performance based on Global rating scale (all P < 0.0000) and felt more confident to perform elliptical excision skills (all P < 0.0000) when compared to the control. There was no significant difference (all P > 0.05) between the groups that trained on bench models. The magnitude of the effect (basic cutaneous surgery skills' training) was considered large (>0.80) in all measurements. Conclusion : The acquisition of elliptical excision skills after instructor-directed training on low-fidelity bench models was similar to the training on high-fidelity bench models; and there was a more substantial increase in elliptical excision performances of students that trained on all simulators compared to the learning on didactic materials.

Aim. The purpose of the study was to investigate the relationship between the total volume of load lifted (TVLL) and the rating of perceived exertion (RPE) measures during different resistance training (RT) schemes using the bench press exercise. Methods. The present study was divided into two experiments. In the first experiment, 18 healthy men performed three different RT schemes: a strength oriented scheme (SS), a muscular endurance oriented scheme (ES) and a hypertrophy oriented scheme (HS). TVLL was calculated for each scheme. Mean-RPE and session-RPE were assessed. In the second experiment, 23 men performed two resistance exercise bouts at different intensities (50 %-1RM and 75%-1RM) with matched TVLL. Mean-RPE and session-RPE were also assessed. Results. SS and HS showed higher TVLL and greater RPE scores as compared to ES (P<0.05). No significant difference was observed between SS and HS. It was verified significant positive correlations between TVLL and session-RPE (SS r=0.63, HS r=0.64, ES r=0.56; P<0.05), and between mean-RPE and TVLL (SS r=0.55, HS r=0.52, ES r=0.47; P<0.05) for all schemes. No differences were observed for mean-RPE, session-RPE and TVLL between the 50%-1RM and 75%1RM. Significant positive relationships between TVLL and session-RPE (50 %-1RM r=0.61, 75 %-1RM r=0.66; p<0.05) and between TVLL and mean-RPE (50 %-1RM r=0.51, 75%1RM r=0.49; P<0.05) were observed. Conclusion. The results of this study have shown that the TVLL in RT influences RPE measures. These findings corroborates the existence of a relationship between total work performed (external training load) and perception of effort (internal training load).

J Strength Cond Res 26(3): 739-744, 2012-Postactivation potentiation (PAP) is a strategy used to improve performance in power activities. The aim of this study was to determine if power during bench press exercise was increased when preceded by 1 repetition maximum (1RM) in the same exercise and to determine which time interval could optimize PAP response. For this, 11 healthy male subjects (age, 25 +/- 4 years; height, 178 +/- 6 cm; body mass, 74 +/- 8 kg; bench press 1RM, 76 +/- 19 kg) underwent 6 sessions. Two control sessions were conducted to determine both bench press 1RM and power (6 repetitions at 50% 1RM). The 4 experimental sessions were composed of a 1RM exercise followed by power sets with different recovery intervals (1, 3, 5, and 7 minutes), performed on different days, and determined randomly. Power values were measured via Peak Power equipment (Cefise, Nova Odessa, Sao Paulo, Brazil). The conditions were compared using an analysis of variance with repeated measures, followed by a Tukey test. The significance level was set at p < 0.05. There was a significant increase in PAP in concentric contractions after 7 minutes of recovery compared with the control and 1-minute recovery conditions (p < 0.05). Our results indicated that 7 minutes of recovery has generated an increase in PAP in bench press and that such a strategy could be applied as an interesting alternative to enhance the performance in tasks aimed at increasing upper-body power performance.

Purpose: Automated weaning modes are available in some mechanical ventilators, but no studies compared them hitherto. We compared the performance of 3 automated modes under standard and challenging situations. Methods: We used a lung simulator to compare 3 automated modes, adaptive support ventilation (ASV), mandatory rate ventilation (MRV), and Smartcare, in 6 situations, weaning success, weaning failure, weaning success with extreme anxiety, weaning success with Cheyne-Stokes, weaning success with irregular breathing, and weaning failure with ineffective efforts. Results: The 3 modes correctly recognized the situations of weaning success and failure, even when anxiety or irregular breathing were present but incorrectly recognized weaning success with Cheyne-Stokes. MRV incorrectly recognized weaning failure with ineffective efforts. Time to pressure support (PS) stabilization was shorter for ASV (1-2 minutes for all situations) and MRV (1-7 minutes) than for Smartcare (8-78 minutes). ASV had higher rates of PS oscillations per 5 minutes (4-15), compared with Smartcare (0-1) and MRV (0-12), except when extreme anxiety was present. Conclusions: Smartcare, ASV, and MRV were equally able to recognize weaning success and failure, despite the presence of anxiety or irregular breathing but performed incorrectly in the presence of Cheyne-Stokes. PS behavior over the time differs among modes, with ASV showing larger and more frequent PS oscillations over the time. Clinical studies are needed to confirm our results. (C) 2012 Elsevier Inc.
