O presente estudo teve por objetivos a) identificar aspectos da história de vida pessoal, das etapas de desenvolvimento evolutivo e das relações familiares e afetivas de mulheres que cumprem pena em regime fechado, com o intuito de colher elementos significativos e contributivos para a compreensão da vulnerabilidade criminal feminina; b) realizar uma análise sistematizada do caráter, segundo abordagem de Wilhelm Reich, a partir do conteúdo do discurso clínico dessas mulheres. Para tal foram estudados três casos de mulheres reclusas em regime fechado no Centro de Ressocialização Feminino, na cidade de São José do Rio Preto, que respondem pelos artigos 33 e 35 da Lei 11343/06, que refere-se ao tráfico de drogas ilícitas e a associação para o crime, e artigo 157 do Código Penal Brasileiro, que refere-se a roubo. O conteúdo das entrevistas realizadas indicou graves dificuldades no crescimento e desenvolvimento por ambiente desfavorável e por relações psico-afetivas empobrecidas ou insatisfatórias. Encontrou-se em comum nos casos estudados, segundo uma análise reichiana, indicativos de fixação na oralidade, ou seja, traços orais insatisfatórios relacionados à primeira infância, indicando pouca referência identificatória que lhes oferecesse base para defenderem-se da realidade. Entendeu-se que tais falhas desenvolvimentais podem indicar vulnerabilidade para ações criminais como forma de defesa contra angústia, fazendo com que atuem de forma mais imediata ou impulsiva na busca de satisfação.

Este estudo teve como objetivo pesquisar a reincidência criminal por meio de três estudos exploratórios. No primeiro foi utilizado o Perfil do Detento no Estado de São Paulo, ano de 2003, documento elaborado pela Secretaria da Administração Penitenciaria, selecionando-se dele a população de 1.280 sujeitos do gênero masculino do Presídio Desembargador "Adriano Marrey" de Guarulhos. Foram encontradas prováveis associações à reincidência criminal nos seguintes fatores: idade, número de delitos cometidos e escolaridade. No segundo utilizou-se um levantamento aleatório, através do número de matrícula dos presos, que atingiu 11% dos 1.654 registrados e classificados em 2004. Os dados dos prontuários criminológicos dessa população carcerária, que foi de 182 sujeitos, foram comparados aos do primeiro estudo. Os resultados corroboraram tendências de associação entre idade, escolaridade, números de delitos e reincidência criminal. No terceiro estudo foram analisados 30 protocolos do Teste do Desenho da Figura Humana (DFH) aplicados em sentenciados do gênero masculino que tinham entre 18 e 35 anos de idade, condenados pelo artigo 157§2° do Código Penal Brasileiro (Assalto a Mão Armada), em regime inicialmente fechado. Esta investigação teve como objetivo conhecer as características de personalidade das pessoas que cometeram crimes. Encontraram-se alguns traços de personalidade que podem estar associados à criminalidade ou a reincidência.Não foram detectadas características psicóticas, mas perturbações e desvios na sexualidade, agressividade, imaturidade, dificuldade de elaboração de frustrações. Estes resultados podem alicerçar o uso das técnicas projetivas nas entrevistas de inclusão. Para tanto se propõe o uso do Desenho da Figura Humana de Machover (1949), com análise proposta por Lourenção Van Kolck (1984). Na discussão dos resultados e nas conclusão foram retomados os fatores que se apresentaram associados à reincidência e alguns temas que se mostraram de interesse para outras pesquisas no campo da psicologia criminal ou penitenciária. Pretendeu-se buscar subsídios que pudessem contribuir para a prevenção da reincidência, com base numa compreensão psicossocial do comportamento criminoso e sempre sob o enfoque da psicologia da saúde. As pessoas envolvidas na execução da pena deverão dar mais ênfase à entrevista de inclusão para cumprir o que determina a Lei de Execução Penal, executando o exame de classificação

This thesis investigates the historical influence of the criminal policy in the context that shapes the first specific law for children and adolescents in Brazil, the 1927 Children's Code, a standard that inaugurates the conceptual scission between children and "minor" and their different treatment by the State. The study addresses the demand for order in the context of changes in the working world in the transition from the slave system to the capitalist mode of production, and the corresponding disciplinary and punitive control mechanisms directed to the segment of childhood and adolescence. The theoretical route proposes a questioning of the political construction of law and justice, as well as the conformation of the punitive techniques, and the construction of the stereotype of the "delinquent", prime target of the criminal policy, focusing on the process of criminalization of the segment in question through the confrontation of the Critical perspective with the approaches of Classical and Positive schools. This research shows the imposition of a bourgeois morality that obscures the social conflict attributing it to people isolated by the criminalization of their conduct; and points out that the historical forms of selective social control were greatly influenced by psychiatry and psychology, either by the elaboration of the image of the "delinquent" or by the expected performance of custodial institutions. Finally, the developments and the permanence of the historical roots of the criminal policy are problematized, relating them to the difficulties currently encountered in the consolidation of the legal garantism paradigm proposed by the Children and Adolescent Statute.

The present study investigated the impact of different legal standards on mock juror decisions concerning whether a defendant was guilty or not guilty by reason of insanity. Undergraduate students (N = 477) read a simulated case summary involving a murder case and were asked to make an insanity determination. The cases differed in terms of the condition of the defendant (rationality deficit or control deficit) and the legal standard given to the jurors to make the determination (Model Penal Code, McNaughten or McNaughten plus a separate control determination). The effects of these variables on the insanity determination were investigated. Jurors also completed questionnaires measuring individualism and hierarchy attitudes and perceptions of facts in the case. Results indicate that under current insanity standards jurors do not distinguish between defendants with rationality deficits and defendants with control deficits regardless of whether the legal standard requires them to do so. Even defendants who lacked control were found guilty at equal rates under a legal standard excusing rationality deficits only and a legal standard excluding control and rationality deficits. This was improved by adding a control test as a partial defence, to be determined after a rationality determination. Implications for the insanity defence in the Criminal Justice System are discussed.

INTRODUÇÃO: a responsabilidade do cirurgião-dentista pode ser entendida como obrigações de ordem penal, civil, ética e administrativa, às quais está sujeito no exercício de sua atividade. Assim, se comprovado um resultado lesivo ao paciente - por imprudência, imperícia ou negligência -, o cirurgião-dentista estará sujeito às penalidades previstas no Código Civil, sendo obrigado a satisfazer o dano e indenizar segundo a consequência provocada. Em processos cíveis, as partes poderão contratar um assistente técnico para fornecer, aos respectivos advogados, conhecimentos técnicos e científicos inerentes ao tema. OBJETIVO: informar sobre a importância da atuação de assistentes técnicos em processos cíveis, propiciando às partes uma maior compreensão dos aspectos técnicos, éticos e legais. CONCLUSÃO: há a necessidade de um maior conhecimento, por parte dos profissionais em Odontologia, sobre os aspectos éticos e legais que norteiam a profissão.

This paper presents an investigation of design code provisions for steel-concrete composite columns. The study covers the national building codes of United States, Canada and Brazil, and the transnational EUROCODE. The study is based on experimental results of 93 axially loaded concrete-filled tubular steel columns. This includes 36 unpublished, full scale experimental results by the authors and 57 results from the literature. The error of resistance models is determined by comparing experimental results for ultimate loads with code-predicted column resistances. Regression analysis is used to describe the variation of model error with column slenderness and to describe model uncertainty. The paper shows that Canadian and European codes are able to predict mean column resistance, since resistance models of these codes present detailed formulations for concrete confinement by a steel tube. ANSI/AISC and Brazilian codes have limited allowance for concrete confinement, and become very conservative for short columns. Reliability analysis is used to evaluate the safety level of code provisions. Reliability analysis includes model error and other random problem parameters like steel and concrete strengths, and dead and live loads. Design code provisions are evaluated in terms of sufficient and uniform reliability criteria. Results show that the four design codes studied provide uniform reliability, with the Canadian code being best in achieving this goal. This is a result of a well balanced code, both in terms of load combinations and resistance model. The European code is less successful in providing uniform reliability, a consequence of the partial factors used in load combinations. The paper also shows that reliability indexes of columns designed according to European code can be as low as 2.2, which is quite below target reliability levels of EUROCODE. (C) 2009 Elsevier Ltd. This paper presents results on a verification test of a Direct Numerical Simulation code of mixed high-order of accuracy using the method of manufactured solutions (MMS). This test is based on the formulation of an analytical solution for the Navier-Stokes equations modified by the addition of a source term. The present numerical code was aimed at simulating the temporal evolution of instability waves in a plane Poiseuille flow. The governing equations were solved in a vorticity-velocity formulation for a two-dimensional incompressible flow. The code employed two different numerical schemes. One used mixed high-order compact and non-compact finite-differences from fourth-order to sixth-order of accuracy. The other scheme used spectral methods instead of finite-difference methods for the streamwise direction, which was periodic. In the present test, particular attention was paid to the boundary conditions of the physical problem of interest. Indeed, the verification procedure using MMS can be more demanding than the often used comparison with Linear Stability Theory. That is particularly because in the latter test no attention is paid to the nonlinear terms. For the present verification test, it was possible to manufacture an analytical solution that reproduced some aspects of an instability wave in a nonlinear stage. Although the results of the verification by MMS for this mixed-order numerical scheme had to be interpreted with care, the test was very useful as it gave confidence that the code was free of programming errors. OctVCE is a cartesian cell CFD code produced especially for numerical simulations of shock and blast wave interactions with complex geometries, in particular, from explosions. Virtual Cell Embedding (VCE) was chosen as its cartesian cell kernel for its simplicity and sufficiency for practical engineering design problems. The code uses a finite-volume formulation of the unsteady Euler equations with a second order explicit Runge-Kutta Godonov (MUSCL) scheme. Gradients are calculated using a least-squares method with a minmod limiter. Flux solvers used are AUSM, AUSMDV and EFM. No fluid-structure coupling or chemical reactions are allowed, but gas models can be perfect gas and JWL or JWLB for the explosive products. This report also describes the code’s ‘octree’ mesh adaptive capability and point-inclusion query procedures for the VCE geometry engine. Finally, some space will also be devoted to describing code parallelization using the shared-memory OpenMP paradigm. The user manual to the code is to be found in the companion report 2007/13.
