Credit-rationing model similar to Stiglitz and Weiss [1981] is combined with the information externality model of Lang and Nakamura [1993] to examine the properties of mortgage markets characterized by both adverse selection and information externalities. In a credit-rationing model, additional information increases lenders ability to distinguish risks, which leads to increased supply of credit. According to Lang and Nakamura, larger supply of credit leads to additional market activities and therefore, greater information. The combination of these two propositions leads to a general equilibrium model. This paper describes properties of this general equilibrium model. The paper provides another sufficient condition in which credit rationing falls with information. In that, external information improves the accuracy of equity-risk assessments of properties, which reduces credit rationing. Contrary to intuition, this increased accuracy raises the mortgage interest rate. This allows clarifying the trade offs associated with reduced credit rationing and the quality of applicant pool.

Patent claims defi ne the protection scope of the intellectual property sought by the patent applicant or patentee. Broad claims are valuable as they can describe more expansive rights to the invention. Therefore, if these claims are too broad a potential infringer will more easily argue against them. But if the claims are too narrow the scope of protection of the intellectual property is greatly reduced. Patent claims have to be, on the one hand, determinate and precise enough and, on the other hand, as inclusive as possible. Therefore patent applicants must fi nd a balance in the broadness of the scope defi ned by their claims. This balance can be achieved by the choice of words with a convenient degree of semantic indeterminacy, by the choice of modifi ers or other strategies. In fact, vagueness in patent claims is a desirable characteristic for such documents. A quantitative and qualitative analysis of a corpus of 350 U.S. patents provides a promising starting point to understand the linguistic instruments used to achieve the balance between property claim scope and precision of property description. To conclude, some issues relating vagueness and pragmatics are suggested as a line of further research.

La tesis estudia uno de los aspectos más importantes de la gestión de la sociedad de la información: conocer la manera en que una persona valora cualquier situación. Esto es importante para el individuo que realiza la valoración y para el entorno con el que se relaciona. La valoración es el resultado de la comparación: se asignan los mismos valores a alternativas similares y mayores valores a alternativas mejor consideradas en el proceso de comparación. Los patrones que guían al individuo a la hora de hacer la comparación se derivan de sus preferencias individuales (es decir, de sus opiniones). En la tesis se presentan varios procedimientos para establecer las relaciones de preferencia entre alternativas de una persona. La valoración progresa hasta obtener una representación numérica de sus preferencias. Cuando la representación de preferencias es homogénea permite, además, contrastar las preferencias personales con las del resto de evaluadores, lo que favorece la evaluación de políticas, la transferencia de información entre diferentes individuos y el diseño de la alternativa que mejor se adapte a las preferencias identificadas. Al mismo tiempo, con esta información se pueden construir comunidades de personas con los mismos sistemas de preferencias ante una cuestión concreta. La tesis muestra un caso de aplicación de esta metodología: optimización de las políticas laborales en un mercado real. Para apoyar a los demandantes de empleo (en su iniciación o reincorporación al mundo laboral o en el cambio de su actividad) es necesario conocer sus preferencias respecto a las ocupaciones que están dispuestos a desempeñar. Además, para que la intermediación laboral sea efectiva, las ocupaciones buscadas deben de ser ofrecidas por el mercado de trabajo y el demandante debe reunir las condiciones para acceder a esas ocupaciones. El siguiente desarrollo de estos modelos nos lleva a los procedimientos utilizados para transformar múltiples preferencias en una decisión agregada y que consideran tanto la opinión de cada uno de los individuos que participan en la decisión como las interacciones sociales, todo ello dirigido a generar una solución que se ajuste lo mejor posible al punto de vista de toda la población. Las decisiones con múltiples participantes inciden, principalmente, en: el aumento del alcance para incorporar a personas que tradicionalmente no han sido consideradas en las tomas de decisiones, la agregación de las preferencias de los múltiples participantes en las tomas de decisiones colectivas (mediante votación, utilizando aplicaciones desarrolladas para la Web2.0 y a través de comparaciones interpersonales de utilidad) y, finalmente, la auto-organización para permitir que interaccionen entre si los participantes en la valoración, de forma que hagan que el resultado final sea mejor que la mera agregación de opiniones individuales. La tesis analiza los sistemas de e-democracia o herramientas para su implantación que tienen más más utilización en la actualidad o son más avanzados. Están muy relacionados con la web 2.0 y su implantación está suponiendo una evolución de la democracia actual. También se estudian aplicaciones de software de Colaboración en la toma de decisiones (Collaborative decision-making (CDM)) que ayudan a dar sentido y significado a los datos. Pretenden coordinar las funciones y características necesarias para llegar a decisiones colectivas oportunas, lo que permite a todos los interesados participar en el proceso. La tesis finaliza con la presentación de un nuevo modelo o paradigma en la toma de decisiones con múltiples participantes. El desarrollo se apoya en el cálculo de las funciones de utilidad empática. Busca la colaboración entre los individuos para que la toma de decisiones sea más efectiva, además pretende aumentar el número de personas implicadas. Estudia las interacciones y la retroalimentación entre ciudadanos, ya que la influencia de unos ciudadanos en los otros es fundamental para los procesos de toma de decisiones colectivas y de e-democracia. También incluye métodos para detectar cuando se ha estancado el proceso y se debe interrumpir. Este modelo se aplica a la consulta de los ciudadanos de un municipio sobre la oportunidad de implantar carriles-bici y las características que deben tomar. Se simula la votación e interacción entre los votantes. ABSTRACT The thesis examines one of the most important aspects of the management of the information society: get to know how a person values every situation. This is important for the individual performing the assessment and for the environment with which he interacts. The assessment is a result of the comparison: identical values are allocated to similar alternatives and higher values are assigned to those alternatives that are more favorably considered in the comparison process. Patterns that guide the individual in making the comparison are derived from his individual preferences (ie, his opinions). In the thesis several procedures to establish preference relations between alternatives a person are presented. The assessment progresses to obtain a numerical representation of his preferences. When the representation of preferences is homogeneous, it also allows the personal preferences of each individual to be compared with those of other evaluators, favoring policy evaluation, the transfer of information between different individuals and design the alternative that best suits the identified preferences. At the same time, with this information you can build communities of people with similar systems of preferences referred to a particular issue. The thesis shows a case of application of this methodology: optimization of labour policies in a real market. To be able support jobseekers (in their initiation or reinstatement to employment or when changing area of professional activity) is necessary to know their preferences for jobs that he is willing to perform. In addition, for labour mediation to be effective occupations that are sought must be offered by the labour market and the applicant must meet the conditions for access to these occupations. Further development of these models leads us to the procedures used to transform multiple preferences in an aggregate decision and consider both the views of each of the individuals involved in the decision and the social interactions, all aimed at generating a solution that best fits of the point of view of the entire population. Decisions with multiple participants mainly focus on: increasing the scope to include people who traditionally have not been considered in decision making, aggregation of the preferences of multiple participants in collective decision making (by vote, using applications developed for the Web 2.0 and through interpersonal comparisons of utility) and, finally, self-organization to allow participants to interact with each other in the assessment, so that the final result is better than the mere aggregation of individual opinions. The thesis analyzes the systems of e-democracy or tools for implementation which are more popular or more advanced. They are closely related to the Web 2.0 and its implementation is bringing an evolution of the current way of understanding democracy. We have also studied Collaborative Decision-Making (CDM)) software applications in decision-making which help to give sense and meaning to the data. They intend to coordinate the functions and features needed to reach adequate collective decisions, allowing all stakeholders to participate in the process. The thesis concludes with the presentation of a new model or paradigm in decision-making with multiple participants. The development is based on the calculation of the empathic utility functions. It seeks collaboration between individuals to make decision-making more effective; it also aims to increase the number of people involved. It studies the interactions and feedback among citizens, because the influence of some citizens in the other is fundamental to the process of collective decision-making and e-democracy. It also includes methods for detecting when the process has stalled and should be discontinued. This model is applied to the consultation of the citizens of a municipality on the opportunity to introduce bike lanes and characteristics they should have. Voting and interaction among voters is simulated.

Un nuevo sistema de gobernanza para afrontar los retos del siglo XXI en la educación universitaria en Perú basado en el modelo de análisis de políticas, surge de observar el efecto de la competencia en los mercados, de la distribución de los escasos recursos según productividad y rendimiento, y de la gestión ineficiente de las universidades ya que estos parámetros están cambiando los criterios de confianza y legitimidad del sistema universitario en Perú. Las universidades se perciben más como instituciones del sector público, mientras que los servicios que ofrecen deben más bien contribuir a la modernización de la sociedad emergente y a la economía del conocimiento. Las reformas universitarias- iniciadas en los años 80 - han estado inspiradas en las organizaciones universitarias exitosas que han logrado modificar su gobernanza y van dirigidas a transformar ciertas instituciones burocráticas en organizaciones capaces de desempeñar la función de actores en esta competición global por los recursos y los mejores talentos. En este contexto, la universidad peruana se enfrenta a dos grandes desafíos: el de adaptarse a las nuevas perspectivas mundiales, y el poder dar mejor respuesta a las demandas, necesidades y expectativas de la sociedad. Un cambio en el sistema de gobernanza para la educación superior universitaria dará una solución integral a estos desafíos permitiéndole enfrentar los problemas de la universidad para su desarrollo e inserción en las corrientes mundiales. La metodología planteada en la investigación es cualitativa parte del análisis de la realidad como un TODO, sin reducirlos a sus partes integrantes, con la interpretación de los hechos, buscando entender las variables que intervienen. Se propone una política para la educación universitaria en Perú que se permeabilice a la sociedad, cambiando el modelo de planificación de un modelo de reforma social a un modelo de análisis de políticas, donde el Estado Peruano actúe como único responsable de responder a la sociedad demandante como su representante legal, y con unos organismo externo e independiente que siente las bases de la práctica, como se está haciendo en muchos modelos universitarios del mundo. Esta investigación presenta una primera fase conceptual, que aborda la evolución histórica de las universidades en el Perú, analizando y clarificando las fuerzas impulsoras a través del tiempo y distinguir las principales líneas que le imprimen dirección y sentido a los cambios de una realidad educativa universitaria. Así mismo, en esta fase se hace un análisis de la situación actual de las universidades en el Perú para llegar a determinar en qué situación se encuentra y si está preparada para enfrentar los retos de la educación universitaria mundial, para esto se analizan los modelos universitarios de mayor prestigio en el mundo. El marco teórico anterior permite sentar, en una segunda fase de la investigación, las bases científicas del modelo que se propone: el modelo de planificación de análisis de políticas para el sistema universitario peruano. Este modelo de ámbito público propuesto para la educación universitaria peruana basa su estrategia en un modelo de planificación con un objetivo común: “Mejorar la calidad de la educación superior universitaria peruana con el fin de aumentar la empleabilidad y la movilidad de los ciudadanos así como la competitividad internacional de la educación universitaria en Perú”, y con unas líneas de acción concretadas en cuatro objetivos específicos: 1) competencias (genéricas y específicas de las áreas temáticas); 2) enfoques de enseñanza, aprendizaje y evaluación; 3) créditos académicos; 4) calidad de los programa. Así como los fundamentos metodológicos del modelo de análisis de políticas, utilizado como estructura política, teniendo en cuenta las características básicas del modelo: a) Planificación desde arriba; b) Se centra en la toma de decisiones; c) Separación entre conocimiento experto y decisión; d) El estudio de los resultados orienta el proceso decisor. Finalmente, se analiza una fase de validación del modelo propuesto para la educación superior universitaria peruana, con los avances ya realizados en Perú en temas de educación superior, como es, el actual contexto de la nueva Ley Universitaria N°30220 promulgada el 8 de julio de 2014, la creación del SUNEDU y la reorganización del SINEACE, que tienen como propósito atender la crisis universitaria centrada en tres ejes principales incluidos en la ley, considerados como bases para una reforma. Primero, el Estado asume la rectoría de las políticas educativas en todos los niveles educativos. El segundo aspecto consiste en instalar un mecanismo de regulación de la calidad que junto con la reestructuración de aquellos otros existentes debieran sentar las bases para que las familias y estudiantes tengan la garantía pública de que el servicio que se ofrece, sin importar sus características particulares, presenten un mínimo común de calidad y un tercer aspecto es que la ley se reafirma en que la universidad es un espacio de construcción de conocimiento basado en la investigación y la formación integral. Las finalidades, la estructura y organización, las formas de graduación, las características del cuerpo docente, la obligatoriedad por los estudios generales, etc., indican que la reflexión académica es el centro articulador de la vida universitaria. Esta validación también se ha confrontado con los resultados de las entrevistas cualitativas a juicio de experto que se han realizado a rectores de universidades públicas y privadas así como a rectores miembros de la ex ANR, miembros de organizaciones como CONCYTEC, IEP, CNE, CONEAU, ICACIT e investigadores en educación superior, con la finalidad de analizar la sostenibilidad del modelo propuesto en el tiempo. Los resultados evidencian, que en el sistema universitario peruano se puede implementar un cambio hacía un modelo de educación superior universitaria, con una política educativa que se base en un objetivo común claramente definido, un calendario para lograrlo y un conjunto objetivos específicos, con un cambio de estructura política de reforma social a un modelo de análisis de políticas. Así mismo se muestran los distintos aspectos que los interesados en la educación superior universitaria deben considerar, si se quiere ocupar un espacio en el futuro y si interesa que la universidad peruana pueda contribuir para que la sociedad se forje caminos posibles a través de una buena docencia que se refleje en su investigación, con alumnos internacionales, sobre todo, en los postgrados; con un investigación que se traduzca en publicaciones, patentes, etc., de impacto mundial, con relevancia en la sociedad porque contribuye a su desarrollo, concretándose en trabajos de muy diversos tipos, promovidos junto con empresas, gobiernos en sus diversos niveles, instituciones públicas o privadas, etc., para que aporten financiación a la universidad. ABSTRACT A new system of governance to meet the challenges of the twenty-first century university education in Peru based on the model of policy analysis, comes to observe the effect of market competition, distribution of scarce resources according to productivity and performance, and inefficient management of universities as these parameters are changing the criteria of trust and legitimacy of the university system in Peru. Universities are perceived more as public sector institutions, while the services provided should rather contribute to the modernization of society and the emerging knowledge economy. The-university reforms initiated in the 80s - have been inspired by successful university organizations that have succeeded in changing its governance and as attempting to transform certain bureaucratic institutions into organizations that act as actors in this global competition for resources and top talent. In this context, the Peruvian university faces two major challenges: to adapt to the new global outlook, and to better respond to the demands, needs and expectations of society. A change in the system of governance for university education give a comprehensive solution to address these challenges by allowing the problems of the university development and integration into global flows. The methodology proposed in this research is qualitative part of the analysis of reality as a whole, without reducing them to their constituent parts, with the interpretation of the facts, seeking to understand the variables involved. a policy for university education in Peru that permeabilizes society is proposed changing the planning model of a model of social reform a model of policy analysis, where the Peruvian State to act as the sole responsible for responding to the applicant as its legal representative, and with external and independent body that provides the basis of practice, as is being done in many university models in the world. This research presents an initial conceptual phase, which deals with the historical development of universities in Peru, analyzing and clarifying the driving forces over time and distinguish the main lines that give direction and meaning to changes in university educational reality. Also, at this stage an analysis of the current situation of universities in Peru is done to be able to determine what the situation is and whether it is prepared to meet the challenges of the global higher education, for this university models are analyzed most prestigious in the world. The above theoretical framework allows to lay in a second phase of research, the scientific basis of the model proposed: the planning model of policy analysis for the Peruvian university system. This proposed model of public sphere for the Peruvian college bases its strategy on a planning model with a common goal: "To improve the quality of the Peruvian university education in order to enhance the employability and mobility of citizens and the international competitiveness of higher education in Peru ", and lines of action materialized in four specific objectives: 1) competences (generic and specific subject areas); 2) approaches to teaching, learning and assessment; 3) credits; 4) quality of the program. As well as the methodological foundations of policy analysis model, used as political structure, taking into account the basic characteristics of the model: a) Planning from above; b) focuses on decision making; c) Separation between expertise and decision; d) The study of the results process guides the decision maker. Finally, a validation phase of the proposed Peruvian university higher education, with the progress already made in Peru on issues of higher education model is analyzed, as is the current context of the new University Law No. 30220 promulgated on July 8 2014, the creation of SUNEDU and reorganization of SINEACE, which are intended to serve the university crisis centered on three main areas included in the law, considered as the basis for reform. First, the State assumes the stewardship of education policies at all educational levels. This validation has also been confronted with the results of qualitative interviews with expert judgment that has been made to directors of public and private universities as well as leading members of the former ANR members of organizations like CONCYTEC, IEP, CNE, CONEAU, ICACIT and researchers in higher education, in order to analyze the sustainability of the proposed model in time. The results show, that the Peruvian university system can implement a change to a model of university education, an educational policy based on clearly defined common goal, a timetable for achieving specific objectives set and, with a change social policy structure to a model of reform policy analysis. It also shows the various aspects that those interested in university education should consider, if you want to occupy a space in the future and if interested in the Peruvian university can contribute to society possible paths is forged through research good teaching, international students, especially in graduate programs; with research that results in publications, patents, etc., global impact, relevance to society because it contributes to their development taking shape in very different types of jobs, promoted with businesses, governments at various levels, public institutions or private, etc., to provide funding to the university.

A clínica da Obesidade Mórbida e a Cirurgia Bariátrica exige estudos e acompanhamentos do paciente. Os benefícios e riscos do emagrecimento por tratamento cirúrgico devem servir como ponto de alerta aos profissionais da saúde. O uso do questionário no serviço de psicologia é norteado pela escuta psicológica. Objetivos: 1) Descrever o perfil sócio-demográfico candidatos à cirurgia bariátrica. 2) Analisar a percepção dos pacientes sobre características de personalidade associadas à obesidade e transtornos alimentares. 3) Descrever os conteúdos psicodinâmicos da narrativa do sujeito e avaliar o sistema tensional inconsciente de dois pacientes por meio do Teste das Relações Objetais de Phillipson (TRO). Método: O delineamento metodológico com análise de dados pelo método epidemiológico e estudo de caso clínico, orientação psicanalítica. Na primeira etapa foram consultados 300 questionários do serviço de psicologia e na segunda dois pacientes com ganho de peso após 24 meses. São pacientes que procuraram tratamento em clínica especializada, em uma metrópole do sudeste brasileiro, sob consentimento pós-informado. Os questionários foram preenchidos por 227 mulheres e 73 homens; com média de idade igual a 36 anos; escolaridade ensino médio e superior, 53%; maioria casados; IMC entre grave e super mórbido (94,3%). Técnicas cirúrgicas indicadas Capella Bypass e Fobi-Capella (67%). Resultados: características psicológicas referidas pelos pacientes, a ansiedade apontou em 93,7% das respostas, seguidas por impulsividade, depressão, tolerância à frustração, baixa auto-estima, resolvedor de problemas dos outros (mais de 50%). No histórico familiar da obesidade está em mais de 70% depressão e uso do álcool em 30%; realização de psicoterapia (30%) e medicamentos para depressão e ansiedade (10%). Na segunda etapa, foi realizado o diagnóstico psicodinâmico, por meio do Teste das Relações Objetais de Phillipson com duas pacientes, cuja análise indicou necessidade de psicoterapia psicanalítica, pois tinham fixações na posição esquizoparanóide e apresentavam dificuldade em lidar com perdas e baixa motivação para mudança e insigth. Conclusões: Com a aplicação do questionário e o registro das observações empíricas, este questionário de entrevista semidirigida preenche condições de melhor acessar e avaliar os conteúdos revelados pelos pacientes. As contradições entre as respostas e o discurso, no contato individual com o psicólogo, apontam a necessidade de investimento no preparo do paciente para a cirurgia e mais acentuadamente o acompanhamento psicológico no primeiro ano do pós-operatório. Há um pensamento mágico a ser trabalhado durante a aplicação do questionário sobre as crenças frente à cirurgia e o emagrecimento e assim convocar o paciente a ocupar o lugar do sujeito implicado em seu processo pré e pós-operatório. O TRO contribuiu na compreensão do diagnóstico psicodinâmico de pacientes com ganho de peso após cirurgia e reforçou a necessidade de maior investimento no pré-operatório.(AU)

A pesquisa permeia a contabilidade e autogestão existentes nos empreendimentos econômicos solidários, em que o modelo de gestão é democrático e participativo e requer ferramentas contábeis compatíveis com suas características. O objetivo é verificar se a aplicação de técnica de ensino-aprendizagem contábil baseada nas rotinas gerenciais e demandas dos usuários contribui com a decodificação da informação contábil, colaborando com o controle gerencial dos empreendimentos. Assim, foi feito experimento em que no pré-teste foi analisado o entendimento contábil no que tange ao conteúdo informacional, sua utilidade e domínio. No pós-teste foi feita análise dos efeitos da aplicação da técnica sobre esses entendimentos. O estudo foi realizado com 16 cooperativas pertencentes à Incubadora Social da Universidade Federal de Goiás e a coleta de dados foi realizada por meio de entrevistas estruturadas, observações e análise de registros. Estas foram transcritas e analisadas pelo método de análise de conteúdo, que consistiu em organizar categorias conceituais representantes do entendimento contábil testado, designada pela ocorrência ou expressão nos dados transcritos. A análise dos resultados foi feita pelo teste não-paramétrico, Postos Sinalizados de Wilcoxon. Os resultados apresentados não demonstraram diferenças significativas com relação ao entendimento contábil dos diretores e não diretores antes e depois da intervenção. Limitações como amostra e a rotatividade de pessoas na cooperativa denotam a necessidade de haver formações recorrentes para os cooperados. Para futuras pesquisas fica o tempo de curso ser prolongado permitindo a participação recorrente e de mais cooperados. Como implicações práticas têm-se a percepção dos cooperados na necessidade de ter e entender as ferramentas e controles para administrar à cooperativa.

The selection process is arguably the most important part of the employee life cycle in an organization, but a process often underdeveloped in many organizations. Successful selection processes can put the right people into critical positions, whereas failure to focus on selection can result in poor performance, turnover, and loss of productivity critical to the continuing success of organizations. This paper creates a model for a hiring manager training that focuses on a strategic selection process to maximize chances for successful hires. Utilizing leadership and selection models, human resources can engage hiring managers in a strategic applicant selection process as well as give tools for screening, interviewing, and selecting the best candidates for employment throughout all levels of their organization.

In the decade to come, the European Union will embark on two new projects, each destined to transform it in fundamental ways: (i) Eastern enlargement, and (ii) economic and monetary union. Neither of these projects will affect all members equally or in the same way. But Greece will, for two reasons, be affected in a manner qualitatively different to all other member states. First, Greece is the only country physically affected by the Luxembourg Summit's decision to begin accession negotiations with some, but not all, Central and Eastern European applicant countries: as a result of this decision, she will continue, for at least another eight to ten years, to be the only member country not to share a common border with another member state, with all the consequent implications in economic and geostrategic tenns. Second, when the European Council meets in early May to select those member states that are deemed to have met the convergence criteria, it will find that Greece is the only member state falling short of those criteria. This development may create additional difficulties for her economy during the transitional period of derogation. It will also pose new risks to Greece, insofar as she will be absent during the initial-and crucial-years of establishing a common monetary policy.

O Controle judicial das políticas públicas necessárias para a efetivação dos direitos constitucionais sociais à prestação é tema muito polêmico na atividade jurisdicional brasileira. Há os que defendem a intervenção irrestrita na tarefa de impor à administração pública a qualquer custo a efetivação das políticas públicas de sua competência. Contudo o nosso trabalho defende que a intervenção do Poder Judiciário no controle de políticas públicas é possível, segundo comando constitucional contido no artigo 3º da Carta Magna, mas com limitações para evitar a violação do princípio da separação dos poderes. Para demonstrar a nossa concepção sobre o tema partimos da definição e da natureza dos direitos fundamentais sociais e sua concepção na ordem constitucional brasileira. Analisamos as principais funções dos direitos fundamentais, concentrando a nossa atenção na função prestacional, ou direito a prestação em sentido estrito. Nesse particular passamos a discutir as questões que envolvem a efetivação dos direitos fundamentais sociais, a partir de sua eficácia jurídica e social até aos aspectos referentes a sua concretização. Salientamos que a efetivação dos direitos fundamentais sociais “derivados” passa por uma atividade legislativa de conformação antes de sua efetivação e que os “originais” poderiam ser concretizados imediatamente, sem se descurar da necessidade de outra atividade legislativa de destinação dos recurso públicos através da lei orçamentária, na foi ressaltado que deveria ser tomado como um dos critérios para essa destinação o princípio do “mínimo existencial”. Analisamos a tese recorrente de defesa da administração para justificar a não efetivação dos direitos sociais à prestação, a denominada “tese da reserva do possível”, salientamos que embora relevante, não era absoluto esse argumento. Contudo a atuação jurisdicional no controle das políticas públicas, não pode fugir da atenção aos princípios da razoabilidade e da proporcionalidade.

This paper describes and compares the institutional framework of the agricultural credit markets in selected European countries. The institutions can be both formal (rules, regulations, authorities and actors) and informal (norms, values and relations). They also interact and in situations where the formal institutions are weak, the informal ones increase in importance. The study is based on a questionnaire sent to agricultural financial experts in selected countries. The case studies show that credit regulations are typically general, with no specific regulations for the agricultural credit market. On the other hand, several countries support agricultural credit in various forms, implying that the governments do not perceive the general credit market to function in the case of agricultural firms. In a risk assessment, the most frequent reasons for rejecting a loan application are all linked to economic performance and the situation of the farmer. Personal characteristics, such as educational level or lack of experience, were generally perceived as less influential. Another interesting point when it comes to risk assessment is that in some countries the importance of asset-based lending compared with cash flow-based lending seems to differ when concerning a first-time applicant and when there is an application to extend a loan. To get an idea of the availability of credit, the loan-to-value (LTV) ratio was calculated, and it showed remarkably low values for Poland and Slovakia. For all the countries, the calculated value was lower than what the financial experts would have expected. This might imply credit rationing in agriculture in some of the countries studied. The financial experts all judged the possibility of an agricultural firm obtaining a loan as higher than that for other small rural firms, implying that the latter are also credit-rationed.

This study attempts to develop performance indicators for the financial markets based on the findings in an earlier Factor Markets Working Paper (No. 33, “Agricultural credit market institutions: A comparison of selected European countries”) and on FADN (Farm Accountancy Data Network) data. Two indicators were developed. One measured the long-term economic sustainability of agricultural firms since the financial characteristics of the firms were perceived as important factors when rejecting a loan applicant. If the indicator works, it should show that a low value in this indicator is related to the performance in the financial markets. The second indicator was the loan-to-value (LTV), or debt-to-asset ratio, the reasoning behind this indicator is that low values can point to credit constraints, and in WP 33 we saw that the interviewed experts expected LTVs to be much higher than what is actually the case. We find that the first indicator can’t be used to measure the performance of the financial institutions, since we can’t show any relationship between the indicator and activities in the financial markets. However, the indicator is valuable for its measurement of the long-term financial sustainability of the agricultural sector, or of the firms. The loan-to-value indicator does imply that most countries would have room to increase the credit.

The aim of this paper is to analyse what is the impact of the second phase of the creation of the Common European Asylum System (CEAS) in the protection of rights of Asylum Seekers in the European Union. The establishment of a CEAS has been always a part of the development of the Area of Freedom, Security and Justice. Its implementation was planned in two phases: the first one, focused on the harmonisation of internal legislation on minimum common standards; the second, based on the result of an evaluation of the effectiveness of the agreed legal instruments, should improve the effectiveness of the protection granted. The five instruments adopted between 2002 and 2005, three Directives, on Qualification, Reception Conditions and Asylum Procedures, and two Regulations, the so-called “Dublin System”, were subjected to an extensive evaluation and modification, which led to the end of the recasting in 2013. The paper discusses briefly the international obligations concerning the rights of asylum seekers and continues with the presentation of the legal basis of the CEAS and its development, together with the role of the Charter of Fundamental Rights of the European Union in asylum matters. The research will then focus on the development in the protection of asylum seekers after the recasting of the legislative instruments mentioned above. The paper will note that the European standards result now improved, especially concerning the treatment of vulnerable people, the quality of the application procedure, the effectiveness of the appeal, the treatment of gender issues in decision concerning procedures and reception. However, it will be also highlighted that Member States maintained a wide margin of appreciation in many fields, which can lead to the compression of important guarantees. This margin concerns, for example, the access to free legal assistance, the definition of the material support to be granted to each applicant for international protection, the access to labour market, the application of the presumptions of the “safety” of a third country. The paper will therefore stress that the long negotiations that characterised the second phase of the CEAS undoubtedly led to some progress in the protection of Asylum Seekers in the EU. However, some provisions are still in open contrast with the international obligations concerning rights of asylum seekers, while others require to the Member State consider carefully its obligation in the choice of internal policies concerning asylum matters.

With the EU-enlargement process well underway, this paper focuses on social citizenship as a conceptual frame for analyzing the restructuring of social institutions in applicant countries in East Central Europe. So far, comparative welfare state analysis has concentrated mainly on the developed economies of the OECD-countries; there is little systematic analytical work on the transitions in post-communist Europe. Theoretically, this paper builds on comparative welfare state analysis as well as on new institutionalism. The initial hypothesis is built on the assumption that emerging patterns of social support and social security diverge from the typology described in the comparative welfare state literature inasmuch as the transformation of postcommunist societies is distinctly different from the building of welfare states in Europe. The paper argues that institutionbuilding is shaped by and embedded in the process of European integration and part of governance in the EU. Anticipating full membership in the European Union, the applicant countries have to adapt to the rules and regulations of the EU, including the "social acquis." Therefore, framing becomes an important feature of institutional changes. The paper seeks to identify distinct patterns and problems of the institutionalization of social citizenship.
