This paper, which was published as a chapter of a Festskrift for Professor Ruth Nielsen, analyses Article 23 CFREU, the new provision on gender equality. It argues that Article 23 adds to the notion of gender equality in EU law, and not only allows, but also demands positive action measures if necessary to ensure equality between women and men. The provision also demands that positive action measures are suitable to achieve their aim. This implies that the EU legislator has to adapt positive action measure to the specific needs of the sector. The paper offers a critique of the proposal to introduce women quotas in board rooms, as proposed by the EU Commission in late 2012. It argues that the Commission unimaginatively copied rules developed for the German public service into a different sector, although these rules have not proven particularly efficient even in the public service. Consequently, a proposal that is demanding, but adapted to the sector should be developed.

Objective: The Finometer (FMS, Finapres Measurement Systems, Amsterdam) records the beat-to-beat finger pulse contour and has been recommended for research studies assessing shortterm changes of blood pressure and its variability. Variability measured in the frequency domain using spectral analysis requires that the impact of breathing be restricted to high frequency spectra (> 0.15 Hz) so data from participants needs to be excluded when the breathing impact occurs in the low frequency spectra (0.04 - 0.15 Hz). This study tested whether breathing frequency can be estimated from standard Finometer recordings using either stroke volume oscillation frequency or spectral stroke volume variability maximum scores. Methods: 22 healthy volunteers were tested for 270s in the supine and upright positions. Finometer recorded the finger pulse contour and a respiratory transducer recorded breathing. Stoke volume oscillation frequency was calculated manually while the stroke volume spectral maximums were obtained using the software Cardiovascular Parameter Analysis (Nevrokard Kiauta, Izola, Slovenia). These estimates were compared to the breathing frequency using the Bland-Altman procedures. Results: Stroke volume oscillation frequency estimated breathing frequency to <±10% 95% levels of agreement in both supine (-7.7 to 7.0%) and upright (-6.7 to 5.4%) postures. Stroke volume variability maximum scores did not accurately estimate breathing frequency. Conclusions: Breathing frequency can be accurately derived from standard Finometer recordings using stroke volume oscillations for healthy individuals in both supine and upright postures. The Finometer can function as a standalone instrument in blood pressure variability studies and does not require support equipment to determine breathing frequency.

Na União Europeia os sectores dos transportes e da indústria são ambos grandes consumidores de energia, mas são os edifícios residenciais e de serviços onde o consumo energético é maior, e em 2005, segundo a EnerBuilding, representavam cerca de 17% dos consumos de energia primária em termos nacionais. A energia gasta com a iluminação, o aquecimento, o arrefecimento e AQS das habitações, locais de trabalho e locais de lazer é superior à consumida pelos sectores dos transportes e da indústria. As habitações representam dois terços do consumo total de energia dos edifícios europeus, o qual aumenta todos os anos com a melhoria da qualidade de vida, traduzindo-se numa maior utilização dos sistemas de climatização. Neste sentido, e de acordo com o decreto-lei que transpõe para a legislação portuguesa a diretiva comunitária relativa ao desempenho energético dos edifícios, todos os Estados da União Europeia devem ter um sistema de certificação energética para informar o cidadão sobre a qualidade térmica dos edifícios, aquando da construção, da venda ou do arrendamento. Assim, entrou em vigor em Portugal, desde 1 de Janeiro de 2009, a obrigatoriedade de apresentação de um certificado de eficiência energética, no ato de compra, venda ou aluguer de edifícios novos e existentes. A certificação energética permite assim aos futuros utilizadores dos edifícios obter informação sobre os potenciais consumos de energia, no caso dos novos edifícios ou no caso de edifícios existentes sujeitos a grandes intervenções de reabilitação, dos seus consumos reais ou aferidos para padrões de utilização típicos, passando o consumo energético a integrar um conjunto dos aspetos importantes para a caracterização de qualquer edifício. Em edifícios de serviços, o certificado energético assegura aos utentes do edifício ou da fração que este reúne condições para garantir a eficiência energética e a adequada qualidade do ar interior. Uma vez que passamos 80% do nosso tempo em edifícios, e que isto se reflete num consumo cada vez mais elevado do sector residencial e dos serviços no consumo total energético do país, este trabalho pretende fazer a comparação dos vários equipamentos de aquecimento, de arrefecimento e de AQS e qual a influência dos mesmos na certificação energética de edifícios, e consequentemente na eficiência dos mesmos, sendo que a eficiência e a certificação energética de um edifício deve ser um aspeto relevante a levar em consideração no momento do planeamento ou da construção, bem como na aquisição de uma nova habitação. Um projeto concebido de modo a tirar proveito das condições climáticas, da orientação solar, dos ventos dominantes e utilizadas técnicas construtivas e os materiais adequados, é possível reduzir os gastos energéticos com a iluminação ou os sistemas de climatização.

Transcript (original spelling and grammar retained): By His Excellency Robert Prescott Esquire, Captain General and Governor in Chief in and over His Majestys Provinces of Upper and Lower Canada, General and Commander in Chief of all His Majesty’s forces in the Provinces of Upper and Lower Canada, Nova Scotia, New Brunswick and their several Dependencies and in the Island of Newfoundland &ca. &ca. &ca. I do hereby authorise and permit Thomas Clark of Queenstown in the County of Lincoln in the Province of Upper Canada merchant to take possession of all that Lot, piece and parcel of Land (being part of the land reserved by his Majesty for Military purposes) situate, lying and being at Queenstown in the Township of Newark, in the Home District in the said Province of Upper Canada, bounded and abutted as follows, that is to say beginning at the Distance of two Chains and ninety links from the South East End of his Majesty’s Store House, the said distance being measured along the Bank up Stream, thence South thirty nine degrees and an half West one Chain and fifty links thence south fifty degrees and an half East one Chain and thirty links thence North thirty nine degrees and an half East to the Edge of the Bank and from thence along the Bank to the place of beginning, containing thirty one perches and one hundred and twenty five square links and to occupy and hold the said Lot, piece and parcel of Land during pleasure subject nevertheless to the provisoes and Conditions herein after contained, that is to say. This thesis reports on the details of the works done to develop a complete system for acquisition of the important marine environmental parameters namely, current, current direction, salinity, temperature and depth. It encompaéps transducers,signalconditioners display arrangements and remote controlled multiplexer which constitue the system. The various associate instruentation and environmental requisites and problems have been discussed and solved to considerable extend. The design and development features of this composite system includes an integrated approach in order to make the final equipment to be simple, inexpensive and easy for operation from small and large boats. This could be achieved with the successful development of all required components with features matching between them, such as sensors, signals conditioners remote operated multiplexers, comon display methods, quick performance check and calibration methods. The major success rests on the development of sensors with excellent performance characteristics suitable for marine environment. out of the 5 sensors. that of current salinity and depth are quite noval types with specific advantages. The environmental effects have been eliminated to the required extend. The common signal conditioner for salinity, temperature and depth has noval design features for achieving simplicity, reliability and accomodating the three sensors of different functional requirements.
