A widely diffused, engaged approach understands human rights as an opportunity to enhance moral progress. Less visible has a critical realm of research that reveals the often ambiguous social life of human rights discourses. This article draws on a specific case study from the intricate issue of how activism for Arab-Palestinian Bedouin citizens in Southern Israel engages with the global human rights discourse. It follows the implications of mobilization, focusing on events related to a campaign against house demolitions in informal,unrecognised settlements. The case shows how human rights discourses tend to silence the agency of political subjects, victimizing and patronizing those who seek emancipation. The ethnographic insights emphasize the role of a range of carnivalesque and spontaneous acts ofresistance, which subvert the patronizing implications of the human rights language.

This paper examines what types of actions undertaken by patent holders have been considered as abusive in the framework of French and Belgian patent litigation. Particular attention is given to the principle of the prohibition of “abuse of rights” (AoR). In the jurisdictions under scrutiny, the principle of AoR is essentially a jurisprudential construction in cases where judges faced a particular set of circumstances for which no codified rules were available. To investigate how judges deal with the prohibition of AoR in patent litigation and taking into account the jurisprudential nature of the principle, an in-depth and comparative case law analysis has been conducted. Although the number of cases in which patent holders have been sanctioned for such abuses is not overabundant, they do provide sufficient leads on what is understood by Belgian and French courts to constitute an abuse of patent rights. From this comparative analysis, useful lessons can be learned for the interpretation of the ambiguous notion of ‘abuse’ from a broader perspective.

The report on the findings of extensive empirical research on equality of educational opportunities carried out in the US on a very large sample of public schools by Coleman and his colleagues has had a major impact on education policy and has given rise to a large amount of research and various interpretations. However, as some interpreters have highlighted, even more important than the findings of the survey themselves has been Coleman’s redefinition of equality of opportunity, abandoning the then prevailing conception of equality of educational opportunities as equality of starting points and replacing it with the concept of equality of educational opportunities as equality of educational outcomes. The question is, therefore, whether equality of outcomes really is one of the two types of equality of opportunity. The purpose of the present article is to show that equality of opportunity and equality of outcomes are two different types of equality. If they are different, the interpretation that Coleman has redefined the concept ofequality of educational opportunity” turns out to be incorrect. (DIPF/Orig.)

The present paper examines some of the tensions, problems and challenges associated with claims for equality of opportunity (the fairness argument). The introductory part identifies three separate forms of justification for public education, including the argument associated with equality of opportunity. Part II examines in detail two questions that reveal part of the anatomy of equality of opportunity: (1) what an opportunity is, and (2) when individuals’ opportunities are equal. This is followed by a presentation of the two basic principles of equality of opportunity: (1) the principle of non-discrimination, and (2) the “levelling the playing field” principle. The next part takes up the multiculturalist hypothesis advanced by minority groups for the accommodation and recognition of cultural diversity. This is followed by the identification of a set of claims comprising the “fairness argument”. The last section focuses on the “currency problem” associated with cultural diversity as a form of “unfair disadvantage”. Part V examines two of the major shortcomings associated with the multicultural conception of equality of opportunity, while the concluding part discusses some of the questions that must be answered by any conception of equal opportunities. The current National Policy for Social Assistance (PNAS) is the instrument that regulates the organization and procedures of social-welfare actions. Developed and approved in 2004 since the Unified Social Assistance System (ITS) was crated in 2003, it reaffirms the democratic principles of the Social Assistance Organic Law (LOAS) focusing on the universalization of social rights and equality of rights when accessing the social-welfare system. In the SUAS point of view, the PNAS highlights the information, monitoring and evaluation fields for being the best way to assure the regulation, organization and control by the Federal Government paying attention to the principles of decentralization and participation. This political-institutional rearrangement occurs through the pact among all the three federal entities. The pact deals with the implementation of the task. It says that it has to be shared between the federal autonomous entities, established by dividing responsibilities. To the cities, considered as the smallest territorial unit of the federation and closer to the population, was given the primary responsibility, which is to feed and maintain the database of SUAS NETWORK and identify families living in situations of social vulnerability. In addition to these responsibilities, the cities that have full autonomy in the management of their actions, have the responsibility to organize the basic social protection and the special social protection, that using the Center of Social Assistance Reference (CRAS) and the Center of Specialized Social Assistance Reference (CREAS), are responsible for the provision of programs, projects and services that strengthen the family and community; that promote people who are able to enjoy the benefits of the Continuing benefit of Provisions (BPC) and transfer of incomes; that hold the infringed rights on its territory; that maximize the protective role of families and strengthen its users organization. In Mossoró/RN, city classified as autonomous in the social assistance management, has five units of CRAS that, for being public utilities, are considered the main units of basic social protection, since they are responsible for the connection between the other institutions that compose the network of local social protection. Also known as Family House, the CRAS, among other programs and services, offers the Integral Attention to Families Program (PAIF), Juvenile ProJovem Program, socio-educational coexistence services programs, as well as sending people to other public policies and social-welfare services network, provides information, among others. In this large field, social workers are highlighted as keys to implement the policy of social assistance within the city, followed by psychologists and educators. They should be effective public employees, as a solution to ensure that the provision of the services are to be continued, provided to the population living around the units. However, what we can find here is inattention to the standard rules of social assistance, which not only undermines the quality of programs and services, but also the consolidation of policy on welfare as public policy of social rights

In today's complex and changing global context, the Latin American and Caribbean region must persevere, more than ever, in three directions: structural change to underpin progress towards more knowledge-intensive sectors, convergence to reduce internal and external gaps in income and productivity, and equality of rights. This is the integrated approach proposed by ECLAC as a route towards the development the region needs. This implies tackling three major challenges: to achieve high and sustained rates of growth so as to close structural gaps and generate quality jobs; to change consumption and production patterns in the context of a genuine technological revolution with environmental sustainability; and to guarantee equality on the basis of greater convergence in the production structure, with universal social protection and capacity-building. Such an endeavour requires the return of politics and of the State's role in promoting investment and growth, redistribution and regulation with a view to structural change for equality, through industrial, macroeconomic, social and labour policies. These are some of the key proposals of Structural Change for Equality: An Integrated Approach to Development, which ECLAC will present to its member States at the thirty-fourth session of the Commission (San Salvador, August 2012). The proposals in that document, which is summarized here, deepen and broaden the ideas set forth in Time for equality: closing gaps, opening trails, aiming towards sustainable development with equality and taking into account the diverse national conditions across the region.

O presente estudo retrata a constituição da Associação de Mulheres do Município de Igarapé-Miri –ASMIM/Pará, como um espaço de lutas, resistências e associativismo de mulheres trabalhadoras. Visa contribuir com o debate acerca das conquistas de uma experiência prática coletiva, na construção do desenvolvimento local, em Igarapé-Miri. Para isso, procurou-se nesta pesquisa entender o cenário da economia solidária, bem como, as diferentes concepções que giram em torno dessa temática em interface com o desenvolvimento local, à medida que, se entende ambas, como estratégias importantes para a constituição da mulher enquanto um sujeito coletivo capaz de romper com a invisibilidade e empoderar-se, no sentido de se tornar protagonista de sua própria história. Ressaltou-se importantes momentos de lutas e resistências femininas em torno de igualdade de direitos, geração de renda e participação na vida pública. Nesse sentido, a ênfase das organizações e movimentos sociais aos quais essas mulheres estiveram/estão articuladas foi importante para compreender de que forma elas foram galgando seu espaço de representação política em nível local, regional e nacional, ou seja, demonstrando novas práticas sócio-econômicas e político-culturais em que se tornaram referências e alteram a realidade do seu papel na sociedade contemporânea. Por fim, realçou-se que essa construção em Igarapé-Miri foi/é de muitas lutas, e, por conseguinte, conflitos que se expressam em âmbito familiar e de trabalho evidenciando desigualdades existentes e, muitas vezes, escamoteadas. Esta pesquisa traz para o debate os princípios de economia solidária, enquanto ambiente propício ao empoderamento das mulheres, de estratégia para um desenvolvimento local e de visibilidade pública para essas mulheres.

In regards to the context of the schooling for less the most favored, the school did not appear as intellectual instrument, and yes as prerequisite to take care of to the new requirements of the work market that if modernized the great social changes together with. The school, in turn, if puts in charge them to know scientific, and, for times, them norms of effective behavior in the society and the familiar group, them feelings and moral values, in a transposition of the “cultural capital” and it “capital stock” that passed by generations. This work, therefore, had as objective to study the expectations of schooling of the child in pertaining to school age, in the universes of the family and the school, from the speech of the agents of this process (parents, responsible, professors and the children) and of some practical educative referring to the schooling of the child, leaving of estimated of that the school is a democratic space, with equality of rights and the duties. Mediated for cultural a historical boarding, one searched to interpret the pertaining to school and familiar context of the participants, by means of a counterpoint with the studied bibliography, being this presented throughout the work. The research was of qualitative character, the data had been collected by means of comment in two classrooms, one of the third and one of the room year. Half-structuralized interviews had been made, that had been recorded e, later, transcribing. The environment of the research was a public school of the basic education of a city of the interior of the State of São Paulo, that received children proceeding from families of the urban popular classrooms. The results of the analysis of the data point that the professors present a vision of ideal model of family and pupil that does not correspond to the reality of the context of these and of the new nomenclatures of the familiar order... Introduction - The Centro de Orientacao ao Adolescente of Campinas (Southeastern Brazil) maintains a program to qualify economically disadvantaged adolescent students aged 15 to 18 years to enter the labor market. Objective - To understand life projects of teenagers who became mothers while participating in the program, in the period from 2003 to 2008, aiming to find the place of professional life in their life trajectory before and after motherhood. Method - Eight young mothers were interviewed, and a qualitative methodology was applied to the analysis of the interviews. Results - The trajectories of study and work were discontinued or adapted due to motherhood. Four young mothers completed high school and none had entered university. Three did not return to work and the rest had diverse work experiences. The reported difficulties to enter the labor market were: inadequate instruments to support the children's care, low income, lack of work experience, presence of small children and little educational background. Final Considerations - Teenage motherhood did not indicate the exclusion of educational or work projects but indicated adjustments and the need for a family and social support network. It was noted the need for public policies targeted at the inclusion of youths in the labor market and at support services such as nurseries. Also, the need for a change in gender relations was demonstrated, with greater equality of rights as a precondition for the inclusion of women, especially those who are mothers, in the labor market.

Der Autor widmet sich der erziehungswissenschaftlichen „Forschungslandschaft im Spiegel der Forschungsevaluation“ im Vereinigten Königreich und stellt Ergebnisse der Research Excellence Framework (REF) vor, eine Forschungsevaluation, die zwischen 2013 und 2014 an allen hochschulischen Einrichtungen im Vereinigten Königreich stattfand. Ein interessantes Ergebnis der referierten REF-Daten ist, dass es keine vollständige Gleichberechtigung zwischen Wissenschaftlerinnen und Wissenschaftlern in Bezug auf für die Karriere relevante Forschungsmerkmale gibt. Im Zentrum der vorliegenden Untersuchung steht das 1865 gegründete Töchter-Institut Mathilde Franziska Annekes in Milwaukee, Wisconsin. Dieses Schulprojekt der Achtundvierzigerin und Frauenrechtlerin wird verglichen mit Bildungsreformansätzen der Amerikanerin Catherine Beecher sowie solchen deutscher Pädagogen. Zum einen soll dabei die Besonderheit von Annekes Konzept herausgearbeitet werden, zum anderen soll der Stellenwert der Schule in den Frauenrechtsaktivitäten von Anneke beleuchtet werden. Die Analyse der sozialen Herkunft ihrer Schülerinnenschaft ergibt eine Neubewertung von Annekes Stellung als Frauenrechtlerin in Milwaukee. (DIPF/Orig.)
