Arbitragem voluntária desportiva ou outra forma de arbitragem necessária?

Atenta a preconização da legislação desportiva a nível interno, bem como a nível internacional, aliada ao usual recurso aos meios alternativos de resolução de litígios – arbitragem voluntária – por imposição das Federações Desportivas aos atletas, o ponto de ordem do presente estudo é aferir se a voluntariedade preconizada pela denominada arbitragem voluntária existe, é efectiva, ou meramente aparente. Este trabalho tem, assim, por objecto de estudo determinados aspectos das cláusulas de resolução de litígios e das convenções de arbitragem celebradas no seio desportivo e a sua efectiva voluntariedade, ou seja, a liberdade contratual e submissão voluntária a tal resolução alternativa de litígios com preterição do recurso aos tribunais judiciais.

Os diferentes níveis de regulação legal dos conflitos de interesses no âmbito da gestão de fundos de investimento mobiliário

In the context of the activity developed by securities investment funds (hereinafter referred to “SIF”) the holders of investment units have a very tiny power to intervene. Aware of the risks that a decoupling between ownership and control may pose, the legislator has foreseen a number of impositions and limitations to the activity of the managing entities, namely to prevent or prohibit the performance of acts in situations of potential conflicts of interests. Accordingly, the purpose of the dissertation on – “Os diferentes níveis de regulação legal dos conflitos de interesses no âmbito da gestão de FIM” – is exactly to determine the field of application of the several levels of legal regulation of the conflicts of interests that arise within the scope of the management of SIF, both at the level of the new legal requirements governing collective investment undertakings, and at the level of the legal requirements governing the conflicts of interests foreseen in the Portuguese Securities Code, in order to clarify the articulation of these different levels of conflicts of interests regulations.

Valuing an offshore exploration project through real options analysis

This thesis applied real options analysis to the valuation of an offshore oil exploration project, taking into consideration the several options typically faced by the management team of these projects. The real options process is developed under technical and price uncertainties, where it is considered that the mean reversion stochastic process is more adequate to describe the movement of oil price throught time. The valuation is realized to two case scenarios, being the first a simplified approach to develop the intuition of the used concepts, and the later a more complete cases that is resolved using both the binomial and trinomial processes to describe oil price movement. Real options methodology demonstrated to be capable of assessing and valuing the projects options, and of overcoming common capital budgeting methodologies flexibility limitation. The added value of the application of real options is evident, but so is the method's increased complexity, which adversely influence its widespread implementation.

Monitoring the early stiffness development in epoxy adhesives for structural strengthening

The present work aimed to assess the early-age evolution of E-modulus of epoxy adhesives used for Fibre-Reinforced Polymer (FRP) strengthening applications. The study involved adapting an existing technique devised for continuous monitoring of concrete stiffness since casting, called EMM-ARM (Elasticity Modulus Measurement through Ambient Response Method) for evaluation of epoxy stiffness. Furthermore, monotonic tensile tests according to ISO standards and cyclic tensile tests were carried out at several ages. A comparison between the obtained results was performed in order to better understand the performance of the several techniques in the assessment of stiffness of epoxy resins. When compared to the other methodologies, the method for calculation of E-modulus recommended by ISO standard led to lower values, since in the considered strain interval, the adhesive had a non-linear stress–strain relationship. The EMM-ARM technique revealed its capability in clearly identifying the hardening kinetics of epoxy adhesives, measuring the material stiffness growth during the entire curing period. At very early ages the values of Young׳s modulus obtained with quasi-static tests were lower than the values collected by EMM-ARM, due to the fact that epoxy resin exhibited a significant visco-elastic behaviour.

José Anastácio da Cunha e a criação da Casa Pia de Lisboa

As modernas ideias científicas e tecnológicas da Europa mais desenvolvida transpoem fronteiras e institucionalizam-se em Portugal com a denominada Reforma Pombalina da Universidade de Coimbra (1770-72), no reinado de D. José. Mais: não só chega a Portugal o pensamento moderno da época como, antecipando a reforma do ensino universitário no resto da Europa, o ensino universitário português faz uma aposta clara nas ciências matemáticas, físicas e naturais, bem como num ensino experimental/laboratorial. Anos mais tarde, no reinado de D. Maria, surgem outros projectos educativos e científicos igualmente modernos tais como o da criação de uma Academia Real da Marinha (1779) ou o de uma Academia Real das Ciências (1779) e idealiza-se um projeto, porventura, ainda mais revolucionário: o da criação de uma instituição de ensino – também de ciências ditas superiores – destinada, na sua génese, a orfãos e desvalidos à qual se chamou Casa Pia de Lisboa (1780), e que alguns autores reportam como sendo uma “universidade plebeia”. Com base em documentação autógrafa, ainda inédita, recentemente descoberta nos Fundos Setecentistas do Arquivo da Casa de Mateus, exploraremos o papel fundamental que José Anastácio da Cunha (1744-1787) – militar, matemático e poeta – desempenhou na concepção do Plano de Estudos para a instituição; em particular para o colégio de S. Lucas, consagrado às classes científicas.

Integrated management systems: A model for maturity assessment

Maturity models are adopted to minimise our complexity perception over a truly complex phenomenon. In this sense, maturity models are tools that enable the assessment of the most relevant variables that impact on the outputs of a specific system. Ideally a maturity model should provide information concerning the qualitative and quantitative relationships between variables and how they affect the latent variable, that is, the maturity level. Management systems (MSs) are implemented worldwide and by an increasing number of companies. Integrated management systems (IMSs) consider the implementation of one or several MSs usually coexisting with the quality management subsystem (QMS). It is intended in this chapter to report a model based on two components that enables the assessment of the IMS maturity, considering the key process agents (KPAs) identified through a systematic literature review and the results collected from two surveys.

Uma ontologia para os processos de negócio da Administração

O órgão coordenador da política arquivística portuguesa promoveu a constituição de uma Lista consolidada (LC) de processos de processos de negócio da Administração Pública (AP). Esta lista de natureza incremental e colaborativa foi desenvolvida a partir da identificação de uma macroestrutura representativa das funções exercidas pela AP, a Macroestrutura Funcional (MEF). Concretizado este produto e colocado à disposição da comunidade, na página oficial da Direção-Geral do Livro, dos Arquivos e das Bibliotecas (DGLAB), importa potenciar a sua aplicabilidade. Neste sentido, encontra-se em curso um projeto que envolve os autores, em contexto universitário, orientado para o desenvolvimento de um vocabulário formal, um modelo de dados que represente este conjunto de conceitos referentes aos processos de negócio e aos relacionamentos entre eles. Pretende-se que esta ontologia possa vir a ser disponibilizada em listas ou diretórios de ontologias com mecanismos de pesquisa (bibliotecas de ontologias) de modo a incrementar a sua utilização na websemântica, para além da sua utilização como esquema de classificação em sistemas eletrónicos de gestão de arquivos (SEGA), businesse intelligence systems e sistemas de gestão do conhecimento. Com esta comunicação pretende-se dar a conhecer à comunidade de profissionais um projeto de aplicação transversal para todas as entidades públicas e para as empresas com interesse na área.
