A presente dissertação busca abordar a questão da restrição ao direito fundamental de liberdade da pessoa toxicodependente no Brasil, consistente, precisamente, na internação forçada para o tratamento de sua saúde e/ou para a segurança pública, sob o olhar do princípio constitucional da dignidade da pessoa humana em suas dimensões positiva, que exige uma obrigação de fazer por parte do Estado, e negativa, que cobra deste uma postura omissiva de proteção, em torno de um mesmo indivíduo; sem se olvidar do interesse público na execução da medida. Para tanto, ao longo do trabalho, a legislação brasileira atinente ao tema é posta em comparação com a sua correspondente portuguesa e, à luz, basicamente, das doutrinas desses países, são examinados direitos afetos à liberdade individual e ao direito social à saúde, sob a costura do apontado princípio estruturante das respectivas Constituições, de modo a permitir a visualização do amparo da medida restritiva no texto maior brasileiro e, ao final, uma análise crítica à ponderação de bens (direitos) realizada pelo legislador ordinário, com possíveis soluções para a sua aplicação em concreto, quando da análise da proporcionalidade da intervenção da liberdade pelo Poder Judiciário.

The article provides a method for long-term forecast of frame alignment losses based on the bit-error rate monitoring for structure-agnostic circuit emulation service over Ethernet in a mobile backhaul network. The developed method with corresponding algorithm allows to detect instants of probable frame alignment losses in a long term perspective in order to give engineering personnel extra time to take some measures aimed at losses prevention. Moreover, long-term forecast of frame alignment losses allows to make a decision about the volume of TDM data encapsulated into a circuit emulation frame in order to increase utilization of the emulated circuit. The developed long-term forecast method formalized with the corresponding algorithm is recognized as cognitive and can act as a part of network predictive monitoring system.

A field survey of flowering plants used as food resource by the adults of Heliconius erato phyllis (Fabricius, 1775) was carried out in four sites located in Rio Grande do Sul state, Brazil. Samples were taken in preserved areas of the Atlantic Rain and Myrtaceae forests, an Eucalyptus plantation, and an urban park. Adult feeding frequencies on flowers were registered monthly from December 1996 to May 1997, on plants located on previously marked 200 m long transects. Flowers on which H. erato phyllis fed in the field were collected, drawn and morphometrically characterized. Feeding was registered on flowers of twenty-three species, of which seventeen are new records for H. erato in Brazil . The use of a given plant varied among localities, as a function of its corresponding abundance. The most visited flowers were those of Lantana camara L. and Stachytarpheta cayennensis (Rich.) Vahl, followed by Dahliapinnata Voss in the urban site. The data suggest the existence of size and shape convergence between the proboscis and the small, tubular flowers upon which H. eratophyllis feeds. They also indicate that H. eratophyllis adults have an opportunistic nectar feeding / pollen gathering habit, using several of those flowers available in a given time and locality that fit such a morphometrical pattern. Since plant species of both primitive and derived families are used, there is no indication that phylogenetic constraints play a major role in this association, nor that color of flowers, growth pattern or size of the plants are relevant in determining their use by H. erato phyllis.

The plastral spotting variation in the chelid turtle Phrynops hilarii (Duméril & Bibron, 1835) in relation to sex, size, and geographic procedence of individuals was analyzed. States for qualitative characters were analyzed using non-parametric tests. Quantitative characters (shell and scute measurements) were standardized for body size by linear regression against carapace length, and were subjected to principal components analysis and canonical discriminant function analysis. Results suggest that increased plastral spotting is a polymorphic ontogenetic trait in P. hilarii. Neither hatchlings nor juveniles have plastral pattern moderately or heavily pigmented. The simplest pattern, however, may persist without changes in some adults. There are no differences between sexes. The spatial distribution of the plastral pattern is not ordered latitudinally or longitudinally, showing no relationship with gradients of elevation, temperature, or precipitation. This pattern trait lacks of taxonomic significance. The morphometric analysis failed to reveal any character of diagnostic utility in the plastron to support the possibility that these patterns correspond to different sympatric taxa.

Shell selection by the hermit crab Paguristes tortugae Schmitt, 1933 from Anchieta Island (Brazil) was analyzed using the six most frequently occupied shell species in the field and taking into account the sexual condition of the individuals, the shell size and the shell species. The experiments were conducted under laboratory conditions and the shell species preference was estimated on the basis of the frequency that each species was chosen by the individuals. The preferred shell species and size were determined by regression analysis. The highest correlation coefficients were obtained for the relations between the hermit dimensions and shell dry weight. The ovigerous females preferred shells with larger internal volume: Leucozonia nassa (Gmelin, 1791) and Cerithium atratum (Born, 1778). In the experiment of shell size, males preferred heavier shells whereas females selected the shape characteristics of the shell, such as the aperture and the internal volume, which are probably related to the growth and offspring guarantee, respectively. In general, and independent of sex condition, P. tortugae showed significant selection among all shells utilized. The results suggest that shell selection by P. tortugae involves sexual and reproductive condition preferences.
