SUMMARY: After World War I began a process of political antinationalization of the women fundamental rights based on the Universal Declaration of the Human Rights, (1Oth December 1948), where rights and values like liberty and equality are exalted. The adoption of the Declaration by the democratically countries, like Portugal, leaded to the execution of full citizenship, independently of gender, race and religion. Therefore, nondiscrimination became a principle to apply in the family, public and labor spheres. This means, for example, share of domestic tasks between men and women, participation in the communal life, and equal opportunities of labor. But were the discriminations surpassed? What is going on the labor level This dissertation results from an inquiry about the labor situation of women in service where constitutionally make uses of the same rights as their colleague’s men. It reflects on the public, private and companies of Ponte de Sor which has for yardstick the III National Plan for Equality of Citizenship and Gender (2007/2010), whose mainline adviser is "the political activity and the social reality deepening (gender mainstreaming)" (2007, p.15). Through this study we fixed a work constituted by three chapters, where it established that "On the Path of Citizenship ..." is a slow process. ln the first chapter tried to broach the historical origin of the concept of citizenship and in the second paragraph was approached the relation of women with labor and power. The third, and last, chapter tries to show the results of questionnaires carried out in Ponte de Sor, in the public, private services and companies. The conclusion reveals the perplexity caused by the barely indifference regarding the questions of genre in the Services questioned in Ponte de Sor.

The principle of legality has evolved into a clear and entrenchedjurisprudential mechanism for protecting common law rights and freedoms. It operates as a shield to preserve the scope of application of fundamental rights and fre edoms. In recent years it has been increasingly applied by the courts to limit the scope of legislative provisions which potentially impinge on human rights and fundamental freedoms. Yet there is one domain where the principle of legality is conspicuously absent: sentencing. Ostensibly, this is paradoxical. Sentencing is the realm where the legalsystem operates in its most coercive manner against individuals. In thisarticle, we argue that logically the principle of legality has an importantrole in the sentencing system given the incursions by criminal sanctionsinto a number of basic rights, including the right to liberty, the freedom ofassociation and the deprivation of property. By way of illustration, we setout how the principle of legality should apply to the interpretation of keystatutory provisions. To this end, we argue that the objectives of generaldeterrence and specifi c deterrence should have less impact in sentencing. It is also suggested that judges should be more reluctant to send offenders with dependants to terms of imprisonment. Injecting the principle of legality into sentencing law and practice would result in the reduction in severity of a large number of sanctions, thereby reducing the frequency and extent to which the fundamental rights of offenders are violated. The methodology set out in this article can be applied to alter the operation of a number of legislative sentencing objectives and rules.

Punishing the innocent is incontestably repugnant. Punishing offenders more harshly than is justified is a form of punishing the innocent, yet this practice is commonplace in the United States. This Article sets out a normative argument in favor of less severe penalties for many forms of offenses. There is already an established principle, which limits punishment to the minimum amount of hardship that is required to achieve the objectives of sentencing. The principle is termed “parsimony” and is widely endorsed. Yet, in reality, it is illusory. It has no firm content and in its current form is logically and jurisprudentially incapable of grounding a persuasive argument for more lenient sentences. This Article gives content to the principle of parsimony. It is argued that application of the principle will result in a considerable reduction in the number of offenders who are sentenced to imprisonment and shorter sentences for many offenders who are jailed. The recommendations in this Article will enhance the fairness and transparency of the sentencing system. The argument is especially important at this point in history. The United States is experiencing an incarceration crisis. The principle of parsimony, properly applied, is an important key to ameliorating the incarceration problem. The Article also examines the operation of the parsimony principle in Australia. Unlike sentencing courts in the United States, Australian judges enjoy considerable discretion in sentencing offenders. Despite the vastly different approach to sentencing in Australia, it too is experiencing a considerable increase in the incarceration rate. It emerges that the courts in a tightly regimented sentencing regime (the United States) and a mainly discretionary system (Australia) effectively ignored the parsimony principle. It is not the strictures in the United States that curtail the imposition of parsimonious sentences; rather, it is the absence of a forceful rationale underpinning the principle and a lack of clarity regarding the attainable objectives of sentencing. This Article addresses these shortcomings. In doing so, it paves the way for fundamentally fairer sentencing outcomes in the United States and Australia.

Equality has become an important concept within secular-liberal societies (Perrons 2005), with white, secular Western women interpellated as quintessentially embodying this equality (Gill and Scharff 2011; McRobbie 2011; Nayak and Kehily 2008). For religious organizations, the interacting spaces of gender and sexuality constitute two of the most contested terrains in rights-giving, and many religions are seen as less progressive regarding equality vis-à-vis other social institutions (Plummer 2003; Tosh and Keenan 2003; Weeks2007). Young religious women have to articulate how they fit into the contours of secular-liberal equality norms as religious subjects. This chapter will focus on how young religious women living in the UK made sense of equality in the context of their religion, focusing on attitudes to gender equality and sexuality equality.

The reality of children living in foster homes is clearly linked to the professionals that surround them both in the educational and residentialsphere. These are children who in all aspects of their livesat all hours, are exposed to the professionalism of those who work with them and not the affection of a family; their development is fully mediated by institutions. It is therefore a priority that teachers have specific training on children living infoster care, that general government (Education and Social Services) provide guidelines for action agreed to allow the coordination between the different professionals involved with children in foster care, considering the complexity of this coordination, as there are many institutions involved with these children: Social Services, schools, foster residences foster ... among others. Educational professionals have an important role in this intervention process, being their good professional work the one that favors a tight development of children in the educational field, but this intervention takes place generally from the ignorance of the specific situation faced by children living inresidential care and from the failure of the educational administration into sharing protocols, time and space, necessary for a proper coordination. In the event children incustody, and because of the uniqueness of their situation and the importance of a good intervention, there should be no space for improvisation. In addition intervention with children in residential care has to be based on a training and intervention from the complementary roles that is to be structured, systematic and evaluated in a continuously way by the professionals involved. We understand that the principle of equality in education requires to offer these minors an opportunity based on an appropriate intervention with formed professionals, knowledgeable and with the time and the necessary conditions...
