The themes of this paper are equality, reasonableness and gender rights in the dynamics of two sequential and convergent processes: the constitutionalization of judicial law, and the internationalization of constitutional law. The thesis of this paper is that in the face of non-compliance of the obligation to regulate, guarantee and protect gender rights, the best option has been to strengthen judicial law, which has enabled the development of rules for protection, the adoption of contemporary methods of interpretation and adjudication of the law, as well as the resolution of shortfalls in protection based on said processes of the constitutionalization and internationalization of local law.

The problem of land ownership protection in this country is an issue that must be faced by those who have as part of their responsibilities the recognition, the restitution and the reparation of victims of forced displacement. One of the points that must be analyzed is the protection of ownership of urban lands, a subject falling under municipal responsibility. The development of a public policy by the City of Medellín for the protection of such lands is a significant advance for the creation of protocols and for the return of rights to those who have adandoned their lands because of violence or who have been divested of their homes in urban areas.

This article makes an historical analysis of the manner in which crimes againsthumanity have acquired an independent status from crimes of war and aggressionever since the concept was first introduced in discussions between the Allies duringthe establishment of the International Military Tribunal at Nuremberg. It describes themanner in which the concept has evolved and been discussed in several internationalbodies, and how it was finally included in the Rome Statute of the International CriminalCourt. The article shows how the Nuremberg trials have a fundamental legaland historical meaning in that they institutionalized individual responsibility for anew category of crimes before an international tribunal. It also shows how after theNuremberg trials, crimes against humanity have been gradually withdrawn fromthe competency of government sovereignty to become a matter for the internationalcommunity of nations.

Transitional provisions are defined as the set of regulations that rule juridical relationships on the occasion of a legislative change. Out of this context of law succession, their indiscriminate application can lead to serious inconsistencies. The analysis of a Spanish private law example is offered to illustrate this fact. It concerns the administrative authorization for the demolition of rented buildings in the cities. A regulation repealed more than fifteen years ago and however widespread utilised on ancient constructions that, after recent urban development, have acquired great economic value; something that in the end explains the current importance of such provisions. What is happening in Spain: denaturalization of the original figure due to a mixture of formalist interpretations and speculative market interests, is presented here to call the attention on the necessary limitation of transitional provisions’ effects.

Este artículo analiza dos cuestiones que se encuentran íntimamente relacionadas. En primerlugar, desde una perspectiva crítica, se efectúa una reflexión sobre el actual modelo de relacioneslaborales español, sometido a un proceso permanente de reformas encaminadasa fomentar el empleo, aunque en la práctica se están traduciendo en un reforzamiento delpoder unilateral del empresario en el seno de las organizaciones productivas, que priva a lostrabajadores de derechos sustanciales en cuya conquista se invirtieron décadas. En segundotérmino, se aborda la incorporación de un creciente colectivo de personas expulsadas delmercado de trabajo al sistema asistencial, que también se encuentra profundamente afectado por los recortes económicos. El complejo modelo asistencial español, gestionado por las ComunidadesAutónomas, no garantiza a este colectivo la cobertura mínima de necesidades, locual está desembocando en una nada deseable regresión: paulatinamente se está retornandoa un modelo benéfico-asistencial, impropio de un Estado social y democrático de Derecho.Para ello, se explicará el modelo actual de servicios sociales, en el marco institucional delestado de bienestar y posteriormente se expondrán algunas de las dificultades actuales,consecuencia de la crisis económica, agravada por la reciente reforma laboral. Aunque lasreflexiones se centran en el ordenamiento jurídico y la realidad laboral española, son extrapolablesa otros países del entorno.

Considering that the employment contract suspension responds to labor stability,one of the most important principles of labor law is important to study it because itsprincipal purpose is to maintain the link between de employer and the employeedespite the presence of adversity or other situations that would break up the relationshipin other fields. However, at the occurrence of any of the grounds of suspensionmay be presented some questions or voids that it will try to be answer in this paper.Consequently we shall refer first to the definition, purpose and characteristics of thesuspension. Subsequently, will be analyzed in detail every single ground of contractsuspension in Colombia. Then, will be studied the effects of the suspension andwe will refer to the resumption of work, and conclude with the comparative analysisof the figure in some Hispanic countries (Mexico, Paraguay and Spain).
