In the throes of her mimetic exposure of the lie of phallocratic discursive unity in 'Speculum of the Other Woman', Irigaray paused on the impossibility of woman’s voice and remarked that ‘it [was] still better to speak only in riddles, allusions, hints, parables.’ Even if asked to clarify a few points. Even if people plead that they just don’t understand. After all, she said, ‘they never have understood.’ (Irigaray 1985, 143).

That the law has never understood a uniquely feminine narrative is hardly controversial, but that this erasure continues to have real and substantive consequences for justice is a reality that feminists have been compelled to remain vigilant in exposing. How does the authority of the word compound law’s exclusionary matrix? How does law remain impervious to woman’s voice and how might it hear woman’s voice? Is there capacity for a dialogic engagement between woman, parler femme, and law?

This paper will explore these questions with particular reference to the experience of women testifying to trauma during the rape trial. It will argue that a logically linked historical genealogy can be traced through which law has come to posit itself as an originary discourse by which thinking is very much conflated with being, or in other terms, law is conflated with justice. This has consequences both for women’s capacity to speak or represent the harm of rape to law, but also for law’s ability to ‘hear’ woman’s voice and objectively adjudicate in cases of rape. It will suggest that justice requires law acknowledge the presence of two distinct and different subjects and that this must be done not only at the symbolic level but also at the level of the parole, syntax and discourse.

Social scientific work on the suppression, mitigation or denial of prejudiced attitudes has tended to focus on the strategic self-presentation and self-monitoring undertaken by individual social actors on their own behalf. In this paper, we argue that existing perspectives might usefully be extended to incorporate three additional considerations. First, that social actors may, on some occasions, act to defend not only themselves, but also others from charges of prejudice. Second, that over the course of any social encounter, interactants may take joint responsibility for policing conversation and for correcting and suppressing the articulation of prejudiced talk. Third, that a focus on the dialogic character of conversation affords an appreciation of the ways in which the status of any particular utterance, action or event as 'racist' or 'prejudiced' may constitute a social accomplishment. Finally, we note the logical corollary of these observations - that in everyday life, the occurrence of 'racist discourse' is likely to represent a collaborative accomplishment, the responsibility for which is shared jointly between the person of the speaker and those other co-present individuals who occasion, reinforce or simply fail to suppress it.

An analysis was conducted of 325 national judicial decisions across 55 jurisdictions, in which CEDAW was referred to in the reported decision. Despite predictions to the contrary based on previous scholarship, significant variations between courts in their interpretation of CEDAW occurred relatively infrequently, courts referred relatively seldom to interpretations of CEDAW by other national courts, and there was little evidence of transnational dialogic approaches to judging. An analysis of these results suggests that domestic judges invoking CEDAW act primarily as domestic actors who use international law in order to advance domestic goals, rather than acting primarily as agents of the international community in applying CEDAW domestically, or contributing to the transnational shaping of international law to suit national interests. The Article suggests an understanding of the domestic implementation of a human rights treaty as not only law, but a unique kind of law that performs a particular function, in light of its quality as something akin to hard and soft law simultaneously.

This article tracks the development of the Brut tradition, from its inception in the ninth century text the Historia Brittonum, via Geoffrey of Monmouth’s twelfth century Historia Regum Britannaie, Wace’s Roman de Brut and Layamon’s Brut (both twelfth century), to the myriad Prose Bruts, in Anglo-Norman, Latin and Middle English, from the thirteenth to the sixteenth centuries. It argues that the Brut is best understood both as a distinctive literary tradition and as a well-spring of mythography from which a range of late medieval, and post-medieval, writers drew. The article indicates the utility of the Brut tradition to emergent notions of English identity and the role the narratives recorded by the Brut tradition played in orchestrating English colonial attitudes to its insular and continental neighbours. The article concludes by assessing the importance of the Brut tradition for book culture and emergent models of literary taste in the later Middle Ages

In many countries, strategies to further develop services and institutions for the education and care of young children are linked to a discourse on professionalism. Ambitious policy goals, it is argued, can only be achieved by a skilled and qualified workforce whose practice is guided by a professional body of knowledge. This article argues that the prevailing conceptualisation of the early childhood professional is constructed out of a particular, hierarchical mode of producing and applying expert knowledge that is not necessarily appropriate to professional practice in the field of early childhood education. However, it is highly effective and contributes to forming a professional habitus that contradicts the relational core of early childhood practice. Drawing on the conceptual framework of hermeneutics, the article explores an alternative paradigm of a relational, systemic professionalism that embraces openness and uncertainty, and encourages co‐construction of professional knowledges and practices. Research, in this frame of thinking, is understood as a dialogic activity of asking critical questions and creating understandings across differences, rather than producing evidence to direct practice.

La question du pluralisme religieux est au Québec, l’objet de désaccords et de variations dans son mode de régulation et ses instruments d’action publique. La consultation publique sur le projet loi n° 94, Loi établissant les balises encadrant les demandes d’accommodement dans l’Administration gouvernementale et dans certains établissements, est au cœur de ceux-ci. En se basant sur l’analyse des séances d’auditions publiques en commission parlementaire qui ont eu lieu au Québec entre mai 2010 et janvier 2011 sur le projet de loi n° 94, cette thèse vise à interroger les enjeux liés à la publicisation des prises de positions et de l’échange d’arguments entre différents acteurs. À partir d’une méthodologie par théorisation enracinée et d’un cadre conceptuel qui se rattache à la communication publique, cette thèse cherche à mettre en évidence quelques-unes des propriétés des interactions verbales et non verbales qui composent et incarnent cette activité délibérative. Elle approche ces interactions du point de vue de leur publicisation en s’appuyant sur deux principes : la participation publique en tant qu’un instant de la construction du problème public et l’audition publique en commission parlementaire comme maillon d’un réseau dialogique qui participe à la publicisation du désaccord sur les accommodements raisonnables. Mettant l’accent sur l’usage du langage (verbal, non verbal et para verbal), l’objectif de cette thèse est de mieux comprendre comment des groupes minoritaires et majoritaires, engagés dans une arène publique où les points de vue par rapport aux accommodements raisonnables sont confrontés et mis en visibilité, gèrent leur situation de parole publique. La démarche de recherche a combiné deux stratégies d’analyse : la première stratégie d’inspiration conversationnelle, qui observe chaque séquence comme objet indépendant, a permis de saisir le déroulement des séances d’audition en respectant le caractère séquentiel des tours de parole La deuxième stratégie reviens sur les principaux résultats de l’analyse des séances d’auditions pour valider les résultats et parvenir à la saturation théorique pour élaborer une modélisation. L’exploitation des données selon cette approche qualitative a abouti au repérage de trois dynamiques. La première fait état des contraintes discursives. La seconde met en évidence le rôle des dimensions motivationnelles et socioculturelles dans la construction des positionnements et dans l’adoption d’un registre polémique. La troisième souligne la portée de la parole publique en termes d’actualisation des rapports de pouvoir et de confirmation de son caractère polémique. La modélisation proposée par cette thèse représente le registre polémique comme un élément constitutif de l’engagement argumentatif des acteurs sociaux mais qui est considérablement enchâssé dans d’autres éléments contextuels et motivationnels qui vont orienter sa portée. En tant qu’elle est exprimée dans un site dialogique, la parole publique en situation d’audition publique en commission parlementaire est en mesure de créer de nouvelles intrigues et d’une possibilité de coexister dans le dissensus. Le principal apport de cette thèse est qu’elle propose une articulation, concrète et originale entre une approche de la parole publique en tant que révélatrice d’autre chose que d’elle-même (nécessaire à tout éclaircissement des points de vue dans cette controverse) et une approche de la parole publique en tant que performance conduisant à la transformation du monde social. D’où, le titre de la thèse : la parole en action. This chapter looks at the assumptions made about the 'fictionality' of prose fiction implicit in the contemporary historical novel. In particular it argues that the recent historical novel has developed a set of 'reality effects' which appear to look back to modernist writing, but in fact work to secure a disguised referentiality in the face of a loss of faith in the fictional.

The Cappadocian variety of Ulaghátsh is unique among the Greek-speaking world in having lost the inherited preposition ‘se’. The innovation is found with both locative and allative uses and has af-ected both syntactic contexts in which ‘se’ was originally found, that is, as a simple preposition (1) and as the left-occurring member of circumpositions of the type ‘se’ + NP + spatial adverb (2). ART.DEF.SG.ACC cushion.SG.ACC behind ‘he went into the houses and hid behind the cushions’ (Dawkins 1916: 348) In this paper, we set out to provide (a) a diachronic account of the loss of ‘se’ in Asia Minor Greek, and (b) a synchronic analysis of its ramifications for the encoding of the semantic and grammatical functions it had prior to its loss. The diachronic development of ‘se’ is traced by comparing the Ulaghátsh data with those obtained from Cappadocian varieties that have neither lost it nor do they show signs of losing it and, crucially, also from varieties in which ‘se’ is in the process of being lost. The comparative analysis shows that the loss first became manifest in circumpositions in which ‘se’ was preposed to the complement to which in turn a wide range of adverbs expressing topological relations were postposed (émi sa qonáca mésa > émi ta qonáca mésa). This finding is accounted for in terms of Sinha and Kuteva’s (1995) distributed spatial semantics framework, which accepts that the elements involved in the constructions under investigation—the verb (émi), ‘se’ and the spatial adverb (mésa)—all contribute to the expression of the spatial relational meaning but with differences in weighting. Of the three, ‘eis’ made the most minimal contribution, the bulk of it being distributed over the verb and the adverb. This allowed for it to be optionally dropped from circumpositions, a stage attested in Phlo-tá Cappadocian and Silliot, and to be later completely abandoned, originally in allative and subsequently in locative contexts (earlier: évɣan so qonáq > évɣan to qonáq; later: so meidán en ávʝa > to meidán en ávʝa). The earlier loss in allative contexts is also dealt with in distributed semantics terms as verbs of motion such as έβγαν are semantically more loaded than vacuous verbs like the copula and therefore the preposition could be left out in the former context more easily than in the latter. The analysis also addresses the possibility that the loss of ‘se’ may ultimately originate in substandard forms of Medieval Greek, which according to Tachibana (1994) displayed SPATIAL ADVERB + NP constructions. Applying the semantic map model (Croft 2003, Haspelmath 2003), the synchronic analysis of the varieties that retain ‘se’ reveals that—like many other allative markers crosslinguistically—it displays a pattern of multifunctionality in expressing nine different functions (among others allative, locative, recipient, addressee, experiencer), which can be mapped against four domains, viz. the spatiotemporal, the social, the mental and the logicotextual (cf. Rice & Kabata 2007). In Ulaghátsh Cappadocian, none of these functions is overtly marked as such. In cases like (1), the intended spatial relational meaning is arrived at through the combination of the syntax and the inherent semantics of the verb and the zero-marked NP as well as from the context. In environments of the type exemplified by (2), the adverb contributes further to the correct interpretation. The analysis additionally shows that, despite the loss of ‘se’, Ulaghátsh patterns with all other Cappadocian varieties in one important aspect: Goal and Location are expressed similarly (by zero in Ulaghátsh, by ‘se’ in the other varieties) whereas Source is being kept distinct (expressed by ‘apó’ in all varieties). Goal-Location polysemy is very common across the world’s languages and, most crucially, prevails over other possible polysemies in the tripartite distinction Source—Location—Goal (Lestrade 2010, Nikitina 2009). Taking into account this empirical observation, our findings suggest that the reor-anisation of spatial systems can have a local effect—in our case the loss of a member of the prepositional paradigm—but will keep the original global picture intact, thus conforming to crosslinguistically robust tendencies.  References Croft, W. 2001.
