Este artículo analiza el impacto del conflicto colombiano sobre la seguridad de la subregión, tomando como punto de referencia principal su impacto sobre el Ecuador. Destaca, para el efecto, las vulnerabilidades que presenta la frontera norte-ecuatoriana y considera las posibilidades para enfrentar sus amenazas dentro de un marco de cooperación regional. Finalmente, el autor plantea la necesidad de desarrollar un enfoque de seguridad cooperativa, en el cual, el conflicto subregional sea abordado desde una perspectiva integral, tomando en cuenta todos sus elementos y complejidades.

El artículo estudia el impacto que la aplicación del Plan Colombia tendrá sobre el Ecuador. Se lo define como el riesgo a la seguridad más importante que tiene el país en el presente y se llama la atención respecto a la necesidad de forjar una posición nacional común que involucre a todos los sectores del país. Esta posición debería colaborar para contener un derrame del conflicto militar al resto de la subregión, garantizar los derechos fundamentales y el bienestar de las poblaciones de frontera, controlar el impacto ecológico del Plan Colombia, y lograr una revisión del Acuerdo de Manta con EE. UU. de modo que se evite la utilización de territorio ecuatoriano para operaciones militares directas en la guerra que se libra en Colombia.

Este artículo analiza el aporte historiográfico de Germán Colmenares. Se abordan, especialmente, los alcances del proyecto historiográfico denominado Historia Regional, los contextos en los que Colmenares desarrolló sus reflexiones teóricas, concretamente su preocupación por el desarrollo de la historiografía colombiana a partir de modelos flexibles de interpretación para el estudio de escenarios “marginales”, y sus indagaciones en relación a la historia económica y social colonial, en el estudio de las regiones fronterizas como veta de análisis de las relaciones sociales y culturales.

La falta de una ley general de procedimientos administrativos ha hecho que, en el Ecuador, no exista una regulación clara sobre la forma de extinguir los actos administrativos. Ello ha generado prácticas administrativas que lindan con la arbitrariedad y no toman en cuenta los derechos generados en virtud de los actos de la administración. La reciente promulgación del Código Territorial soluciona en algo el problema, al establecer un procedimiento general para todos los gobiernos autónomos descentralizados. El presente texto analiza la forma en que el referido Código aborda el tema, forma que, si bien tiene sus particularidades, en general sigue el esquema del Estatuto del Régimen Jurídico y Administrativo de la Función Ejecutiva, permitiendo con ello una necesaria uniformización de procedimientos.

Este artículo presenta la situación actual del narcotráfico en México y lo que ha sido la lucha antidrogas adelantada en coordinación con Estados Unidos, así como el papel de los militares mexicanos en la misma. Este trabajo es parte de un proyecto de investigación que desarrollé hace algunos meses, y cuya hipótesis central hacía referencia a la necesaria diferenciación que tendría que existir entre la política antidrogas desarrollada por Estados Unidos en México y la adelantada en otros países –los Andes–, diferenciación que surgiría a partir de la cercanía territorial entre México y Estados Unidos y el consecuente riesgo de desbordamiento de la violencia de Sur a Norte.

El artículo trata sobre diferentes visiones de la política exterior brasilera. Primero introduce las principales directivas de la política exterior: desarrollo económico y social, así como delimitación limítrofe con los países de América del Sur. La segunda establece la situación de las relaciones de Brasil luego de la guerra fría, con algunos países y regiones en el mundo: Estados Unidos, Unión Europea, América Latina, China, África, India y otras regiones. Finalmente se refiere a los intereses nacionales brasileros en las Naciones Unidas en campos como energía, medio ambiente y defensa.

During the 18th Century, the northeast of the Amazonian region, especially the jurisdiction of Quixos, was one of the most ignored regions of South America. Its dominions, dependents in part to the Real Audiencia of Quito, did not enjoy sufficient attention from the monarchial administration; therefore, the territorial domination and its natives did not take shape in absolute terms given the difficulties of indigenous resistance against strategies to slowly subordinate and eventually dismantle the Spanish politics of border territories.

In the colonial period, the Spanish politics towards the American frontiers was oriented not only to recognition and military protection of the borders, but also to control trade in the regions. During the demarcation of the boundaries in the 18th Century, the smuggling in the borders degenerated in various conflicts between the Spanish and Portuguese authorities. However, illegal trade played an important role en la satisfaction of the provisions in the zone, making possible the establishment of local alliances. This article addresses these questions taking as object the study the border Luso-Spanish in the Amazon Valley, between captaincy of Negro River and the province of Maynas, 1780-1820.

This article studies the impacts of the independence war in the regional border of the High Negro River, taking as it’s object of analysis the existing multiples connections between the inhabitants of both sides of the imaginary boundary line. From July 1817, the independence war in Venezuela changed the coordinates: the struggles between the republican patriots and those obedient to the King (Realistas), faithful to the restoration of the Spanish monarchy of Fernando VII, managed the great border region, and influenced the political, social and local dynamics, mainly the existing cross-border relations between both, impacted the ordinary life of the local population and affected the diplomacy between the Portuguese and Spanish American authorities, those faithful to the King (Realistas) and patriots.

Different economic and financial structures require different crisis responses. Different crises also require different tools and resources. The first ‘stage’ of the financial crisis (2007-09) was similar on both sides of the Atlantic, and the response was also quite similar. The second stage of the crisis is unique to the euro area. Increasing financial disintegration within the region has forced the ECB to become the central counterparty for the entire cross-border banking market and to intervene in the sovereign bond market of some stressed countries. The actions undertaken by the European Central Bank (ECB), however, have not always represented the best response, in terms of effectiveness, consistency and transparency. This is especially true for the Securities Markets Programme (SMP): by de facto imposing its absolute seniority during the Greek PSI (private sector involvement), the ECB has probably killed its future effectiveness.

Effective enforcement and compliance with EU law is not just a legal necessity, it is also of economic interest since the potential of the Single Market will be fully exploited. Enforcement barriers generate unjustified costs and hindrances or uncertainty for cross-border business and might deprive consumers from receiving the full benefit of greater choice and/or cheaper offers. The EU has developed several types of enforcement efforts (preventive initiatives, pre-infringement initiatives and formal infringement procedures). More recently, the emphasis has been placed on effective prevention. This CEPS Policy Brief analyses the functioning of one preventive mechanism (the 98/34 Directive) and assesses its potential to detect and prevent technical or other barriers in the course of the last 25 years. Based on an empirical approach, it shows that this amazing mechanism has successfully prevented thousands of new technical barriers from arising in the internal goods market.

This paper reflects on the challenges facing the effective implementation of the new EU fundamental rights architecture that emerged from the Lisbon Treaty. Particular attention is paid to the role of the Court of Justice of the European Union (CJEU) and its ability to function as a ‘fundamental rights tribunal’. The paper first analyses the praxis of the European Court of Human Rights in Strasbourg and its long-standing experience in overseeing the practical implementation of the European Convention for the Protection of Human Rights and Fundamental Freedoms. Against this analysis, it then examines the readiness of the CJEU to live up to its consolidated and strengthened mandate on fundamental rights as one of the prime guarantors of the effective implementation of the EU Charter of Fundamental Rights. We specifically review the role of ‘third-party interventions’ by non-governmental organisations, international and regional human rights actors as well as ‘interim relief measures’ when ensuring effective judicial protection of vulnerable individuals in cases of alleged violations of fundamental human rights. To flesh out our arguments, we rely on examples within the scope of the relatively new and complex domain of EU legislation, the Area of Freedom, Security and Justice (AFSJ), and its immigration, external border and asylum policies. In view of the fundamental rights-sensitive nature of these domains, which often encounter shifts of accountability and responsibility in their practical application, and the Lisbon Treaty’s expansion of the jurisdiction of the CJEU to interpret and review EU AFSJ legislation, this area can be seen as an excellent test case for the analyses at hand. The final section puts forth a set of policy suggestions that can assist the CJEU in the process of adjusting itself to the new fundamental rights context in a post-Lisbon Treaty setting.

Cross-border banking is currently not stable in Europe. Cross-border banks need a European safety net. Moreover, a truly integrated European level banking system may help to break the diabolical loop between the solvency of the domestic banking system and the fiscal standing of the national sovereign. This policy paper first sketches the building blocks of a banking union. Importantly, a new European Deposit Insurance and Resolution Authority (EDIRA) should start simultaneously with the ECB assuming supervisory powers. A combination of European supervision and local resolution cannot work because it is not ‘incentive compatible’. Next, this paper proposes a transition period to gradually phase in the European deposit insurance coverage. Finally, we calculate that a European Deposit Insurance Fund would amount to about €30-50 billion for the 75 euro area banks that were subject to the EBA stress tests. This Fund could be created over a period of time through risk-based deposit insurance premiums levied on these banks. Once up and running, the Fund would then turn into a European Deposit Insurance and Resolution Fund to also deal with the resolution of one or more of these European banks.

The Canadian Migration Monitoring Network (CMMN) consists of standardized observation and migration count stations located largely along Canada’s southern border. A major purpose of CMMN is to detect population trends of migratory passerines that breed primarily in the boreal forest and are otherwise poorly monitored by the North American Breeding Bird Survey (BBS). A primary limitation of this approach to monitoring is that it is currently not clear which geographic regions of the boreal forest are represented by the trends generated for each bird species at each station or group of stations. Such information on “catchment areas” for CMMN will greatly enhance their value in contributing to understanding causes of population trends, as well as facilitating joint trend analysis for stations with similar catchments. It is now well established that naturally occurring concentrations of deuterium in feathers grown in North America can provide information on their approximate geographic origins, especially latitude. We used stable hydrogen isotope analyses of feathers (δ²Hf) from 15 species intercepted at 22 CMMN stations to assign approximate origins to populations moving through stations or groups of stations. We further constrained the potential catchment areas using prior information on potential longitudinal origins based upon bird migration trajectories predicted from band recovery data and known breeding distributions. We detected several cases of differences in catchment area of species passing through sites, and between seasons within species. We discuss the importance of our findings, and future directions for using this approach to assist conservation of migratory birds at continental scales.

Despite the many models developed for phosphorus concentration prediction at differing spatial and temporal scales, there has been little effort to quantify uncertainty in their predictions. Model prediction uncertainty quantification is desirable, for informed decision-making in river-systems management. An uncertainty analysis of the process-based model, integrated catchment model of phosphorus (INCA-P), within the generalised likelihood uncertainty estimation (GLUE) framework is presented. The framework is applied to the Lugg catchment (1,077 km2), a River Wye tributary, on the England–Wales border. Daily discharge and monthly phosphorus (total reactive and total), for a limited number of reaches, are used to initially assess uncertainty and sensitivity of 44 model parameters, identified as being most important for discharge and phosphorus predictions. This study demonstrates that parameter homogeneity assumptions (spatial heterogeneity is treated as land use type fractional areas) can achieve higher model fits, than a previous expertly calibrated parameter set. The model is capable of reproducing the hydrology, but a threshold Nash-Sutcliffe co-efficient of determination (E or R 2) of 0.3 is not achieved when simulating observed total phosphorus (TP) data in the upland reaches or total reactive phosphorus (TRP) in any reach. Despite this, the model reproduces the general dynamics of TP and TRP, in point source dominated lower reaches. This paper discusses why this application of INCA-P fails to find any parameter sets, which simultaneously describe all observed data acceptably. The discussion focuses on uncertainty of readily available input data, and whether such process-based models should be used when there isn’t sufficient data to support the many parameters.
