This investigation aims at describing, analyzing and interpreting the Commitment in Initial Petitions, which is a genre circumscribed in the judicial domain. For this purpose, we have chosen sections, facts as found and relevant law , sections of the petition, with the understanding that, in this way, respectively, the narration of events, which gives margin to the propositioning to the judicial action, and the exposition of the law that upholds the author s intention. We base our discussion on the field of Linguistics, more precisely, Textual Discourse Analysis (TDA), whose theoretical basis is derived from Textual Linguistics (TL) and Enunciative Linguistics. We foreground, particularly, the way in which the author of texts, objects of analysis, use discursive strategies that evidence ER. The relevance of this study, then, is in the formation of a critique of the judicial text, as it conceives of a dialogical approach to the point of view, raising not only questions about the way in which a linguistic instance conceives an object of discourse, but also considering questions of language inherent to technical writing and, in this aspect, contributing to the work of those operating in Law about the many ways ER is formed in the body of a petition. We selected two categories to analyze that, according to Adam (2011), characterize the degree of ER in the textual material of the propositional enunciations: the different types of representation of speech and the indications of profile of mediators. In this sense, with this task as an objective, we base our study regarding point of view on Rabatel (2003, 2009a, 2010) with relation to the enunciative approach, including the study of PDV in polyphonic and dialogical theoretical framework to study the ER from different types of speech representations that conceive forms of transmission of discourse and the role of the enunciating subject, mainly the responsibility and the prerogative by the propositional contents. In the same way, intending to study the indications of the mediator profiles, we observed the postulations of Guentchéva (1994, 1996), which develop the notion of mediative grammatical categories, of which permit the linguistic marking of distance and engagement of the enunciator with regard to the information expressed. The methodology we adopted was based on qualitative research, of an interpretive and introspective nature, in light of the fact that his study focuses on processes and strategies underlying language use. The corpus of the research is comprised of Initial Petitions, which gave rise to actions originating in the Civil Court of Currais Novos County RN. The data analysis shows that an object of discourse is always perspective oriented and presents the point of view of one or more enunciators. Consequently, the producer of a text, using the PDV of other enunciators, influences and establishes the argumentative orientation of the text. In the same way, it evidences the relevance of the use of mediated constructions in the judicial text, as they function as strategies attenuated to the responsibility of the producer of the text with what is said, and at the same time points to a discourse of authority through the entrance of the sources of law. Moreover, it reveals the documental and international importance of this practice, at the same time that it exposes the compositional and normative difficulties with regard to legal and linguistic aspects

This paper analyses the history of Hypolita Maria das Dores, mulatto woman, free born, was enslaved and, by an act of freedom, appealed to court to prove the illegitimacy of her captivity and regain their freedom and their children. The main scenarios of this social and legal struggle are Crato (Ceará) and Exu (Pernambuco), places where she lived in the 19th century. The main objective of this work is to understand how to set the tensions and alliances involving the struggle for freedom inside and outside justice, in differentiated provincial spaces. An approach that belongs to the field of the social history of slavery, we ll prioritize the narrative of life. In it, Hypolita is taken as the subject of her story, as she faces stately and patriarchal values in a slave society. The documentary corpus that allows such vertical investigative consists of parish registers, we examined the baptisms, marriages and death records; analyzed registry documents of postmortem inventories, petitions and crafts; reports of provincial presidents and, finally, the O Araripe s and O Cearense s journalistic information. The investigation of the case allowed the understanding of how, in space and time specific, freedom was understood, usurped and claimed by various social subjects in the frame of morals and justice institutionalized

The objective of this work is to understand some of the modifications caused for the phenomenon of the westernization in the hinterland of the Capitania do Rio Grande e in the life of the indians populations that inhabited there during the Colonial Period. We break of the quarrel of Serge Gruzinski concerning the westernization, understood while immersed phenomenon in the context of the expansion of the commercial capitalism and that, for the imposition of the culture occidental person to the alteridades of the New World, emprende the conquest of its territories, bodies and souls. The space clipping has covered the hinterland of the Capitania do Rio Grande, specifically the colonial territory of the Freguesia da Gloriosa Senhora Santa Ana do Seridó. The chosen chronological limit for the research corresponds to the Colonial Period and part of the Imperial one. However, the emphasis falls again on the period that it initiates in 1670, year of the oldest concession of would sesmaria known until the moment in the hinterland of the Rio Grande, extending itself until the decade of 1840. Sources of written by hand nature, cartographic printed and compose the used document roll: official correspondence and legislation, petitions of would sesmaria, inventories post-mortem, justifications of debt, registers of parish, maps, action civil court jurisdiction, notes of notary's office, land landmarks. We take the method, analyzed for Carlo Ginzburg, to cross these sources between itself and to detect its implied particularitities and ideas in the space between lineses, but, attributing it status to they of a colonial speech, fruit of the bureaucracy of where it was originated and of the social place of who produced it. We look for to demonstrate, throughout the work, that the phenomenon of the westernization desestruturou the aboriginal societies and its habitat, constructing, over its rubbles, a colonial territory that found in the cartography of the Freguesia de Santa Ana an efficient instrument of control of the space and the population. On the other hand, if the imposition of the culture occidental person exterminou great part of the native population that inhabited the hinterland of the Rio Grande, the remainders of these indians and the mestizos of descending them had survived in diverse ways in the freguesia: in the condition of captives of war or in regimen of servile work, as living or assistants in the farms, populations and village; rambling without route in the fields and the population spots; as mediating agents between the world occidental person and the native, exerting military or civil positions and still appealing to Justice in search of its rights of inheritance. Vilas, “logares” e cidades: a história da educação rural do Pará na Primeira República - 1889 a 1897

Trata-se de um estudo sobre a história da educação rural no Pará, entre 1889-1897. A intenção última é conhecer, a partir da pesquisa histórica, como se deu a educação rural do Pará na Primeira República, tendo como foco os governos provisórios de Justo Chermont e Huert Bacelar e o governo constitucional de Lauro Sodré. Nosso objetivo geral é entender como a educação para homens e mulheres do interior do Pará foi pensada e operacionalizada no plano governamental. Especificamente, estabelecemos quatro objetivos: a) Levantar os investimentos feitos nas escolas rurais no período em questão; b) Descrever como eram concebidas as escolas rurais do estado do Pará na Primeira República; c) Entender quais os procedimentos utilizados, através dos documentos oficiais, para formar o cidadão das escolas rurais; d) Compreender os objetivos da formação educacional da população rural. Duas questões nortearam a investigação: 1º) Que intenções permeavam a educação destinada às populações das áreas rurais do Pará nos governos do período de 1889 a 1897? 2º) O que foi realizado, no plano governamental, para a concretização desses objetivos? As fontes documentais foram coletadas no Arquivo Público do Estado do Pará, na biblioteca Arthur Vianna e nos Setor de Obras Raras do Centro Cultural do Pará Tancredo Neves (CENTUR). O corpus da pesquisa está composto de: relatórios dos governadores; mensagens, ofícios, abaixo-assinados, circulares e requerimentos; relatórios de diretores da Instrução Pública; relatórios de visitadores; relatórios de grupo escolares; cadernos de Leis do período. Metodologicamente, operamos a análise em três momentos: 1) momento da heurística; 2) momento da crítica; 3) momento da interpretação. O texto está composto de introdução, três seções e considerações finais. O trabalho realizado indica que os governos estaduais na Primeira República pouco fizeram pela formação do homem do interior do estado, apesar do uso político acentuado da educação como prioridade para estes. Identificamos que os investimentos com a Instrução Pública tiveram seu limite estabelecido pela ideologia do regime republicano que entendia a população rural como uma gente de segunda ou de terceira, que precisava ser “lapidada” para o trabalho. Por extensão, o espaço rural é compreendido como o lugar do atraso, da incivilidade e que, portanto, um pouco de formação à sua população era o suficiente para transformar homens rudes em cidadãos, ainda que de categoria inferior.

A presente pesquisa dispõe sobre a efetividade do Sistema Interamericano de Direitos Humanos com relação aos casos brasileiros e a situação geral de violação de Direitos Humanos no Brasil. O estudo parte da exposição de uma concepção e fundamentação dos Direitos Humanos, para posteriormente analisar a consolidação de sua proteção internacional com o surgimento dos sistemas de promoção e de garantia dos Direitos Humanos, em âmbito global e regional, destacando em seguida o Sistema Interamericano de Proteção aos Direitos Humanos, em que se faz uma análise dos seus principais órgãos: Corte e Comissão Interamericanas. No estudo sobre a Comissão Interamericana, ao discorrer sobre funcionamento, requisitos para o ingresso e trâmite das petições individuais, apresenta-se os casos brasileiros em curso na Comissão, identificados a partir da análise dos seus relatórios anuais, disponíveis no seu endereço eletrônico. Com isso, traça-se um perfil dos casos enviados á Comissão Interamericana, ressaltando que, em regra, não esgotam os recursos judiciais internos, o que corresponde a um requisito processual para o ingresso de petições individuais. Logo, estas são enviadas com fundamento nas vias excepcionais, mormente a exceção da demora injustificada em tutelar jurisdicionalmente os casos de violações ocorridos no Brasil, o que faz do Sistema Interamericano não um órgão coadjuvante ou complementar. De modo a auferir a efetividade do Sistema Interamericano para a promoção e a garantia dos Direitos Humanos no Brasil, apresenta-se o monitoramento que a Comissão realiza desde 1997, quando estabeleceu ao governo brasileiro suas Recomendações sobre a situação geral de violação de Direitos Humanos, a partir da missão in loco que fez no país em 1995; e com a análise dos casos brasileiros em tramitação na Comissão Interamericana, identifica-se também quais denúncias geraram Recomendações ao Brasil e a relação destas com políticas públicas, inovações e alterações legislativas ocorridas internamente

This paper examines the impact of disastrous and ‘ordinary’ floods on human societies in what is now Austria. The focus is on urban areas and their neighbourhoods. Examining institutional sources such as accounts of the bridge masters, charters, statutes and official petitions, it can be shown that city communities were well acquainted with this permanent risk: in fact, an office was established for the restoration of bridges and the maintenance of water defences and large depots for timber and water pipes ensured that the reconstruction of bridges and the system of water supply could start immediately after the floods had subsided. Carpenters and similar groups gained 10 to 20 per cent of their income from the repair of bridges and other flood damage. The construction of houses in endangered zones was adapted in order to survive the worst case experiences. Thus, we may describe those communities living along the central European rivers as ‘cultures of flood management’. This special knowledge vanished, however, from the mid-nineteenth century onwards, when river regulations gave the people a false feeling of security.

El propósito de este trabajo es investigar los motivos, anhelos, sueños, deseos que llevan a un grupo de entre 20 y 25 ex presos políticos a reunirse semanalmente en el local del sindicato Luz y Fuerza, Córdoba. Optamos por entrevistar a quienes daban la sensación de ser más participativos o más explícitos, en la elección procuramos que hubiesen casi por igual miembros de las dos organizaciones mayoritarias en el pasado: Montoneros y Partido Revolucionario de los Trabajadores. El celo a la hora de elegir se entronca con las subculturas que emergieron de las organizaciones. Otro aspecto observado es la cuestión de género, mujeres y hombres, equitativamente incorporados, se constituyeron en narradores.2 En la ciudad mediterránea hubo alrededor de dos mil detenidos por causas políticas a partir de la dictadura que iniciara Jorge Rafael Videla. La curiosidad social es acicateada por el número exiguo de ex-represaliados que constituyen la comisión de presos políticos, que entre otras tareas peticiona ante las autoridades solicitando reivindicaciones a raíz de su condición de ex detenidos, organizan eventos sociales y políticos, gestionan los ex centros de detención convertidos en "museos de la memoria", impulsan los juicios contra los ex represores, editan publicaciones. Concurrimos a las reuniones semanales, a asados, "locreadas"; empleamos en las investigaciones la observación participante. La participación se dio en eventos, en compartir ruedas de mate en la casa de los entrevistados, íntimas ruedas de café, por un fenómeno de indexicalidad en relación con el discurso ideológico pudimos avanzar en la profundidad de la conversación. Además, de las entrevistas en profundidad, analizamos material periodístico y material escrito por los detenidos; cuando la emoción del entrevistado dificultaba la conversación, en algunos casos nos remitieron a elaboraciones suyas sobre la situación planteada.. Nos favoreció, en el trabajo, el hecho de haber participado en la vida política, y el tener familiares que lucharon junto a los ex-represaliados. A pesar de ello no fue fácil llegar a subjetividades que hacía largo tiempo se hallaban abroqueladas. Mead e Erving Goffman nos acompañaron en el camino de reconocimiento de los selfs en la dramaturgia montada en el local de Luz y Fuerza

El concepto de misericordia divina ha pasado por diversos estadios en su evolución, pero las concepciones de la religión cristiana y de la religión pagana no siempre se oponen. En este artículo se examinan las fuentes filosóficas (Aristóteles, filosofía helenística), literarias (Sófocles, Homero) y epigráficas, hallándose significados variados, a veces superpuestos temporalmente, y también el uso del concepto en las plegarias paganas y en las peticiones oficiales. Si bien el racionalismo estoico considera a la misericordia como incompatible con la sabiduría y la justicia, el cristiano Lactancio recupera el valor de las pasiones utilizadas apropiadamente, marcando un hito en la conversión de una emoción pagana en una virtud y un deber cristianos

This paper analyzes the processes of extinction of indigenous collective lands and villages in Rio de Janeiro and Espírito Santo, from mid-eighteenth century to the nineteenth century, giving emphasis on the role of IndigenousÆs policy aiming to delay the process. Based on the correspondence among authorities, laws, statistical reports, and petitions from the Indians themselves, we approach the agrarian conflicts among indigenous, non-Indian residents and municipal councils, focusing on the issue of controversies and discussions regarding ethnicity that played a central role in these disputes.
