The Financial Action Task Force embraces financial inclusion as complementary to anti-money laundering and counterterrorist financing, as it enhances transparency. This support is based on the premise that the increased use of formal financial services leads to a reduction of usage of informal services. We present evidence on eight African countries that both are not negatively associated. Moreover, informal employment and cash preference reduce the inclination to use mobile financial services. If an increase in transparency acts as disincentive to use formal services, the alignment of financial inclusion and integrity will fail.

While corporate non-compliance receives much attention, conservative and over-compliant responses are often ignored. These responses go beyond what is required by a particular regulatory requirement. In many cases, regulators may support such responses because they advance regulatory objectives. In the context of risk-based regulation and compliance, especially the model implemented by the Financial Action Task Force to combat money laundering and financing of terrorists, that may, however, not necessarily be the case. With this risk-based approach, regulated institutions are required to respond to higher risks by adopting enhanced risk mitigation measures and are allowed to simplify those measures where the risks are assessed as low. Failure in the latter cases to simplify risk mitigation measures where appropriate, may be inefficient and, in some instances, may even undermine regulatory objectives. This article investigates the drivers of conservative responses by South African banks to statutory anti-money laundering and counter-terrorist financing laws.

The potential for criminals and terrorism financiers to secure lucrativegovernment contracts poses a risk to Australia’s anti-money laundering,anti-corruption and counter-terrorism financing objectives. This articlecompares the customer due diligence measures that banks are required to implement to prevent money laundering and terrorism financing with the general supplier due diligence practices and processes of key Australian government departments and agencies. It identifies various weaknesses in current procurement practices relating to standard contracts and argues that these render Australian public procurement vulnerable to criminal abuse, threaten compliance with its sanctions regime and potentially undermine the crime combating objectives of its money laundering and terrorism financinglaws. The article recommends that the national interest calls for awhole-of-government approach to improve supplier due diligence in public procurement.

This work is based on the analysis of three Brazilian cases of condemnation by accounting fraud and financial reports manipulation of data, where we tried to identify if there is condemnation by accounting fraud in Brazil and the main factors considered by the judge to convince them about the accounting fraud. The theoretical reference quoted involves the theory of fraud, the psychology of fraud, examples of financial fraud in foreign companies and Brazilians banks and the law in Brazil regarding fraud and money laundering. The methodology consisted in studies of Brazilian cases with the data collection criteria from three law suits. The methodology used was the Contents Analysis The samples were chosen according to the impact those cases had in Brazil and the facility to access their law suits. Therefore, we chose Gallus Agropecuária S/A, Encol S/A and Banco Santos S/A for a matter of convenience. The evidence indicated that in those three cases, the court was convinced by the accounting fraud due to omission of relevant financial information in the balance sheet, by information provided to the market that didn¿t reflect the healthy of the company (assets written up without the property). It was identified as well that, in those three cases, there was condemnation not only for the accounting fraud per si, but also by the combination of other crimes as money laundering, fraud gang, material and ideological false fraud, and bankruptcy.

O objetivo desta pesquisa foi compreender de que modo a emergência de estilos de gestão pública baseados em rede pode contribuir para a construção de políticas públicas relacionadas à prevenção e repressão à lavagem de dinheiro. O arcabouço teórico fundamentou-se nas teorias de redes interorganizacionais, mais especificamente, nas redes de políticas públicas. Foram estudadas relações de colaboração e cooperação que, por transcenderem os limites organizacionais, garantem maior flexibilidade e abrangência ao processo de construção de políticas públicas. As reflexões sobre estas teorias foram realizadas a partir de um contexto empírico específico: o da articulação entre instituições brasileiras que atuam na prevenção e repressão à lavagem de dinheiro. Este contexto foi escolhido pela percepção de que a prática de ilícitos financeiros traz enormes prejuízos a nações que precisam superar desigualdades econômicas e sociais. A escolha metodológica foi motivada por questões ontológicas e epistemológicas que apontaram a metodologia reflexiva como a mais adequada para o alcance dos objetivos propostos na pesquisa. A partir da construção dos dados empíricos foi possível criar construtos que sintetizam os benefícios e desafios da constituição de redes de políticas públicas. As conexões interpretativas subsequentes reforçam a ideia de que os espíritos democrático, republicano e de cooperação devem nortear os valores compartilhados na rede. Assim, se a atuação interna da rede se aprimora, torna-se possível superar entraves endógenos (foco apenas na boa reputação externa) e exógenos (pressão das elites corruptas) à rede, o que resulta em uma melhor interação entre os participantes, gerando resultados mais efetivos para a sociedade.

This thesis work aims to bring a better viewing on an atypical case of financial analysis. The lstituto per le Opere di Religione (IOR), commonly known as the Vatican Bank, has peculiarities according to its goals as a bank. Belonging to a Catholic religious congregation, IOR has been used to manage the resources of the church, and ensure that these resources are used for the operation of it and, also for religious works. However the financial transactions made by the bank remained secret throughout its existence until mid 2012. This feature of not providing relevant information at the local and international community brought harm. Several cases of corruption and money laundering came up, bringing scandals that cause bad looks for the religious entity. In order to interact with the international community and understanding the importance of it, the Roman Apostolic Catholic Church decides to joing the international accounting procedures (IFRS) and went on to provide yearly financial statement reports and other information from its bank from 2012 . Thus, this thesis work takes on the role of analyzing the financial statements of the IOR and present its economic and financial health from the Capital Structure ratios, liquidity and profitability in the period 2012-2014. Overall, there has been a significant reduction in indebtedness 548% in 2012 to 362% in 2014. However, such an index showing is still high. In addition, the debt profile remained bad (87.47% short-term in 2014). The Liquidity ratios, both indices fell during the analysed period. Noteworthy is that even with retractions, the indices are equal or greater than 1, which indicates financial footing able to pay off debts. Regarding profitability, in 2013 it represented atypical moment, considering the economic performance of the IOR in the investigated period. La ricerca è dedicata a verificare se e come, a livello dell’Unione europea, la lotta alla criminalità (ed in particolare quella organizzata) venga condotta nel rispetto di diritti e libertà fondamentali, e se la cooperazione tra Stati membri su questo fronte possa giungere a promuovere standard omogenei ed elevati di tutela degli stessi. Gli ambiti di cooperazione interessati sono principalmente quello giudiziario in materia penale e quello di polizia, e la ritrosia degli Stati a cedere all’Unione competenze in materia si è accompagnata ad un ritardo ancora maggiore dell’emersione, nell’ambito degli stessi, della dimensione dei diritti. Ciò ha reso molto difficile lo sviluppo completo ed equilibrato di uno “spazio di libertà, sicurezza e giustizia” (art. 67 TFUE). L’assetto istituzionale introdotto dal Trattato di Lisbona e l’attribuzione di valore giuridico vincolante alla Carta hanno però posto le basi per il superamento della condizione precedente, anche grazie al fatto che, negli ambiti richiamati, la salvaguardia dei diritti è divenuta competenza ed obiettivo esplicito dell’Unione. Centrale è per la ricerca la cooperazione giudiziaria in materia penale, che ha visto la ricca produzione normativa di stampo repressivo recentemente bilanciata da interventi del legislatore europeo a finalità garantista e promozionale. L’analisi degli strumenti nella prospettiva indicata all’inizio dell’esposizione è quindi oggetto della prima parte dell’elaborato. La seconda parte affronta invece la cooperazione di polizia e quello degli interventi volti alla confisca dei beni e ad impedire il riciclaggio, misure – queste ultime - di particolare rilievo soprattutto per il contrasto al crimine organizzato. Sottesi all’azione dell’Unione in queste materie sono, in modo preponderante, due diritti: quello alla salvaguardia dei dati personali e quello al rispetto della proprietà privata. Questi, anche in ragione delle peculiarità che li caratterizzano e della loro natura di diritti non assoluti, sono analizzati con particolare attenzione.
