In the post-World War II era human rights have emerged as an enormous global phenomenon. In Finland human rights have particularly in the 1990s moved from the periphery to the center of public policy making and political rhetoric. Human rights education is commonly viewed as the decisive vehicle for emancipating individuals of oppressive societal structures and rendering them conscious of the equal value of others; both core ideals of the abstract discourse. Yet little empirical research has been conducted on how these goals are realized in practice. These factors provide the background for the present study which, by combining anthropological insights with critical legal theory, has analyzed the educational activities of a Scandinavian and Nordic network of human rights experts and PhD students in 2002-2005. This material has been complemented by data from the proceedings of UN human rights treaty bodies, hearings organized by the Finnish Foreign Ministry, the analysis of different human rights documents as well as the manner human rights are talked of in the Finnish media. As the human rights phenomenon has expanded, human rights experts have acquired widespread societal influence. The content of human rights remains, nevertheless, ambiguous: on the one hand they are law, on the other, part of a moral discourse. By educating laymen on what human rights are, experts act both as intermediaries and activists who expand the scope of rights and simultaneously exert increasing political influence. In the educational activities of the analyzed network these roles were visible in the rhetorics of legality and legitimacy . Among experts both of these rhetorics are subject to ongoing professional controversy, yet in the network they are presented as undisputable facts. This contributes to the impression that human rights knowledge is uncontested. This study demonstrates how the network s activities embody and strengthen a conception of expertise as located in specific, structurally determined individuals. Simultaneously its conception of learning emphasizes the adoption of knowledge by students, emphasizing the power of experts over them. The majority of the network s experts are Nordic males, whereas its students are predominantly Nordic females and males from East-European and developing countries. Contrary to the ideals of the discourse the network s activities do not create dialogue, but instead repeat power structures which are themselves problematic.

A continuum model based on the critical state theory of soil mechanics is used to generate stress and density profiles, and to compute discharge velocities for the plane flow of cohesionless materials. Two types of yield loci are employed, namely, a yield locus with a corner, and a smooth yield locus. The yield locus with a corner leads to computational difficulties. For the smooth yield locus, results are found to be relatively insensitive to the shape of the yield locus, the location of the upper traction-free surface and the density specified on this surface. This insensitivity arises from the existence of asymptotic stress and density fields, to which the solution tends to converge on moving down the hopper. Numerical and approximate analytical solutions are obtained for these fields and the latter is used to derive an expression for the discharge velocity. This relation predicts discharge velocities to within 13% of the exact (numerical) values. While the assumption of incompressibility has been frequently used in the literature, it is shown here that in some cases, this leads to discharge velocities which are significantly higher than those obtained by the incorporation of density variation.

A continuum model based on the critical-state theory of soil mechanics is used to generate stress, density, and velocity profiles, and to compute discharge rates for the flow of granular material in a mass flow bunker. The bin–hopper transition region is idealized as a shock across which all the variables change discontinuously. Comparison with the work of Michalowski (1987) shows that his experimentally determined rupture layer lies between his prediction and that of the present theory. However, it resembles the former more closely. The conventional condition involving a traction-free surface at the hopper exit is abandoned in favour of an exit shock below which the material falls vertically with zero frictional stress. The basic equations, which are not classifiable under any of the standard types, require excessive computational time. This problem is alleviated by the introduction of the Mohr–Coulomb approximation (MCA). The stress, density, and velocity profiles obtained by integration of the MCA converge to asymptotic fields on moving down the hopper. Expressions for these fields are derived by a perturbation method. Computational difficulties are encountered for bunkers with wall angles θw [gt-or-equal, slanted] 15° these are overcome by altering the initial conditions. Predicted discharge rates lie significantly below the measured values of Nguyen et al. (1980), ranging from 38% at θw = 15° to 59% at θw = 32°. The poor prediction appears to be largely due to the exit condition used here. Paradoxically, incompressible discharge rates lie closer to the measured values. An approximate semi-analytical expression for the discharge rate is obtained, which predicts values within 9% of the exact (numerical) ones in the compressible case, and 11% in the incompressible case. The approximate analysis also suggests that inclusion of density variation decreases the discharge rate. This is borne out by the exact (numerical) results – for the parameter values investigated, the compressible discharge rate is about 10% lower than the incompressible value. A preliminary comparison of the predicted density profiles with the measurements of Fickie et al. (1989) shows that the material within the hopper dilates more strongly than predicted. Surprisingly, just below the exit slot, there is good agreement between theory and experiment.

O presente estudo abordou a possibilidade de materialização do atual Projeto Ético-Político do Serviço Social brasileiro na direção social impressa no trabalho dos assistentes sociais que atuam na Secretaria de Administração Penitenciária do Rio de Janeiro (SEAP), com vínculos trabalhistas precários. Selecionamos os profissionais com contratos temporários, ou seja, precários, por entendermos que a fragilidade do vínculo trabalhista pode ser um importante fator de acirramento e de agudização da tensão inerente ao trabalho profissional do assistente social nesse campo sócio-ocupacional, impactando prejudicialmente não só nas condições de trabalho dos profissionais, mas, de modo importante, na qualidade dos serviços prestados aos usuários e, por conseguinte, nas possibilidades e limites de materialização do atual Projeto Profissional crítico. Daí por que considerarmos necessários estudos que se voltem aos profissionais com vínculos trabalhistas precários, especialmente profissionais que atuam em locais complexos como a Secretaria de Administração Penitenciária. Destacamos a relevância de investigações que se atenham ao trabalho profissional, na medida em que se constitui locus privilegiado de contato entre o assistente social e aqueles que atende, tendo em vista o caráter interventivo da profissão. A pesquisa empírica foi realizada por meio de entrevistas com assistentes sociais que trabalham na SEAP, com o perfil selecionado, ou seja, vínculo trabalhista precário. Utilizamos, ainda, nossa experiência como assistente social, as observações no campo e as conversas informais com os entrevistados. Esta investigação foi orientada pela teoria social crítica, ou seja, o materialismo histórico e dialético.

As mudanças no sistema produtivo trazem a subsunção do setor serviços ao setor fabril. Os serviços na atualidade ganham centralidade na organização produtiva do capital. E, o processo de trabalho do setor serviços, nesse contexto, é atravessado por formas de administração pública a partir da lógica privada. Cada política social se constitui a partir de racionalidades que implicam na organização do processo de trabalho e na prestação dos serviços oferecidos a população. Para pensarmos o Serviço Social na Educação é imprescindível compreender como a política educacional brasileira se organiza em um contexto de capitalismo periférico. Estamos presenciando uma organização educacional a partir de programas e projetos que materializam as orientações de organismos internacionais com o objetivo do alcance de metas que coloquem o Brasil no mesmo patamar dos países centrais. Nesse estudo abordamos como esse quadro se materializa na realidade do município do Rio de Janeiro. A partir do Programa Interdisciplinar de Apoio às Escolas (Proinape) que foi criado em 2010 e tem como profissionais assistentes sociais, professores e psicólogos, que atuam nos diversos atravessamentos que se interpõem no processo ensino-aprendizagem. Acreditamos que esse trabalho é permeado por diversas racionalidades que perpassam a luta de classes. Desta forma, essa dissertação desvelará, a partir da teoria social crítica, as racionalidades presentes no processo de trabalho do Proinape da Secretaria Municipal de Educação do Rio de Janeiro (SME/RJ) demonstrando a quais lógicas esse programa vem servindo.

This dissertation sets out to provide immanent critique and deconstruction of ecological modernisation or ecomodernism.It does so, from a critical social theory approach, in order to correctly address the essential issues at the heart of the environmental crisis that ecomodernism purports to address. This critical approach argues that the solution to the environmental crisis can only be concretely achieved by recognising its root cause as being foremost the issue of material interaction between classes in society, and not simply between society and nature in any structurally meaningful way. Based on a metaphysic of false dualism, ecological modernisation attributes a materiality of exchange value relations to issues of society, while simultaneously offering a non- material ontology to issues of nature. Thus ecomodernism serves asymmetrical relations of power whereby, as a polysemic policy discourse, it serves the material interests of those who have the power to impose abstract interpretations on the materiality of actual phenomena. The research of this dissertation is conducted by the critical evaluation of the empirical data from two exemplary Irish case studies. Discovery of the causal processes of the various public issues in the case studies and thereafter the revelation of the meaning structures under- pinning such causal processes, is a theoretically- driven task requiring analysis of those social practices found in the cognitive, cultural and structural constitutions respectively of actors, mediations and systems.Therefore, the imminent critique of the case study paradigms serves as a research strategy for comprehending Ireland’s nature- society relations as influenced essentially by a systems (techno- corporatist) ecomodernist discourse. Moreover, the deconstruction of this systems ideological discourse serves not only to demonstrate how weak ecomodernism practically undermines its declared ecological objectives, but also indicates how such objectives intervene as systemic contradictions at the cultural heart of Ireland’s late modernisation.

This paper builds on Ferguson's important contribution to the debate on personalization in social work that appeared in the British Journal of Social Work in 2007. Whereas Ferguson approached the topic through the lens of political philosophy, the account below draws on critical social theory to examine not only the nature of personalization, but also its supportive pillar of individualization. In particular, Axel Honneth's critique of individualization in modern society is presented before setting out his ideas on the need for self-realization through inter-subjective recognition. The implications of Honneth's position are then considered in terms of four interrelated dimensions of social work practice, namely: (i) social work as symbolic interaction; (ii) social work as care; (iii) social work as respect; and (iv) social work as validation. It is argued that this constellation of practices poses a direct and necessary challenge to a social work of personalization.

Summary: This article outlines a framework for approaching ethical dilemmas arising from the development, evaluation and implementation of child welfare policies. As such, it is relevant to policy-makers, social researchers and social workers. The central tenets of the framework are developed by drawing on ideas from moral philosophy and critical social theory. These ideas are presented as axioms, theorems and corollaries, a format which has been employed in the social sciences to offer a rational justification for a set of claims. • Findings: This process of reasoning leads to four principle axioms that are seen to shape the ethical scrutiny of social policy: 1) problematizing knowledge; 2) utilizing structured forms of inquiry to enhance understanding; 3) engendering enabling communication with those affected by the ethical concern; and 4) enhancing self-awareness. • Applications: The four axioms are then applied, by way of example, to the current and contentious, 'third way' policy of mandated prevention in child welfare, where the aim is to obviate deleterious outcomes in later life. It is argued that the framework can be applied beyond this specific concern to other pressing, ethical challenges in child welfare.

While substantive EU non-discrimination law has been harmonized in great detail, the enforcement regime for EU non-discrimination law consists merely of a few isolated elements. Thus, the pursuit of unity through harmonization in substantive EU law is accompanied by considerable regulatory autonomy for Member States in securing the efficiency of those laws, reflecting the diversity of national enforcement regimes, and resulting in twenty-seven different national models for enforcing discrimination law in labour markets. This article pursues two connected arguments through a comparison of rules for enforcing non-discrimination law in labour markets in Britain and Italy. First, it argues that enforcing non-discrimination law in labour markets is best achieved when responsive governance, repressive regulation and mainstreaming equality law are combined. Second, the article submits that diversity of national legal orders within the EU is not necessarily detrimental, as it offers opportunities for mutual learning across legal systems.The notion of mutual learning across systems is proposed in order to analyse the transnational migration of legal ideas within the EU. Such migration has been criticized in debates about the ‘transplantation’ of legal concepts or legal irritation through foreign legal ideas, in particular by comparative labour lawyers. However, EU harmonization policies in the field of non-discrimination law aim to impact on national labour laws. The article develops the notion of mutual learning across legal systems in order to establish conditions for transnational migration of legal ideas, and demonstrates the viability of these concepts by applying them to the field of non-discrimination law

Esta dissertação estuda essencialmente dois problemas: (A) uma classe de equações unidimensionais de reacção-difusão-convecção em meios não uniformes (dependentes do espaço), e (B) um problema elíptico não-linear e paramétrico ligado a fenómenos de capilaridade. A Análise de Perturbação Singular e a dinâmica de Hamilton-Jacobi são utilizadas na obtenção de expressões assimptóticas para a solução (com comportamento de frente) e para a sua velocidade de propagação. Os seguintes três métodos de decomposição, Adomian Decomposition Method (ADM), Decomposition Method based on Infinite Products (DIP), e New Iterative Method (NIM), são apresentados e brevemente comparados. Adicionalmente, condições suficientes para a convergência da solução em série, obtida pelo ADM, e uma aplicação a um problema da Telecomunicações por Fibras Ópticas, envolvendo EDOs não-lineares designadas equações de Raman, são discutidas. Um ponto de vista mais abrangente que unifica os métodos de decomposição referidos é também apresentado. Para subclasses desta EDP são obtidas soluções numa forma explícita, para diferentes tipos de dados e usando uma variante do método de simetrias de Bluman-Cole. Usando Teoria de Pontos Críticos (o teorema usualmente designado mountain pass) e técnicas de truncatura, prova-se a existência de duas soluções não triviais (uma positiva e uma negativa) para o problema elíptico não-linear e paramétrico (B). A existência de uma terceira solução não trivial é demonstrada usando Grupos Críticos e Teoria de Morse.

Esta dissertação estuda em detalhe três problemas elípticos: (I) uma classe de equações que envolve o operador Laplaciano, um termo singular e nãolinearidade com o exponente crítico de Sobolev, (II) uma classe de equações com singularidade dupla, o expoente crítico de Hardy-Sobolev e um termo côncavo e (III) uma classe de equações em forma divergente, que envolve um termo singular, um operador do tipo Leray-Lions, e uma função definida nos espaços de Lorentz. As não-linearidades consideradas nos problemas (I) e (II), apresentam dificuldades adicionais, tais como uma singularidade forte no ponto zero (de modo que um "blow-up" pode ocorrer) e a falta de compacidade, devido à presença do exponente crítico de Sobolev (problema (I)) e Hardy-Sobolev (problema (II)). Pela singularidade existente no problema (III), a definição padrão de solução fraca pode não fazer sentido, por isso, é introduzida uma noção especial de solução fraca em subconjuntos abertos do domínio. Métodos variacionais e técnicas da Teoria de Pontos Críticos são usados para provar a existência de soluções nos dois primeiros problemas. No problema (I), são usadas uma combinação adequada de técnicas de Nehari, o princípio variacional de Ekeland, métodos de minimax, um argumento de translação e estimativas integrais do nível de energia. Neste caso, demonstramos a existência de (pelo menos) quatro soluções não triviais onde pelo menos uma delas muda de sinal. No problema (II), usando o método de concentração de compacidade e o teorema de passagem de montanha, demostramos a existência de pelo menos duas soluções positivas e pelo menos um par de soluções com mudança de sinal. A abordagem do problema (III) combina um resultado de surjectividade para operadores monótonos, coercivos e radialmente contínuos com propriedades especiais do operador de tipo Leray- Lions. Demonstramos assim a existência de pelo menos, uma solução no espaço de Lorentz e obtemos uma estimativa para esta solução.

Les travaux de l’actuel directeur de l’Institut de recherches sociales (Institut für Sozialforschung (IfS) de Francfort et les commentaires qu’ils se sont attirés posent la question des conditions de possibilité d’une étude scientifique de la vie institutionnelle du principe d’égalité juridique qui comprenne celui-ci comme une composante essentielle de l’infrastructure morale de la société moderne et qui, de cette vie, permette de diagnostiquer les pathologies ainsi que d’indiquer les forces actives de développement. Ce projet de sociologie juridique critique suppose un concept de droit qui dépasse l’opposition traditionnelle, du moins depuis plus de deux siècles, entre positivisme juridique et jusnaturalisme. Par son truchement, un tel concept de droit se présente comme une contribution de la Théorie critique de la société (ci-après « TCS »). Nous verrons cependant que, en raison de l’état d’avancement actuel du projet honnéthien de sociologie critique, la dimension proprement sociologique du présent dossier était limitée d’emblée.

In this article, I deal with airs and sounds and scents, while keeping an eye on the law. My field of enquiry is the interstitial area between sensory and affective occurrences, namely sensory experiences that are traditionally thought to be a causal result of external stimuli, and affective experiences that are mostly associated with emotional changes and generally allude to something internal. I am arguing that there is no constructive difference between internal and external origin of occurrences. In its stead, I suggest the concept of atmosphere, namely an attempt at understanding affective occurrences as excessive, collective, spatial and elemental. However, it quickly becomes apparent that an atmosphere is legally determined. The law controls affective occurrences by regulating property of sensory stimulation. At the same time, the law guides bodies into corridors of sensory compulsion – an aspect of which is consumerism in capitalist societies. The law achieves this by allowing certain sensory options to come forth while suppressing others, something which is particularly obvious in cases of intellectual property protection that capture the sensorial. I deal with the law in its material, spatial manifestation and in particular through what I have called the ‘lawscape’, namely the fusion of space and normativity. I employ a broadly Deleuzian methodology with insights from radical geography, affective studies, and urban and critical legal theory in order to develop and link the various parts of the text.

Cécile Laborde a développé le projet d’un républicanisme critique reposant sur un dialogue entre théorie républicaine normative et théorie sociale critique. Nous proposons ici une présentation et une discussion des principales orientations de ce projet.
