Los jóvenes no cualificados, que participan en los dispositivos educativos de segunda oportunidad, recorren itinerarios de transición al mercado laboral cada vez más complejos. Por lo que conocer sus expectativas y su capacidad de agencia resulta ineludible para mejorar nuestro acompañamiento como profesionales de la intervención sociolaboral. En este artículo exploramos la adaptación de esos jóvenes a una exigencia creciente de cualificación, que los está excluyendo laboralmente. Frente a este proceso, observamos que contraponen una resistencia basada en su capital simbólico, a través de la afectividad y la estética. Nuestro interés por estas respuestas nace de la desorientación percibida entre los profesionales de los programas educativos. Incapaces de comprender las trayectorias divergentes que estos jóvenes plantean, ante los itinerarios homogéneos que se les ofrecen para su inserción social. Tras el análisis de las creaciones artísticas y estéticas de los adolescentes, intuimos que hay dos factores que activan su resistencia a las limitaciones de sus expectativas de éxito. Por un lado, una variable institucional, que apunta a una deficiente planificación de los itinerarios formativos, que los jóvenes perciben que les aboca a la infracualificación y a un mercado laboral precario e inestable. Y por otro lado, una resistencia a la exclusión, que se enraíza en un imaginario de éxito y de movilidad social propio de una juventud globalizada.

The developing intersection between the law of negligence and sports coaching in the UK provides a profoundly distinctive context, as compared to that of the more traditional learned professions, in which to critically examine the issue of professional liability. More specifically, detailed consideration of the Bolam test in the context of sports coaching, where the majority of coaches are volunteers, reinforces the Bolam doctrine as a control mechanism designed to protect both claimants and defendants alike. Importantly, a fuller analysis of related jurisprudence, even in instances where defendant coaches lack a formal qualification, and/or may not have engaged in considered and reasoned decision-making, reveals the potential for the Bolam test to operate as a quasi-defence, thereby safeguarding coaches from negligence liability. Nonetheless, in discharging this heightened standard of care incumbent upon them, coaches must ensure that the coaching practices adopted are regular, approved, and capable of withstanding robust and logical scrutiny. Ultimately, this article’s analysis of the principles of professional liability, in the specific circumstances of sports coaching, should prove to be of appreciably wider interest and utility for practitioners specialising in personal injury law.

Many engineers currently in professional practice will have gained a degree level qualification which involved studying a curriculum heavy with mathematics and engineering science. While this knowledge is vital to the engineering design process so also is manufacturing knowledge, if the resulting designs are to be both technically and commercially viable.
The methodology advanced by the CDIO Initiative aims to improve engineering education by teaching in the context of Conceiving, Designing, Implementing and Operating products, processes or systems. A key element of this approach is the use of Design-Built-Test (DBT) projects as the core of an integrated curriculum. This approach facilitates the development of professional skills as well as the application of technical knowledge and skills developed in other parts of the degree programme. This approach also changes the role of lecturer to that of facilitator / coach in an active learning environment in which students gain concrete experiences that support their development.
The case study herein describes Mechanical Engineering undergraduate student involvement in the manufacture and assembly of concept and functional prototypes of a folding bicycle.

Within the UK the quality of care delivered in some hospitals, nursing homes and caring facilities has been the subject of significant enquiry, challenge and concern in recent years. There was need for a change in the culture of patient and client care. Traditionally a change in culture is seen as moving from an organisational head through to the organisation and in this case through to front-line care. This hasn’t necessarily achieved the desired effect and impact in terms of quality of care within the UK. Historically, certainly nurses have acted more as recipients of change, rather than agents of change
This paper suggests that schools of nursing and medicine with robust core values and a more consistently enacted culture of care, are better able and more likely to transfer this to nursing and medical students within their professional socialisation. In addition, and rather than the newly qualified nurse or doctor being absorbed into existing cultures of care delivery (which are not necessarily always reflecting high qualities of care), schools of nursing and medicine could better facilitate the development of more `agency’ within students and better equipping the students on qualification and stepping into practice, with a role and function as potential agents of change. Effective leadership within schools of nursing and medicine can both translate to quality and consistency, and enactment of organisational core values and working culture. The working culture of schools is intrinsic to developing students as agents of change

Enfoca a educação continuada e a sua relação com a formação profissional do bibliotecário. Seu objetivo é refletir como integrar a capacitação contínua à formação desse profissional no contexto brasileiro. Pois, aspectos de ordem teórico-práticos apontam para a necessidade de maior incorporação de procedimentos metodológicos no fazer bibliotecário. Isto se dá em função de que as operações empíricas têm se tornado insuficientes para garantir a qualidade da informação gerada no âmbito de sistemas de informação. Assim, com base em ações-reflexões a partir desse contexto, identificou-se que necessário se faz adotar programas que possibilitem a capacitação desse profissional na formação-em-serviço, para melhor qualificar o processo de geração, transferência e uso da informação________________________________________________________________________________ABSTRACT Focus the continuous education and its relation with the professional formation of the librarian. The development of broadband Internet connections has fostered new audiovisual media services and opened new possibilities for accessing broadcasts. The Internet retransmission case of TVCatchup before the CJEU was the first case concerning new technologies in the light of Art. 3.1. of the Information Society Directive. On the other side of the Atlantic the Aereo case reached the U.S. Supreme Court and challenged the interpretation of public performance rights. In both cases the recipients of the services could receive broadcast programs in a way alternative to traditional broadcasting channels including terrestrial broadcasting or cable transmission. The Aereo case raised the debate on the possible impact of the interpretation of copyright law in the context of the development of new technologies, particularly cloud based services. It is interesting to see whether any similar problems occur in the EU. The „umbrella” in the title refers to Art. 8 WCT, which covers digital and Internet transmission and constitutes the backrgound for the EU and the U.S. legal solutions. The article argues that no international standard for qualification of the discussed services exists.

A literatura realça a importância do impacto do comportamento parental no desenvolvimento de ansiedade em crianças e adolescentes. Dado a pertinência do tema, o foco do presente estudo visa analisar o papel que a perceção dos adolescentes sobre os estilos educativos parentais tem sobre a manifestação de sintomatologia ansiosa. A amostra desta investigação envolveu 136 adolescentes do 3º ciclo do ensino básico, 48 rapazes e 88 raparigas com idades compreendidas entre os 12 e os 15 anos, com uma média de idades de 13,2 anos, recolhida no Colégio São Martinho em Coimbra. O protocolo de investigação incluiu os seguintes instrumentos de colheita de dados: Questionário Sociodemográfico, State-Trait Anxiety Inventory for Children (STAIC) e EMBU-A. Os resultados do estudo sugerem que os adolescentes mais velhos manifestam maior sintomatologia ansiosa, estatisticamente significativa ao nível da ansiedade-estado. No que respeita ao desempenho académico, são os adolescentes com elevado insucesso escolar que exteriorizam mais ansiedade-traço. Porém, não foram encontradas diferenças significativas na manifestação da ansiedade dos adolescentes em função das variáveis género, posição na fratria e habilitações literárias dos pais. Por seu lado, em relação aos estilos educativos parentais, os jovens que têm maior insucesso escolar percecionam níveis elevados de sobreproteção da mãe, e de rejeição do pai e da mãe. Os adolescentes que têm um pai com mais baixo nível de escolaridade percecionam maior rejeição materna, e são os filhos de mães com menos habilitações literárias que sentem maior sobreproteção da mãe e rejeição do pai. Verificou-se, em particular, uma associação significativa entre a rejeição paterna e níveis mais elevados de sintomatologia ansiosa. O modelo preditivo avançado no estudo confirma que a rejeição paterna, em conjunto com a idade do adolescente, são bons preditores da sintomatologia ansiosa. Especificamente, a rejeição paterna é evidenciada como o melhor preditor da sintomatologia ansiosa, sendo o principal responsável pela manifestação de ansiedade nos adolescentes. Os resultados sugerem que a rejeição do pai desencadeia níveis elevados de sintomatologia ansiosa. Assim, este estudo permite concluir que a rejeição paterna é o estilo educativo parental que exerce maior influência na manifestação de ansiedade nos adolescentes. / The literature highlights the importance of the impact of parental behavior on the development of anxiety in children and adolescents. Given the relevance of the topic, the focus of this study is to analyze the role that the adolescents’ perception about parental rearing styles have on the manifestation of anxiety symptoms. The sample of this research involved 136 adolescents from the 3rd cycle of basic education, 48 boys and 88 girls aged between 12 and 15 years, with a mean age of 13,2 years, gathered in Colégio São Martinho in Coimbra. The investigation protocol included the following data collection instruments: Sociodemographic Questionnaire, State-Trait Anxiety Inventory for Children (STAIC) and the EMBU-A. The results of the study suggest that older adolescents show greater anxiety symptoms, statistically significant at the level of state anxiety. With regard to academic performance, are adolescents with high failure rates that externalize more trait anxiety. However, there were significant differences in the manifestation of anxiety in adolescents function of the variables gender, sibling position and educational background of the parents. For its part, in relation to parental rearing styles, young people who have higher academic failure perceive high levels of overprotection of the mother, and rejection of father and mother. Adolescents who have a father with the lowest educational level perceive greater maternal rejection, and are the children of mothers with less qualification who feel greater overprotection of the mother and father's rejection. There was, in particular, a significant association between paternal rejection and higher levels of anxiety symptoms. The predictive model advanced in the study confirms that parental rejection, together with the adolescents’ age, are good predictors of anxiety symptoms. Specifically, parental rejection is evidenced as the best predictor of anxiety symptoms, being primarily responsible for the manifestation of anxiety in adolescents. The results suggest that the father rejection triggers high levels of anxiety symptoms. Thus, this study shows that rejection is the paternal parental rearing style that has more influence on the manifestation of anxiety in adolescents.

In the last twenty years aerospace and automotive industries started working widely with composite materials, which are not easy to test using classic Non-Destructive Inspection (NDI) techniques. Pairwise, the development of safety regulations sets higher and higher standards for the qualification and certification of those materials. In this thesis a new concept of a Non-Destructive defect detection technique is proposed, based on Ultrawide-Band (UWB) Synthetic Aperture Radar (SAR) imaging. Similar SAR methods are yet applied either in minefield [22] and head stroke [14] detection. Moreover feasibility studies have already demonstrated the validity of defect detection by means of UWB radars [12, 13]. The system was designed using a cheap commercial off-the-shelf radar device by Novelda and several tests of the developed system have been performed both on metallic specimen (aluminum plate) and on composite coupon (carbon fiber). The obtained results confirm the feasibility of the method and highlight the good performance of the developed system considered the radar resolution. In particular, the system is capable of discerning healthy coupons from damaged ones, and correctly reconstruct the reflectivity image of the tested defects, namely a 8 x 8 mm square bulge and a 5 mm drilled holes on metal specimen and a 5 mm drilled hole on composite coupon.

The construction industry is responsible for 40% of European Union (EU) end-use emissions but addressing this is problematic, as evident from the performance gap between design intention and on-site energy performance. There is a lack of the expertise needed for low energy construction (LEC) in the UK as the complex work processes involved require ‘energy literacy’ of all construction occupations, high qualification levels, broad occupational profiles, integrated teamworking, and good communication . This research identifies the obstacles to meeting these requirements, the nature of the expertise needed to break down occupational divisions and bridge those interfaces where the main heat losses occur, and the transition pathway implied. Obstacles include a decline in the level, breadth and quality of construction vocational education and training (VET), the lack of a learning infrastructure on sites, and a fragmented employment structure. To overcome these and develop enhanced understanding of LEC requires a transformation of the existing structure of VET provision and construction employment and a new curriculum based on a broader concept of agency and backed by rigorous enforcement of standards. This can be achieved through a radical transition pathway rather than market-based solutions to a low carbon future for the construction sector.

En 1994, le législateur québécois a transformé la fiducie en un patrimoine d’affectation, c’est-à-dire un ensemble de biens et d’obligations sans titulaire, administré par un tiers, pour une fin particulière. Cette nouvelle qualification remet en question l’assise classique du droit privé : le rapport inhérent entre un droit et son titulaire, le sujet de droit, dont le droit émane et pour qui il est, en principe, exercé. Cette thèse tente de comprendre quelles sont les conditions de possibilités des droits sans sujet en droit civil actuel. Mon objectif est de repenser la notion de droit subjectif de manière générale afin qu’elle prenne en considération l’existence et la pertinence de ces droits sans sujet. Pour ce faire, deux entreprises sont nécessaires : (i) comprendre le paradigme dominant afin de bien cerner l’ampleur de la nouveauté et la résistance qu’elle engendre ; (ii) mettre au jour les fondements et les limites des droits sans sujet afin d’évaluer, dans une prochaine étape, si cette manière de comprendre les droits ne serait pas une alternative intéressante aux droits subjectifs actuels.

Professional Practice in Learning and Development: How to Design and Deliver Plans for the Workplace

Introduction The world is changing! It is volatile, uncertain, complex and ambiguous. As cliché as it may sound the evidence of such dynamism in the external environment is growing. Business-as-usual is more of the exception than the norm. Organizational change is the rule; be it to accommodate and adapt to change, or instigate and lead change. A constantly changing environment is a situation that all organizations have to live with. What makes some organizations however, able to thrive better than others? Many scholars and practitioners believe that this is due to the ability to learn. Therefore, this book on developing Learning and Development (L&D) professionals is timely as it explores and discusses trends and practices that impact organizations, the workforce and L&D professionals. Being able to learn and develop effectively is the cornerstone of motivation as it helps to address people’s need to be competent and to be autonomous (Deci & Ryan, 2002; Loon & Casimir, 2008; Ryan & Deci, 2000). L&D stimulates and empowers people to perform. Organizations that are better at learning at all levels; the individual, group and organizational level, will always have a better chance of surviving and performing. Given the new reality of a dynamic external environment and constant change, L&D professionals now play an even more important role in their organizations than ever before. However, L&D professionals themselves are not immune to the turbulent changes as their practices are also impacted. Therefore, the challenges that L&D professionals face are two-pronged. Firstly, in relation to helping and supporting their organization and its workforce in adapting to the change, whilst, secondly developing themselves effectively and efficiently so that they are able to be one-step ahead of the workforce that they are meant to help develop. These challenges are recognised by the CIPD, as they recently launched their new L&D qualification that has served as an inspiration for this book. L&D plays a crucial role at both strategic (e.g. organizational capability) and operational (e.g. delivery of training) levels. L&D professionals have moved from being reactive (e.g. following up action after performance appraisals) to being more proactive (e.g. shaping capability). L&D is increasingly viewed as a driver for organizational performance. The CIPD (2014) suggest that L&D is increasingly expected to not only take more responsibility but also accountability for building both individual and organizational knowledge and capability, and to nurture an organizational culture that prizes learning and development. This book is for L&D professionals. Nonetheless, it is also suited for those studying Human Resource Development HRD at intermediate level. The term ‘Human Resource Development’ (HRD) is more common in academia, and is largely synonymous with L&D (Stewart & Sambrook, 2012) Stewart (1998) defined HRD as ‘the practice of HRD is constituted by the deliberate, purposive and active interventions in the natural learning process. Such interventions can take many forms, most capable of categorising as education or training or development’ (p. 9). In fact, many parts of this book (e.g. Chapters 5 and 7) are appropriate for anyone who is involved in training and development. This may include a variety of individuals within the L&D community, such as line managers, professional trainers, training solutions vendors, instructional designers, external consultants and mentors (Mayo, 2004). The CIPD (2014) goes further as they argue that the role of L&D is broad and plays a significant role in Organizational Development (OD) and Talent Management (TM), as well as in Human Resource Management (HRM) in general. OD, TM, HRM and L&D are symbiotic in enabling the ‘people management function’ to provide organizations with the capabilities that they need.
