Considérant la « nouveauté » du phénomène de dénonciation auprès des policiers et l’utilisation croissante du concept social de « crime motivé par la haine », peu d’études ont été réalisées au Canada sur l’incidence de ces crimes pour les personnes comme pour la société. Cette recherche exploratoire a comme objectif de comprendre la façon dont ce type de crime se distingue des autres manifestations de conflits ou d’incidents et de comprendre les impacts de ce type de victimisation pour les homosexuels en particulier. Plus spécifiquement, ce mémoire vise à approfondir la compréhension du stigmate homosexuel et son impact sur la reportabilité des événements de victimisation criminelle aux autorités judiciaires. Pour ce faire, cinq intervenants communautaires, deux policiers, un avocat et quatre victimes considérant avoir vécu des événements de violence homophobe ont été interviewés. Cet échantillon diversifié a permis de mieux comprendre le phénomène de sous-déclaration des incidents de violences homophobes de la part des victimes et d’obtenir une vue d’ensemble des perceptions des acteurs clés qui peuvent être confrontés au phénomène. L’analyse des entretiens suggère d’importantes lacunes sur le plan de la formation des divers intervenants qui entrainent des difficultés à reconnaître une violence homophobe. Les intervenants confient ne pas se sentir pas suffisamment outillés pour intervenir auprès d’une victime de violence homophobe, n’estiment pas tous posséder les compétences et une compréhension suffisante des réalités des minorités sexuelles, de l'homophobie et de l'hétérosexisme, en somme, l’ensemble des savoirs ultimement nécessaires à une assistance et un accompagnement efficaces pour la déclaration aux autorités d’une telle violence vécue par les victimes. Du côté des victimes de violence(s) homophobe(s), il ressort que la discrimination basée sur l’orientation sexuelle est encore prégnante dans leurs interactions quotidiennes. De leur point de vue, la banalisation et l’impunité de certains comportements homophobes par les instances judiciaires viennent renforcer l’idée chez les victimes et la société d’une forme d’infériorité de l’orientation homosexuelle. L’apposition d’une étiquette homosexuelle paraît ainsi avoir de multiples conséquences psychologiques et sociales sur les victimes, notamment sur leur développement identitaire et sexuel. L’intégration des stigmates homosexuels et l’autostigmatisation, qui les poussent à se déprécier, voire à déprécier l’ensemble de la communauté homosexuelle, surgissent de leur perception de la présence de forts stéréotypes homosexuels, d’une société majoritairement hétérosexiste et de l’opérationnalisation sociale d’une distanciation entre le « nous » hétérosexuel et le « eux » homosexuel. Par leur marginalisation, leur mise en infériorité historique, l’ambiguïté du concept de « crimes motivés par la haine », la noncompréhension de la violence et des répercussions qu’ont les intervenants communautaires et judiciaires de la situation et partant, dans bien des cas, de la prise en charge inadéquate qui en découle pour les victimes des violences homophobes, il est possible de comprendre les appréhensions mentales que les victimes entretiennent ainsi que leur réticence à solliciter de l’aide et encore plus à rapporter la victimisation vécue aux autorités judiciaires.

A fraude e evasão fiscal são realidades cada vez mais presentes no quotidiano nacional. Não raras vezes, somos bombardeados por notícias, que nos dão conta de suspeita da prática de crimes de natureza fiscal, perpetuados por indivíduos com cargos importantes, e influência no panorama nacional, causando grandes danos para os cofres do Estado. Por esse motivo, o legislador tem adotado uma postura mais interventiva, no sentido de punir mais severamente os agentes que praticam este tipo de crimes. Assim, temos assistido à criminalização e à responsabilização dos agentes que praticam este tipo de criminalidade. Paralelamente a responsabilização dos agentes, temos a responsabilização das sociedades, contudo tal como veremos ao longo da dissertação, esta realidade é bastante recente entre nós. De facto, o código penal anterior à versão introduzida pela lei n.º 59/2007, de 4 de setembro, não responsabilizavam penalmente e diretamente as sociedades, admitindo-se apenas, a sua responsabilização de forma estritamente excecional. Contudo, e tal como veremos, o nosso ordenamento jurídico já prevê que haja responsabilidade penal, fiscal e civil das sociedades e dos seus administradores. Nesse sentido, faremos todo o enquadramento legal da responsabilidade penal, fiscal e civil das sociedades e dos seus administradores, e de que modo é que ela opera. No final da exposição acerca do regime geral da responsabilidade, faremos uma pequena análise e enquadramento ao concreto caso do BES, na exata medida em que, estamos perante um caso em que existem fortes suspeitas da existência de crimes tributários fiscais levados a cabo por administradores daquela sociedade anónima que causaram elevado prejuízos para o banco levando o mesmo à falência.

O objetivo deste trabalho foi apresentar os aspectos metodológicos do monitoramento fenológico de uma área de Caatinga preservada por meio de câmeras digitais, exemplificando sua aplicação para um dia na estação chuvosa e outro na estação seca. Para isso, foram descritas todas as etapas envolvidas na obtenção e processamento das imagens digitais diárias de uma área de Caatinga preservada, incluindo os índices %R (vermelho), %G (verde), %B (azul) e excG (excesso de verde). As imagens dos dias 10/05/2015 e 15/09/2015 foram usadas para representar o período com e sem folhas, respectivamente. Para estas datas, os valores médios dos índices foram: %R = 0,3326, %G = 0,3514, %B = 0,3124, excG = 13,7139 para o dia 10/05; e %R = 0,3465, %G = 0,3411, %B = 0,3125, excG = 7,4177 para 15/09. Esta metodologia envolvendo o monitoramento constante desse tipo de vegetação, por meio de fotografias digitais repetidas, é capaz de detectar as mudanças nos padrões de verde no dossel, principalmente por meio do índice excG.

The analysis and value of digital evidence in an investigation has been the domain of discourse in the digital forensic community for several years. While many works have considered different approaches to model digital evidence, a comprehensive understanding of the process of merging different evidence items recovered during a forensic analysis is still a distant dream. With the advent of modern technologies, pro-active measures are integral to keeping abreast of all forms of cyber crimes and attacks. This paper motivates the need to formalize the process of analyzing digital evidence from multiple sources simultaneously. In this paper, we present the forensic integration architecture (FIA) which provides a framework for abstracting the evidence source and storage format information from digital evidence and explores the concept of integrating evidence information from multiple sources. The FIA architecture identifies evidence information from multiple sources that enables an investigator to build theories to reconstruct the past. FIA is hierarchically composed of multiple layers and adopts a technology independent approach. FIA is also open and extensible making it simple to adapt to technological changes. We present a case study using a hypothetical car theft case to demonstrate the concepts and illustrate the value it brings into the field.

This article surveys literature bearing on the issue of parental liability and responsibility for the crimes of young offenders, with a particular focus on comparing different approaches to dealing with the issue in Australia and Canada. This comparative analysis of Australian and Canadian legislative and policy approaches is situated within a broader discussion of arguments about the “punitive turn” in youth justice, responsibilisation, and cross-jurisdictional criminal justice policy transfer and convergence. Our findings suggest that there are significant differences in the manner and extent to which Australia and Canada have invoked parental responsibility laws and policies as part of the solution to dealing with youth crime. We conclude by speculating on some of the reasons for these differences and establishing an agenda for additional needed cross-jurisdictional research. In particular, we argue that it would be fruitful to undertake a cross-jurisdictional study that examines the development and effects of parental responsibility laws across a larger number of different Western countries as well as across individual states and provinces within these national jurisdictions.

The linguistics of violence in film and on television is a hotly debated topic, especially whenever outrageously violent crimes are committed in the community. The debate tends to proceed thus: was the perpetrator addicted to watching violent films and videos, and if so, did the language of mediated violence translate into the language of everyday action, blurring the boundaries between fantasy and reality? The cause—effect relationship between fantasies enacted on screen and horrific real-life crimes has never been proven scientifically, despite endless governmental inquiries and many attempts by academics to discover a causation formula. I will not be looking so much at the vexed question of the relationship between stylized violence on celluloid and real violence in a community. Rather, I wish to explore the nature of a particular form of mediated, gendered violence through an analysis of the language of several key films made in the past decade focusing on the violent crime of rape: Hollywood films The Accused (1988), Casualties of War (1989), Thelma and Louise (1991), Strange Days (1996), and the Australian films Shame (1988) and The Boys (1998). In this way, I wish to show how rape is depicted linguistically in film, and how such films may actually give solutions to this abhorrent kind of violence rather than thrill the viewer vicariously, or, in a worst case scenario, stimulate people to further violence.

In this article we survey relevant international literature on the issue of parental liability and responsibility for the crimes of young offenders. In addition, as a starting point for needed cross-jurisdictional research, we focus on different approaches that have been taken to making parents responsible for youth crime in Australia and Canada. This comparative analysis of Australian and Canadian legislative and policy approaches is situated within a broader discussion of arguments about parental responsibility, the ‘punitive turn’ in youth justice, and cross-jurisdictional criminal justice policy transfer and convergence. One unexpected finding of our literature survey is the relatively sparse attention given to the issue of parental responsibility for youth crime in legal and criminological literature compared to the attention it receives in the media and popular-public culture. In Part I we examine the different views that have been articulated in the social science literature for and against parental responsibility laws, along with arguments that have been made about why such laws have been enacted in an increasing number of Western countries in recent years. In Part II, we situate our comparative study of Australian and Canadian legislative and policy approaches within a broader discussion of arguments about the ‘punitive turn’ in youth justice, responsibilisation, and cross-jurisdictional criminal justice policy transfer and convergence. In Part III, we identify and examine the scope of different parental responsibility laws that have been enacted in Australia and Canada; noting significant differences in the manner and extent to which parental responsibility laws and policies have been invoked as part of the solution to dealing with youth crime. In our concluding discussion, in Part IV, we try to speculate on some of the reasons for these differences and set an agenda for needed future research on the topic.

Official rates of female delinquency have been rising steadily in countries such as Australia, England, Canada and the United States since the 1960s. They have also generally been rising at a rate faster than that for boys. As yet there is little consensus about the reasons for these rises or even whether such rate rises reflect any real increase in female delinquency at all. Against this backdrop of rising official crimes rates for young women, this article revisits the various criminological explanations for these trends.

There is a growing sense of crisis in rural ways of life, which manifests itself in economic decline, depopulation, depleted environments, and a crisis of rural identities. Crime is one potent marker of crisis, the more so as it spoils the image of healthy, cohesive community. The social reaction it elicits, the policing of this ‘other rural’, is also a guide to the dimensions of crisis. The social sciences have witnessed a renewed international interest in the study of ‘other rurals’: the neglected, invisible or excluded aspects of country life. This book brings a fresh approach to the study of crime that challenges the urban-centric assumptions of much western criminology and sociology. It explores rural crime and social reactions to it, in relation to processes and patterns of community formation and change in rural Australia, including the social, economic, cultural and political forces shaping the history, structure and everyday life of rural communities. Policing the Rural Crisis is based on five years of extensive original empirical research in rural and regional Australia. It draws on ideas and debates in contemporary social theory across several disciplines, making the analysis relevant to the study of crime and social change elsewhere.

The Australian report for the Global Media Monitoring Project 2010 (GMMP 2010) involved a study of 374 stories that were sampled from 26 Australian newspapers, radio and television stations, and internet news services on 10 November 2009. This snapshot of reporting on that day suggests that women are under-represented in the Australian news media as both the sources and creators of news. Females made up only 24% of the 1012 news sources who were heard, read about or seen in the stories that were studied. Neglect of female sources was particularly noticeable in sports news. Women made up only 1% of the 142 sources who were talked about or quoted in sports stories. Female sources of news were disproportionately portrayed as celebrities and victims. Although women made up only 24% of sources overall, they comprised 44% of victims of crimes, accidents, war, health problems, or discrimination. Unsurprisingly, women made up 32% of sources in stories about violent crimes and 29% in stories about disasters, accidents or emergencies – usually in the role of victim. Females were commonly defined in terms of their status as a mother, daughter, wife, sister or other family relationship. Family status was mentioned for 33% of women quoted or discussed in the news stories compared to only 13% of male sources. Women also made up 75% of sources described as homemakers or parents. The Australian GMMP 2010 study also indicates a gender division among the journalists who wrote or presented the news. Only 32% of the stories were written or presented by female reporters and newsreaders. The gender inequality was again most evident in sports journalism.
