Underspanned suspension bridges are structures with important economical and aesthetic advantages, due to their high structural efficiency. However, road bridges of this typology are still uncommon because of limited knowledge about this structural system. In particular, there remains some uncertainty over the dynamic behaviour of these bridges, due to their extreme lightness. The vibrations produced by vehicles crossing the viaduct are one of the main concerns. In this work, traffic-induced dynamic effects on this kind of viaduct are addressed by means of vehicle-bridge dynamic interaction models. A finite element method is used for the structure, and multibody dynamic models for the vehicles, while interaction is represented by means of the penalty method. Road roughness is included in this model in such a way that the fact that profiles under left and right tyres are different, but not independent, is taken into account. In addition, free software {PRPgenerator) to generate these profiles is presented in this paper. The structural dynamic sensitivity of underspanned suspension bridges was found to be considerable, as well as the dynamic amplification factors and deck accelerations. It was also found that vehicle speed has a relevant influence on the results. In addition, the impact of bridge deformation on vehicle vibration was addressed, and the effect on the comfort of vehicle users was shown to be negligible.

We propose a new algorithm for the design of prediction structures with low delay and limited penalty in the rate-distortion performance for multiview video coding schemes. This algorithm constitutes one of the elements of a framework for the analysis and optimization of delay in multiview coding schemes that is based in graph theory. The objective of the algorithm is to find the best combination of prediction dependencies to prune from a multiview prediction structure, given a number of cuts. Taking into account the properties of the graph-based analysis of the encoding delay, the algorithm is able to find the best prediction dependencies to eliminate from an original prediction structure, while limiting the number of cut combinations to evaluate. We show that this algorithm obtains optimum results in the reduction of the encoding latency with a lower computational complexity than exhaustive search alternatives.

Optical filters are crucial elements in optical communications. The influence of cascaded filters in the optical signal will affect the communications quality seriously. In this paper we will study and simulate the optical signal impairment caused by different kinds of filters which include Butterworth, Bessel, Fiber Bragg Grating (FBG) and Fabry-Perot (FP). Optical signal impairment is analyzed from an Eye Opening Penalty (EOP) and optical spectrum point of view. The simulation results show that when the center frequency of all filters aligns with the laser’s frequency, the Butterworth has the smallest influence to the signal while the F-P has the biggest. With a -1dB EOP, the amount of cascaded Butterworth optical filters with a bandwidth of 50 GHz is 18 in 40 Gbps NRZ-DQPSK systems and 12 in 100 Gbps PMNRZ- DQPSK systems. The value is reduced to 9 and 6 respectively for Febry-Perot optical filters. In the situation of frequency misalignment, the impairment caused by filters is more serious. Our research shows that with a frequency deviation of 5 GHz, only 12 and 9 Butterworth optical filters can be cascaded in 40 Gbps NRZ-DQPSK and 100 Gbps PM-NRZ-DQPSK systems respectively. We also study the signal impairment caused by different orders of the Butterworth filter model. Our study shows that although the higher-order has a smaller clipping effect in the transmission spectrum, it will introduce a more serious phase ripple which seriously affects the signal. Simulation result shows that the 2nd order Butterworth filter has the best performance.

The hot-spot phenomenon is a relatively frequent problem occurring in current photovoltaic generators. It entails both a risk for the photovoltaic module’s lifetime and a decrease in its operational efficiency. Nevertheless, there is still a lack of widely accepted procedures for dealing with them in practice. This paper presents the IES–UPM observations on 200 affected photovoltaic modules. Visual and infrared inspection, as well as electroluminescence, peak power rating and operating voltage tests have been carried out. Thermography under steady state conditions and photovoltaic module operating voltage, both at normal photovoltaic system operating conditions, are the selected methods to deal in practice with hot-spots. The temperature difference between the hot-spot and its surroundings, and the operating voltage differences between affected and non-affected photovoltaic modules are the base for establishing defective criteria, at the lights of both lifetime and operating efficiency considerations. Hot-spots temperature gradients larger than 20 °C, in any case, and larger than 10 °C when, at the same time, voltage operating losses are larger than the allowable power losses fixed at the photovoltaic module warranties, are proposed as rejecting conditions for routine inspections under contractual frameworks. The upper threshold of 20 °C is deduced for temperate climates from the basic criterion of keeping absolute hot-spot temperatures below 20 °C.

Chemical-looping combustion allows an integration of CO2 capture in a thermal power plant without energy penalty; secondly, a less exergy destruction in the combustion chemical transformation is achieved, leading to a greater overall thermal efficiency. This paper focus on the study of the energetic performance of this concept of combustion in an integrated gasification combined cycle power plant when synthesis gas is used as fuel for the gas turbines. After thermodynamic modelling and optimization of some cycle parameters, the power plant performance is evaluated under diverse working conditions and compared to a conventional integrated gasification combined cycle with precombustion capture. Energy savings in CO2 capture and storage has been quantified. The overall efficiency increase is found to be significant and even notable, reaching values of around 7%. In order to analyze the influence of syngas composition on the results, different H2-content fuels are considered.

La combustión mediante lazo químico permite una integración de captura de CO2 en una planta térmica de potencia sin penalización energética. Se alcanza una menor destrucción exergética, alcanzándose un rendimiento térmico idóneo. Este proyecto se centra en el estudio del rendimiento energético en una planta de potencia con gasificación integrada cuando la cámara de combustión de las turbinas de gas se sustituye por un sistema de combustión CLC. Después del diseño termodinámico y optimización de algunos parámetros del ciclo, el rendimiento de la planta de potencia es evaluado bajo distintas condiciones de trabajo y comparado con el que se obtendría en una planta de ciclo combinado convencional con gasificación integrada y captura pre-combustión. La frecuencia con la que se producen explosiones sobre edificios, ya sean accidentales o intencionadas, es reducida, pero sus efectos pueden ser catastróficos. Es deseable poder predecir de forma suficientemente precisa las consecuencias de estas acciones dinámicas sobre edificaciones civiles, entre las cuales las estructuras reticuladas de hormigón armado son una tipología habitual. En esta tesis doctoral se exploran distintas opciones prácticas para el modelado y cálculo numérico por ordenador de estructuras de hormigón armado sometidas a explosiones. Se emplean modelos numéricos de elementos finitos con integración explícita en el tiempo, que demuestran su capacidad efectiva para simular los fenómenos físicos y estructurales de dinámica rápida y altamente no lineales que suceden, pudiendo predecir los daños ocasionados tanto por la propia explosión como por el posible colapso progresivo de la estructura. El trabajo se ha llevado a cabo empleando el código comercial de elementos finitos LS-DYNA (Hallquist, 2006), desarrollando en el mismo distintos tipos de modelos de cálculo que se pueden clasificar en dos tipos principales: 1) modelos basados en elementos finitos de continuo, en los que se discretiza directamente el medio continuo mediante grados de libertad nodales de desplazamientos; 2) modelos basados en elementos finitos estructurales, mediante vigas y láminas, que incluyen hipótesis cinemáticas para elementos lineales o superficiales. Estos modelos se desarrollan y discuten a varios niveles distintos: 1) a nivel del comportamiento de los materiales, 2) a nivel de la respuesta de elementos estructurales tales como columnas, vigas o losas, y 3) a nivel de la respuesta de edificios completos o de partes significativas de los mismos. Se desarrollan modelos de elementos finitos de continuo 3D muy detallados que modelizan el hormigón en masa y el acero de armado de forma segregada. El hormigón se representa con un modelo constitutivo del hormigón CSCM (Murray et al., 2007), que tiene un comportamiento inelástico, con diferente respuesta a tracción y compresión, endurecimiento, daño por fisuración y compresión, y rotura. El acero se representa con un modelo constitutivo elastoplástico bilineal con rotura. Se modeliza la geometría precisa del hormigón mediante elementos finitos de continuo 3D y cada una de las barras de armado mediante elementos finitos tipo viga, con su posición exacta dentro de la masa de hormigón. La malla del modelo se construye mediante la superposición de los elementos de continuo de hormigón y los elementos tipo viga de las armaduras segregadas, que son obligadas a seguir la deformación del sólido en cada punto mediante un algoritmo de penalización, simulando así el comportamiento del hormigón armado. En este trabajo se denominarán a estos modelos simplificadamente como modelos de EF de continuo. Con estos modelos de EF de continuo se analiza la respuesta estructural de elementos constructivos (columnas, losas y pórticos) frente a acciones explosivas. Asimismo se han comparado con resultados experimentales, de ensayos sobre vigas y losas con distintas cargas de explosivo, verificándose una coincidencia aceptable y permitiendo una calibración de los parámetros de cálculo. Sin embargo estos modelos tan detallados no son recomendables para analizar edificios completos, ya que el elevado número de elementos finitos que serían necesarios eleva su coste computacional hasta hacerlos inviables para los recursos de cálculo actuales. Adicionalmente, se desarrollan modelos de elementos finitos estructurales (vigas y láminas) que, con un coste computacional reducido, son capaces de reproducir el comportamiento global de la estructura con una precisión similar. Se modelizan igualmente el hormigón en masa y el acero de armado de forma segregada. El hormigón se representa con el modelo constitutivo del hormigón EC2 (Hallquist et al., 2013), que también presenta un comportamiento inelástico, con diferente respuesta a tracción y compresión, endurecimiento, daño por fisuración y compresión, y rotura, y se usa en elementos finitos tipo lámina. El acero se representa de nuevo con un modelo constitutivo elastoplástico bilineal con rotura, usando elementos finitos tipo viga. Se modeliza una geometría equivalente del hormigón y del armado, y se tiene en cuenta la posición relativa del acero dentro de la masa de hormigón. Las mallas de ambos se unen mediante nodos comunes, produciendo una respuesta conjunta. En este trabajo se denominarán a estos modelos simplificadamente como modelos de EF estructurales. Con estos modelos de EF estructurales se simulan los mismos elementos constructivos que con los modelos de EF de continuo, y comparando sus respuestas estructurales frente a explosión se realiza la calibración de los primeros, de forma que se obtiene un comportamiento estructural similar con un coste computacional reducido. Se comprueba que estos mismos modelos, tanto los modelos de EF de continuo como los modelos de EF estructurales, son precisos también para el análisis del fenómeno de colapso progresivo en una estructura, y que se pueden utilizar para el estudio simultáneo de los daños de una explosión y el posterior colapso. Para ello se incluyen formulaciones que permiten considerar las fuerzas debidas al peso propio, sobrecargas y los contactos de unas partes de la estructura sobre otras. Se validan ambos modelos con un ensayo a escala real en el que un módulo con seis columnas y dos plantas colapsa al eliminar una de sus columnas. El coste computacional del modelo de EF de continuo para la simulación de este ensayo es mucho mayor que el del modelo de EF estructurales, lo cual hace inviable su aplicación en edificios completos, mientras que el modelo de EF estructurales presenta una respuesta global suficientemente precisa con un coste asumible. Por último se utilizan los modelos de EF estructurales para analizar explosiones sobre edificios de varias plantas, y se simulan dos escenarios con cargas explosivas para un edificio completo, con un coste computacional moderado. The frequency of explosions on buildings whether they are intended or accidental is small, but they can have catastrophic effects. Being able to predict in a accurate enough manner the consequences of these dynamic actions on civil buildings, among which frame-type reinforced concrete buildings are a frequent typology is desirable. In this doctoral thesis different practical options for the modeling and computer assisted numerical calculation of reinforced concrete structures submitted to explosions are explored. Numerical finite elements models with explicit time-based integration are employed, demonstrating their effective capacity in the simulation of the occurring fast dynamic and highly nonlinear physical and structural phenomena, allowing to predict the damage caused by the explosion itself as well as by the possible progressive collapse of the structure. The work has been carried out with the commercial finite elements code LS-DYNA (Hallquist, 2006), developing several types of calculation model classified in two main types: 1) Models based in continuum finite elements in which the continuous medium is discretized directly by means of nodal displacement degrees of freedom; 2) Models based on structural finite elements, with beams and shells, including kinematic hypothesis for linear and superficial elements. These models are developed and discussed at different levels: 1) material behaviour, 2) response of structural elements such as columns, beams and slabs, and 3) response of complete buildings or significative parts of them. Very detailed 3D continuum finite element models are developed, modeling mass concrete and reinforcement steel in a segregated manner. Concrete is represented with a constitutive concrete model CSCM (Murray et al., 2007), that has an inelastic behaviour, with different tension and compression response, hardening, cracking and compression damage and failure. The steel is represented with an elastic-plastic bilinear model with failure. The actual geometry of the concrete is modeled with 3D continuum finite elements and every and each of the reinforcing bars with beam-type finite elements, with their exact position in the concrete mass. The mesh of the model is generated by the superposition of the concrete continuum elements and the beam-type elements of the segregated reinforcement, which are made to follow the deformation of the solid in each point by means of a penalty algorithm, reproducing the behaviour of reinforced concrete. In this work these models will be called continuum FE models as a simplification. With these continuum FE models the response of construction elements (columns, slabs and frames) under explosive actions are analysed. They have also been compared with experimental results of tests on beams and slabs with various explosive charges, verifying an acceptable coincidence and allowing a calibration of the calculation parameters. These detailed models are however not advised for the analysis of complete buildings, as the high number of finite elements necessary raises its computational cost, making them unreliable for the current calculation resources. In addition to that, structural finite elements (beams and shells) models are developed, which, while having a reduced computational cost, are able to reproduce the global behaviour of the structure with a similar accuracy. Mass concrete and reinforcing steel are also modeled segregated. Concrete is represented with the concrete constitutive model EC2 (Hallquist et al., 2013), which also presents an inelastic behaviour, with a different tension and compression response, hardening, compression and cracking damage and failure, and is used in shell-type finite elements. Steel is represented once again with an elastic-plastic bilineal with failure constitutive model, using beam-type finite elements. An equivalent geometry of the concrete and the steel is modeled, considering the relative position of the steel inside the concrete mass. The meshes of both sets of elements are bound with common nodes, therefore producing a joint response. These models will be called structural FE models as a simplification. With these structural FE models the same construction elements as with the continuum FE models are simulated, and by comparing their response under explosive actions a calibration of the former is carried out, resulting in a similar response with a reduced computational cost. It is verified that both the continuum FE models and the structural FE models are also accurate for the analysis of the phenomenon of progressive collapse of a structure, and that they can be employed for the simultaneous study of an explosion damage and the resulting collapse. Both models are validated with an experimental full-scale test in which a six column, two floors module collapses after the removal of one of its columns. The computational cost of the continuum FE model for the simulation of this test is a lot higher than that of the structural FE model, making it non-viable for its application to full buildings, while the structural FE model presents a global response accurate enough with an admissible cost. Finally, structural FE models are used to analyze explosions on several story buildings, and two scenarios are simulated with explosive charges for a full building, with a moderate computational cost.

El consumo de combustible en un automóvil es una característica que se intenta mejorar continuamente debido a los precios del carburante y a la creciente conciencia medioambiental. Esta tesis doctoral plantea un algoritmo de optimización del consumo que tiene en cuenta las especificaciones técnicas del vehículo, el perfil de orografía de la carretera y el tráfico presente en ella. El algoritmo de optimización calcula el perfil de velocidad óptima que debe seguir el vehículo para completar un recorrido empleando un tiempo de viaje especificado. El cálculo del perfil de velocidad óptima considera los valores de pendiente de la carretera así como también las condiciones de tráfico vehicular de la franja horaria en que se realiza el recorrido. El algoritmo de optimización reacciona ante condiciones de tráfico cambiantes y adapta continuamente el perfil óptimo de velocidad para que el vehículo llegue al destino cumpliendo el horario de llegada establecido. La optimización de consumo es aplicada en vehículos convencionales de motor de combustión interna y en vehículos híbridos tipo serie. Los datos de consumo utilizados por el algoritmo de optimización se obtienen mediante la simulación de modelos cuasi-estáticos de los vehículos. La técnica de minimización empleada por el algoritmo es la Programación Dinámica. El algoritmo divide la optimización del consumo en dos partes claramente diferenciadas y aplica la Programación Dinámica sobre cada una de ellas. La primera parte corresponde a la optimización del consumo del vehículo en función de las condiciones de tráfico. Esta optimización calcula un perfil de velocidad promedio que evita, cuando es posible, las retenciones de tráfico. El tiempo de viaje perdido durante una retención de tráfico debe recuperarse a través de un aumento posterior de la velocidad promedio que incrementaría el consumo del vehículo. La segunda parte de la optimización es la encargada del cálculo de la velocidad óptima en función de la orografía y del tiempo de viaje disponible. Dado que el consumo de combustible del vehículo se incrementa cuando disminuye el tiempo disponible para finalizar un recorrido, esta optimización utiliza factores de ponderación para modular la influencia que tiene cada una de estas dos variables en el proceso de minimización. Aunque los factores de ponderación y la orografía de la carretera condicionan el nivel de ahorro de la optimización, los perfiles de velocidad óptima calculados logran ahorros de consumo respecto de un perfil de velocidad constante que obtiene el mismo tiempo de recorrido. Las simulaciones indican que el ahorro de combustible del vehículo convencional puede lograr hasta un 8.9% mientras que el ahorro de energía eléctrica del vehículo híbrido serie un 2.8%. El algoritmo fusiona la optimización en función de las condiciones del tráfico y la optimización en función de la orografía durante el cálculo en tiempo real del perfil óptimo de velocidad. La optimización conjunta se logra cuando el perfil de velocidad promedio resultante de la optimización en función de las condiciones de tráfico define los valores de los factores de ponderación de la optimización en función de la orografía. Aunque el nivel de ahorro de la optimización conjunta depende de las condiciones de tráfico, de la orografía, del tiempo de recorrido y de las características propias del vehículo, las simulaciones indican ahorros de consumo superiores al 6% en ambas clases de vehículo respecto a optimizaciones que no logran evitar retenciones de tráfico en la carretera. ABSTRACT Fuel consumption of cars is a feature that is continuously being improved due to the fuel price and an increasing environmental awareness. This doctoral dissertation describes an optimization algorithm to decrease the fuel consumption taking into account the technical specifications of the vehicle, the terrain profile of the road and the traffic conditions of the trip. The algorithm calculates the optimal speed profile that completes a trip having a specified travel time. This calculation considers the road slope and the expected traffic conditions during the trip. The optimization algorithm is also able to react to changing traffic conditions and tunes the optimal speed profile to reach the destination within the specified arrival time. The optimization is applied on a conventional vehicle and also on a Series Hybrid Electric vehicle (SHEV). The fuel consumption optimization algorithm uses data obtained from quasi-static simulations. The algorithm is based on Dynamic Programming and divides the fuel consumption optimization problem into two parts. The first part of the optimization process reduces the fuel consumption according to foreseeable traffic conditions. It calculates an average speed profile that tries to avoid, if possible, the traffic jams on the road. Traffic jams that delay drivers result in higher vehicle speed to make up for lost time. A higher speed of the vehicle within an already defined time scheme increases fuel consumption. The second part of the optimization process is in charge of calculating the optimal speed profile according to the road slope and the remaining travel time. The optimization tunes the fuel consumption and travel time relevancies by using two penalty factors. Although the optimization results depend on the road slope and the travel time, the optimal speed profile produces improvements of 8.9% on the fuel consumption of the conventional car and of 2.8% on the spent energy of the hybrid vehicle when compared with a constant speed profile. The two parts of the optimization process are combined during the Real-Time execution of the algorithm. The average speed profile calculated by the optimization according to the traffic conditions provides values for the two penalty factors utilized by the second part of the optimization process. Although the savings depend on the road slope, traffic conditions, vehicle features, and the remaining travel time, simulations show that this joint optimization process can improve the energy consumption of the two vehicles types by more than 6%.

El presente trabajo se basa en la filosofía de la Construcción sin Pérdidas (“Lean Construction”), analizando la situación de esta filosofía en el sector de la edificación en el contexto internacional y español, respondiendo las siguientes preguntas: 1. ¿Cómo surge el “Lean Construction”? 2. ¿Cuáles son sus actividades, funciones y cometidos? 3. ¿Existe regulación del ¨Lean Construction” en otros países? 4. ¿Existe demanda del ¨Lean Construction” en España? 5. ¿Existe regulación del ¨Lean Construction” en España? 6. ¿Cómo debería ser la regulación ¨Lean Construction” en España? 7. ¿Cuál es la relación del “Lean Construction” con el “Project & Construction Management”? 8. ¿Cómo debería ser la regulación de “Lean Construction” en España considerando su relación con el “Project & Construction Management”? Las preguntas indicadas las hemos respondido detalladamente en el presente trabajo, a continuación se resume las respuestas a dichas preguntas: 1. El “Lean Construction” surge en agosto de 1992, cuando el investigador finlandés Lauri Koskela publicó en la Universidad de Stanford el reporte TECHNICAL REPORT N° 72 titulado “Application of the New Production Philosophy to Construction”. Un año más tarde el Dr. Koskela invitó a un grupo de especialistas en construcción al primer workshop de esta materia en Finlandia, dando origen al International Group for Lean Construction (IGLC) lo que ha permitido extender la filosofía a EEUU, Europa, América, Asia, Oceanía y África. “Lean Construction” es un sistema basado en el enfoque “Lean Production” desarrollado en Japón por Toyota Motors a partir de los años cincuenta, sistema que permitió a sus fábricas producir unidades con mayor eficiencia que las industrias americanas, con menores recursos, en menor tiempo, y con un número menor de errores de fabricación. 2. El sistema “Lean Construction” busca maximizar el valor y disminuir las pérdidas de los proyectos generando una coordinación eficiente entre los involucrados, manejando un proyecto como un sistema de producción, estrechando la colaboración entre los participantes de los proyectos, capacitándoles y empoderándoles, fomentando una cultura de cambio. Su propósito es desarrollar un proceso de construcción en el que no hayan accidentes, ni daños a equipos, instalaciones, entorno y comunidad, que se realice en conformidad con los requerimientos contractuales, sin defectos, en el plazo requerido, respetando los costes presupuestados y con un claro enfoque en la eliminación o reducción de las pérdidas, es decir, las actividades que no generen beneficios. El “Last Planner System”, o “Sistema del Último Planificador”, es un sistema del “Lean Construction” que por su propia naturaleza protege a la planificación y, por ende, ayuda a maximizar el valor y minimizar las pérdidas, optimizando de manera sustancial los sistemas de seguridad y salud. El “Lean Construction” se inició como un concepto enfocado a la ejecución de las obras, posteriormente se aplicó la filosofía a todas las etapas del proyecto. Actualmente considera el desarrollo total de un proyecto, desde que nace la idea hasta la culminación de la obra y puesta en marcha, considerando el ciclo de vida completo del proyecto. Es una filosofía de gestión, metodologías de trabajo y una cultura empresarial orientada a la eficiencia de los procesos y flujos. La filosofía “Lean Construction” se está expandiendo en todo el mundo, además está creciendo en su alcance, influyendo en la gestión contractual de los proyectos. Su primera evolución consistió en la creación del sistema “Lean Project Delivery System”, que es el concepto global de desarrollo de proyectos. Posteriormente, se proponen el “Target Value Design”, que consiste en diseñar de forma colaborativa para alcanzar los costes y el valor requerido, y el “Integrated Project Delivery”, en relación con sistemas de contratos relacionales (colaborativos) integrados, distintos a los contratos convencionales. 3. Se verificó que no existe regulación específica del ¨Lean Construction” en otros países, en otras palabras, no existe el agente con el nombre específico de “Especialista en Lean Construction” o similar, en consecuencia, es un agente adicional en el proyecto de la edificación, cuyas funciones y cometidos se pueden solapar con los del “Project Manager”, “Construction Manager”, “Contract Manager”, “Safety Manager”, entre otros. Sin embargo, se comprobó la existencia de formatos privados de contratos colaborativos de Integrated Project Delivery, los cuales podrían ser tomados como unas primeras referencias para futuras regulaciones. 4. Se verificó que sí existe demanda del ¨Lean Construction” en el desarrollo del presente trabajo, aunque aún su uso es incipiente, cada día existe más interesados en el tema. 5. No existe regulación del ¨Lean Construction” en España. 6. Uno de los objetivos fundamentales de esta tesis es el de regular esta figura cuando actúe en un proyecto, definir y realizar una estructura de Agente de la Edificación, según la Ley de Ordenación de la Edificación (LOE), y de esta manera poder introducirla dentro de la Legislación Española, protegiéndola de eventuales responsabilidades civiles. En España existe jurisprudencia (sentencias de los tribunales de justicia españoles) con jurisdicción civil basada en la LOE para absolver o condenar a agentes de la edificación que son definidos en los tribunales como “gestores constructivos” o similares. Por este motivo, en un futuro los tribunales podrían dictaminar responsabilidades solidarias entre el especialista “Lean Construction” y otros agentes del proyecto, dependiendo de sus actuaciones, y según se implemente el “Lean Project Delivery System”, el “Target Value Design” y el “Integrated Project Delivery”. Por otro lado, es posible que el nivel de actuación del especialista “Lean Construcción” pueda abarcar la gestión del diseño, la gestión de la ejecución material (construcción), la gestión de contratos, o la gestión integral de todo el proyecto de edificación, esto último, en concordancia con la última Norma ISO 21500:2012 o UNE-ISO 21500:2013 Directrices para la dirección y gestión de proyectos. En consecuencia, se debería incorporar adecuadamente a uno o más agentes de la edificación en la LOE de acuerdo a sus funciones y responsabilidades según los niveles de actuación del “Especialista en Lean Construction”. Se propone la creación de los siguientes agentes: Gestor del Diseño, Gestor Constructivo y Gestor de Contratos, cuyas definiciones están desarrolladas en este trabajo. Estas figuras son definidas de manera general, puesto que cualquier “Project Manager” o “DIPE”, gestor BIM (Building Information Modeling), o similar, puede actuar como uno o varios de ellos. También se propone la creación del agente “Gestor de la Construcción sin Pérdidas”, como aquel agente que asume las actuaciones del “gestor de diseño”, “gestor constructivo” y “gestor de contratos” con un enfoque en los principios del Lean Production. 7. En la tesis se demuestra, por medio del uso de la ISO 21500, que ambos sistemas son complementarios, de manera que los proyectos pueden tener ambos enfoques y ser compatibilizados. Un proyecto que use el “Project & Construction Management” puede perfectamente apoyarse en las herramientas y técnicas del “Lean Construction” para asegurar la eliminación o reducción de las pérdidas, es decir, las actividades que no generen valor, diseñando el sistema de producción, el sistema de diseño o el sistema de contratos. 8. Se debería incorporar adecuadamente al agente de la edificación “Especialista en Lean Construction” o similar y al agente ¨Especialista en Project & Construction Management” o DIPE en la Ley de Ordenación de la Edificación (LOE) de acuerdo a sus funciones y responsabilidades, puesto que la jurisprudencia se ha basado para absolver o condenar en la referida Ley. Uno de los objetivos fundamentales de esta tesis es el de regular la figura del “Especialista en Lean Construction” cuando actúa simultáneamente con el DIPE, y realizar una estructura de Agente de la Edificación según la LOE, y de esta manera protegerlo de eventuales responsabilidades solidarias. Esta investigación comprueba que la propuesta de definición del agente de edificación DIPE, según la LOE, presentada en la tesis doctoral del Doctor Manuel Soler Severino es compatible con las nuevas definiciones propuestas. El agente DIPE puede asumir los roles de los diferentes gestores propuestos en esta tesis si es que se especializa en dichas materias, o, si lo estima pertinente, recomendar sus contrataciones. ABSTRACT This work is based on the Lean Construction philosophy; an analysis is made herein with regard to the situation of this philosophy in the building sector within the international and Spanish context, replying to the following questions: 1. How did the concept of Lean Construction emerge? 2. Which are the activities, functions and objectives of Lean Construction? 3. Are there regulations on Lean Construction in other countries? 4. Is there a demand for Lean Construction in Spain? 5. Are there regulations on Lean Construction in Spain? 6. How should regulations on Lean Construction be developed in Spain? 7. What is the relationship between Lean Construction and the Project & Construction Management? 8. How should regulations on Lean Construction be developed in Spain considering its relationship with the Project & Construction Management? We have answered these questions in detail here and the replies are summarized as follows: 1. The concept of Lean Construction emerged in august of 1992, when Finnish researcher Lauri Koskela published in Stanford University TECHNICAL REPORT N° 72 entitled “Application of the New Production Philosophy to Construction”. A year later, Professor Koskela invited a group of construction specialists to Finland to the first workshop conducted on this matter; thus, the International Group for Lean Construction (IGLC) was established, which has contributed to extending the philosophy to the United States, Europe, the Americas, Asia, Oceania, and Africa. Lean Construction is a system based on the Lean Production approach, which was developed in Japan by Toyota Motors in the 1950s. Thanks to this system, the Toyota plants were able to produce more units, with greater efficiency than the American industry, less resources, in less time, and with fewer manufacturing errors. 2. The Lean Construction system aims at maximizing the value of projects while reducing waste, producing an effective coordination among those involved; it manages projects as a production system, enhancing collaboration between the parties that participate in the projects while building their capacities, empowering them, and promoting a culture of change. Its purpose is to develop a construction process free of accidents, without damages to the equipment, facilities, environment and community, flawless, in accordance with contractual requirements, within the terms established, respecting budgeted costs, and with a clear approach to eliminating or reducing waste, that is, activities that do not generate benefits. The Last Planner System is a Lean Construction system, which by its own nature protects planning and, therefore, helps to maximize the value and minimize waste, optimizing substantially the safety and health systems. Lean Construction started as a concept focused on the execution of works, and subsequently the philosophy was applied to all the stages of the project. At present it considers the project’s total development, since the time ideas are born until the completion and start-up of the work, taking into account the entire life cycle of the project. It is a philosophy of management, work methodologies, and entrepreneurial culture aimed at the effectiveness of processes and flows. The Lean Construction philosophy is extending all over the world and its scope is becoming broader, having greater influence on the contractual management of projects. It evolved initially through the creation of the Lean Project Delivery System, a global project development concept. Later on, the Target Value Design was developed, based on collaborative design to achieve the costs and value required, as well as the Integrated Project Delivery, in connection with integrated relational (collaborative) contract systems, as opposed to conventional contracts. 3. It was verified that no specific regulations on Lean Construction exist in other countries, in other words, there are no agents with the specific name of “Lean Construction Specialist” or other similar names; therefore, it is an additional agent in building projects, which functions and objectives can overlap those of the Project Manager, Construction Manager, Contract Manager, or Safety Manager, among others. However, the existence of private collaborative contracts of Integrated Project Delivery was confirmed, which could be considered as first references for future regulations. 4. There is a demand for Lean Construction in the development of this work; even though it is still emerging, there is a growing interest in this topic. 5. There are no regulations on Lean Construction in Spain. 6. One of the main objectives of this thesis is to regulate this role when acting in a project, and to define and develop a Building Agent structure, according to the Building Standards Law (LOE by its acronym in Spanish), in order to be able to incorporate it into the Spanish law, protecting it from civil liabilities. In Spain there is jurisprudence in civil jurisdiction based on the LOE to acquit or convict building agents, which are defined in the courts as “construction managers” or similar. For this reason, courts could establish in the future joint and several liabilities between the Lean Construction Specialist and other agents of the project, depending on their actions and based on the implementation of the Lean Project Delivery System, the Target Value Design, and the Integrated Project Delivery. On the other hand, it is possible that the level of action of the Lean Construction Specialist may comprise design management, construction management and contract management, or the integral management of the entire building project in accordance with the last ISO 21500:2012 or UNE-ISO 21500:2013, guidelines for the management of projects. Accordingly, one or more building agents should be appropriately incorporated into the LOE according to their functions and responsibilities and based on the levels of action of the Lean Construction Specialist. The creation of the following agents is proposed: Design Manager, Construction Manager, and Contract Manager, which definitions are developed in this work. These agents are defined in general, since any Project Manager or DIPE, Building Information Modeling (BIM) Manager or similar, may act as one or as many of them. The creation of the Lean Construction Manager is also proposed, as the agent that takes on the role of the Design Manager, Construction Manager and Contract Manager with a focus on the Lean Production principles. 7. In the thesis it is demonstrated that through the implementation of the ISO 21500, both systems are supplementary, so projects may have both approaches and be compatible. A project that applies the Project & Construction Management may perfectly have the support of the tools, techniques and practices of Lean Construction to ensure the elimination or reduction of losses, that is, those activities that do not generate value, thus designing the production system, the design system, or the contract system. 8. The Lean Construction Specialist or similar and the Specialist in Project & Construction Management should be incorporated appropriately into the LOE according to their functions and responsibilities, since jurisprudence has been based on such Law to acquit or convict. One of the main objectives of this thesis is the regulate the role of the Lean Construction Specialist when acting simultaneously with the DIPE, and to develop a structure of the building agent, according to the LOE, and in this way protect such agent from joint and several liabilities. This research proves that the proposal to define the DIPE building agent, according to the LOE, and presented in the doctoral dissertation of Manuel Soler Severino, Ph.D. is compatible with the new definitions proposed. The DIPE agent may assume the roles of the different managers proposed in this thesis if he specializes in those topics or, if deemed pertinent, recommends that they be engaged.

Polyamides composed of four amino acids, imidazole (Im), pyrrole (Py), hydroxypyrrole (Hp), and β-alanine (β), are synthetic ligands that form highly stable complexes in the minor groove of DNA. Although specific pairing rules within the 2:1 motif can be used to distinguish the four Watson⋅Crick base pairs, a comparable recognition code for 1:1 polyamide:DNA complexes had not been described. To set a quantitative baseline for the field, the sequence specificities of Im, Py, Hp, and β for the four Watson⋅Crick base pairs were determined for two polyamides, Im-β-ImPy-β-Im-β-ImPy-β-Dp (1, for Im, Py, and β) and Im-β-ImHp-β-Im-β-ImPy-β-Dp (2, for Hp), in a 1:1 complex within the DNA sequence context 5′-AAAGAGAAGAG-3′. Im residues do not distinguish G,C from A,T but bind all four base pairs with high affinity. Py and β residues exhibit ≥10-fold preference for A,T over G,C base pairs. The Hp residue displays a unique preference for a single A⋅T base pair with an energetic penalty.

We used Computer-Assisted Personalized Approach (CAPA), a networked teaching and learning tool that generates computer individualized homework problem sets, in our large-enrollment introductory plant physiology course. We saw significant improvement in student examination performance with regular homework assignments, with CAPA being an effective and efficient substitute for hand-graded homework. Using CAPA, each student received a printed set of similar but individualized problems of a conceptual (qualitative) and/or quantitative nature with quality graphics. Because each set of problems is unique, students were encouraged to work together to clarify concepts but were required to do their own work for credit. Students could enter answers multiple times without penalty, and they were able to obtain immediate feedback and hints until the due date. These features increased student time on task, allowing higher course standards and student achievement in a diverse student population. CAPA handles routine tasks such as grading, recording, summarizing, and posting grades. In anonymous surveys, students indicated an overwhelming preference for homework in CAPA format, citing several features such as immediate feedback, multiple tries, and on-line accessibility as reasons for their preference. We wrote and used more than 170 problems on 17 topics in introductory plant physiology, cataloging them in a computer library for general access. Representative problems are compared and discussed.

The empirical observation that homologous proteins fold to similar structures is used to enhance the capabilities of an ab initio algorithm to predict protein conformations. A penalty function that forces homologous proteins to look alike is added to the potential and is employed in the coupled energy optimization of several homologous proteins. Significant improvement in the quality of the computed structures (as compared with the computational folding of a single protein) is demonstrated and discussed.

We present rules that allow one to predict the stability of DNA pyrimidine.purine.pyrimidine (Y.R.Y) triple helices on the basis of the sequence. The rules were derived from van't Hoff analysis of 23 oligonucleotide triplexes tested at a variety of pH values. To predict the enthalpy of triplex formation (delta H degrees), a simple nearest-neighbor model was found to be sufficient. However, to accurately predict the free energy of the triplex (delta G degrees), a combination model consisting of five parameters was needed. These parameters were (i) the delta G degrees for helix initiation, (ii) the delta G degrees for adding a T-A.T triple, (iii) the delta G degrees for adding a C(+)-G.C triple, (iv) the penalty for adjacent C bases, and (v) the pH dependence of the C(+)-G.C triple's stability. The fitted parameters are highly consistent with thermodynamic data from the basis set, generally predicting both delta H degrees and delta G degrees to within the experimental error. Examination of the parameters points out several interesting features. The combination model predicts that C(+) -G.C. triples are much more stabilizing than T-A.T triples below pH 7.0 and that the stability of the former increases approximately equal to 1 kcal/mol per pH unit as the pH is decreased. Surprisingly though, the most stable sequence is predicted to be a CT repeat, as adjacent C bases partially cancel the stability of one another. The parameters successfully predict tm values from other laboratories, with some interesting exceptions.

A presente dissertação tem como tema central a onerosidade excessiva na revisão e extinção dos contratos no direito civil brasileiro. Ela aborda as hipóteses de rompimento do princípio do equilíbrio econômico contratual na fase de execução dos contratos em virtude da superveniência de fatos extraordinários e imprevisíveis que interrompem sua originária relação de equivalência. O presente estudo divide-se em seis grandes partes. Em primeiro lugar, fazem-se necessárias uma introdução e uma descrição da problemática relacionada ao tema. Em seguida, apresenta-se a origem histórica da revisão e da extinção contratual a partir do exame da cláusula rebus sic stantibus. Feito isso, são relatadas as teorias que as fundamentam pela doutrina e pela jurisprudência antes do advento do texto legal expresso que trata da matéria. Concluída essa fase histórica, analisa-se o direito positivo brasileiro vigente, primeiramente, por questões cronológicas, a revisão por onerosidade excessiva no Código de Defesa do Consumidor. Posteriormente, as disposições legais inseridas no Código Civil que possibilitam a revisão e resolução dos contratos por onerosidade excessiva, com uma análise dogmática dos pressupostos positivos e negativos necessários à aplicação dos arts. 317 e 478 do Código Civil. Em seguida, o estudo procura analisar algumas questões pontuais relacionadas à aplicação dos dois artigos, tais como: (i) quem tem legitimidade e interesse para requerer a revisão e resolução dos contratos, de acordo com os arts. 317 e 478 do Código Civil, respectivamente; (ii) qual é o papel do juiz na revisão e resolução dos contratos, de acordo com os arts. 317 e 478 do Código Civil, respectivamente; e (iii) se há concorrência na aplicação desses artigos ou deve ser observado um procedimento sequencial em atenção ao princípio da preservação dos contratos. Finalmente, o trabalho apresenta breve síntese e conclusões.

A maioria das demandas envolvendo pedidos de danos morais no judiciário trabalhista brasileiro é originada a partir de abusos patronais cometidos no exercício do poder diretivo, em especial de sua dimensão fiscalizatória. Embora inexista, no Brasil, disciplina normativa específica quanto aos limites à maior parte das manifestações do poder de fiscalização, seu exercício é restringido pela dignidade da pessoa humana, que deve ser compreendida de acordo com a noção de trabalho decente propugnada pela OIT. A dignidade humana constitui cláusula geral de proteção aos direitos da personalidade, dentre eles, os direitos à intimidade e à vida privada, os mais ofendidos por meio da fiscalização patronal abusiva nas fases précontratual, contratual e pós-contratual. Práticas como a revista pessoal nos trabalhadores e em seus pertences, a limitação à utilização de banheiros, a instalação de câmeras e microfones no local de trabalho e o monitoramento dos computadores utilizados na empresa revelam, por vezes, violações a esses direitos. A revista não encontra fundamento no poder de fiscalização e no direito de propriedade do empregador, salvo quando tiver por objetivo a garantia da saúde ou segurança no ambiente laboral. A instalação de equipamentos audiovisuais, quando visar a proteção patrimonial do empregador ou for essencial ao procedimento de gestão, somente pode se dar nos espaços em que o trabalho for efetivamente desenvolvido e por tempo determinado, fundada em situação específica, sendo imprescindível a ciência dos monitorados quanto à instalação e à localização dos equipamentos. A escuta telefônica e o monitoramento de computadores e e-mails somente será possível quando o empregador determinar a utilização dos meios exclusivamente para os fins da prestação laboral, com ciência inequívoca dos trabalhadores, além de disponibilizar ou autorizar a utilização de meios alternativos para a comunicação pessoal. Não devem ser admitidas quaisquer limitações à utilização de banheiros, bem como o estabelecimento de escala de gravidez no âmbito empresarial. Sendo o tomador de serviços legitimado a exercer o poder fiscalizatório sobre a atividade produtiva empreendida no estabelecimento e havendo a indiscutível imperatividade da proteção aos direitos da personalidade obreiros, é necessária a fixação normativa de limites ao poder patronal, em prol do estabelecimento da segurança jurídica. O direito de resistência é contraface do poder diretivo, no sentido de que o uso irregular deste faz nascer aquele e, consequentemente, os limites do poder diretivo condicionam os do ius resistentiae. Os trabalhadores devem exercê-lo com fulcro nos direitos à vida privada, à intimidade, à honra e à dignidade humana. A doutrina deve valer-se da técnica da ponderação para estabelecer os limites ao poder fiscalizatório patronal, com fulcro no princípio da proporcionalidade. A divergência jurisprudencial deve ser minimizada pela atividade criativa dos juízes quanto aos limites ao poder fiscalizatório, consoante o princípio da proporcionalidade, e por meio da utilização de mecanismos específicos voltados à redução da insegurança jurídica no Judiciário Trabalhista, tais como recursos de revista, embargos de divergência, incidentes de uniformização de jurisprudência, súmulas, precedentes normativos e orientações jurisprudenciais. Nada impede, ainda, que limites ao poder fiscalizatório patronal sejam estabelecidos por meio de negociação coletiva.
