Resumo:
The Reverend Joseph McKeen (1757-1807) was the first president of Bowdoin College, Brunswick, Maine, USA, (founded 1794). McKeen is famous for his inaugural address in which he calls students to serve the common good. His view of common good is a deeply theological view, coloured by the theological era in which he lived and worked. This study examines the idea of common in the light of McKeen’s college sermons, taking note of the following subjects: Scottish Common Sense Realism; The Nature of True Virtue; The Controversy with Unitarianism; and Science and Mathematics. McKeen’s view of common good is not simply a political view. He is not merely a republican, expressing his views on the future of the republic in a classical political way. He is also, indeed primarily, a pastor and theologian.

The object of analysis in the text are the issues concerned with the transmission easement and the adverse possession thereof on the grounds of the Polish law. The text features: (1) a historical outline of the solutions concerned with easements in the Polish law following 1945, (2) the institution of transmission easement introduced in 2008 and the solutions concerned with the claims for the establishment thereof at court, (3) the institution of adverse possession of transmission easement pursuant to civil law regulations, judicature and the legal doctrine. On account of the need to elaborate the wide-ranging legal issues concerned with the transmission easement in this text, the analysis embraces two research questions giving rise to the following conclusions: (1) What function is performed by the institution of transmission easement in the system of civil-law relations in the Polish law? The legislator in the articles introducing a transmission easement ossified the solutions functioning in the judicature of the Polish courts before 2008. The legal interpretation took a turn for clarification, that is for the establishment of a norm in the situation where its comprehension was dubious. It is noteworthy that in the period prior to 2008, the law provided for easement appurtenant, and on account of the usual course of judicial decisions also for easement appurtenant with the content corresponding to transmission easement. In 2008 these two “legal existences” were supplemented with a transmission easement, which nevertheless failed to resolve all the legal problems; nay, this gave rise to even more problems, e.g. the one of non-establishment of interpolar norms which would address the issues arising in connection with the use of various easement institutions in legal transactions. While amending the civil law, the legislator aimed to bring order to legal transactions by streamlining the unregulated actual state of easement in relation to transmission infrastructure, but also in relation to the situations where an easement was yet to be established and a facility yet to be constructed. Thus, such action is intended to regulate the disorderly legislation in force as well as to safeguard investment processes. This is of particular significance, for example, for energy companies which are burdened with statutory public-law obligations as regards securing energy supplies and providing for the development of energy infrastructure. Hence, the de facto introduced civil-law solutions indirectly served to realise the principles of the doctrine of easement in the public interest. (2) What legal problems in the civil-law relations does the application of the institution of transmission easement by adverse possession entail? On account of the functioning of various institutions of easement, that is (1) an easement appurtenant, (2) an easement appurtenant with the content corresponding to a transmission easement, and as of 2008 (3) a transmission easement, a problem arose as to which of the given easements companies exercised in particular periods, all the more so because before 1989 the State Treasury owned them and many of the transmission facilities were put in place by virtue of administrative decisions. The commonly held belief is that in the period of “society-oriented economy” as well as up to 2008 infrastructure companies could exercise an easement appurtenant which corresponded to the content of a transmission easement. Therefore, in such a case the running of the prescriptive period should allow for the general rules laid down for an easement appurtenant. Apart from the problem of the relation of a capacity to exercise a right to property and the free development of civil-law relations before 1989, the recognition of the running of prescriptive periods – given the functioning of the three various easements as legal institutions – became a significant legal problem. By way of illustration, the recognition – against the period of exercising transmission easement – of the period required for the acquisition thereof by adverse possession, whereby before 3 August 2008 the real estate featured the legal state corresponding to the content of this right, is debatable. One cannot recognise that within that period a transmission easement was exercised, because such a right was not in existence as yet. Therefore, the institution that might be employed is the running of the period as regards the adverse possession in relation to an easement appurtenant with the content of a transmission easement. Still, the problem remains as to whether the period of the exercise of the easement appurtenant with the content corresponding to a transmission easement can be recognised against the period of possession required for the adverse possession of a transmission easement pursuant to the regulations introduced in 2008. One might incline to the position whereby in such a case it would be right to fully recognise – against the period of exercising a transmission easement – the period of exercising an easement appurtenant corresponding thereto in respect of its content. That being so, the adverse possession of a transmission easement might ensue in such a situation on 3 August 2008 at the earliest, that is the moment the regulations governing this right come into effect. Conversely, if the prescriptive period expires before that date, the entrepreneur would acquire an easement appurtenant with the content corresponding to the transmission easement. Such an interpretation is aligned with the purpose intended by the legislator, which is to bring order to the actual state of the broadest scope with the aid of a new legal instrument. The text, while analysing the issue of a transmission easement and an adverse possession thereof as a institution of the civil law, presents only some selected problems. Hence, the analysis does not include, for example, the issues concerned with claims for remuneration (for usufruct without contractual basis or usufruct fees), or claims for compensation (redress or amends). Furthermore, the text does not conduct a more profound analysis of the relation between the provisions regulating public-law relations (e.g. acts of law introducing the institution of dispossession) and the provisions regulating civil-law relations (the easements in question).

The paper assumes that fear presents a certain degree of ambivalence. To say it with Hans Jonas (1903-1993), fear is not only a negative emotion, but may teach us something very important: we recognize what is relevant when we perceive that it is at stake. Under this respect, fear may be assumed as a guide to responsibility, a virtue that is becoming increasingly important, because of the role played by human technology in the current ecological crisis. Secondly, fear and responsibility concern both dimensions of human action: private-individual and publiccollective. What the ‘heuristics of fear’ teaches us, is to become aware of a deeper ambivalence, namely the one which characterizes as such human freedom, which may aim to good or bad, to self-preservation or self-destruction. Any public discussion concerning political or economic issues related with human action (at an individual or collective level) ought not to leave this essential idea out of consideration.

The Visceral Leishmaniose (LV) disease is endemic in some places in Brazil. It is caused by the protozoa Leishmania chagasi, being transmitted for vector, the phlebotomies, Lutzomyia longipalpis. In virtue of the expansion of the illness in Rio Grande do Norte, it is necessary to evaluate the determinative ambient factors in the proliferation of the vector for better control of the illness. The variable rainfall and the social variables had been analyzed using space regression with two models and the ambient variable of ZANE and the variables analyzed in 205 houses in the cities of Natal, Extremoz, Nísia Floresta, São Gonçalo do Amarante, São Jose do Mipibu, Parnamirim and Macaíba the Person and ML Chi-square were used . The analyses had shown that high rainfall, plain relief, the forest, the humid tropical climate the activities of production culture of sugar cane and fruit culture and the presence of bovines increase the risk of the LV. The work showed that it has space aggregation and that ambient factors influence in the LV in the State

Enquadramento: Actualmente existe um elevado números de pessoas em situação de dependência, com algum tipo de incapacidade funcional ou em risco de perda de funcionalidade, que necessitam ingressar na Rede Nacional de Cuidados Continuados com o intuito de se promover uma melhoria das condições de vida e bem-estar das pessoas, através da prestação de cuidados continuados de saúde e de apoio social. Aceitando a vulnerabilidade da pessoa humana, a doença revela-se como um período de fragilidade circunstancial às condições decorrentes da sua existência. O utente/família deparam-se com a desmoralização, a ameaça, o desamparo e a perda de sentido, podendo levar o mesmo a uma profunda tristeza, desespero e sofrimento. Neste sentido e tendo em conta que a esperança influencia o bem-estar e uma vez que se encontra ligada à existência, tanto física como emocional e espiritual é fundamental percebermos até que ponto a esperança pode ajudar a pessoa a lidar com o futuro. Objetivos: Avaliar níveis de esperança nos Doentes internados em Cuidados Continuados, e identificar determinantes socio-demográficos, clínicas e psicossociais correlacionadas com essa esperança. Métodos: O estudo foi realizado,na Unidade de Cuidados Continuados da Santa Casa da Misericórdia de Seia, nas unidades de internamento de Média Duração e Reabilitação e Unidade de Longa Duração e Manutenção. O questionário foi aplicado a 46 doentes, com idades compreendidas entre os 46 e os 92 anos de idade ( x =74.39 anos). Trata-se de um estudo não experimental, quantitativo, do tipo transversal, descritivo e correlacional. O instrumento de recolha de dados integrou um Questionário de caracterização sócio-demográfica e clínica, a escala da Esperança (Herth Hope Index), uma escala para a avaliação da Qualidade de Vida – Functinal Assessement of Cancer Therapy – General e o Questionário de Sono de Oviedo. Resultados: Os dados mostram que 45,7% dos participantes apresenta esperança reduzida, 39,1% esperança elevada e 15,2% esperança moderada. Constatámos ainda que apenas o “bem-estar funcional” da escala da QDV e os “fenómenos adversos” da escala do sono se correlacionam significativamente (p=0,000; p=0,035) com a esperança explicando respetivamente 55,2% e 31,1% da variância explicada. Já o género, idade, estado civil, situação profissional, escolaridade, rendimento mensal, tipologia e número de internamentos, mostraram não estar relacionados com a esperança dos nossos doentes. Conclusão: A esperança é uma crença ou virtude inerente ao Homem, que pode assumir níveis diferenciados, que acompanha o ser humano no seu processo de viver e de morrer condicionando ajustes nos momentos de crise, afectando e/ou sendo afetada pelo bem-estar e a qualidade de vida. Cette recherche qualitative a comme objectif de comprendre et d’analyser l’expérience pénale d’individus ayant été déclarés « délinquants dangereux » ou « délinquants à contrôler », en vertu des dispositions légales prévues à la Partie XXIV (articles 752 et suivantes) du Code criminel canadien. Plus spécifiquement, nous avons voulu mettre en lumière comment se vit l’apposition de ce statut « dangereux » au plan personnel et social au moment des procédures judiciaires, lors de l’exécution de leur peine d’incarcération et dans le cadre de leur liberté surveillée, le cas échéant. Pour ce faire, nous avons rencontré dix-neuf hommes visés par ces dispositions légales afin de restituer en profondeur leur expérience pénale par rapport à ce « statut » légalement imposé, et ce, à partir de leur point de vue. Il en ressort que les individus faisant l’objet d’une déclaration spéciale traversent un grand bouleversement émotif, d’une part, en lien avec les délits qu’ils ont commis et d’autre part, relativement à la peine leur ayant été imposée. Ces sentiments complexes semblent se positionner en paradoxe entre un sentiment de culpabilité pour les gestes commis et l’impression d’avoir été traités injustement. Les hommes rencontrés partagent également un parcours pénal difficile marqué par de l’exclusion, du rejet ainsi que des mauvais traitements physiques ou psychologiques. Ils rapportent beaucoup d’impuissance à pouvoir faire évoluer leur situation, soit de se défaire de leur statut « dangereux ». Enfin, l’analyse des propos rapportés montre que l’imposition d’une déclaration spéciale ne constitue pas une « simple » peine puisqu’elle induit un processus de stigmatisation immédiat, discréditant et permanent qui a des implications importantes au niveau social et personnel. Ces implications ont de fait, engendré une transformation à l’égard de la perception qu’ils ont d’eux-mêmes ainsi que dans leurs façons de se comporter socialement.

Este artigo dá uma introdução à noção de necessidade. O objetivo principal é refletir sobre os fundamentos e as fontes da necessidade. Primeiro, apresentamos a semântica dos mundos possíveis. Como ela depende fundamentalmente da noção de mundo possível, discutimos algumas críticas relevantes a essa noção. Em seguida, analisamos duas teorias do novo atualismo, que pretendem justamente explicar a necessidade sem recorrer a mundos possíveis, a saber, a teoria de Fine, na qual as essências de objetos são os fundamentos da necessidade, e a teoria de Jubien, na qual as necessidades são obtidas em virtude da relação básica de necessitação entre propriedades. Propomos algumas modificações às duas teorias. Finalmente, apresentamos uma estrutura do reino das necessidades segundo a qual a necessidade metafísica é a necessidade genuína e mais inclusiva.

O Exército tem vindo a sofrer inúmeras reestruturações em virtude das revisões de que foi alvo o Conceito Estratégico de Defesa Nacional (2013). A atual orgânica, aprovada pela Resolução do Conselho de Ministro n.º 26/2013, de 19 abril, estabeleceu como linhas de ação prioritárias (de entre outras) a adaptação e racionalização de estruturas e a rentabilização de meios e capacidades, por forma a obter ganhos de eficiência, economias de escala e inovação de procedimentos a curto, médio e longo prazo. Com o intuito de adaptar, racionalizar e rentabilizar as estruturas edificadas e as capacidades logísticas, desenvolveu-se o projeto “Defesa 2020”, que visa implementar um modelo sustentável potenciador da racionalização da supracitada despesa pública e incrementador da eficiência na utilização dos recursos. Hodiernamente, as entidades não primam somente pela adoção de estratégias a nível de melhorias de eficiência económica, mas também a nível do acompanhamento da evolução tecnológica. Neste contexto, o presente trabalho tem como objeto de estudo a nova orgânica do Exército e os novos procedimentos do Sistema Logístico na gestão do Fardamento, com o fim de verificar as eventuais oportunidades de melhoria que os mesmos poderão ser alvo. Decorrente do expresso acima, derivam os objetivos deste que se consubstanciam na viabilidade e melhorias possíveis de aplicar aos serviços Logísticos do Exército na gestão do Fardamento, com a génese no estudo benchmarking dos serviços Logísticos do Ejército de Tierra (Espanha) por força da sua proximidade geográfica e da sua maior maturidade. Para o estudo da problemática levantada e para a concretização dos objetivos citados, realizou-se uma recolha de dados que teve como base o método hipotético-dedutivo. Os resultados obtidos nesta investigação demonstram que a gestão do fardamento no Exército Português se encontra numa fase embrionária, o que permite a adoção de melhorias que possibilitem um desempenho mais favorável e funcionamento mais eficaz, deparando-se com conspectos que podem ser melhorados, nomeadamente o planeamento de rede de transportes, a acessibilidade de vendas aos militares e a partilha de informação de artigos disponíveis e suas características. Conclui-se que é possível aperfeiçoar procedimentos no Sistema Logístico tendo em conta a eficiência e eficácia necessária à organização, no meio onde se insere.

The focus of Aristotelian ethics is not to understand the essence of virtue, but rather the formation of underlying principles which define each individual’s ethics (êthos) that promotes happiness (eudaimonía) as their ultimate end. In this article I will emphasize the relationship between eudaimonía and ethos. This is relevant because êthos may be interpreted as source (pegé) from decisions as character or imprint, (charaktér) thanks to actions performed in order to reach eudaimonía.

En partant de la documentation filmique de deux performances (Da ist eine kriminelle Berührung in der Kunst [Ulay, 1976] et Data [Gagnon, 2010]) qui a comme particularité commune d’avoir été soumise à des manœuvres cinématographiques, ce mémoire élabore une théorisation permettant de les penser autrement qu’en tant que documents, mais en tant que films, et plus précisément en tant qu’œuvres esthétiques complémentaires à la performance d’origine. Tombant dans une béance théorique par le fait de leur hybridité supposément contradictoire (performance, éphémère/cinéma, préservation), les deux films nous invitent à penser une conceptualisation renouvelée de la performance. Depuis cette perspective, nous démontrerons que, si le geste de performance est lui-même enchâssé dans le geste cinématographique, c’est en fonction de cette co-constitution des œuvres qu’il faut les aborder : en plus de référer à un contenu performatif, ces films performent une réalité inachevée, en termes de classification théorique mais aussi en termes de valeur politique. Nous verrons finalement qu’à travers le thème fédérateur du détournement artistique, pensé dans un rapport critique des institutions culturelles, les deux œuvres ont pour visée une transformation qui a pour but l’établissement de nouveaux rapports sociaux et politiques. Ultimement, nous défendrons que cette intervention à même une structure sociale établie ne soit possible que si la performance d’origine est présentée cinématographiquement, par le concept du geste cinématographique de performance.

Il souligne notamment le lien qui unit les manières d’être et l’art, tant chez les Grecs qu’au début de la modernité. La phronèsis se définissait tout d’abord en relation aux autres manières de faire, dont la technè fait partie. Si Platon et Aristote les distinguent, les auteurs de la modernité assimileront ces deux manières de faire. De plus, on peut voir dans la forme du langage employé pour écrire sur la prudence un reflet de la vertu antique. Il s’agit de donner, tant par le style que par le propos, un exemple de prudence. Cette vertu, qui est d’ailleurs la première des vertus cardinales, est donc fondamentale pour comprendre le rapport entre l’éthique et l’art, de l’Antiquité au début de la modernité. Elle annonce aussi les débuts de l’esthétique moderne, en ce qu’elle donne des règles à suivre pour arriver à ses fins, qu’il s’agisse de n’importe quelle manière de faire.
