O presente estudo analisa o regime da conformidade das mercadorias na Convenção das Nações Unidas sobre Contratos de Compra e Venda Internacional de Mercadorias CISG, tema de maior parte dos litígios envolvendo o Comércio Internacional. Assim, após breve histórico da Convenção, ressaltando sua atual importância, aborda-se o conceito de conformidade das mercadorias e as diferentes características que este engloba. Prossegue-se, então, à análise dos diversos e complementares critérios de verificação da conformidade, tanto de ordem subjetiva quanto objetiva, expostos particularmente no art. 35 da Convenção. Detalha-se a maneira como a vontade das partes interage com os requisitos objetivos traçados, bem como o modo de aplicação e as discussões doutrinárias e jurisprudências que incidem sobre cada um deles. Dessa forma, busca-se consolidar a teoria e a prática do Comércio Internacional, para estabelecer as formas adequadas e inadequadas de aplicação do conceito de conformidade da Convenção, bem como seus efeitos sobre as partes contratantes.

Studies were carried out during May 1997 to January 1998 in Kishoregani district in Bangladesh to investigate the production potential of carp polyculture in combination with Amblypharyngodon mola in seasonal ponds. The preliminary results indicate that A. mola can be successfully cultured in small seasonal ponds in polyculture with carp. This practice can result in an increase in the households' consumption of small fish which have a very high content of calcium, iron and vitamin A. In addition to the nutritional benefits, it can also provide additional income through sale of carp and surplus small fish.

World farmed salmon production reached 145,000 metric tons (t) in 1988 and an estimated 217,000 t in 1989. The latter figure is comparable to the U. S. annual salmon catch (about 250,000 t) and is approaching one-third the size of the world wild salmon catch (about 700,000 t). The rapid expansion of farmed salmon supplies in the late 1980's has led to sharp price decreases. Lower prices have forced some farmers out of business, but at the same time, a large number of farmers first began harvesting salmon on a commercial scale as the 1980's ended. Farmed salmon production could exceed 270,000 t in 1990.

A pesquisa analisa a validade da cláusula de raio no aspecto do direito civil-empresarial (privado) e da concorrência (público). No âmbito do direito civil-empresarial analisa-se a cláusula de raio em conjunto com a cláusula de aluguel percentual e possível lesão à boa-fé objetiva. No aspecto do direito da concorrência é analisado o mercado relevante na dimensão produto e geográfica, bem como as externalidades positivas e negativas produzidas pela cláusula de raio. Para a realização da pesquisa adota-se o método dedutivo, realizado a partir de pesquisa bibliográfica e jurisprudencial sobre o tema. Traz como resultado os parâmetros que devem ser utilizados para a análise da cláusula de raio e a hipótese em que ela pode ser prevista.

Silver belly (Leiognathus Spp.) forms a major fishery in recent years in the Rameswaram island but fetches for the fishermen very low prices ranging from Rs. 0.03 to 0.12/Kg only, there being practically no demand for the fish. The possibilities of utilizing this cheap fish are discussed and the processing method described. During the glut season the cost of production of Silver belly fish meal works out to competitive prices of Rs. 500 to 700/ton. The silver belly fish meal is of high quality with good protein content averaging 57.71% in commercial samples and 61.90% in laboratory samples and with a high pepsin digestibility of 90.0% to 92.5%. The essential amino acid composition of the Silver belly fish meal compares very favorably with other round fish meals, with high contents of lysine, leucine, arginine, isoleucine, methionine, phenyl alanine, threonine and valine. Since there is good demand for fish meal as poultry and cattle food both in the internal and external markets, there is good scope for large scale production and sale of fish meal.

A report on characterisation of technology roadmaps, its purpose and formats are presented. A fast-start process is developed to support the initiation of technology roadmapping in firms to address the industrial needs. The purpose of each roadmap is related to a number of planning aims: product, capability, integration, strategic, long-range, programme and process planning. The second set of categories are related to the format of the roadmap, based on observed structure: multiple or single layers, bars, tables, graphs, pictorial forms, flow diagrams and text. It is concluded that technology roadmaps processes a great potential for supporting the development and implementation of business product and technology strategy.

Haplochrmine cichlids were the most abundant taxa in Lakes Victoria, Kyoga and Nabugabo prior to introduction of the Nile perch. As stocks of the introduced predator increased, these taxa were depleted to such an extent that they are now virtually absent from the lake. The haplochromine cichlids played an important role in the ecology of Lakes Victoria, Kyoga and Nabugabo. They occupied virtually all trophic levels in the lake and facilitated an efficient flow of energy through the ecosystem. Their depletion seem to have left much organic matter whose decomposition has contributed to accumulation of dead organic matter which may be contributing to prolonged anoxia in Lake Victoria. The haplochromines formed an important small-scale fishery. Fishermen formerly subsisting on this fishery have been driven out of business because they cannot afford the expensive nets required for Nile perch fishery. In addition to providing a cheap source of fish protein to humans, the species were an important source of Scientific material for students of genetics antd adaptive radiation.

Eco-innovations, eco-efficiency and corporate social responsibility practices define much of the current industrial sustainability agenda. While important, they are insufficient in themselves to deliver the holistic changes necessary to achieve long-term social and environmental sustainability. How can we encourage corporate innovation that significantly changes the way companies operate to ensure greater sustainability? Sustainable business models (SBM) incorporate a triple bottom line approach and consider a wide range of stakeholder interests, including environment and society. They are important in driving and implementing corporate innovation for sustainability, can help embed sustainability into business purpose and processes, and serve as a key driver of competitive advantage. Many innovative approaches may contribute to delivering sustainability through business models, but have not been collated under a unifying theme of business model innovation. The literature and business practice review has identified a wide range of examples of mechanisms and solutions that can contribute to business model innovation for sustainability. The examples were collated and analysed to identify defining patterns and attributes that might facilitate categorisation. Sustainable business model archetypes are introduced to describe groupings of mechanisms and solutions that may contribute to building up the business model for sustainability. The aim of these archetypes is to develop a common language that can be used to accelerate the development of sustainable business models in research and practice. The archetypes are: Maximise material and energy efficiency; Create value from 'waste'; Substitute with renewables and natural processes; Deliver functionality rather than ownership; Adopt a stewardship role; Encourage sufficiency; Re-purpose the business for society/environment; and Develop scale-up solutions. © 2014 The Authors. An investigation in innovation management and entrepreneurial management is conducted in this thesis. The aim of the research is to explore changes of innovation styles in the transformation process from a start-up company to a more mature phase of business, to predict in a second step future sustainability and the probability of success. As businesses grow in revenue, corporate size and functional complexity, various triggers, supporters and drivers affect innovation and company's success. In a comprehensive study more than 200 innovative and technology driven companies have been examined and compared to identify patterns in different performance levels. All of them have been founded under the same formal requirements of the Munich Business Plan Competition -a research approach which allowed a unique snapshot that only long-term studies would be able to provide. The general objective was to identify the correlation between different factors, as well as different dimensions, to incremental and radical innovations realised. The 12 hypothesis were formed to prove have been derived from a comprehensive literature review. The relevant academic and practitioner literature on entrepreneurial, innovation, and knowledge management as well as social network theory revealed that the concept of innovation has evolved significantly over the last decade. A review of over 15 innovation models/frameworks contributed to understand what innovation in context means and what the dimensions are. It appears that the complex theories of innovation can be described by the increasing extent of social ingredients in the explanation of innovativeness. Originally based on tangible forms of capital, and on the necessity of pull and technology push, innovation management is today integrated in a larger system. Therefore, two research instruments have been developed to explore the changes in innovations styles. The Innovation Management Audits (IMA Start-up and IMA Mature) provided statements related to product/service development, innovativeness in various typologies, resources for innovations, innovation capabilities in conjunction to knowledge and management, social networks as well as the measurement of outcomes to generate high-quality data for further exploration. In obtaining results the mature companies have been clustered in the performance level low, average and high, while the start-up companies have been kept as one cluster. Firstly, the analysis exposed that knowledge, the process of acquiring knowledge, interorganisational networks and resources for innovations are the most important driving factors for innovation and success. Secondly, the actual change of the innovation style provides new insights about the importance of focusing on sustaining success and innovation ii 16 key areas. Thirdly, a detailed overview of triggers, supporters and drivers for innovation and success for each dimension support decision makers in putting their company in the right direction. Fourthly, a critical review of contemporary strategic management in conjunction to the findings provides recommendation of how to apply well-known management tools. Last but not least, the Munich cluster is analysed providing an estimation of the success probability of the different performance cluster and start-up companies. For the analysis of the probability of success of the newly developed as well as statistically and qualitative validated ICP Model (Innovativeness, Capabilities & Potential) has been developed and applied. While the model was primarily developed to evaluate the probability of success of companies; it has equal application in the situation to measure innovativeness to identify the impact of various strategic initiatives within small or large enterprises. The main findings of the model are that competitor, and customer orientation and acquiring knowledge important for incremental and radical innovation. Formal and interorganisation networks are important to foster innovation but informal networks appear to be detrimental to innovation. The testing of the ICP model h the long term is recommended as one subject of further research. Another is to investigate some of the more intangible aspects of innovation management such as attitude and motivation of mangers. IV

Purpose This study aims to present an in-depth theoretical and practical analysis of HRM practice in the light of Islamic values and principles. It looks at the four main HRM functions of recruitment and selection, training and development, performance appraisal, and rewards, from the Islamic perspective. Besides establishing a theoretical base for the influence of Islam on HRM, it analyses the key characteristics of HRM practice as applied in Jordanian universities and analyses the extent to which Islamic values are embedded in that practice. Design/methodology/approach The paper draws on a structured questionnaire distributed to 500 respondents working in four Jordanian universities which sought to elicit the respondents views on the influence of Islamic values within specific HR functions. Findings The findings indicate that there is a diffusion of Islamic values into HRM practice in the participating organisations. The extent of the diffusion varies between the organisations; there is a clear indication that explicitly Islamic values are being practiced, albeit to a limited extent. Originality/value The role of spirituality and/or religion in shaping the working of contemporary organisations is not sufficiently recognised in the literature. This paper is a response to the limited number of research studies assessing the extent of the absorption of religious values into the management of human resources. The study undertaken examines the current status of HRM practice in Jordanian universities and contributes to deepening the contemporary understanding of interactions between Islamic values and the core HR functions.

The desire to obtain competitive advantage is a motivator for implementing Enterprise Resource Planning (ERP) Systems (Adam & O’Doherty, 2000). However, while it is accepted that Information Technology (IT) in general may contribute to the improvement of organisational performance (Melville, Kraemer, & Gurbaxani, 2004), the nature and extent of that contribution is poorly understood (Jacobs & Bendoly, 2003; Ravichandran & Lertwongsatien, 2005). Accordingly, Henderson and Venkatraman (1993) assert that it is the application of business and IT capabilities to develop and leverage a firm’s IT resources for organisational transformation, rather than the acquired technological functionality, that secures competitive advantage for firms. Application of the Resource Based View of the firm (Wernerfelt, 1984) and Dynamic Capabilities Theory (DCT) (Teece and Pisano (1998) in particular) may yield insights into whether or not the use of Enterprise Systems enhances organisations’ core capabilities and thereby obtains competitive advantage, sustainable or otherwise (Melville et al., 2004). An operational definition of Core Capabilities that is independent of the construct of Sustained Competitive Advantage is formulated. This Study proposes and utilises an applied Dynamic Capabilities framework to facilitate the investigation of the role of Enterprise Systems. The objective of this research study is to investigate the role of Enterprise Systems in the Core Dynamic Capabilities of Asset Lifecycle Management. The Study explores the activities of Asset Lifecycle Management, the Core Dynamic Capabilities inherent in Asset Lifecycle Management and the footprint of Enterprise Systems on those Dynamic Capabilities. Additionally, the study explains the mechanisms by which Enterprise Systems sustain the Exploitability and the Renewability of those Core Dynamic Capabilities. The study finds that Enterprise Systems contribute directly to the Value, Exploitability and Renewability of Core Dynamic Capabilities and indirectly to their Inimitability and Non-substitutability. The study concludes by presenting an applied Dynamic Capabilities framework, which integrates Alter (1992)’s definition of Information Systems with Teece and Pisano (1998)’s model of Dynamic Capabilities to provide a robust diagnostic for determining the sustained value generating contributions of Enterprise Systems. These frameworks are used in the conclusions to frame the findings of the study. The conclusions go on to assert that these frameworks are free - standing and analytically generalisable, per Siggelkow (2007) and Yin (2003).
