La presente monografía tiene por objetivo analizar a través de la corriente constructivista de Alexander Wendt, cómo a partir de la política exterior de la Unión Europea, se crea una identidad europea que tiene efectos sobre Colombia a través de los Laboratorios de Paz. La creación de dicha identidad estuvo condicionada por la apropiación de ciertos mecanismos dentro de su política exterior, como la ayuda para el desarrollo y la diplomacia preventiva. Es de esta manera como la identidad europea afecta a Colombia a través de la creación de los Laboratorios de Paz por medio de mecanismos como actividades económicas alternativas y fuente de ingresos y empleo, sustitución de cultivos ilícitos, transferencia de conocimientos tecnológicos y administrativos, apoyo a procesos de paz al interior de la población, fortalecimiento institucional y participación ciudadana.

El presente trabajo analiza el sector panelero colombiano y la viabilidad de implementar un proyecto productivo capaz de transformar los residuos generados en el proceso de producción de la panela en nuevos productos como bioetanol o papel, de esta manera, se busca contribuir al cierre del ciclo productivo y la generación de nuevas alternativas de trabajo para la región. Para llevar a cabo este trabajo se realizó un estudio de campo en 15 trapiches de la región de Cundinamarca, donde se encontró que este residuo es utilizado dentro del proceso como fuente de energía (combustible). Adicionalmente, se revisó información secundaria relacionada con la producción de papel y etanol; posteriormente se realizó un proceso de análisis de la información enfocado en la capacidad energética del bagazo, los costos asociados a los procesos de producción y el impacto ambiental de los mismos, con el fin de determinar mediante un análisis de factibilidad la implementación de una nueva infraestructura que permita desarrollar procesos de producción. Finalmente, después de realizar el análisis de factibilidad teniendo en cuenta el impacto ambiental y la eficiencia energética del bagazo, teniendo en cuenta la cantidad de bagazo mensual producida y la capacidad instalada de las plantas de transformación de papel y etanol, se llegó a la conclusión que es más eficiente y viable utilizar este insumo como combustible en las moliendas de la región.

Dentro de este trabajo de investigación se quiere profundizar en la teoría que abarca la relación estratégica comunitaria en los mercados internacionales donde se quiere resaltar si ha habido investigaciones alrededor de este tema y si el aporte que se está dando en esta investigación realmente si es información nueva que se está investigando. Se quiere enfocar la investigación hacia como las empresas están realizando la penetración de mercados internacionales pensando en la comunidad en la que están ingresando, sus costumbres, creencias y aspectos sociales.

El presente estudio de caso tiene como propósito hacer un análisis de la influencia que ha tenido el Centro Internacional de Negocios y Exposiciones –Corferias– en el desarrollo urbano de la UPZ°107 Quinta Paredes entre los años 2000 y 2010. Este análisis parte de identificar a los recintos feriales como nodos que impulsan el desarrollo económico y el intercambio comercial, cultural y tecnológico entre las ciudades, lo que permite vislumbrar su importancia en términos de competitividad urbana. No obstante, dichos nodos también producen impactos en las dinámicas del desarrollo urbano, en tanto que ejercen una influencia en los aspectos sociales, espaciales, económicos y culturales de las ciudades. Las conclusiones del presente trabajo permiten entrever el papel que Corferias ha tenido en las transformaciones urbanísticas que se han generado en la UPZ°107 Quinta Paredes durante la primera década del siglo XXI.

The armed conflict in Colombia, which has generated over three million internally displaced persons, has dramatic humanitarian consequences and raises serious issues regarding the protection of displaced peoples’ rights. The underlying reasons for the displacement often lie in the dynamics associated with territorial control and land seizures undertaken for strategic, military or purely economic purposes. Domestic and international legal provisions have established the victims’ right to the restitution of their homes and property as the “preferred remedy” in cases of displacement. However, policies dealing with displacement, both those of the Colombian government and of several international institutions, fail to take this sufficiently into account. A comprehensive reparation policy for victims must necessarily entail the reversion of lands, territories and goods seized in Colombia under the pretext of the internal armed conflict.

Establishing the pattern of crime is fundamental for the successful investigation ofinternational crimes (genocide, war crimes, and crimes against humanity). A patternof crime is the aggregate of multiple incidents that share common features related tothe victims, the perpetrators, and the modus operandi. Pattern evidence and analysishave been used successfully, mainly in the investigation of large-scale killings, destruction,and displacement; the use for sexual violence charges has been remarkablymore limited. There is a need to overcome this gap by setting proper methods of datacollection and analysis. At the level of evidence collection, under-reporting should beaddressed through victimization surveys or secondary analysis of data available fromdifferent sources. At the level of analysis, the available evidence needs to be subject toimpartial examination beyond the pre-conceptions of the conflict parties and advocacygroups, in compliance with scientific standards for quantitative, qualitative, andGIS (Geographic Information Systems)methods. Reviewing the different investigativeexperiences and jurisprudence will help to set the right methodology and contribute mostefficiently to putting an end to the impunity regarding sexual crimes.

In trademark systems such as the Andean Community, a state authority verifiesthat the marks are distinctive, lawful and do not affect third parties, and after that,given their ownership. In this context, particular interest has sparked the possibilityof individuals by agreements or statements of co-existence, are who ensure that theirsigns meet the conditions for simultaneous registrations.Such agreements for the coexistence of marks are problematic if one thinks thatthe holders of interests that would be available also seem to matter to consumers,competitors and the market. Therefore, define the scope of contractual freedom inthe field of trademark law, whose rules are considered imperative, acquire practicaland theoretical importance because its realization i) recognizes the risks that maybe relevant to evaluating trade agreements and ii) contributes to debates on the roleof private autonomy in areas reserved for non-derogable norms. Thus, this researchputs the declarations of consent for the coexistence of registrations in Colombia, ina larger scope of the limits of freedom of contract.

Considering that the employment contract suspension responds to labor stability,one of the most important principles of labor law is important to study it because itsprincipal purpose is to maintain the link between de employer and the employeedespite the presence of adversity or other situations that would break up the relationshipin other fields. However, at the occurrence of any of the grounds of suspensionmay be presented some questions or voids that it will try to be answer in this paper.Consequently we shall refer first to the definition, purpose and characteristics of thesuspension. Subsequently, will be analyzed in detail every single ground of contractsuspension in Colombia. Then, will be studied the effects of the suspension andwe will refer to the resumption of work, and conclude with the comparative analysisof the figure in some Hispanic countries (Mexico, Paraguay and Spain).

Water, considered as an environmental resource and as an economic and social good, should be part of the Colombian public agenda, not only not only in terms of the use and preservation of hydro resources, but also in terms of the social implications of its possession and use. The world wide preoccupation with the diminution of natural resources, species extinction and water shortage has its origins in the seventies. One of the results was the establishment of international conventions and agreements to achieve responsible management of natural resources. Regarding water as a resource, it is intrinsically bound to the Earth’s natural processes and ecosystems. As regards the Colombian case, the “right to water in Colombia” is analyzed taking into account: water as an integral part of sustainable development, the right to water as a global debate and, finally, the right to water in the Colombian context within the explanatory framework of the Water Referendum.

The text argues that, even if different sectors of society have some strategic points of agreement on the issue of land, which converge on the specific issue of restitution, they strongly disagree on various other points. On one side are some who advocate “pure restitution” and consequently support a restitution policy that focuses on correcting the illegal dispossession and clarifying land titles and individual rights to property, which would serve to boost the land market and allow for rural development policies that modernize agricultural production, fundamentally based on large, corporate ownership. On the other end of the spectrum are advocates of what we call “comprehensive restitution,” who promote adopting a restitution policy that meets the requirements not only of corrective justice but also of recognition and redistribution, advancing the interest of peasant, indigenous, and afro-Colombian communities.
