As relações entre memória e justiça têm sido objeto constante de estudos. Parte desses estudos se desenvolve no campo da chamada justiça de transição. Dentro deste campo pode-se visualizar a demanda por responsabilização criminal de agentes estatais que praticaram delitos em um regime anterior. No caso da discussão sobre a transição brasileira após a ditadura militar de 1964 à 1985, é comum observar tal demanda, seja na literatura ou mesmo entre movimentos sociais e ativistas. Este trabalho pretende se inserir no debate sobre a transição brasileira, para entender quais funções a pena poderia desempenhar e, em que medida, a demanda por responsabilização criminal dos agentes da ditadura pode ser prejudicial à democracia. Pretende-se estudar, portanto, se a mencionada demanda por punição pode produzir efeitos positivos na transição brasileira. Assim, será possível analisar com maior clareza a necessidade de investir no discurso pela punição.

[ES]Este proyecto trata de revisar las diferentes Oficinas de Asistencia a las Víctimas de Delitos (OAVD) de algunas Comunidades Autónomas, desde la situación en la que se encuentran las personas víctimas de delitos que acuden a estos centros, hasta la manera de proceder de los mismos en relación a su labor (asistencia, orientación, protección, ayuda, etc. a éstas); así como de delimitar las funciones que realizan con el fin de subrayar la necesidad de un modelo de atención integral a víctimas de delitos, entendido en un sentido amplio, complejo y diverso

Esta dissertação apresenta um panorama acerca da responsabilização dos crimes de violência sexual contra crianças e adolescentes no Brasil de 1990 a 2011 - 21 (vinte e um) anos da promulgação do Estatuto da Criança e do Adolescente (ECA). Destaca os projetos, programas e políticas implementados, bem como as alterações no ECA e no Código Penal no período, oferecendo subsídios para uma análise crítica da concepção de política pública adotada na área. Também apresenta uma amostra dos casos sentenciados a partir de 120 (cento e vinte) denúncias realizadas ao Disque Denúncia Nacional (Disque 100) e de 18 (dezoito) casos atendidos por Centros de Defesa da Criança e do Adolescente filiados à Associação Nacional dos Centros de Defesa (ANCED). Ressalta a escassez de ações voltadas para os autores de violência sexual, a tendência ao recrudescimento de penas nessa área e a influência de agências e organismos internacionais em relação às políticas públicas para crianças e adolescentes no Brasil

[ES]Se aborda la Mediación Penal desde la perspectiva de la nueva normativa que ha entrado en vigor o estará vigente próximamente. Incluye un estudio sobre la supresión de las faltas, la creación de los denominados Delitos Leves en el Código Penal y la incorporación del Principio de Oportunidad. (Reforma del Código Penal y Ley de Enjuiciamiento Criminal). Especial relevancia del Estatuto de la Víctima del Delito, y la influencia y aplicación a Víctimas de Violencia de Género. Así como la especial consideración a la Justicia Restaurativa en la Mediación Penal. Se elabora un estudio sobre la Mediación Penal en los Anteproyectos de Reforma de 2011 y 2012.

Reproductive data collected from porbeagle, shortfin mako, and blue sharks caught around New Zealand were used to estimate the median length at maturity. Data on clasper development, presence or absence of spermatophores or spermatozeugmata, uterus width, and pregnancy were collected by observers aboard tuna longline vessels. Direct maturity estimates were made for smaller numbers of sharks sampled at recreational fishing competitions. Some data sets were sparse, particularly over the vital maturation length range, but the availability of multiple indicators of maturity made it possible to develop estimates for both sexes of all three species. Porbeagle shark males matured at 140–150 cm fork length and females at about 170–180 cm. New Zealand porbeagles therefore mature at shorter lengths than they do in the North Atlantic Ocean. Shortfin mako males matured at 180–185 cm and females at 275 –285 cm. Blue shark males matured at about 190 –195 cm and females at 170–190 cm; however these estimates were hampered by small sample sizes, difficulty obtaining representative samples from a population segregated by sex and maturity stage, and maturation that occurred over a wide length range. The U.S. Atlantic coast and Gulf of Mexico commercial shark fisheries have greatly expanded over the last 30 years, yet fishery managers still lack much of the key information required to accurately assess many shark stocks. Fishery observer programs are one tool that can be utilized to acquire this information. The Commercial Shark Fishery Observer Program monitors the U.S. Atlantic coast and Gulf of Mexico commercial bottom longline (BLL) large coastal shark fishery. Data gathered by observers were summarized for the 10-year period, 1994 to 2003. A total of 1,165 BLL sets were observed aboard 96 vessels, with observers spending a total of 1,509 days at sea. Observers recorded data regarding the fishing gear and methods used, species composition, disposition of the catch, mortality rates, catch per unit of effort (sharks per 10,000 hook hours), and bycatch of this fishery. Fishing practices, species composition, and bycatch varied between regions, while catch rates, mortality rates, and catch disposition varied greatly between species.

John Otterbein Snyder (1867–1943) was an early student of David Starr Jordan at Stanford University and subsequently rose to become an assistant professor there. During his 34 years with the university he taught a wide variety of courses in various branches of zoology and advised numerous students. He eventually mentored 8 M.A. and 4 Ph.D. students to completion at Stanford. He also assisted in the collection of tens of thousands of fish specimens from the western Pacific, central Pacific, and the West Coast of North America, part of the time while stationed as “Naturalist” aboard the U.S. Fish Commission’s Steamer Albatross (1902–06). Although his early publications dealt mainly with fish groups and descriptions (often as a junior author with Jordan), after 1910 he became more autonomous and eventually rose to become one of the Pacific salmon, Oncorhynchus spp., experts on the West Coast. Throughout his career, he was especially esteemed by colleagues as “a stimulating teacher,” “an excellent biologist,” and “a fine man.

Fishery observers collected data from 307 tows during 96 trips aboard skimmer trawl vessels in Louisiana’s coastal waters from September 2004 through June 2005 to estimate catch rates of target and nontarget species, including sea turtles (Cheloniidae and Dermochelyidae), by area and season during commercial shrimping operations. About 16,965.7 kg of total catch were recorded during 517.0 hours of fishing operations. Based on weight extrapolations from species composition samples, penaeid shrimp (Penaeidae) dominated the catch at 66%, followed by finfish at 19%, nonpenaeid shrimp crustaceans at 7%, discarded penaeid shrimp at 6%, and debris at 3%. Noncrustacean invertebrates comprised less than 1%. Catch rates in kilograms per hour by category was 21.6 for penaeid shrimp, 6.2 for finfish, 2.2 for nonpenaeid crustaceans, 1.8 for discarded penaeid shrimp, and 0.9 for debris. White shrimp, Litopenaeus setiferus, other penaeid shrimp, and Gulf menhaden, Brevoortia patronus, were the top three dominant species by weight. Seasonally, a higher catch rate was observed from May through August 2005 for penaeid shrimp as compared with the September through December 2004 period. Conversely, the September through December 2004 period experienced a higher catch rate for finfish than during May through August 2005. No sea turtle interactions were documented.

Data collected by fisheries observers aboard U.S. pelagic longline vessels were examined to quantify and describe elasmobranch bycatch off the southeastern U.S. coast (lat. 22°–35°N, long. 71°–82°W). From 1992 to 2000, 961 individual longline hauls were observed, during which 4,612 elasmobranchs (15% of the total catch) were documented. Of the 22 elasmobranch species observed, silky sharks, Carcharhinus falciformis, were numerically dominant (31.4% of the elasmobranch catch). The catch status of the animals (alive or dead) when the gear was retrieved varied widely depending on the species, with high mortalities seen for the commonly caught silky and night, C. signatus, sharks and low mortalities for rays (Dasyatidae and Mobulidae), blue, Prionace glauca; and tiger, Galeocerdo cuvier; sharks. Discard percentages also varied, ranging from low discards (27.6%) for shortfin mako, Isurus oxyrinchus, to high discards for blue (99.8%), tiger (98.5%), and rays (100%). Mean fork lengths indicated the majority of the observed by-catch — regardless of species — was immature, and significant quarterly variation in fork length was found for several species including silky; dusky, C. obscurus; night; scalloped hammerhead, Sphyrna lewini; oceanic whitetip, C. longimanus; and sandbar, C. plumbeus; sharks. While sex ratios overall were relatively even, blue, tiger, and scalloped hammerhead shark catches were heavily dominated by females. Bootstrap methods were used to generate yearly mean catch rates (catch per unit effort) and 95% confidence limits; catch rates were generally variable for most species, although regression analysis indicated significant trends for night, oceanic whitetip, and sandbar sharks. Analysis of variance indicated significant catch rate differences among quarters for silky, dusky, night, blue, oceanic whitetip, sandbar, and shortfin mako sharks.

The National Marine Fisheries Service’s Alaska Fisheries Science Center (AFSC) has a long and successful history of conducting research in cooperation with the fishing industry. Many of the AFSC’s annual resource assessment surveys are carried out aboard chartered commercial vessels and the skill and experience of captains and crew are integral to the success of this work. Fishing companies have been contracted to provide vessels and expertise for many different types of research, including testing and evaluation of survey and commercial fishing gear and development of improved methods for estimating commercial catch quantity and composition. AFSC scientists have also participated in a number of industry-initiated research projects including development of selective fishing gears for bycatch reduction and evaluating and improving observer catch composition sampling. In this paper, we describe the legal and regulatory provisions for these types of cooperative work and present examples to illustrate the process and identify the requirements for successful cooperative research.

An observer program of the shark drift gillnet fishery off the Atlantic coast of Florida and Georgia was begun in 1993 to define the fishery and estimate bycatch including bottlenose dolphin, Tursiops truncatus, and sea turtles. Boats in the fishery were 12.2-19.8 m long. Nets used were 275-1,800 m long and 3.2-4.1 m deep. Stretched-mesh sizes used were 12.7-29.9 cm. Fishing trips were usually <18 h and occurred within 30 n.mi. of port. Fishing with an observer aboard occurred between Savannah, Ga., and Jacksonville, Fla., and off Cape Canaveral, Fla. Nets were set at least 3 n.mi. offshore. Numbers of boats in the fishery increased from 5 in 1993 to 11 in 1995, but total trips decreased from 185 in 1994 to 149 in 1995. During 1993-95, 48 observer trips were completed and 52 net sets were observed. No marine mammals were caught and two loggerhead turtles, Caretta caretta, were caught and released alive. A total of 9,270 animals (12 shark, 21 teleost, 4 ray, and 1 sea turtle species) were captured. Blacknose, Carcharhinus acronotus; Atlantic sharpnose, Rhizoprionodon terraenovae; and blacktip shark, C. limbatus), were the dominant sharks caught. King mackerel, Scomberomorus cavalIa; little tunny, Euthynnus alleteratus; and cownose ray, Rhinoptera bonasus, were the dominant bycatch species. About 8.4% of the total catch was bycatch. Of the totals, 9.4% of the sharks and 37.3% ofthe bycatch were discarded.

South African (Cape) fur seals, Arctocephalus pusillus pusillus, interact with the South African trawl fisheries-offshore demersal, inshore demersal, and midwater fisheries. These interactions take thef ollowing forms: Seals take or damage netted fish, on particular vessels they become caught in the propeller, seals drown in the nets, live seals come aboard and may be killed. Except in specific cases of seals damaging particular trawler propellers, interactions result in little cost to the offshore and midwater trawl fisheries. For the inshore fishery, seals damage fish in the net at an estimated cost in excess of R69, 728 (US$18,827) per year, but this is negligible (0.3%) in terms ofthe value of the fishery. Seal mortality is mainly caused by drowning in trawl nets and ranges from 2,524 to 3,636 seals of both sexes per year. Between 312 and 567 seals are deliberately killed annually, but this most likely takes place only when caught and they enter the area below deck, where they are difficult to remove, and pose a potential threat to crew safety. Overall, seal mortality during trawling operations is negligible (0.4-0.6%) in terms of the feeding population of seals in South Africa.

Pelagic pair trawling for tuna, Thunnus spp., and swordfish, Xiphias gladius, was introduced in U.S. Northwest Atlantic waters in 1991. During autumn (October-November) of 1992 under the authority oft he Federal Atlantic Swordfish Regulations, the National Marine Fisheries Service placed observers aboard pelagic pair trawl vessels to document the catch, bycatch, discard, and gear used in this new fishery. The fishery is conducted primarily at night along shelf-edge waters from June to November. In late 1991, revised regulations restricted swordfish to bycatch in this fishery resulting in pelagic pair trawl vessels targeting tuna throughout 1992. Analyses of 1992 data indicate that albacore, T. alalunga, was the predominant species caught, although yellowfin tuna, T. albaeares, and bigeye tuna, T. obesus, were the preferred target species. Bycatch also included swordfish, large sharks, pelagic rays and other pelagic fishes, other tunas, and marine mammals.

A presente dissertação propõe analisar o perigo como fundamento de punibilidade de condutas humanas e suas reverberações no campo dogmático para comprovar a tese de sua progressiva perda de materialidade na dogmática penal hodierna. Para tanto se adotou como principais linhas de análise os institutos da tentativa, da teoria do bem jurídico e da estrutura dos crimes de perigo. Inicialmente, objetivando pontuar o local da fala e das críticas que se direcionam as construções atuais, problematizou-se a própria concepção dogmática optando por um paradigma de contenção do poder punitivo como decorrência da deslegitimação da pena já denunciada pela criminologia crítica, negando, portanto, qualquer função tutelar no direito penal ou desnecessidade de ofensividade na estrutura típica. Por fim, como marco teórico possível de análise da mutação que se observa no desenvolver histórico, apontam-se as tendências político-criminais atuariais no âmbito da dogmática penal, como uma vertente de legitimação (simbólica) da opção política hodierna pelo Estado Penal.

A propriedade de auto-cura, em redes inteligente de distribuição de energia elétrica, consiste em encontrar uma proposta de reconfiguração do sistema de distribuição com o objetivo de recuperar parcial ou totalmente o fornecimento de energia aos clientes da rede, na ocorrência de uma falha na rede que comprometa o fornecimento. A busca por uma solução satisfatória é um problema combinacional cuja complexidade está ligada ao tamanho da rede. Um método de busca exaustiva se torna um processo muito demorado e muitas vezes computacionalmente inviável. Para superar essa dificuldade, pode-se basear nas técnicas de geração de árvores de extensão mínima do grafo, representando a rede de distribuição. Porém, a maioria dos estudos encontrados nesta área são implementações centralizadas, onde proposta de reconfiguração é obtida por um sistema de supervisão central. Nesta dissertação, propõe-se uma implementação distribuída, onde cada chave da rede colabora na elaboração da proposta de reconfiguração. A solução descentralizada busca uma redução no tempo de reconfiguração da rede em caso de falhas simples ou múltiplas, aumentando assim a inteligência da rede. Para isso, o algoritmo distribuído GHS é utilizado como base na elaboração de uma solução de auto-cura a ser embarcada nos elementos processadores que compõem as chaves de comutação das linhas da rede inteligente de distribuição. A solução proposta é implementada utilizando robôs como unidades de processamento que se comunicam via uma mesma rede, constituindo assim um ambiente de processamento distribuído. Os diferentes estudos de casos testados mostram que, para redes inteligentes de distribuição compostas por um único alimentador, a solução proposta obteve sucesso na reconfiguração da rede, indiferentemente do número de falhas simultâneas. Na implementação proposta, o tempo de reconfiguração da rede não depende do número de linhas nela incluídas. A implementação apresentou resultados de custo de comunicação e tempo dentro dos limites teóricos estabelecidos pelo algoritmo GHS.
