A obrigatoriedade do Poder Legislativo em editar norma regulamentadora em face de decisão em mandado de injunção

A falta de regulamentação de muitos pontos da Carta Constitucional motivou a nova postura do Superior Tribunal Federal – alargar a acepção inicial do Mandado de Injunção, no sentido de conceder um prazo ao legislador para que regulamente o que ainda não o está, sob pena de, vencido o prazo, passar o requerente a gozar o direito constitucional. O início deste trabalho irá tratar da separação dos Poderes, do Estado Democrático de Direito e de sua abordagem na Constituição Federal. O segundo capítulo irá estudar o Poder Legislativo e a edição de normas, leis, finalidade e a relação entre o Legislativo e a Carta Magna de 1988. No terceiro e último capítulo, adentraremos ao Mandado de Injunção, bem como sua finalidade precípua e o alcance das liberdades constitucionais. Ainda no mesmo capítulo, será revista a contraposição entre a omissão legislativa e o Mandado de Injunção, bem como a postura do Poder Judiciário em relação a essa questão. No fim desse capítulo, será analisado o procedimento do Mandado de Injunção e o posicionamento do STF acerca da matéria e, dentro desse contexto, será avaliada a existência ou não de imposição, pelo Poder Judiciário ao poder legiferante, de produzir a norma faltante, previamente ordenada pela Constituição Federal. Ao seu final, será estudado os Mandados de Injunção nº 232-1/RJ, 323-8/DF e 712/PA.

结构弛豫对Zr_(64.13)Cu_(15.75)Ni_(10.12)Al_(10)块体非晶合金硬度和剪切带特征的影响

通过接近玻璃转变温度的等温退火获得不同弛豫状态的Zr64.13Cu15.75Ni10.12Al10块体非晶合金样品。利用维氏显微硬度计和洛氏硬度计研究结构弛豫对合金硬度和压痕周围剪切带特征的影响规律。结果表明:在590K等温退火处理使Zr64.13Cu15.75Ni10.12Al10块体非晶合金发生焓弛豫行为,其维氏显微硬度随退火时间的延长较快增加后趋于稳定,而大载荷洛氏硬度对结构弛豫不敏感。通过洛氏压痕周围剪切带特征的研究,定量比较了结构弛豫对剪切带间距、数量的影响规律。

Régimen jurídico de las lenguas y reconocimiento de la diversidad lingüística en el Tratado por el que se establece una Constitución para Europa

The territory of the European Union is made up of a rich and wide-ranging universe of languages, which is not circumscribed to the «State languages». The existence of multilingualism is one of Europe’s defining characteristics and it should remain so in the constantly evolving model of Europe’s political structure. Nonetheless, until now, the official use of languages has been limited to the «State languages» and has been based on a concept of state monolingualism that has led to a first level of hierarchization among the languages of Europe. This has affected the very concept of European language diversity. The draft of the treaty establishing a European Constitution contains various language-related references that can be grouped in two major categories: on the one hand, those references having to do the constitutional status of languages, and on the other, those regarding the recognition of European language diversity. Both issues are dealt with in this article. In analyzing the legal regime governing languages set forth in the draft of the constitutional treaty, we note that the draft is not based on the concept of the official status of languages. The language regulation contained in the draft of the constitutional treaty is limited in character. The constitutional language regime is based on the concept of Constitutional languages but the official status of languages is not governed by this rule. The European Constitution merely enunciates rights governing language use for European citizens vis-à-vis the languages of the Constitution and refers the regulation of the official status of languages to the Council, which is empowered to set and modify that status by unanimous decision. Because of its broad scope, this constitutes a regulatory reservation. In the final phase of the negotiation process a second level of constitutional recognition of languages would be introduced, linked to those that are official languages in the member states (Catalan, Basque, Galician, etc.). These languages, however, would be excluded from the right to petition; they would constitute a tertium genus, an intermediate category between the lan guages benefiting from the language rights recognized under the Constitution and those other languages for which no status is recognized in the European institutional context. The legal functionality of this second, intermediate category will depend on the development of standards, i.e., it will depend on the entrée provided such languages in future reforms of the institutional language regime. In a later section, the article reflects on European Union language policy with regard to regional or minority languages, concluding that the Union has not acted in accordance with defined language policy guidelines when it has been confronted, in the exercise of its powers, with regional or minority languages (or domestic legislation having to do with language demands). The Court of Justice has endeavoured to resolve on a case by case basis the conflicts raised between community freedoms and the normative measures that protect languages. Thus, using case law, the Court has set certain language boundaries for community freedoms. The article concludes by reflecting on the legal scope of the recognition of European language diversity referred to in Article II-82 of the European Constitution and the possible measures to implement the precept that might constitute the definition of a true European language policy on regional or minority languages. Such a policy has yet to be defined.

Pravastatin inhibits cell proliferation and increased MAT1A expression in hepatocarcinoma cells and in vivo models

Background: Statins may have therapeutic effects on hepatocarcinoma (HCC). This type of disorder is the most common malignant primary tumour in the liver. Our objective was to determine whether pravastatin had a therapeutic effect in vitro and in vivo models. Method: We design in vitro and in vivo model. In vitro we used PLC and determine cell proliferation. In vivo, we used and animal model to determined, PCNA and MAT1A expression and transaminases levels. Results: We found that pravastatin decreases cell proliferation in vitro (cell proliferation in pravastatin group was 82%, in sorafenib group 51% and in combined group 40%) and in vivo (in pravastatin group 80%, in sorafenib group 76.4% and in combined group 72.72%). The MAT1A levels, was significantly higher in Pravastatin group (D 62%, P 94%, S 71%, P + S 91%). The transaminases levels, decreased significantly in Pravastatin group (GOT and GPT levels D 619.5 U/L; 271 U/L) (P 117.5 U/L; 43.5 U/L) (S 147 U/L; 59 U/L) (P + S 142 U/L; 59 U/L). Conclusion: The combination of pravastatin + sorafenib were more effective than Sorafenib alone.

A participação feminina na construção de um parlamento democrático

Elabora um histórico da luta da mulher pela conquista da cidadania no Brasil, tomando por base a Assembleia Constituinte de 1933 e a Assembleia Constituinte de 1987. Aborda os seguintes itens: a influência do movimento feminista no Brasil e a conquista do direito de voto; composição da bancada feminina e os temas propostos pelas mulheres durante as duas Assembleias Nacionais Constituintes; conquistas femininas no mercado de trabalho e na participação política.

Representação feminina na Câmara dos Deputados

Debate atual em torno de questões que visam ao crescimento e ao fortalecimento da representatividade feminina parlamentar em nível nacional. Com base na revisão da literatura sobre a história da mulher, sobre o gênero e sobre o poder simbólico, busca-se verificar que possíveis fatores podem ser limitadores à ampliação dessa representatividade após a edição da Lei nº 9504/1997 e da Lei nº 12.034/2009. Parte-se do fato de que a bancada feminina na Câmara dos Deputados representa apenas 8,77% de um universo de 513 parlamentares e analisam-se as referidas leis, descrevendo-se, como exemplo, o perfil das eleições de 2006 e de 2010 e o contexto que envolve o universo feminino do ponto de vista material e simbólico.
