This thesis examines the regulatory and legislative approach taken in the United Kingdom to deal with deaths arising from work related activities and, in particular, deaths that can be directly attributed to the behaviour of corporations and other organisations. Workplace health and safety has traditionally been seen in the United Kingdom as a regulatory function which can be traced to the very earliest days of the Industrial Revolution. With an emphasis on preventing workplace accidents and ill-health through guidance, advice and support, the health and safety legislation and enforcement regime which had evolved over the best part of two centuries was considered inadequate to effectively punish corporations considered responsible for deaths caused by their activities following a series of disasters in the late twentieth and early twenty-first centuries. To address this apparent inadequacy, the Corporate Manslaughter and Corporate Homicide Act 2007 was introduced creating the offence of corporate manslaughter and corporate homicide. Based on a gross breach of a relevant duty of care resulting in the death of a person, the Act effectively changed what had previously considered a matter of regulation, an approach that had obvious weaknesses and shortcomings, to one of crime and criminal law. Whether this is the best approach to dealing with deaths caused by an organisation is challenged in this thesis and the apparent distinction between ‘criminal’ and ‘regulatory’ offences is also examined. It was found that an amended Health and Safety at Work etc. Act 1974 to include a specific offence of corporate killing, in conjunction with the Health and Safety (Offences) Act 2008 would almost certainly have resulted in a more effective approach to dealing with organisations responsible for causing deaths as consequence of their activities. It was also found that there was no substantive difference between ‘regulatory’ and ‘criminal’ law other than the stigma associated with the latter, and that distinction would almost certainly disappear, at least in the context of worker safety, as a consequence of the penalties available following the introduction of the Health and Safety (Offences) Act 2008.

This research is based on the hypothesis that law and order model is displacing the procedura justice system in Spain. After a thorough review of the international literature, one can observe that the traditional structure of the penal system does not seem to be capable of containing the new forms of crime. The new penal model assumes that public opinion is alarmed and unwilling to understand rational approaches to crime, so it will be likely to accept measures aimed at calming the fear of crime, through extensive control policies and penal tools to manage uncivil behavior. Objectives and methodology A measuring instrument has been developed to confirm this hypothesis, consisting of ten features that characterize the law and order model. This instrument has been used to identify examples of its ten features in the rules and practices developed at each phase of the Spanish criminal justice system. The analysis has focused specifically on public discourse about delinquency, criminal policy decisions, legislative processes, police routines, judicial dynamics, and prison system practices. Main results The investigation has shown that there are many processes and practices indicating that the law and order model is consolidating itself in the Spanish penal system. Nevertheless this process has a different intensity at each phase, being stronger at the legislative stage and softer in the penitentiary enforcement phase. One of the main conclusions is, therefore, that the designed instrument is ideal for measuring the degree of penetration of the model throughout the system. Some of the most striking results of the reasearch will be presented at the conference. Finally, proposals arise that could prevent the new model is fully seated in our criminal justice system, finding that the trend toward more severe penalties shown already unsustainable.

Attaran and colleagues in an open letter to WHO expressed their concern about the upcoming Olympic and Paralympic Games in Rio de Janeiro and the threat posed by the Zika epidemic (Attaran 2016). We agree that Zika virus is of great public health concern and much remains to be known about this disease. Care should be taken to reduce the risk of infection, especially to pregnant women. However, we argue that this is not sufficient reason for changing the original plans for the Games, in particular because of the time of the year when they will take place. The present article outlines several scientific results related to Zika and mosquito-borne infectious diseases dynamics that we believe ratify the current position of WHO in not endorsing the postponing or relocation of the 2016 Olympic and Paralympic Games (WHO 2016).

Background: Indoor aeroallergens are the main cause of sensitization in children and represent a risk factor for the development of allergic diseases. Objective: Identify the major indoor aeroallergens most often sensitized to pediatric patients treated at the Allergy Service at the “Dr. José Eleuterio González” University Hospital of Monterrey Methods: We performed an observational and descriptive study where we reviewed reports of positive skin tests to the following common indoor aeroallergens: Dermatophagoides farinae (D. farinae), Dermatophagoides pteronyssinus (D. pteronyssinus), Canis familiaris (C. familiaris), Felis domesticus (F. domesticus), Blattella germanica (B. germanica) and Periplaneta americana (P. americana), found in patients under 16 years with symptoms of allergy, during the period of 2011-2012. Results: We performed 439 skin tests to aeroallergens in pediatric patients. Of these, 57.6% were male and 42.4% were female. Mean age was 6.3 years. The age groups were under 3 years: 17.8%, 3-5 years: 35%, 6-12 years: 36%, and 13-16 years: 11.2%. The main diagnoses were: allergic rhinitis (71.8%), asthma (16.6%), and atopic dermatitis (4.3%). In 57.9% of the cases, they had at least one positive skin test to any aeroallergen. The rate of sensitization to speciic aeroallergens was: D. Pteronyssinus 49.0%, D. farinae 44.6%, B. germanica 13.9%, P. Americana 10.9%, F. domesticus 10.7%, and C. familiaris 5.9%. Conclusion: Indoor aeroallergen sensitization can occur early in life, although it was more frequent in the preschooler and elementary school group. Dust house mites were the most commom cause of allergic sensitization.

This project in teaching innovation and improvement aims to disseminate the case method as one of the most innovative educational instruments inteaching of Law in general, and specifically with regard to Family and Inheritance Law. The methodology used ensures learning through a legal conflict, which must be resolved by the students themselves from different viewpoints as legal agents. This is an activity in teaching innovation, in which students become the protagonists. Participation is voluntary, and the main aim is student motivation. The subject's aim is for students to learn public speaking skills fundamental to the profession while familiarising themselves with judicial practice. Theteacher sets up a legal conflict in order for students to resolve the dispute as legal agents with divergent viewpoints - in other words, as judges, attorneys, lawyers and so on. The project seeks alternatives to traditional teaching methods and is an innovative teaching method aimed at professionally training future lawyers as well as being a model that involves students more in their own learning.

Following the methodology of Ferreira and Dionísio (2016), the objective of this paper is to analyze the behavior stock markets in the G7 countries and find which of those countries is the first to reach levels of long-range correlations that are not significant. We carry out this analysis using detrended cross-correlation analysis and its correlation coefficient, to check for the existence of long-range dependence in time series. The existence of long-range dependence could be understood as a possibility of EMH violation. This analysis remains interesting because studies are not conclusive about the existence or not of long memory in stock return rates.

La problématique des marquages corporels en tant que pratiques ancestrales s'insèrent dans des formes contemporaines d'inscription corporelle. Nous nous sommes permis d'essayer de savoir s'il s'agissait toujours d'une expression d'un malaise psychologique important ? Quelles peuvent en être les conséquences ? Pourquoi marquer le corps ? La mise en oeuvre de ce travail s'est articulée en deux phases, au départ, nous avons opéré par une pré-enquête d'envergure qui a regroupé 200 adolescents (10 filles et 190 garçons). Ensuite et dans un deuxième temps nous avons interrogé dix adolescents qui se marquent la peau dont trois garçons, âgés de quinze à dix-neuf ans. Grâce à une « tri approche » : Entretien clinique, tests du Rorschach et du TAT. Les résultats auxquels nous sommes parvenus peuvent être résumés comme suit : ces pratiques expriment une souffrance qui peine à trouver une voie d'expression symbolique autre que le corps, l'angoisse et la relation d'objet du type anaclitique, l'organisation défensive renseigneraient essentiellement sur des défenses narcissiques, centrées notamment autour du clivage et le retournement sur soi, une identité fragile marquée par une image du corps et représentation de soi fragiles et un sur (dés) investissement des limites. Il s'agit d'une emprise sur le corps et sur les marques mêmes, permettant de retrouver l'objet et le recréer. À partir des principaux résultats obtenus, nous envisageons de travailler, en filigrane sur les spécificités des types de marquages corporels existant en Algérie. En effet si le présent travail s'est étayé sur une analyse prônant la globalité, un comparatif entre les types de marquages, de même, l'établissement d'un lien entre la symbolique de certaines pratiques et les soubassements psychodynamiques qui l'entourent, serait d'un apport considérable dans la compréhension du fait étudié dans ses moindres « recoins ». -- The problem of the physical markings as ancestral practices fit into contemporary forms of physical registration. We allowed to try to know if it was always about an expression of an important psychological illness? What can be the consequences? Why to mark the body? The application of this work articulated in two phases, at first, we operated by a large-scale pre- inquiry which grouped together 200 teenagers (10 girls and 190 boys). Then and in the second time we interrogated ten teenagers who mark the skin among which three boys, from fifteen to nineteen years old. Thanks to one « sorting approaches »: clinical Interview, tests of Rorschach and TAT. The results which we reached can be summarized as follows: these practices express a suffering which has difficulty in finding a way of symbolic expression other one than the body, the fear and the relation of object of the type anaclitique, the defensive organization would inform essentially about narcissistic defences, centred notably around the cleavage and the reversal on one, a fragile identity marked by an image of the body and the representation of one fragile and one on investment of the limits. It is about an influence on the body and on the marks, allowing to find the object and to recreate it. From the main obtained results, we intend to work, between the lines on the specificities of the types of physical markings existing in Algeria. Indeed if the present work supported on an analysis lauding the global nature, a comparative degree between the types of markings, also, the establishment of a link between the symbolism of certain practices and the bases psychodynamiques who surround him, would be of a considerable contribution in the understanding of the fact studied in its slightest « hidden recesses ».

El retiro del servicio de los empleados públicos aparece como una facultad reglada en las normas del empleo público que, cuando se da alguna de las hipótesis legales que lo hacen procedente, facultan al nominador para ejercer sus atribuciones legales, persiguiendo, ante todo, razones del servicio: su mejora, renovación, eficiencia y moralidad, entre otras. A partir del concepto de una buena administración del Estado, establecer la procedencia y elementos estructurales de una política de prevención del daño antijurídico en relación con el retiro del servicio de servidores públicos que, conforme al ordenamiento jurídico gozan de una especial protección constitucional. Conocer el concepto, el alcance, la regulación y desarrollo jurisprudencial de esta trascendental atribución para el servicio público, resulta indispensable para la debida aplicación del derecho, del ejercicio de las atribuciones públicas por parte de la Administración, y para la prevención del daño antijurídico.

This work deals with the problematic of the determinations that contribute to become the adolescents involved with law. Thus, in this research, the social exclusion is apprehended as one of the most important determining to understand this problematic, once we defend that it is part of the trajectory of this adolescent's life since its birth as a punishment that starts before they becoming envolved in act's that break the law. It is still questioned the discussion of the reduction of the penal age, viewed aa a proposal that will contribute to perpetuate the repression. The objectives of the research were: analyze the problematic of adolescents in conflict with law, where social exclusion is seen here as a main category. The research also aims to understand the situation towards social exclusion and that this public is undertaken in the state of Rio Grande do Norte, more specifically in Natal. This is dane through analysis of the profile of adolescents that are submitted to the treatment at Centro Integrate de Atendimento ao Adolescente Acusado de Ato Infracional - CIAD in 2005. This is dane on arder to identify of the State's and society's actions towards this issue, how it has prevailed in analyzing if there is punishing or social protection. The research also contributed with discussion towards the non penal reduction of for underage minors. The approach realized if of qualiquantitative nature. The research was realized with 190 male adolescent subjects, age ranging from 12 to 21 that were interns at CIAD in the year of 2005. The research shows that their fundamental rights (education, health, amongst others) are disrespected on a daily basis by the State. The State prioritizes economic issues, making social inequality more profound. The main argument is that this problematic has its main oring in the social exclusion and it is imposed to the adolescents as a punishment before thes have been involved with the law going on top of the social protection. When the adolescent goes from being the victim to executioner, the Statute of Children and Adolescents is questioned by many sectors that defend the reduction of penal minority as a solution to reduce the country's violence. Thus, it was aimed here to discuss arguments that point to non exclusion, discrimination and repression. It is proposed that the State should assume children and adolescents as a priority, implementing what the statute establishes as well as assures related to the fruition of denied rights as a way to prevent their future involvement with violence

This study aime to estimate the properties of the Escala de percepção de professores dos comportamentos agressivos de crianças na escola. The research was conducted in a socio-educational institution in two phases. In the first one different educators completed the scale concerning the children and teenagers who attended the institution (N = 100). In the second, the children and teenagers with the highest or the lowest scores on the scale above (n = 60) responded to the Children’s Action Tendency Scale, which investigates strategies of conflict resolution. The results demonstrated adequate reliability of the scale of perception. However, they indicated that the educators’ evaluation did not correspond to how children and teenagers judged the hypothetical conflicts since the boys were rated as more aggressive than girls on the perception scale.

La tesis estudia una serie de intervenciones gestadas en el ámbito judicial que se ocuparon de regular la vida de niños y jóvenes acusados de delinquir. Nominados como 'menores', se trataba de un sector de la población que se encontraba fuera de los marcos normativos previstos por la definición moderna de la infancia y la juventud. En este sentido, el objetivo principal de la investigación es presentar una primera aproximación a tres aspectos vinculados a la construcción social de la minoridad en la provincia de Buenos Aires en el período comprendido entre 1930 y 1943. En primer lugar, pensar la transformación de la forma de concebir los delitos cometidos por los niños y jóvenes y de juzgar sus transgresiones, iniciada en la década de 1920 y consolidada en la década de 1930. En segundo lugar, pensar la configuración de ideas punitivas estructuradas sobre la educación como un elemento clave para reemplazar el castigo tradicional para este sector de la población. En tercer lugar, pensar la centralidad conferida a la familia en dichas ideas y en las prácticas judiciales, que la erigían como una estrategia de solución y como la causa principal del peligro diagnosticado
