Performance Information and Innovation in the Canadian Government (Working Paper 43)

The presentation made at the conference addressed the issue of linkages between performance information and innovation within the Canadian federal government1. This is a three‐part paper prepared as background to that presentation. • Part I provides an overview of three main sources of performance information - results-based systems, program evaluation, and centrally driven review exercises – and reviews the Canadian experience with them. • Part II identifies and discusses a number of innovation issues that are common to the literature reviewed for this paper. • Part III examines actual and potential linkages between innovation and performance information. This section suggests that innovation in the Canadian federal government tends to cluster into two groups: smaller initiatives driven by staff or middle management; and much larger projects involving major programs, whole departments or whole-of-government. Readily available data on smaller innovation projects is skimpy but suggests that performance information does not play a major role in stimulating these initiatives. In contrast, two of the examples of large-scale innovation show that performance information plays a critical role at all stages. The paper concludes by supporting the contention of others writing on this topic: that more research is needed on innovation, particularly on its link to performance information. In that context, other conclusions drawn in this paper are tentative but suggest that the quality of performance information is as important for innovation as it is for performance management. However, innovation is likely to require its own particular performance information that may not be generated on a routine basis for purposes of performance management, particularly in the early stages of innovation. And, while the availability of performance information can be an important success factor in innovation, it does not stand alone. The commonality of a number of other factors identified in the literature surveyed for this paper strongly suggests that equal if not greater priority needs to be given to attenuating factors that inhibit innovation and to nurturing incentives.

Radiative rates for E1, E2, M1, and M2 transitions in Br-like ions with 43≤Z≤50

Energies and lifetimes are reported for the eight Br-like ions with 43≤Z≤50, namely Tc IX, Ru X, Rh XI, Pd XII, Ag XIII, Cd XIV, In XV, and Sn XVI. Results are listed for the lowest 375 levels, which mostly belong to the 4s²4p⁵, 4s²4p⁴4ℓ, 4s4p⁶,4s²4p⁴5ℓ, 4s²4p³4d², 4s4p⁵4ℓ, and 4s4p⁵5ℓ configurations. Extensive configuration interaction among 39 configurations (generating 3990 levels) has been considered and the general-purpose relativistic atomic structure package (grasp) has been adopted for the calculations. Radiative rates are listed for all E1, E2, M1, and M2 transitions involving the lowest 375 levels. Previous experimental and theoretical energies are available for only a few levels of three, namely Ru X, Rh XI and Pd XII. Differences with the measured energies are up to 4% but the present results are an improvement (by up to 0.3 Ryd) in comparison to other recently reported theoretical data. Similarly for radiative rates and lifetimes, prior results are limited to those involving only 31 levels of the 4s²4p⁵, 4s²4p⁴4d, and 4s4p⁶ configurations for the last four ions. Moreover, there are generally no discrepancies with our results, although the larger calculations reported here differ by up to two orders of magnitude for a few transitions.

Symmetry reduction due to gallium substitution in the garnet Li6.43(2)Ga0.52(3)La2.67(4)Zr2O12

Single-crystal structure refinements on lithium lanthanum zirconate (LLZO; Li7La3Zr2O12) substituted with gallium were successfully carried out in the cubic symmetry space group I [Formula: see text]3d. Gallium was found on two lithium sites as well as on the lanthanum position. Due to the structural distortion of the resulting Li6.43(2)Ga0.52(3)La2.67(4)Zr2O12 (Ga-LLZO) single crystals, a reduction of the LLZO cubic garnet symmetry from Ia[Formula: see text] d to I [Formula: see text]3d was necessary, which could hardly be analysed from X-ray powder diffraction data.

En este artículo el autor realiza un estudio detallado de la trascendental STC (1.ª) 43/2010, de 26 de julio, que marcó un hito en la interpretación que el Alto Tribunal realizó del art. 241 LOPJ, tras la reforma legislativa operada en el año 2007, a través de la LO 6/2007, de 24 de mayo. En esta sentencia se otorga el amparo porque un Juzgado de Primera Instancia había producido una clara indefensión a los recurrentes, consistente en la imposibilidad de éstos de conocer y comparecer en un proceso ejecutivo en el que resultaban afectados directamente sus intereses, pues se subastó y adjudicó una vivienda de su propiedad pese a haber sido advertido el Juzgado, por diferentes conductos, de que ellos eran los titulares registrales de dicho bien inmueble. La especial relevancia de la STC (1.ª) 43/2010, de 26 de julio —con claras concomitancias con la STC (2.ª) 40/2005, ya que ambas tienen su origen en actos procesales del mismo procedimiento judicial de ejecución, aunque los demandantes de amparo fueran distintos—, radica en resaltar el reforzado protagonismo, en aras de la defensa del derecho fundamental a la tutela judicial efectiva, que ha adquirido el incidente de nulidad de actuaciones, tras la reforma operada en el art. 241.1 LOPJ por la LO 6/2007, de 24 de mayo, por la que se modifica la Ley Orgánica 2/1979, de 3 de octubre, del Tribunal Constitucional. El TC cambia su postura y viene a afirmar, sin ambages, que el incidente de nulidad de actuaciones se ha erigido en el instrumento clave para la tutela del derecho fundamental a la tutela judicial efectiva sin indefensión, como última vía que permite la reparación ante la jurisdicción ordinaria, máxime si se tiene en cuenta el nuevo sistema, mucho más restrictivo, de admisión a trámite del recurso de amparo ante el TC (sólo si concurre una «especial trascendencia constitucional»).
