his chapter considers the EU’s socio-economic constitution under the lens of humaneness. It argues that the EU’s unique socio-economic constitution demands equilibrium of socio-economic integration instead of widening the gap between economic integration at EU levels and social integration at national levels. While the EU lacks the legislative competences to achieve this equilibrium, the constitutional principle still prevails. Indeed, the EU competences reflect its own values as well as the socio-economic constitutions of its constituent Member States. These frequently do not allow for total state-governance of social spheres such as working life, education, care or other social services. Instead, societal actors are given scope to (co-)govern these spheres at national levels. Accordingly, the apparent tension between the EU’s socio-economic values and principles and its limited competences in the social policy field can be resolved through a dynamic interpretation of the EU Treaties towards a “constitution of social governance”. This interpretation reads the Treaties as authorising governance by societal actors. The chapter connects the idea of humanness to the ideals of social governance at EU level and proposes two options for practical application of the concept. These are rules for trans-national labour markets based on European collective labour agreements and a European higher education sector developed by agreements between universities.

The work of children’s liberationists have been long been critiqued for pushing the parameters of rights discourse too far; specifically, by suggesting that there are no significant differences between children and adults, including their ability for self-determination. John Holt’s 1974 text Escape from Childhood is one such work which was deemed highly controversial for its time. This article uses Holt’s Escape from Childhood as an overarching framework against which to examine the current state of play on children’s rights as explicated through the UN Convention on the Rights of the Child. It suggests that whilst Holt has often been critiqued for being too radical, in the context of current children’s rights discourse Holt’s visioning is not as radical as it might first appear.

A diversidade, complexidade e imprevisibilidade que caracterizam a sociedade actual exigem da Escola uma articulação eficaz entre as aprendizagens e a realidade sociocultural dos alunos, de modo a promover a formação de cidadãos instruídos, competentes, críticos e aptos para aprender a aprender ao longo da vida. Neste sentido, é crucial contextualizar e gerir o currículo, adequando-o à multiplicidade e idiossincrasias dos alunos e seus contextos, assegurando-lhes aprendizagens funcionais e de qualidade. A implementação do processo de Reorganização Curricular do Ensino Básico, consubstanciado através da promulgação do Decreto-Lei n.º 6/2001, de 18 de Janeiro, ambiciona(va) melhorar a eficácia de resposta da escola ao seu mandato social, atribuindo a esta a centralidade na reconceptualização do currículo nacional em função dos contextos com que trabalha. Para tal, a auto-implicação, a negociação e a colaboração são pressupostos indispensáveis a um processo de gestão curricular centrado na escola e operacionalizado no contexto das suas diferentes estruturas. Nesta perspectiva, estruturas de gestão curricular intermédia como o conselho de turma e o departamento curricular, assumem particular ênfase na promoção e desenvolvimento de práticas de colaboração docente fulcrais a processos de gestão curricular. Assim, analisar e aprofundar conhecimento sobre condições facilitadoras, bem como factores de dificultação, do desenvolvimento de práticas de colaboração docente no contexto das referidas estruturas, identificadas na sequência da implementação da orientação de política curricular traduzida no referido decreto-lei constituiu o principal objectivo subjacente a este estudo. Procurou-se relacionar esta análise com dimensões de cultura profissional e organizacional, que a literatura e a investigação revistas documentam como factores relevantes na transformação de práticas curriculares. O presente estudo decorreu em dois momentos: o primeiro, no ano lectivo de 2006/2007, assumiu uma natureza predominantemente quantitativa, privilegiando-se como técnica de recolha de dados o inquérito por questionário aplicado 2718 professores que se encontravam a leccionar Ciências da Natureza, Ciências Naturais ou Ciências Físico-Químicas na rede de escolas públicas com 2º e 3º Ciclos da Direcção Regional de Educação do Norte (DREN) e do Centro de Área Educativa (CAE) de Aveiro, o qual foi complementado com a realização de uma entrevista semi-estruturada a seis professores de Ciências Físicas e Naturais; o segundo momento, realizado no ano lectivo de 2007/2008, adoptou uma metodologia de investigação, essencialmente, qualitativa – estudo de caso – desenvolvido numa escola básica com 2º e 3º ciclos com doze professores pertencentes a um conselho de turma e com oito professores de Ciências Físicas e Naturais afectos ao departamento curricular de Matemática e Ciências Experimentais. Este momento caracterizou-se pela: i) realização de dois percursos formativos, um com professores do conselho de turma e outro com os professores de Ciências Físicas e Naturais; ii) observação de reuniões de trabalho em contexto das estruturas supramencionadas; iii) planificação, implementação e avaliação de uma aula em regime de co-docência, abordando uma temática na perspectiva Ciência, Tecnologia e Sociedade e iv) realização de entrevistas a todos os professores participantes, aos Presidentes do Conselho Executivo e do Conselho Pedagógico e à Coordenadora do Departamento Curricular de Matemática e Ciências Experimentais. O sistema de análise de dados utilizado visou a compreensão das dinâmicas de trabalho docente desenvolvidas no processo de gestão curricular no contexto das estruturas de gestão intermédia em análise. Neste sentido, privilegiaram-se a análise estatística e de conteúdo como técnicas de tratamento dos dados. Os resultados deste estudo apontam para a prevalência de uma cultura docente fortemente individualizada, balcanizada e burocratizada, facto que restringe o desenvolvimento de práticas de gestão curricular e de dinâmicas de trabalho docente sustentadas e adequadas ao contexto e necessidades específicas dos alunos. Sugerem, igualmente, que o desenvolvimento de práticas de colaboração docente não é consequência directa da decisão espontânea e voluntarismo dos professores ou de uma imposição externa não assumida pelos mesmos, mas sim de uma convergência de factores de responsabilização, reconhecimento da utilidade e eficácia da colaboração, e incentivo organizacional que se revelaram pouco significativos no estudo em causa. Por outro lado, indiciam que uma efectiva colaboração docente implica transformações no plano das culturas, que não decorrem dos normativos, e é potenciada por processos de negociação, onde os diferentes actores educativos partilham responsabilidades e uma autonomia cimentada numa visão colectiva e integradora do projecto educativo e curricular da escola. No sentido de contribuir para a consolidação do conhecimento no domínio em estudo, consideramos necessária a realização de outras investigações centradas no mesmo objecto de estudo, mas desenvolvidas em outros contextos escolares.

AIMS: To determine whether parental factors earlier in life (parenting, single parent family, parental substance use problem) are associated with patterns of alcohol consumption among young men in Switzerland. METHODS: This analysis of a population based sample from the Cohort Study on Substance Use Risk Factors (C-SURF) included 5,990 young men (mean age 19.51 years), all attending a mandatory recruitment process for the army. These conscripts reported on parental monitoring and rule-setting, parental behaviour and family structure. The alcohol use pattern was assessed through abstention, risky single occasion drinking (RSOD), volume drinking and dependence. Furthermore, the impact of age, family socio-economic status, educational level of the parents, language region and civil status was analysed. RESULTS: A parental substance use problem was positively associated with volume drinking and alcohol dependence in young Swiss men. Active parenting corresponded negatively with RSOD, volume drinking and alcohol dependence. Single parent family was not associated with a different alcohol consumption pattern compared to standard family. CONCLUSION: Parental influences earlier in life such as active parenting (monitoring, rule-setting and knowing the whereabouts) and perceived parental substance use problem are associated with alcohol drinking behaviour in young male adults. Therefore, health professionals should stress the importance of active parenting and parental substance use prevention in alcohol prevention strategies.

The historically-reactive approach to identifying safety problems and mitigating them involves selecting black spots or hot spots by ranking locations based on crash frequency and severity. The approach focuses mainly on the corridor level without taking the exposure rate (vehicle miles traveled) and socio-demographics information of the study area, which are very important in the transportation planning process, into consideration. A larger study analysis unit at the Transportation Analysis Zone (TAZ) level or the network planning level should be used to address the needs of development of the community in the future and incorporate safety into the long-range transportation planning process. In this study, existing planning tools (such as the PLANSAFE models presented in NCHRP Report 546) were evaluated for forecasting safety in small and medium-sized communities, particularly as related to changes in socio-demographics characteristics, traffic demand, road network, and countermeasures. The research also evaluated the applicability of the Empirical Bayes (EB) method to network-level analysis. In addition, application of the United States Road Assessment Program (usRAP) protocols at the local urban road network level was investigated. This research evaluated the applicability of these three methods for the City of Ames, Iowa. The outcome of this research is a systematic process and framework for considering road safety issues explicitly in the small and medium-sized community transportation planning process and for quantifying the safety impacts of new developments and policy programs. More specifically, quantitative safety may be incorporated into the planning process, through effective visualization and increased awareness of safety issues (usRAP), the identification of high-risk locations with potential for improvement, (usRAP maps and EB), countermeasures for high-risk locations (EB before and after study and PLANSAFE), and socio-economic and demographic induced changes at the planning-level (PLANSAFE).

Conflicts over human rights in relations between East Asia and the West have increased since the end of the Cold War. Western governments express concern about human rights standards in East Asian countries. In the East, these expressions have been perceived as interference in internal affairs. Due to dramatic economic development, East Asian nations recently have gained in pride and self-confidence as global actors. Such development is observed with suspicion in the West. Concerned about the decline of global U.S. influence, some American scholars have re-invented the notion of "culture" to point at an alleged East Asian threat. Also East Asian statesmen use the cultural argument by claiming the existence of so-called 'Asian values', which they allege are the key to Eastern economic success. This thesis argues that issues of human rights in East-West relations are not only a consequence of well-intended concern by Western governments regarding the human rights and welfare of the citizens of East Asian nations, but are in fact dominated by and used as a pawn in interplay with more complicated questions of global power and economic relations between East and West. The thesis reviews the relevance of culture in East-West relations. In the West, particularly Samuel P. Huntington with his prediction of the Clash of Civilizations stands out. Singapore's Lee Kuan Yew has been very vocal on the Eastern side. Whereas the West tries to cope with its decrease of global influence, after hundreds of years under Western hegemonism, the East believes in an Asian way of development without interference form the West. Most of this dispute revolves around the issue of human rights. The West claims the universality of rights which in fact emphasizes political and civil rights. Western countries critizise poor human rights standards in East Asia. The East, in return, accuses the West of hypocritical policies that seek global dominance. East Asian governments assert that due to a different stage of development they have to stress first their rights to development in order to assure stability. In particular, China argues this way. The country's leadership, however, shows concern about human rights and has already improved its human rights record over the past years. This thesis analyses the dispute over human rights in a case study on Germany and China. Both countries have a mutual interest in trade relations which has conflicted with Germany's criticism of China's problematic human rights record. In 1996, the two countries clashed after the German parliament passed a resolution condemning China's treatment of Tibet. This caused a lot of damage to the Chinese-German relationship which in the course of the year went back to normality. In the light of these frictions a German human rights policy that focuses on unspectacular grass-roots support of China, for example in strengthening China's legal system, would be preferable. Such co-operation must be based on mutual respect.

The addition of the Charter of Rights and Freedoms represented a fundamental shift in Canadian governance. Many saw the tabling of such a document as a further, even fmal, step towards the Americanization of the Canadian polity. While the Charter's presence has significantly altered the relationship between citizens, government and the courts, it has done so by maintaining the traditional values and experiences that has been the hallmarks of Canadian constitutionalism. This is in contrast to the fears harboured by critics suggesting that the Charter was a further Americanization of the Canadian Polity, notwithstanding the very different natures of the American Bill of Rights and the Canadian Charter. Analyzing American Supreme Court precedent use by the Canadian Supreme Court has demonstrated that such an Americanization has not, in fact, occurred. In the present analysis of American precedent use in section 1 limitation of rights cases, the citation of these precedents are at best episodic, at least on the quantitative level. Qualitatively, the Canadian Supreme Court generally uses American jurisprudence to further support broad definitions of 'great rights' . As for the more intricate details of rights limitations and the process involved in detennining how Charter rights are limited, one would be hard pressed to find even cursory references to American case law.

This study explores the stories and experiences of second-generation Portuguese Canadian secondary school students in Southern Ontario, Canada. The purpose of this research was to understand the educational experiences of students, specifically the successes, challenges, and struggles that the participants faced within the education system. Questions were also asked about identity issues and how participants perceived their identities influencing their educational experiences. Six Portuguese Canadian students in grades 9 to 11 were interviewed twice. The interviews ranged from 45 minutes to 90 minutes in length. Data analysis of qualitative, open-ended interviews, research journals, field notes and curricular documents yielded understandings about the participants' experiences and challenges in the education system. Eight themes emerged from data that explored the realities of everyday life for second-generatiop Portuguese Canadian students. These themes include: influences of part-time work on schooling, parental involvement, the teacher is key, challenges and barriers, the importance of peers, Portuguese Canadian identity, lack of focus on identity in curricul:um content, and the dropout problem. Recommendations in this study include the need for more community-based programs to assist students. Furthermore, teachers are encouraged to utilize strategies and curriculum resources that engage learners and integrate their histories and identities. Educators are encouraged to question power dynamics both inside and outside the school system. There is also a need for further research with Portuguese Canadian students who are struggling in the education system as well as an examination of the number of hours that students work.

The purpose of this study was to explore elementary educators’ knowledge of moral development, how this knowledge relates to their beliefs and sense of efficacy pertaining to character education practices and the socio-moral reasoning of their students. It was hypothesized that educators’ beliefs and practices related to character education would reflect their pedagogy rather than knowledge of moral development theory. It was further hypothesized that there would be differences in student socio-moral reasoning specifically the beliefs and desires that guide actions would differ based on grade and gender. This mixed-method study employing self-report questionnaires, open response vignettes, and semi-structured educator interviews yielded quantitative and qualitative data. Findings indicated socio-moral reasoning of students differed according to grade (age) and gender. Knowledge of moral development theory was found to vary among participants however some practices employed by educators did align with a social cognitive approach to moral development. Significant variables identified consistently among educator and student participants included, autonomy, social competence, sense of school community, and supportiveness. These variables, in conjunction with a sense of fairness, have been identified elsewhere as foundational to moral development (Nucci, 2009), and intrinsic motivation (Ryan & Deci, 2000) and are relevant to educators working to develop student socio-moral reasoning as an aspect of character.

Ce mémoire est une analyse socio-juridique de la discrimination en milieu de travail et de son impact sur le devoir juridique de représentation syndicale, ou plus précisément, sur la responsabilité syndicale en contexte de diversité. Partant d’une première approche sociométrique du phénomène, suivie d’une deuxième davantage socio-juridique, le constat est à l’effet que la discrimination en milieu de travail a des répercussions jusque dans les milieux syndiqués,où les flux d’immigration semblent, à plusieurs égards, bousculer l’ordre établi. La revue de littérature permet de dégager deux grands axes de recherche : un premier concernant les forums : dans l’état actuel du droit, ce sont les Tribunaux des droits de la personne qui élaborent les normes applicables au devoir juridique de représentation syndicale dans les cas allégués de discrimination au travail, les Commissions des relations de travail s’adaptant mais lentement, sinon avec réticence, à la nouvelle donne ; le deuxième concernant spécifiquement la partie syndicale : cette dernière pondère l’effet des normes applicables en matière de discrimination au travail tant en fonction de ses propres intérêts stratégiques, que de l’attente des membres, que des préjugés et stéréotypes présents dans le milieu de travail. L’analyse globale porte sur 689 décisions en provenance de quatre Commissions des relations de travail — Québec, Fédéral, Ontario et Colombie-Britannique — et ainsi que des quatre Tribunaux des droits de la personne correspondants, sur une période de dix ans, allant du 1er janvier 2000 au 31 décembre 2009. Quant aux forums, la conclusion est à l’effet qu’au cours de la période étudiée, aucune institution n’a de préséance sur l’autre en ce qui a trait aux motifs illicites de discrimination. Les deux se complétent sans presque se chevaucher, et chacune à leur manière, contribuent fortement à faire progresser les droits de la personne. Par contre, les Commissions des relations de travail ont préséance quant au harcèlement, tandis que les Tribunaux des droits de la personne sont prépondérants face aux mesures d’accommodement. Quant à la partie syndicale, si elle a toujours agi, pour des raisons historiques, en fonction de ses intérêts stratégiques, de l’attente des membres, et des préjugés et stéréotypes présents sur les lieux de travail. Mais, ce qui change au fil du temps, c’est tout ce qui entoure le devoir juridique de représentation syndicale, c’est-à-dire tout le climat général d’application, ainsi que tout le contexte d’analyse et d’évaluation des situations. Quel est donc l’impact de la discrimination en milieu de travail sur le devoir juridique de représentation syndicale ? Dans la mesure où le contexte d’analyse et d’évaluation des situations est la lecture que font les agents, du climat général d’application, et des changements qu’ils y apportent en fonction de leurs propres intérêts stratégiques, du point de vue syndical, cet impact est triple : d’abord, devant chaque cas d’espèce, (1) l’acteur syndical doit désormais jongler avec beaucoup plus de facteurs qu’auparavant ; deuxièmement, (2) envers les salariés de l’unité de négociation, la marge de manoeuvre est beaucoup plus restreinte en contexte de lutte contre la discrimination ; enfin, et c’est le point le plus important, (3) l’économie générale des droits de la personne a pour effet d’introduire une hiérarchie dans les normes applicables, ce qui oblige l’acteur syndical à s’adapter, de façon constante, à un climat général d’application sans cesse changeant, auquel tous les agents contribuent, y compris lui-même.

Noam Chomsky, figure notoire du cognitivisme innéiste en psycholinguistique, est aussi un important penseur américain et activiste politique ayant écrit sur une multitude de sujets, issus de domaines variés : politique interne et étrangère des États-Unis, critique des médias de masse et enjeux sociaux liés aux droits de l’Homme, pour ne nommer que ceux-ci. Par contre, et malgré l’abondance de ses écrits à ce propos, Chomsky est, à ce jour, très peu étudié en philosophie de l’éducation : ce mémoire de maîtrise s’inscrit ainsi dans une perspective d’exploration, de définition et d’analyse de la pensée éducative chomskyenne, dans le but de présenter et réfléchir la portée possible d’une telle pensée dans l’axe philosophique des recherches en éducation. Devant la rareté, voire l’absence de recherches francophones et anglophones concernant notre objet d’étude, plus d’une centaine de livres, articles, entrevues et vidéos portant sur la philosophie chomskyenne et celle de grands penseurs humanistes, critiques ou opposés aux postulats chomskyens ont été retenus, lus et analysés dans le cadre de ce projet. Deux objectifs précis ont guidé ce mémoire : d’abord, présenter et analyser la pensée éducative chomskyenne en regard de ses fondements philosophiques et de ses ancrages intellectuels dans les traditions humaniste et critique en philosophie éducative, puis mettre en lumière l’unicité de cette pensée par rapport à ces traditions et à quelques courants opposés en éducation. Au terme de ce mémoire, nous espérons ainsi répondre aux questions suivantes : dans quelle mesure Chomsky s’inscrit-il dans les traditions humaniste et critique en éducation? Peut-il être considéré comme un héritier de la pensée de certains philosophes particuliers? En quoi sa pensée, relative à la philosophie de l’éducation, est-elle pertinente et innovante pour ce domaine fondamental? Et, finalement, quelles critiques pouvons-nous lui adresser?

We study the evolution of educational attainment of the 1932–1972 cohorts using a calibrated model of investment in human capital with heterogeneous learning ability. The inter-cohort variation in schooling is driven by changes in skill prices, tuition, and education quality over time, and average learning ability across cohorts. A version of the model with static expectations is successful in accounting for the main patterns in the data. Rising skill prices for college explain the rapid increase in college graduation till the 1948 cohort. The measured decline in average learning ability contributes to explain the stagnation in college graduation between the 1948 and 1972 cohorts.

L’objectif de cette thèse est d’analyser et de comprendre la dynamique de la controverse autour de l’adoption en 2009 du code des personnes et de la famille au Mali. Elle s’intéresse particulièrement aux principaux enjeux, c'est-à-dire aux questions à l’origine de cette controverse ainsi qu’aux stratégies mises en place par les différents acteurs sociaux (les organisations islamiques et leurs alliés, d’une part, et d’autre part, les organisations féminines et les leurs) afin d’infléchir le processus. En plus du pourquoi et du comment de cette controverse, notre recherche visait à comprendre le bilan du processus tiré par les acteurs eux-mêmes, le sentiment qui les anime à l’issu de ce long processus, leur appréciation de leur expérience, et leur vision de l’avenir. Pour étudier cette problématique, nous avons choisi l’approche de l’action collective protestataire, laquelle s’inspire à la fois des théories de l’action collective, et de celles des mouvements sociaux et des dynamiques contestataires. Afin d’analyser les enjeux au cœur de cette controverse, les stratégies utilisées par les acteurs ainsi que leur bilan du processus, nous avons opté pour une démarche qualitative. En plus de la littérature grise, des articles de presse, documents audio et audiovisuels sur le sujet, notre travail de terrain de quatre mois dans la capitale malienne nous a permis de réaliser plusieurs entrevues auprès des acteurs impliqués dans ce processus. S’étendant de 1996 à 2011, soit seize ans, l’élaboration du code des personnes et de la famille au Mali fut un processus long, complexe, inhabituel et controversé. Les résultats de notre recherche révèlent que plusieurs enjeux, notamment sociaux, étaient au cœur de cette controverse : le «devoir d’obéissance » de la femme à son mari, la légalisation du mariage religieux, l’« égalité » entre fille et garçon en matière d’héritage et de succession et la reconnaissance de l’enfant naturel ont été les questions qui ont suscité le plus de débats. Si durant tout le processus, les questions relatives à l’égalité de genre, au respect des droits de la femme et de l’enfant, étaient les arguments défendus par les organisations féminines et leurs alliés, celles relatives au respect des valeurs religieuses (islamiques), sociétales ou socioculturelles maliennes étaient, par contre, mises de l’avant par les organisations islamiques et leurs alliés. Ainsi, si le discours des OSC féminines portait essentiellement sur le « respect de l’égalité des sexes » conformément aux engagements internationaux signés par le Mali, celui des OSC islamiques s’est, en revanche, centré sur le « respect des valeurs islamiques et socioculturelles » du Mali. Quant aux canaux de communication, les OSC féminines se sont focalisées sur les canaux classiques comme la presse, les radios, les conférences, entre autres. Les OSC islamiques ont également utilisé ces canaux, mais elles se sont distinguées des OSC féminines en utilisant aussi les prêches. Organisés généralement dans les mosquées et autres espaces désignés à cet effet, ces prêches ont consacré la victoire des OSC islamiques. Les radios islamiques ont joué elles aussi un rôle important dans la transmission de leurs messages. Pour ce qui est des stratégies d’actions, l’action collective qui a changé la donne en faveur des OSC islamiques (renvoi du code en seconde lecture, prise en compte de leurs idées), a été le meeting du 22 août 2009 à Bamako, précédé de marches de protestation dans la capitale nationale et toutes les capitales régionales du pays. Quant aux OSC féminines, elles n’ont mené que quelques actions classiques (ou habituelle) comme les pétitions, le plaidoyer-lobbying, les conférences-débats, au point que certains observateurs ont parlé de « stratégie d’inaction » chez elles. L’analyse a également révélé l’utilisation de stratégies inusitées de menaces et d’intimidation par certains acteurs du camp des OSC islamiques à l’endroit des partisans du code. Si chaque groupe d’acteurs a noué des alliances avec des acteurs locaux, les OSC féminines sont les seules à reconnaitre des alliances avec les acteurs extérieurs. Aujourd’hui, si la plupart des membres des OSC islamiques ne cachent pas leur satisfaction face à leur « victoire » et se présentent en « sauveur de la nation malienne », la plupart des membres des OSC féminines se disent, quant à elles, très « déçues » et « indignées » face à l’adoption du code actuel. Elles ne comprennent pas pourquoi d’un « code progressiste », le Mali s’est retrouvé avec un « code rétrograde et discriminatoire » envers les femmes. La thèse confirme non seulement la difficile conciliation entre droit coutumier, loi islamique et droit « moderne », mais également l’idée que le droit demeure l’expression des rapports de pouvoir et de domination. Enfin, notre recherche confirme la désormais incontournable influence des acteurs religieux sur le processus d’élaboration des politiques publiques au Mali.
