In 1858, a volume entitled Midnight Scenes and Social Photographs – being sketches of life in the streets, wynds and dens of the city of Glasgow was published under the pseudonym of ‘Shadow’ by Alexander Brown, a Glaswegian flâneur and reformer. Its frontispiece is an etching which depicts a theatre-like proscenium arch whose curtains have been withdrawn to reveal to the audience all the poverty, destitution and disorder that one was likely to find after dark in the insalubrious quarters of the city. At the extreme left-hand side, partly obscured by the curtain a silhouetted figure stands behind an unwieldy camera perched on a tripod. Distinctly unaffected by the mêlée, an arm is calmly raised and a finger precisely arched in the moment before the shutter is clicked and the scene committed to record. The volume, however, relies exclusively on textual descriptions to evoke the underside of the city and contains no photographs at all. Instead, the use of the word photograph in the title can be understood as a metaphor for detached scientific objectivity, a quality much celebrated by nineteenth-century reformers and investigators of social ills. As it happened, a decade after Shadow disappeared into the labyrinthine back-lands of Old Town Glasgow, he was followed there by a real photographer. In 1868, Thomas Annan was commissioned by the City Improvements Trust to take photographs of the Old Town in its last moments of existence before it was pulled down under a series of legislative acts. But perhaps paradoxically, given Shadow’s faith in the analytical properties of photography, Annan’s work seems to refute much of the material contained in Midnight Scenes and other similar tracts. Instead of the dens, shebeens, labyrinths and rowdy crowds described by Shadow, Annan’s depictions of the Old Town convey a static, calm environment, one which is often sparsely inhabited by a curious but apparently orderly population.
Taking account of the sensational tendencies of many reformists’ texts, this paper investigates the discrepancies between the two representations, focussing in particular on the constraints which operated on Annan during his commission. It argues that Annan’s compositions – which became very influential on other 19th century photographers of everyday life such as John Thomson or Jacob Riis – far from being dispassionate analytical works, emerged as a result of a matrix of factors which included: photographic and artistic precedents; Annan’s own predilections as a photographer; technological limitations; the nature of the commission from the City Improvements Trust and political climate in which it was given; the medieval urban fabric in which he had to operate; and, perhaps, most importantly, the identity of the Old Towns inhabitants themselves.

This chapter has two major sections, one by Lederach and the apprentices, and one by Goldberg. The introduction above represents an amalgam of Lederach’s own writing and Goldberg’s, which summarizes some key information, but loses in written flow what it gains in information. As Goldberg reviewed Lederach’s initial chapter, she became deeply interested and asked Lederach for further materials. She conducted two interviews and collected background and supplementary materials and used them to explore some areas that were touched on by Lederach, but, if expanded, offered greater richness. In order to preserve the clarity of writing, the material will be presented in two sections. The first will include Lederach’s original chapter with the apprentice narratives. We start with an overview provided by John Paul that describes several practices incorporated into the process of the past three years. Each of the four apprentices will then reflect on how they experienced these practices and the impact, if any, they have had on their lives and professional careers. Each segment written by Lederach and the apprentices is written in the first person, starting with Lederach’s practices, below. Following will be Goldberg’s work deepening the information presented in Lederach’s section, and the conclusion.

In the UK stroke is the third most common cause of death for women and the incidence in African Caribbean women is higher than the general population. Stroke burden has major consequences for the physical, mental and social health of African Caribbean women. In order to adjust to life after stroke individuals affected employ a range of strategies which may include personal, religious (church) or spiritual support (i.e. prayer), individual motivation, or resignation to life with a disability. This study explored these areas through the coping mechanisms that African Caribbean women utilised post stroke in the context of stroke recovery and lifestyle modification efforts needed to promote healthy living post stroke. A qualitative approach using Interpretative Phenomenological Analysis was adopted. Eight women were recruited into the study. Semi structured in-depth interviews were audio recorded and were transcribed verbatim. Data were analysed using a four-stage framework: familiarisation, sense making, developing themes and data refinement and analysis. Three main themes on coping emerged: the need to follow medical rules to manage stroke, strength and determination, and the use of religion and faith to cope with life after stroke. These findings illustrate both a tension between religious beliefs and the medical approach to stroke and highlight the potential benefits that religion and the church can play in stroke recovery. Implications for practice include acknowledgement and inclusion of religion and church based health promotion in post stroke recovery.

O objetivo deste estudo foi analisar os seguintes tópicos: a possibilidade de interpretação literal do artigo 798 do Código Civil brasileiro, a aplicação das súmulas 61 e 105 do STF, o cabimento de indenização à família do suicida, os entendimentos da neurociência sobre possibilidades que podem interferir na ideação suicida, a visão e, finalmente, posicionamentos do Superior Tribunal de Justiça (STJ) e do Supremo Tribunal Federal do Brasil e quanto ao pagamento da indenização estabelecido no contrato de seguro de vida em caso de suicídio do contratante antes dos dois anos da assinatura do contrato. Buscou-se, também, comparar a doutrina e jurisprudência do Brasil e de Portugal. Na estrutura, iniciou-se por considerações sobre a interpretação jurídica e, em seguida, foram desenvolvidos os capítulos acerca de negócio jurídico, dos contratos, dos contratos de seguro de vida e da boa fé presente e necessária. Como o foco principal eram os contratos de seguro de vida e baseando-se na doutrina e na jurisprudência, de modo geral, mesmo a legislação dos dois países diferindo em pequenos aspectos, concluiu-se que: (1) o seguro é a cobertura de evento futuro e incerto que poderá gerar o dever de indenizar por parte do segurador; (2) a boa-fé - que é presumida - constitui elemento intrínseco do seguro, e é caracterizada pela lealdade nas informações prestadas pelo segurado ao garantidor do risco pactuado; (3) o legislador procurou evitar fraudes contra as seguradoras na hipótese de contratação de seguro de vida por pessoas que já tinham a idéia de suicídio quando firmaram o instrumento contratual; (4) uma coisa é a contratação causada pela premeditação ao suicídio, que pode excluir a indenização. Outra, diferente, é a premeditação para o próprio ato suicida;(5) é possível a interpretação entre os enunciados das Súmulas 105 do STF e 61 da Corte Superior na vigência do Código Civil de 2002; e (6) as regras relativas aos contratos de seguro devem ser interpretadas sempre com base nos princípios da boa fé e da lealdade contratual. Essa premissa é extremamente importante para a hipótese de indenização securitária decorrente de suicídio, pois dela extraise que a presunção de boa fé deverá também prevalecer sobre a exegese literal do art. 798 do Código Civil 2002. O período de 02 anos contido na norma não deve ser examinado isoladamente, mas em conformidade com as demais circunstâncias que envolveram sua elaboração, pois seu objetivo certamente não foi substituir a prova da premeditação do suicídio pelo mero transcurso de um lapso temporal. Há de se distinguir a premeditação que diz respeito ao ato do suicídio daquela que se refere ao ato de contratar o seguro com afinalidade única de favorecer o beneficiário que receberá o capital segurado. Somente a última hipótese permite a exclusão da cobertura contratada, pois configura a má-fé contratual. Em Portugal, salvo em raras exceções, apenas o critério temporal tem sido considerado. Continuando com o objetivo deste estudo, pretendeu-se refletir sobre as pesquisas neurocientíficas acerca do suicídio e, nelas, constam aspectos efetivamente que merecem ser considerados pela ciência jurídica. Suicídio é tema complexo e digno de reflexões por parte de profissionais de várias áreas de atuação. Suas causas ainda são motivo de curiosidade e de investigação. A idéia de uma associação entre disfunção serotoninérgica e suicídio é antiga e bastante consistente, surgindo ainda nos anos 1970 com as primeiras pesquisas. Defende-se que a boa fé necessária nos contratos de seguro, especialmente nos de seguro de vida, prevalece mesmo nos casos em que o contratante se esquece ou deixa de informar algum detalhe que, mais tarde, possa vir a comprometer o recebimento do prêmio por seus beneficiários. Há fortes evidências de que determinantes neurobiológicos, independentes das doenças psiquiátricas, implicam em comportamento suicida, estudados especialmente nos últimos 20 anos. Assim, noções básicas sobre a neurobiologia do suicídio podem finalmente produzir ferramentas clínicas para tratar comportamento suicida e evitar mortes, além de poder nortear seguradoras na análise de propostas de seguros de vida. Textos legais não têm sido elaborados com fundamento na sedimentação existente nos repositórios da psicopatologia forense, psiquiatria, psicanálise e sociologia sobre o suicídio, disponíveis há décadas e de forma reiteradamente confirmados. Na mesma linha, os textos deixaram de lado incontáveis pesquisas sobre o tema, notadamente a respeito de sua etiologia, causas primárias, efeitos, e correlação com outras ciências, como neurociência, psiquiatria e psicanálise. Não buscaram informações sobre o comportamento singular do suicida, nem reconheceram o estado sui generis de desequilíbrio mental em que o ato final foi praticado. Sabe-se que os transtornos psiquiátricos são fundamentais para o entendimento do comportamento suicida, mas também já está comprovada a realidade de problemas comuns, como distúrbios do sono, e sono insuficiente é um problema da sociedade moderna. Dentre os neurotransmissores, a serotonina é considerada como a maior candidata a um vínculo etiológico entre distúrbios do sono e suicídio, pois suas alterações promovem estados de vigília e de início do sono. Como somente 14% de pessoas que tentaram suicídio tiveram pensamentos suicidaprévios à tentativa de suicídio de forma potencialmente impulsiva ou reativa, a insônia foi o fator importante visualizado antes de tentativas de suicídio graves e letais em relação a planosespecíficos de suicídio. Nas pesquisas neurocientíficas revisadas, constatou-se que: (1) a frequência de pesadelos está diretamente associada a maior risco de suicídios na população em geral; (2) sono de má qualidade está associado a suicídios na maturidade e velhice na população em geral; (3) sono curto (menos de cinco horas) está associado a maiores probabilidades de ideação suicida e tentativa de suicídio; (4) pesadelos frequentes são preditores de tentativas de suicídio; e (5) a presença de qualquer problema de sono está associada com maior risco de suicídio na população em geral. A associação entre redução da resposta de hormônio de crescimento e comportamento suicida nos pacientes com depressão só é encontrada quando há simultaneamente uma alteração serotoninérgica. Geneticamente analisados, determinantes neurobiológicos são independentes de transtorno psiquiátrico com o qual estão associados, pois muitos suicídios ocorrem de maneira inesperada. Além disso, quando se considera a depressão como único fator, percebe-se que muitas pessoas depressivas nunca se tornam suicidas e muitos suicídios são cometidos por pessoas consideradas normais.Quanto à colesterolemia, na maior categoria de concentração de colesterol total no soro, o risco relativo ajustado de suicídio violento é mais do que o dobro em comparação com a categoria mais baixa. Nas avaliações eletroencefalográficas em adolescentes suicidas pode-se dizer existir uma hipótese de ativação reduzida esquerda posterior, que não está relacionada à depressão, mas ao comportamento agressivo ou suicida. Essas abordagens da Neurociência servem, portanto, para indicar que um contratante de seguro de vida, mesmo saudável, pode estar vivenciando problemas da vida contemporânea e, mesmo sem jamais ter tido qualquer pensamento ou ideação suicida, vir a cometer esse ato extremo por alterações independentes de sua vontade. Entende-se que, neste foco, a ciência jurídica deve refletir para fazer inserir de maneira obrigatória nos pré-requisitos da apólice, informações sobre exames molecu-lares e sobre algum eventual distúrbio do sono, já que existem achados evidenciados sobre alguns fenômenos não antes considerados. Como abordado neste estudo, já existe uma seguradora portuguesa que solicitam exames moleculares, mas nenhuma no Brasil. Assim, isto indica já ser um início de mudança.

This chapter looks at the assumptions made about the 'fictionality' of prose fiction implicit in the contemporary historical novel. In particular it argues that the recent historical novel has developed a set of 'reality effects' which appear to look back to modernist writing, but in fact work to secure a disguised referentiality in the face of a loss of faith in the fictional.

In R v McNally, gender deception is found capable of leading to the vitiation of consent to sexual intercourse and, in so doing, places restriction on the freedom of transgendered individuals in favour of cisgendered freedom. This paper seeks to challenge the standing of this decision by adopting a combined methodological approach between Deleuzian post-structuralism and Gewirthian legal idealism. In so doing, we attempt to show that the combination offers a novel and productive approach to contentious decisions, such as that in McNally. Our approach brings together post-structuralist corporeality which conceives of the body as material and productive, and Gewirth’s ‘agent’ to conceptualise the legal body as an entity which can, and should, shape judicial reasoning. It does this by employing the criterion of categorically necessary freedom on institutionalised practical reasoning. These ‘bodies of agents’ can be conceived as the underpinning and justificatory basis for the authority of the law subject to the morally rational Principle of Generic Consistency. This egalitarian condition precedent requires individualisation and the ability to accept self-differentiation in order to return to a status, which can be validly described as “law”. Ultimately, we argue that this theoretical combination responds to a call to problematise the connection made between gender discourse and judicial reasoning, whilst offering the opportunity to further our conceptions of law and broaden the theoretical armoury with which to challenge judicial reasoning in McNally. That is, a ‘good faith’ attempt to further and guarantee transgender freedoms.

The following study aims to examine a controversial and relatively unexplored subject within our system: the legal framework on unfair business-to-consumer commercial practices. Given the fact that this subject is based on the Directive 2005/29/EC, we considered to be appropriate to explore, firstly, the background and origin of such normative instrument. Nevertheless, we have centered our analysis on the interpretation of the set rules established by the Portuguese legal system (Law nr 57/2008, March 26th). For this dissertation, we have proposed a model of tripartite approach. Chapter V seeks to shed light on the general clause by analyzing a set of open concepts such as professional diligence, honest market practice, good faith or material distortion of the consumer’s economic behavior. In chapter VI, we will focus on two common types of unfair commercial practices: misleading and aggressive practices. Finally, due to the fact that chapter VII deals with the black list, we have illustrated the listed practices by giving real life examples. Taking into account the indefinite concepts used in the general prohibition and in the misleading and aggressive clauses, it is particularly difficult to demonstrate the unfairness of the professional’s behavior. In the light of this information, we have concluded that the regime fails on achieving its main goal: it does not protect proper and effectively the consumer’s interests.

This marketing plan project is a culmination of extensive strategies with the use of experiential marketing to address issues confronting the Kenyan tourism industry in order to have a sustainable tourism sector. Following the terrorist attack carried out by Islamist militants’ belonging to al-Shabaab terrorist organization on Nairobi’s Westgate shopping mall in September 2013, tourist forecast has gone down sharply with an average of 20% fall in tourists’ arrivals which is likely to have an impact on the tourism sector in Kenya. Even before the deadly attack on Westgate, the most lethal attack by Islamist terrorists in 15 years in Kenya, the government through the Kenya tourist board had announced that in 2013 tourist arrivals were down by 12%, at 495,978, according to an October 2013 report by Bloomberg. Tourism revenues were also down by 7.4%, over FY12/13 (July-June) to reach KES96.24bn, according to a September 2013 report on the local Capital FM website. Beyond 2013, much will depend on how quickly the Kenya tourist board can regain control of the situation. The Kenyan government believes that the Westgate mall attack was a 'one-off' incident, with a low probability of a similar event happening again over the short term period. Germany, United States, United Kingdom, Australia, Italy, France and Canada continue to be the key source market however; the Kenya tourist board can make continued growth stronger from new emerging markets in order to increase new arrivals into the country. The marketing plan outlines the objectives to be implemented and provides the implementation strategy, activity plans, monitoring and evaluation plans, financial requirements projections and proposes a new structure of experiential marketing. A number of regional forces are identified that will impact tourism into the country including global, social and economic forces, emerging trends in visitor motivations and behavior, emerging forces in experiential marketing. A major component of the strategy identifies target markets for Kenya to commensurate with the level of resources that will be available for marketing and promotion, in keeping with the forces and trends identified and the nature of the Kenya tourism environment. The agreed upon target market segments are: generic/mass travel, experiential travel, creative travel, adventure seeking travel, senior/extended/long stay travel, and business related travel. The strategy phases the development of the target markets over the years of the marketing strategies in order to yield the best opportunity for results. A core activity in developing a marketing strategy is determining the nature of experiences Kenya offers in tourism. The strategy’s experience development process will continue to develop within the context of the products identified which will be promoted regionally: culture/heritage, nature, community-based. Each county in the country has a significant number of attractions and experiences and the challenge of the country is to bring these together in a creative and innovative way in order to encourage tourists to visit more than one county in Kenya.

The object of this dissertation is the analysis of the legal framework applicable to contracts for provision of electronic communications services, while trying to offer solutions to some of the issues regarding this matter. The main focus of this study will be the rules concerning service’s suspension, which have been recently amended. The technological development and the establishment of these services as information transmitters and work tools were noteworthy for its growing importance at the present time. These services include cable television, telephone (landline and mobile) and internet and they are regulated by Law nr 23/96, July 26th, along with other essential public services. Said law sets a group of principles and duties, such as good faith (article 3), continuity and quality of the service (article 7) and the duty to rightfully inform the user (article 4), in order to protect the users. For the analysis of legal framework applicable to these particular contracts it is also fundamental to mention Law nr 5/2004, February 10th, known as Electronic Communications Law. The provisions regarding the service’s suspension are currently prescribed in articles 52.º and 52.º-A of the law. Given the amendments introduced by Law nr 10/2013, January 28th, consumers are subjected to a regulation different from the one applicable to the other users, established in the new article 52.º-A. From our analysis, we have concluded that the main change from past provisions has to do with the automatic termination of the contract as consequence of the consumer’s failure to pay the price or to conclude a written payment arrangement after service’s suspension.
