Bajo la tipología de estudio de caso, la presente investigación pretende explicar la influencia ejercida desde el Banco Mundial en la configuración de políticas públicas nacionales en Bolivia para la privatización del suministro, transporte y acceso al agua potable. El objetivo general de la investigación es explicar los alcances y limitaciones del modelo de privatización del agua en Bolivia como política pública, promovido por el Banco Mundial (BM), en la primera década del siglo XXI. Sosteniendo que el modelo de privatización del BM ha sido permeado y superado por el interés nacional del pueblo boliviano en materia de acceso al agua. Finalmente, la metodología empleada será de corte cualitativa a partir del análisis de documentos oficiales, textos académicos y científicos, legislaciones y disposiciones tomadas desde el BM y desde Bolivia en lo que respecta a la privatización del agua.

En el periodo que va desde el 2000 al 2011, el Partido Conservador Colombiano y el panorama político del país tuvo múltiples cambios desde el punto de vista organizacional, la gran mayoría de los presidentes de los Directorios Nacionales del Partido que asumieron durante este periodo, implementaron estrategias de reforma que específicamente en el caso de las mujeres, se refieren a la creación de la Organización Nacional de Mujeres, la inclusión de cuotas, la inclusión del voto privilegiado para las mujeres, la creación de la Secretaria de la Mujer, la creación de la figura de la Consulta Popular, entre otras, que se muestran hoy como grandes fortalezas en la organización. A pesar de esto, no se puede desconocer el conjunto de resistencias explícitas fundamentadas en el comportamiento tradicional de un partido que llevan a la constitución de instituciones no formales por costumbre y conveniencia y que han trascendido aún el día de hoy. Éstas se manifiestan durante el periodo de estudio con la inclusión del voto preferente, el clientelismo, la negativa a la consulta, el machismo, las divisiones internas por personalismos políticos y el machismo, las cuales en muchos casos han sido parte de la estructura tradicional del Partido Conservador y que aún persisten. Dichas estrategias serán definidas en este trabajo como contrareforma. En el marco de estas pujas entre reforma y contrareforma las mujeres del Partido se consolidaron y se empoderaron dentro de la organización, ellas se han beneficiado de las dos vertientes. Así como se fortalecieron con la reforma, con la contrareforma, muchas de las mujeres ingresaron al Partido para lograr sus grandes caudales electorales e incluso convertirse hoy en día en caciques. En este sentido, este trabajo va a permitir identificar cómo se ha apropiado el Partido Conservador Colombiano del tema de la mujer al interior de su organización interna, teniendo en cuenta los procesos de reforma y contrareforma desde el año 2000 hasta el año 2011.

Esta investigación analiza la incidencia de los intereses políticos en la consecución formal de la ciudadanía femenina en Colombia a mediados del siglo XX, en un contexto marcado por la influencia de postulados liberales capitalistas y del discurso de modernidad. Desde una perspectiva histórica que incluye al género como variable, se presenta evidencia empírica de los principales intereses políticos masculinos como factor central en la aprobación formal del ingreso de las mujeres al espacio público y la ampliación del concepto de ciudadanía. El texto busca complementar enfoques que han privilegiado intereses electorales o movilizaciones feministas como determinantes del voto femenino, llenando así un vacío académico en la literatura de género. Sin minimizar la importancia de las luchas feministas, se concluye que diversos intereses morales, electorales, diplomáticos y económicos posibilitaron en la aprobación del voto femenino en un contexto histórico nacional e internacional particular, marcado por el influyente discurso de modernidad.

In 2003, an electoral reform changed the mechanism to assign seats in the Colombian Congress. I simulate the 2006 Senate elections using the previous assignment mechanism to determine which senators benefited from the reform, i.e. would have not been elected had the reform not been made. With the results of the simulation, I use a regression discontinuity design to compare the senators that would have been barely elected anyways with those who would have lost, but were near to be elected. I check the differences in the amount of law drafts presented, the attendance to voting sessions, and a discipline index for each senator as proxy of their legislative behavior. I find that the senators benefiting from the reform present a different legislative behavior during the 4-year term with respect to the senators that would have been elected anyways. Since the differential legislative behavior cannot be interpreted as being better (worse) politician, I examine if the behavioral difference gives them an electoral advantage. I find no difference in the electoral result of 2010 Senate election in terms of the probability of being (re)elected in 2010, the share of votes, the share of votes within their party list, and the concentration of their votes. Additionally, I check the probability of being investigated for links with paramilitary groups and I find no differences. The results suggest that political reforms can change the composition of governing or legislative bodies in terms of performance, but it does not necessarily translate into an electoral advantage.

Es tracta d'una investigació historiogràfica de caràcter exploratori del fenomen dels serveis socials a Catalunya. La principal novetat de l'estudi resideix en l'enfocament històric, realitzat a partir de l'anàlisi institucional, normatiu i de les polítiques de serveis socials, centrat bàsicament en el territori català. El treball s'ha estructurat en tres partes. La primera, dedicada al projecte d'investigació, tracta del marc de referència, on es presenten unes reflexions inicials, s'efectuen unes precisions sobre la utilització dels termes i el mètode i es tracta de l'objecte d'estudi. A continuació es determina el tipus d'investigació i es delimita l'àmbit territorial i cronològic. En tercer lloc, s'estableix el marc teòric de referència i es formulen les principals qüestions i consideracions plantejades a l'entorn de la problemàtica d'estudi i el darrer apartat es refereix als mètodes i tècniques emprades, fent una especial referència a les dificultats sorgides en l'aplicació del mètode comparatiu i l'observació i, finalment, es concreten les dimensions operatives i les fonts documentals. Atesa la complexitat i la importància que tenia per a la investigació, es dedica íntegrament el capítol segon a l'establiment d'un marc de referència relatiu als conceptes tècnic i jurídic dels serveis socials, així com a altres termes propers, como la caritat, la beneficència, l'assistència social, l'acció social, la seguretat social o el treball social, entre altres. Al final es presenta una definició operativa per a utilitzar en el transcurs del treball. La segona part, que es titula "Una visió històrica de los serveis socials a Catalunya", es refereix pròpiament a la investigació. El primer capítol tracta dels antecedents, que s'inicien amb la pobresa i la caritat medievals, es revisen, després, les aportacions del Renaixement i els canvis produïts al final del absolutisme, així com els derivats de la industrialització, incloent les realitzacions de la Mancomunitat de Catalunya i de la Generalitat republicana, i, finalment, es revisa l'etapa franquista, tant les actuacions públiques com les innovadores experiències cíviques. El segon capítol es centra en l'etapa de la transició, quan es produeix la gestació dels serveis socials de la democràcia, on es tracta del paper desenvolupat per la iniciativa social i la Generalitat provisional, i s'analitza el tractament dels serveis socials en la Constitució espanyola i l'Estatut d'autonomia de Catalunya. El següent capítol es dedica a la dècada dels vuitanta i s'exposen les actuacions dels primers ajuntaments democràtics i la constitució i estructuració de la Generalitat autonòmica, així com les transferències rebudes de l'Estat i de la Seguretat Social en aquesta matèria. S'analitza la definició, l'estructuració i l'organització dels serveis a través de les principals lleis i reglaments que els regulen. En el capítol quart es tracta la dècada següent, on es produeixen transformacions remarcables. S'analitzen els significats dels canvis que es situen des de la fase excepcional de consens fins a una altra de certa normalitat democràtica. Es revisen els aspectes i les novetats principals, com la creació del Departament de Benestar Social, la Llei 4/1994 i els debats i plans d'actuació del mundo local, especialment les repercussions de les reformes organitzatives i les de les lleis territorials catalanes: creació de les comarques, la reducció del paper de les diputacions i la redistribució competencial local. Finalment, es constata el fort creixement dels serveis socials i la seva consolidació en el territori. A la tercera part es presenten les conclusions i consideracions referents a les qüestions plantejades inicialment en el projecte d'investigació. El darrer apartat es dedica a la bibliografia i els annexos.

The exercise of disciplinary action, for the practice of misconduct by a lawyer or trainee lawyer, is the sole responsibility of the O.A., as professional body representative of their peers. The disciplinary procedure prescribed in the statute of the O.A., presents a framework for an integrated accusatory principle of research. The participation of the rapporteur of the disciplinary proceedings in the voting of the resolution imposing a disciplinary sanction is substantively unconstitutional for violating paragraph 5 of article 32nd of the Portuguese Constitution. The requirement to comply with this legislation stems, ultimately, from the similar nature of the fundamental rights of the accused lawyer or trainee lawyer to the rights, freedoms and guarantees protected in criminal proceedings.

Garantir a oferta de uma educação de qualidade nas escolas públicas de estados e municípios é um grande desafio a ser enfrentado pelo Brasil. Em se tratando da aprovação nos vestibulares para cursos superiores prestigiados socialmente, o êxito de egressos dessas instituições é difícil em qualquer universidade. Esta investigação, de natureza qualitativa articula dados quantitativos para fundamentar as discussões acerca dos fatores que explicam a aprovação desses estudantes no processo seletivo para o curso de medicina da Universidade Federal de Pernambuco [UFPE]. A fim de se realizar o estudo de caso em questão, utilizamos três instrumentos de recolha: o questionário, contendo informações pessoais e dados da formação educacional dos três egressos e de seus familiares; a entrevista semiestruturada, onde os três estudantes e seus pais tiveram a possibilidade de discorrer sobre os temas propostos; e a história de vida, através da qual um dos sujeitos retratou todo o conjunto da experiência vivida. Todo o material foi comparado e relacionado durante a análise por meio da triangulação de dados. Os nossos resultados confirmam os achados de outros trabalhos do gênero quando apontam que melhorar a qualidade da Educação Básica é essencial para que o Brasil avance na formação de mão de obra, mas, diferencia-se de alguns deles, quando sugere que, em relação aos candidatos que tentam ingressar no curso de medicina, tão importantes quanto o interesse e a mobilização do estudante e de seus pais em relação aos estudos são os investimentos em serviços de apoio pedagógico e psicológico, tanto aqueles prestados pelas escolas quanto os que são realizados em locais especializados [dependendo do caso].

Antes da realização do ciclo eleitoral que marcou a vida portuguesa em 2009, houve uma tentativa, que chegou a ser aprovada na generalidade, para alterar a Lei Eleitoral no que concerne às eleições autárquicas e surgiram estudos sobre as possíveis alterações da lei para a eleição da Assembleia da República. As dificuldades sentidas pelo Governo de maioria relativa, chefiada por José Sócrates, na sua ação governatiava, desde logo na aprovação do Orçamento para 2010, trouxera, de novo para a discussão a questão da estabilidade governativa. Este artigo procura mostrar para essa estabilidade - tanto a nível do Poder Central como do Poder Local - não resulta da alteração da Lei, mas da construção de uma consciência democrática.

The strengthening of the European Union’s fiscal rules with the approval of the so-called ‘six-pack’, and the parallel worsening of economic conditions in Europe, re-opened the debate about the relationship between fiscal discipline and growth. Influential voices have argued against the EU’s perceived obsession with fiscal discipline, which risks being self-defeating in bad times. However, EU fiscal rules are not as rigid as commonly thought, but represent a sophisticated system of surveillance and ex-post control that provides sufficient room for manoeuvre under exceptional circumstances.

Genetically modified (GM) cotton was approved for commercial cultivation in 2002. Hybrids to date have carried the Bt (Bacillus thuringiensis) gene, which confers resistance to Lepidoptera and certain Coleoptera. As well as "official" Bt hybrids (i.e., those that have gone through a formal approval process), there are "unofficial" Bt hybrids produced without such approval. The owners of the official hybrids, Monsanto-Mahyco, claim that the unofficial hybrids are not as good and could even damage the perception of Bt cotton amongst farmers. Anti-GM groups claim that neither type of Bt hybrid provides either yield or economic advantages over non-Bt hybrids. This paper reports the first study of official versus unofficial versus non-Bt hybrids in India (622 farmers in Gujarat State) with the specific aim of comparing one hypothesized ranking in terms of gross margin of (a) official Bt hybrids, (b) unofficial Bt hybrids, and (c) non-Bt hybrids. Results suggest that the official Bt varieties (MECH 12 and MECH 162) significantly outperform the unofficial varieties in terms of gross margin. However, unofficial, locally produced Bt hybrids can also perform significantly better than non-Bt hybrids, although second-generation (F2) Bt seed appears to have no yield advantage compared to non-Bt hybrids but can save on insecticide use. The paper explores some of the implications of this ranking.

The community pharmacy service medicines use review (MUR) was introduced in 2005 ‘to improve patient knowledge, concordance and use of medicines’ through a private patient–pharmacist consultation. The MUR presents a fundamental change in community pharmacy service provision. While traditionally pharmacists are dispensers of medicines and providers of medicines advice, and patients as recipients, the MUR considers pharmacists providing consultation-type activities and patients as active participants. The MUR facilitates a two-way discussion about medicines use. Traditional patient–pharmacist behaviours transform into a new set of behaviours involving the booking of appointments, consultation processes and form completion, and the physical environment of the patient–pharmacist interaction moves from the traditional setting of the dispensary and medicines counter to a private consultation room. Thus, the new service challenges traditional identities and behaviours of the patient and the pharmacist as well as the environment in which the interaction takes place. In 2008, the UK government concluded there is at present too much emphasis on the quantity of MURs rather than on their quality.[1] A number of plans to remedy the perceived imbalance included a suggestion to reward ‘health outcomes’ achieved, with calls for a more focussed and scientific approach to the evaluation of pharmacy services using outcomes research. Specifically, the UK government set out the main principal research areas for the evaluation of pharmacy services to include ‘patient and public perceptions and satisfaction’as well as ‘impact on care and outcomes’. A limited number of ‘patient satisfaction with pharmacy services’ type questionnaires are available, of varying quality, measuring dimensions relating to pharmacists’ technical competence, behavioural impressions and general satisfaction. For example, an often cited paper by Larson[2] uses two factors to measure satisfaction, namely ‘friendly explanation’ and ‘managing therapy’; the factors are highly interrelated and the questions somewhat awkwardly phrased, but more importantly, we believe the questionnaire excludes some specific domains unique to the MUR. By conducting patient interviews with recent MUR recipients, we have been working to identify relevant concepts and develop a conceptual framework to inform item development for a Patient Reported Outcome Measure questionnaire bespoke to the MUR. We note with interest the recent launch of a multidisciplinary audit template by the Royal Pharmaceutical Society of Great Britain (RPSGB) in an attempt to review the effectiveness of MURs and improve their quality.[3] This template includes an MUR ‘patient survey’. We will discuss this ‘patient survey’ in light of our work and existing patient satisfaction with pharmacy questionnaires, outlining a new conceptual framework as a basis for measuring patient satisfaction with the MUR. Most statistical methodology for phase III clinical trials focuses on the comparison of a single experimental treatment with a control. An increasing desire to reduce the time before regulatory approval of a new drug is sought has led to development of two-stage or sequential designs for trials that combine the definitive analysis associated with phase III with the treatment selection element of a phase II study. In this paper we consider a trial in which the most promising of a number of experimental treatments is selected at the first interim analysis. This considerably reduces the computational load associated with the construction of stopping boundaries compared to the approach proposed by Follman, Proschan and Geller (Biometrics 1994; 50: 325-336). The computational requirement does not exceed that for the sequential comparison of a single experimental treatment with a control. Existing methods are extended in two ways. First, the use of the efficient score as a test statistic makes the analysis of binary, normal or failure-time data, as well as adjustment for covariates or stratification straightforward. Second, the question of trial power is also considered, enabling the determination of sample size required to give specified power. Copyright © 2003 John Wiley & Sons, Ltd.

FIDIC has over the years produced standard forms of contracts for the international procurement of projects. A source of continuing criticism of its Red Book concerns the duality in the traditional role of the engineer as the employer's agent and as an independent third party holding the balance fairly between the employer and the contractor. In response to this and other criticisms FIDIC produced a replacement for it in 1999. The role of the engineer under the new Red Book is critically examined in the light of relevant case law, expert commentaries and feedback from two multidisciplinary workshops with international participation. The examination identified three major changes: (1) a duty to act impartially has been replaced by a duty to make fair determination of certain matters; (2) it is open to parties to allow greater control of the engineer by the employer by stating in the appropriate part of the contract powers the engineer must not exercise without the employer's approval; (3) there is provision for a Dispute Adjudication Board (DAB) to which disputes may be referred. Although the duality has not been eliminated completely, the contract is structured flexibly enough to support those who wish to contract on the basis of the engineer acting solely as the agent of the employer.

Each year, small Member States receive a disproportionate share of the European Union's (EU's) budget. A prominent explanation for this is that Council decision-making involves a healthy dose of vote selling, whereby large Member States offer small states generous fiscal transfers in exchange for influence over policy. But nobody has investigated whether net budget contributors actually get anything for their money. In this paper I identify the vote selling model's observable implications and find virtually no evidence consistent with Council cash-for-votes exchanges. I also show that a compromise model – the leading model of EU decision-making to date – modified to incorporate vote selling does not outperform a standard one that assumes votes are traded rather than sold. Taken together, the results suggest that Council decision-making operates with little or no vote selling, and that regardless of whatever they think they might be buying, net budget contributors get little or nothing in return for their money. These findings call for further investigation into how Member States approach the issue of fiscal transfers, and into the factors other than formal voting weight that affect the power of actors engaged in EU decision-making.

This article examines the superficial and deep ethical and moral dilemmas confronting ‘insider’ researchers which we term external and internal ethical engagement. External ethical engagement refers to the traditional, easily identifiable ethical issues that insider researchers attend to by submitting their application for ethical approval to their institution’s internal review board. Internal ethical engagement relates to the deeper level ethical and moral dilemmas that insider researchers have to deal with once ‘in the field’ linked to on-going personal and professional relationships with participants, insider knowledge, conflicting professional and researcher roles, and anonymity. By reviewing the literature in this area and drawing on the authors’ experiences of undertaking interpretive studies at institutions where they were members of staff, we explore these concepts and examine the implications for insider researchers.
