This project examines what an ethical code of conduct would look like in Afghanistan through analysis of historical, cultural and linguistic aspects found within its regions, as well as an examination of ethical codes of conduct for translators and interpreters in other countries. While numerous ethical guidelines and codes of conduct for translators and interpreters exist throughout global communities, it seems that creating a successful standardized ethical code of conduct in Afghanistan may be difficult to achieve given cultural and linguistic complexities. An ethical code of conduct for translators and interpreters in Afghanistan should include particular focus on: cultural sensitivity and courtesy, impartiality, conflict of interest, options for withdrawal, as well as reflect the importance of Pashtunwali.

This work attempts to create a systemic design framework for man-machine interfaces which is self consistent, compatible with other concepts, and applicable to real situations. This is tackled by examining the current architecture of computer applications packages. The treatment in the main is philosophical and theoretical and analyses the origins, assumptions and current practice of the design of applications packages. It proposes that the present form of packages is fundamentally contradictory to the notion of packaging itself. This is because as an indivisible ready-to-implement solution, current package architecture displays the following major disadvantages. First, it creates problems as a result of user-package interactions, in which the designer tries to mould all potential individual users, no matter how diverse they are, into one model. This is worsened by the minute provision, if any, of important properties such as flexibility, independence and impartiality. Second, it displays rigid structure that reduces the variety and/or multi-use of the component parts of such a package. Third, it dictates specific hardware and software configurations which probably results in reducing the number of degrees of freedom of its user. Fourth, it increases the dependence of its user upon its supplier through inadequate documentation and understanding of the package. Fifth, it tends to cause a degeneration of the expertise of design of the data processing practitioners. In view of this understanding an alternative methodological design framework which is both consistent with systems approach and the role of a package in its likely context is proposed. The proposition is based upon an extension of the identified concept of the hierarchy of holons* which facilitates the examination of the complex relationships of a package with its two principal environments. First, the user characteristics and his decision making practice and procedures; implying an examination of the user's M.I.S. network. Second, the software environment and its influence upon a package regarding support, control and operation of the package. The framework is built gradually as discussion advances around the central theme of a compatible M.I.S., software and model design. This leads to the formation of the alternative package architecture that is based upon the design of a number of independent, self-contained small parts. Such is believed to constitute the nucleus around which not only packages can be more effectively designed, but is also applicable to many man-machine systems design.

This work examines independence in the Canadian justice system using an approach adapted from new legal realist scholarship called ‘dynamic realism’. This approach proposes that issues in law must be considered in relation to their recursive and simultaneous development with historic, social and political events. Such events describe ‘law in action’ and more holistically demonstrate principles like independence, rule of law and access to justice. My dynamic realist analysis of independence in the justice system employs a range methodological tools and approaches from the social sciences, including: historical and historiographical study; public administrative; policy and institutional analysis; an empirical component; as well as constitutional, statutory interpretation and jurisprudential analysis. In my view, principles like independence represent aspirational ideals in law which can be better understood by examining how they manifest in legal culture and in the legal system. This examination focuses on the principle and practice of independence for both lawyers and judges in the justice system, but highlights the independence of the Bar. It considers the inter-relation between lawyer independence and the ongoing refinement of judicial independence in Canadian law. It also considers both independence of the Bar and the Judiciary in the context of the administration of justice, and practically illustrates the interaction between these principles through a case study of a specific aspect of the court system. This work also focuses on recent developments in the principle of Bar independence and its relation to an emerging school of professionalism scholarship in Canada. The work concludes by describing the principle of independence as both conditional and dynamic, but rooted in a unitary concept for both lawyers and judges. In short, independence can be defined as impartiality, neutrality and autonomy of legal decision-makers in the justice system to apply, protect and improve the law for what has become its primary normative purpose: facilitating access to justice. While both independence of the Bar and the Judiciary are required to support access to independent courts, some recent developments suggest the practical interactions between independence and access need to be the subject of further research, to better account for both the principles and the practicalities of the Canadian justice system.

ABSTRACT - The evaluation of performance and its implementation are, in the current socioeconomic framing, each time more necessary as form to improve the effectiveness and the efficiency amidst the organizations. For the practical professional it is verified that the implementation of the performance evaluation, presents gaps that can compromise it. Knowing the importance of the individuals in the success of the implementation of the performance evaluation, it becomes basic to analyze its perceptions face to the model and its implementation. The problem of inquiry of this study pretends to know which the perceptions of the technicians of radiology evaluated and appraisers face to the models of evaluation of performance implanted in the Portuguese Hospitals (Hospital Curry Cabral). The purpose to the level of the management is to minimize the obstacles of implementation and to maximize the strong points. Bibliographical research on the main concepts was effectuated, after what we define the objectives of empirica inquiry: - To compare the perceptions of the radiology technicians subjected to models of performance evaluation “Pro-Activa”. Using an exploratory and descriptive approach, studied the impact of these tools used in the hospitals of the study. The methodology for collecting information to professionals out of the study based on questionnaires of both open and closed questions with a quantitative approach to nature. For analysis and data processing software was used. The main conclusions: there is the lack of training for all involved, a process devoid of impartiality, neutrality and accuracy, as well as a general motivation of the professionals regarding the evaluation of performance.

Portugal, in particular, and Europe in general are paradigms of diversity in unity and of the need for intercultural mediation and social intervention policies enabling the reception, hospitality, respect for others and their training in a more inclusive society. From a research and sociological and anthropological level of knowledge, the ESECS-IPLeiria invested, in 2013, on a Master program in Intercultural Mediation and Social Intervention that is a unique example in Portugal. In this paper, in addition to present the Master’s curriculum, we invest in the distinction between preventive mediation, transformative and social empowerment, rather than focusing on solving, typical of conflict resolution, based on the questionable pillar of neutrality and impartiality.

Introduction: It is urgent that higher education in health develop a proactive ethico-moral commitment in students which is translated into the creation of socio-professional values. Objectives: To evaluate the ethical foundations which support morality in higher education students. Methods: A descriptive, cross-sithectional study, performed in 345 ESSV/IPV students, 80% female, average age of 20.82 years old. The “Questionário de Cidadania Ativa e Modo de Agir Ético” (CiAMAE) by Cunha (2015) was applied. Results: The results were 74.8% of the students showed a positive/adequate ethical method of acting; (with 45.8% adequate and 29% very adequate). In 25.2% the method of acting was ethically inadequate. The morality of the student’s actions were focused mostly on individualism and were based on the following ethical principles: 68.7% ethical subjectivism (69.1%♂ and 68.6%♀); 56.5% Relativism ( 56.5%♂ and 56.7%♀); 53.9% Deontological Ethics (Kant) (55.8%♂ and 47.0%♀); 11.3% Subjectivism/Ethical Selfishness (7.4%♂ and 12.3%♀). Conclusions: We may infer that the majority of the students do not have/ do not use an impartial consideration of good as criteria for morality of actions. They mostly manifested accepting an ethical subjectivist perspective, which means that good is not considered as a value for everyone. In contrast, applying the criteria of ethical impartiality would imply considering the greater good, and choosing/adopting the universal point of view in which any rational and enlightened student would choose for him/ herself and for others that universal greater good.
