[ES] La estrategia de la Banca española con respecto a Internet se ha enmarcado entre la modernización del sector y el miedo a la competencia de terceras partes. En el artículo mostramos como, desde la efervescencia inicial, las entidades se han centrado en construir un negocio rentable parte de una estrategia multicanal. Sin embargo todavía las instituciones españolas no han conseguido aprovechar todas las ventajas que presenta Internet a la hora de facilitar la comercialización de productos financieros.

A presente tese propõe um modelo de injusto penal rigorosamente dualista, assimentendido aquele que, ao lado do desvalor da ação, exija sempre e necessariamente a efetivaocorrência de um desvalor do resultado, consistente na afetação, danosa ou perigosa, da esferade existência de terceiros. A hipótese que conduz a investigação é a de que, mesmo diante dosmovimentos expansionistas do poder punitivo hoje verificados, é possível defender a viabilidade de tal concepção de injusto penal. Para a demonstração dessa hipótese, parte-se domodelo dual de sociedade proposto por Jürgen Habermas, que tem na teoria do agircomunicativo a chave para a proteção do mundo da vida frente aos influxos colonizatóriosprovenientes dos sistemas econômico e político administrativo. A partir desse marco teórico,propõe-se uma releitura de alguns dos conceitos fundamentais da teoria do delito, de modo aconferir-lhes interpretação compatível com a concepção dualista rigorosa de injusto adotada.Por fim, para verificar a plausibilidade da hipótese colocada, tais conceitos fundamentais sãopostos à prova diante de situações teóricas tradicionalmente classificadas como de difícilconciliação com uma concepção de injusto baseada na necessária ocorrência de desvalor doresultado, como é o caso dos crimes de perigo abstrato e dos crimes tentados.

O presente estudo procura estabelecer critérios para orientar as decisões sobre conflitos surgidos entre os verdadeiros proprietários de imóveis e terceiros de boa-fé. A partir da evolução do conceito de propriedade, do individualismo liberal da era moderna ao feixe de direitos, deveres e poderes jurídicos de uma relação jurídica complexa nos dias atuais, destaca-se a importância do registro de imóveis e da publicidade que lhe é inerente para a segurança das transações imobiliárias e a proteção de interesses individuais e coletivos. Considerando a prevalência dos valores existenciais sobre os patrimoniais e tendo por referência o princípio supremo da dignidade da pessoa humana, são sugeridos, como critérios de ponderação, a posse e a função social da propriedade, a boa-fé, a usucapião e a teoria da aparência. Examina-se, assim, a possibilidade de flexibilizar a norma que faculta ao proprietário o direito de reivindicar o imóvel independentemente da boa-fé do terceiro adquirente, se o registro for cancelado, discutindo-se ainda as soluções encontradas pela doutrina e pela jurisprudência para o problema proposto.

This is the Species management in aquatic Habitats overview of sub projects and their management produced by the Environment Agency in 1998. This report was under the R&D Project, which it was initiated in 1995 to provide information on species of conservation value of particular relevance to the Environment Agency (then the National Rivers Authority, NRA), in relation to its activities affecting aquatic environments. Outputs comprise Species Action Plans (SAPs), practical management guidelines for Agency staff and third parties, and various research and survey outputs to improve the knowledge base on the status and ecological requirements of priority species. This R&D Technical Report provides an overview of the work undertaken, additionally identifying lessons to be learnt in the management of species-related research within the framework of the UK Biodiversity Action Plan. The process of species selection was initially based upon a wide ranging review of priority species of relevance to the then NRA, encompassing both highly threatened species and species that are relatively common but are at particular risk from Agency activities.

This is the Species management in aquatic Habitats WRc Interim 1997 document produced by the Environment Agency in 1997. This document reports progress on R&D Project 640, which aims to provide information on species of conservation value of particular relevance to the Environment Agency, in relation to its activities affecting aquatic environments. A range of stand-alone outputs is being produced, comprising Species Action Plans, practical management guidelines for Agency staff and third parties, and various research outputs to improve the knowledge base on the status and ecological requirements of priority species. The species of conservation values are: water shrew, daubenton’s bat, Kingfisher, yellow wagtail, Grey wagtail, sand martin, reed bunting, dipper, marsh warbler, great crested new, spined loach, brook lamprey, river lamprey, sea lamprey, shining rams-horn snail, little whirlpool rams-horn snail, depressed river mussel, a freshwater pea mussel, native crayfish, and triangular club-rush. The process of species selection was altered during the course of the project by the report on biodiversity by the UK Biodiversity Steering Group (1995). Whilst still including species that were not particularly endangered but were greatly influenced by the activities of the Agency, the project addressed species on the ‘short’ and ‘middle’ priority lists of the Biodiversity report, particularly those for which the Agency had specific responsibilities.

A presente pesquisa tem como principal objetivo investigar as características do casal heterossexual moderno praticante de swing. Em especial, busca-se compreender quais fatores influenciam as negociações dos adeptos acerca da prevenção de DSTs/Aids. O swing, também conhecido como troca de casais, é considerado uma das experiências possíveis de não exclusividade sexual dentro da relação conjugal, o que significa dizer que os parceiros que o praticam, em comum acordo, permitem a ocorrência de intercursos sexuais envolvendo terceiros e preferencialmente em ambientes compartilhados. O estabelecimento do swing enquanto estilo de vida é a principal premissa dos praticantes. A partir das observações etnográficas de festas swingers realizadas em uma boate na Zona Oeste da cidade do Rio de Janeiro, da análise dos discursos de casais informantes e do levantamento das pesquisas sobre swing realizadas no Brasil, Europa e Estados Unidos, foi possível refletir a respeito das particularidades socioculturais deste grupo, bem como apreender o conjunto de valores que o orientam. As trajetórias dos sujeitos, desde o descobrimento do swing até o envolvimento real com o universo em questão, também são abordados neste trabalho. Finalmente, procura-se descrever e analisar os principais aspectos em torno das condutas sexuais dos swingers e a relação destas com o uso ou desuso de estratégias preventivas a fim de suscitar reflexões contributivas às discussões sobre prevenção de DSTs/Aids entre swingers.

Attributing a dollar value to a keyword is an essential part of running any profitable search engine advertising campaign. When an advertiser has complete control over the interaction with and monetization of each user arriving on a given keyword, the value of that term can be accurately tracked. However, in many instances, the advertiser may monetize arrivals indirectly through one or more third parties. In such cases, it is typical for the third party to provide only coarse-grained reporting: rather than report each monetization event, users are aggregated into larger channels and the third party reports aggregate information such as total daily revenue for each channel. Examples of third parties that use channels include Amazon and Google AdSense. In such scenarios, the number of channels is generally much smaller than the number of keywords whose value per click (VPC) we wish to learn. However, the advertiser has flexibility as to how to assign keywords to channels over time. We introduce the channelization problem: how do we adaptively assign keywords to channels over the course of multiple days to quickly obtain accurate VPC estimates of all keywords? We relate this problem to classical results in weighing design, devise new adaptive algorithms for this problem, and quantify the performance of these algorithms experimentally. Our results demonstrate that adaptive weighing designs that exploit statistics of term frequency, variability in VPCs across keywords, and flexible channel assignments over time provide the best estimators of keyword VPCs.

El ordenamiento jurídico portugués consagra un régimen fiscal especial para el sector cooperativo, basado, al igual que otros ordenamientos como el español o el italiano, en la protección de la mutualidad como forma de organización empresarial especialmente benéfica en el plano social. Para alcanzar ese objetivo, el régimen fiscal cooperativo debe ser selectivo, lo que significa que al legislador se le plantea el reto de establecer criterios para separar, dentro del marco cooperativo, lo que debe ser protegido de lo que no merece protección fiscal. El legislador portugués optó por un modelo basado en dos grupos de ramos cooperativos claramente diferenciados según los beneficios fiscales aplicables, ambos con amplias exenciones fiscales. El presente trabajo no se centra en el contenido de los beneficios aplicables sino en las condiciones que las cooperativas deben reunir para acogerse a esos regímenes fiscales favorables. Estos criterios son: i) una división entre operaciones con socios y operaciones con terceros; ii) una delimitación de las operaciones o actividades cooperativas según estén o no vinculadas con el “fin propio de la cooperativa”; y iii) una estructura prevalentemente mutualista del factor trabajo. Esta fórmula legal tiene su raíz en una legislación de 1929 y se ha mantenido hasta el día de hoy debido en parte a un fenómeno de inercia legislativa. El presente trabajo, basándose en la metodología de la sociología jurídica, asienta en una encuesta dirigida a 64 cooperativas, por la que se buscaba indagar hasta qué punto estos criterios (de acuerdo con los que se seleccionan las cooperativas que pueden acogerse a los regímenes fiscales favorables) cuadran con la realidad cooperativa actual. Como era de esperar, la vetustez del régimen hizo que se encontraran desajustes muy significativos, que reclaman una reforma urgente.

The research examines the relationships between three common trust considerations (vendor, Internet and third parties) and attitudes towards online purchasing. The study incorporates privacy and security concerns as a moderating variable and finds that these relationships vary depending on the level of concerns a consumer has when purchasing online. The study suggests that "fears" surrounding the Internet as a place to do business still hinder the use of it for e-commerce purposes, but that the presence of a reputable agent might in some manner mitigate this risk. In the context of business to consumer relationships trust in the vendor is important for the consumer to accept any risk associated with a transaction. Theoretical implications for online customer behavior theory are also discussed. © 2009 Elsevier Inc.

Recent work has noted an increase in the number of parties at the national level in both proportional and majoritarian electoral systems. While the conventional wisdom maintains that the incentives provided by the electoral system will prevent the number of parties at the district level from exceeding two in majoritarian systems, the evidence presented here demonstrates otherwise. I argue that this has occurred because the number of cleavages articulated by parties has increased as several third parties have begun articulating cleavages that are not well represented by the two larger parties.

The literature has difficulty explaining why the number of parties in majoritarian electoral systems often exceeds the two-party predictions associated with Duverger’s Law. To understand why this is the case, I examine several party systems in Western Europe before the adoption of proportional representation. Drawing from the social cleavage approach, I argue that the emergence of multiparty systems was because of the development of the class cleavage, which provided a base of voters sizeable enough to support third parties. However, in countries where the class cleavage became the largest cleavage, the class divide displaced other cleavages and the number of parties began to converge on two. The results show that the effect of the class cleavage was nonlinear, producing the greatest party system fragmentation in countries where class cleavages were present – but not dominant – and smaller in countries where class cleavages were either dominant or non-existent.

One of the core properties of Software Defined Networking (SDN) is the ability for third parties to develop network applications. This introduces increased potential for innovation in networking from performance-enhanced to energy-efficient designs. In SDN, the application connects with the network via the SDN controller. A specific concern relating to this communication channel is whether an application can be trusted or not. For example, what information about the network state is gathered by the application? Is this information necessary for the application to execute or is it gathered for malicious intent? In this paper we present an approach to secure the northbound interface by introducing a permissions system that ensures that controller operations are available to trusted applications only. Implementation of this permissions system with our Operation Checkpoint adds negligible overhead and illustrates successful defense against unauthorized control function access attempts.
