Em mãos, tem-se um livro que se pretende, antes de qualquer coisa, uma divulgação, para a disposição e conhecimento de um público mais amplo de leitores brasileiros, da ideia do assim chamado “sistema jurídico romanístico”, que já há algumas décadas vem sendo laboriosa e incansavelmente desenvolvida e promovida sobretudo por Sandro Schipani e por Pierangelo Catalano e por seus discípulos. Essa concepção não deixa de ser uma particular e original aplicação daquela corrente que sempre vicejou no seio dos estudos jus-romanísticos, no sentido de se reconhecer no direito romano uma dimensão e uma perspectiva que extrapola os apertados termos históricos em que se desenrolou a antiga civilização romana, propugnando-se por um direito romano que seja sempre considerado matéria atual. Da ideia de sistema jurídico romanístico despontam importantes repercussões para a América Latina, área geográfica, cultural e política para a qual Schipani e Catalano sempre voltaram as suas atenções. Com efeito, reconhece-se, no âmbito do sistema jurídico romanístico, um verdadeiro subsistema jurídico latino-americano, que seria próprio de um modo latino-americano de se fazer o direito (caracterizado por uma comunicação direta com os princípios do direito romano comum, sempre evocados como fonte de interpretação do direito e de integração do ordenamento jurídico, e de características marcadamente universalistas, ao contrário do espírito nacionalista que permearia o subsistema jurídico europeu, e destacando-se uma tradição jurídica que exalta o papel da doutrina, reafirmando-se o papel histórico da interpretatio prudentium).

This work, developed within the Master's Degree Program in Public Administration and Government of Eaesp-FGV, consists of an exploratory study on performance measurement in the public sector. It is focused on the identification of complexity elements embedded in the implementation of public policies, to which the goals and targets of a target-oriented system relate, and especially on the implementation of this system as a management tool itself, from the case study of the then ongoing "Programa de Metas da Cidade de São Paulo 2013-2016". All information was obtained from municipal managers, in Government Departments responsible for strategic support activities to the implementation of the system, and sectoral Government Departments whose scope also included crosscutting actions, through interviews conducted from a starting question, and then followed by the free talk of the respondents. Through discourse analysis, an assortment of information was conducted, concerning to: 1) the impacts on management, articulation, and governance of the use of performance measurement and result-oriented management; 2) the flow and publicity of information on performance, produced within the monitoring process of this given target-oriented system, and also concerning the use given to this information; 3) the recording and register of experiences and learning related to the Programa de Metas, and its potential to result as a legacy for the public administrative structure of the City of São Paulo. Assuming that the stories managers tell, in this field of Applied Social Sciences, are as valid as Science or the theoretical constructs on the subject, all information gathered from the point of view of the interviewed public officials was segmented and problematized under the light of the literature on performance measurement. The main objective of this research is to contribute to the creation of parameters for qualitative analysis of the information generated in the implementation of a target-oriented system in Public Management at the local level. It is, from then on, expected that these parameters may help managers and researchers on the monitoring and evaluation of performance of a given government, by favoring the translation of merely arithmetic data on percentage of fulfillment of specific commitments, into eloquent elements more enabled to express the evolution of a mandate. A presente dissertação tem como objeto de pesquisa as políticas públicas de democratização do ensino criadas após a Constituição Federal de 1988. Com as teorias de direito e desenvolvimento e a educação superior como pano de fundo, pretende-se relacionar aspectos do direito e políticas públicas sob o enfoque institucional, buscando compreender a realidade dos programas ProUni, Reuni, Fies e Lei de Cotas. Questiona-se, com base em uma em uma metodologia jurídica das políticas públicas, como são construídos os programas para democratização do acesso ao ensino superior tendo em vista os planos macro, meso e microinstitucional como definido por Bucci e como funcionam as ações governamentais de inclusão nas instituições superiores de ensino público e privado. A pesquisa possibilitou constatar que faltam arranjos mesoinstitucionais que coordenem as políticas, tornando-as complementares e mais coerentes entre si, Não foram encontradas agregações institucionais exclusivas para as políticas de acesso ao ensino superior.

A gestão para resultados (GpR) tem adquirido importância crescente nos municípios brasileiros, assumindo diferentes funções no interior das organizações públicas. No entanto, implementação de sistemas de GpR no setor público pode vir acompanhada de novos problemas oriundos da complexidade da mensuração de resultados em ambientes expostos ao escrutínio social e político. Nesse contexto, o objetivo deste trabalho é analisar de forma crítica os sistemas de GpR implantados nas prefeituras de Rio de Janeiro e São Paulo, visando a estabelecer, com base na teoria, conexões entre as diferentes funções exercidas pelos sistemas de GpR e as disfunções vivenciadas pelos gestores públicos no cotidiano. Para tanto, foram mapeadas, com base na teoria, as diferentes funções desempenhadas pelos sistemas de GpR e separadas em três macrocategorias: desempenho, governança e política. A partir dessa categorização, foram delimitadas as possíveis disfunções da GpR relacionadas com as intersecções dessas diferentes macrocategorias. Com base nas categorias teóricas estabelecidas, foram coletados dados sobre a GpR nas duas prefeituras, com destaque para a entrevista de 12 gestores e 3 representantes da sociedade civil. Os achados de pesquisa permitiram demonstrar que a Prefeitura do Rio de Janeiro implementou um sistema de GpR voltado principalmente para a melhoria do desempenho, ao passo que São Paulo focou nas funções relacionadas à macrocategoria da governança. Em relação às disfunções, o Rio de Janeiro apresentou indícios de definição tecnocrátia das metas e gaming interno, ao passo que a Prefeitura de São Paulo esteve marcada por gaming externo, miopia e lock-in. Os resultados permitiram identificar ainda outras variáveis relevantes para o estudo das disfunções da GpR, como a cultura política, o envolvimento do prefeito no sistema, a entrada na agenda do tema da GpR, o grau de institucionalização do sistema de GpR. Os resultados demonstram que as diferentes funções assumidas por esses sistemas estão correlacionadas com as disfunções. O capítulo final explora essas possibilidades de correlações.

In recent decades the public sector comes under pressure in order to improve its performance. The use of Information Technology (IT) has been a tool increasingly used in reaching that goal. Thus, it has become an important issue in public organizations, particularly in institutions of higher education, determine which factors influence the acceptance and use of technology, impacting on the success of its implementation and the desired organizational results. The Technology Acceptance Model - TAM was used as the basis for this study and is based on the constructs perceived usefulness and perceived ease of use. However, when it comes to integrated management systems due to the complexity of its implementation,organizational factors were added to thus seek further explanation of the acceptance of such systems. Thus, added to the model five TAM constructs related to critical success factors in implementing ERP systems, they are: support of top management, communication, training, cooperation, and technological complexity (BUENO and SALMERON, 2008). Based on the foregoing, launches the following research problem: What factors influence the acceptance and use of SIE / module academic at the Federal University of Para, from the users' perception of teachers and technicians? The purpose of this study was to identify the influence of organizational factors, and behavioral antecedents of behavioral intention to use the SIE / module academic UFPA in the perspective of teachers and technical users. This is applied research, exploratory and descriptive, quantitative with the implementation of a survey, and data collection occurred through a structured questionnaire applied to a sample of 229 teachers and 30 technical and administrative staff. Data analysis was carried out through descriptive statistics and structural equation modeling with the technique of partial least squares (PLS). Effected primarily to assess the measurement model, which were verified reliability, convergent and discriminant validity for all indicators and constructs. Then the structural model was analyzed using the bootstrap resampling technique like. In assessing statistical significance, all hypotheses were supported. The coefficient of determination (R ²) was high or average in five of the six endogenous variables, so the model explains 47.3% of the variation in behavioral intention. It is noteworthy that among the antecedents of behavioral intention (BI) analyzed in this study, perceived usefulness is the variable that has a greater effect on behavioral intention, followed by ease of use (PEU) and attitude (AT). Among the organizational aspects (critical success factors) studied technological complexity (TC) and training (ERT) were those with greatest effect on behavioral intention to use, although these effects were lower than those produced by behavioral factors (originating from TAM). It is pointed out further that the support of senior management (TMS) showed, among all variables, the least effect on the intention to use (BI) and was followed by communications (COM) and cooperation (CO), which exert a low effect on behavioral intention (BI). Therefore, as other studies on the TAM constructs were adequate for the present research. Thus, the study contributed towards proving evidence that the Technology Acceptance Model can be applied to predict the acceptance of integrated management systems, even in public. In the present time, public organizations are employing more and more solutions that uses information technology in order to ofer more transparency and better services for all citizens. Integrated Systems are IT which carry in their kernel features of integration and the use of a unique database. These systems bring several benefits and face some obstacles that make their adoption difficult. The conversion to a integrated system may take years and, thus, the study of the adoption of this IT in public sector organizations become very stimulant due to some peculiarities of this sector and the features of this technology. First of all, information about the particular integrated system in study and about its process of conversion are offered. Then, the researcher designs the configuration of the conversion process aim of this study the agents envolved and the moments and the tools used to support the process in order to elaborate the methodology of the conversion process understood as the set of procedures and tools used during all the conversion process. After this, the researcher points out, together with all the members of the conversion team, the negative and positive factors during the project. Finally, these factors were analysed through the Hospitality Theory lens which, in the researcher opinion, was very useful to understand the elements, events and moments that interfered in the project. The results consolidated empirically the Hospitality Theory presumptions, showing yet a limitation of this theory in the case in study

This work has as its theme the social function of terrenos de marinha. Theresearch universe is the terrenos de marinha of Natal coastline, focusing on thefulfillment of its social function. Prescribed by law since the colonial period with thepurpose of protecting the coast and free movement of people and goods, theywere swathes of land not available to private use by individuals. With the transitionfrom the allotments system to the purchase and sale, regard to land access,crystallized with the creation of the Land Law in the nineteenth century, the land isheld as merchandise and terrenos de marinha, following this logic, also acquireexchange value and become capable of enjoyment by private individuals, with thecondition of tax payments to the state. This is seen until the twentieth century,when in 1988, primarily because of the Federal Constitution promulgation, begins anew cycle when is possible to use on terrenos de marinha the principle of thesocial function of property. From this perspective this study aims to identify thesocial function of terrenos de marinha in Natal, focusing on the public destinationand the use value of the city coastline. To this end, it was made a data collection inthe on-line information system of the Federal Heritage Department of Rio Grandedo Norte (SPU / RN) and in the terrenos de marinha areas, in order to find out ifthey had public or private use, or if they were empty lots, as well as if thepopulation access to the shore exist. Interviews with managers of the SPU weremade. The empirical study showed that the social function of terrenos de marinhain the city of Natal still didn´t happen, considering the constant existence of vacantlots in their areas, the lack of access in significant portions of the coastline and thereduced areas directed to common use along the coastline, minimizing its potentialof enjoyment by the population. It concludes by pointing to the existence of a newtransition phase on the terrenos de marinha, in witch, gradually, come up lawprovisions in the legal system and public policies to expand the purely taxcollection function attributed to this land for two centuries. In this direction, thesocial function of terrenos de marinha is embodied in concomitant adjustment ofthe tax collection function and the rescue of coastline use value, national heritageand a place for sociability and social relations development

The freedom of social communication referred to those freedoms exercised under of the media. The journalism is professional activity responsible for factual information, real, pluralistic and of the public interest, directed diffusely to social orientation. The right of the information, characterized as diffuse right or of fruition by uncertain and numerous holders, is subdivided in the right of the inform, inform yourself and right to be informed. The journalists, as occupants of a enlarged spectrum concerning of right of the inform, have responsibility for the information they disseminate, devoir that puts on the basis of the constitutional right to be informed. This duty is divided with journalistic companies, when them realized. In the research, examined the existence of constitutional guarantees the right to be informed. To answer the question, realized research to support bibliographical and documentary. The guaranty is a empirical preoccupation coated with legality, since lends itself effect concretize a right. Traced so a panel of guarantees of institutional imprint, substantive and procedural. Treating of the institutional guarantees the right to information, it would refer to true institutions (as the free press) and may begin subjective rights. In the case of substantial guarantees, we would have access to information, the confidentiality of the fonts and the incensurable feature of journalistic information. A guarantee peculiar would be constitution of bodies responsible for monitoring the quality of the vehicles of communication. The research arose from the necessity of showing ways to be followed by the actors of the System Guaranteeing Rights of the Child and Adolescent (SGD), regarding the implementation of rights for young people, because the legislation in force in Brazil is currently considered a model around the world and, paradoxically, the fundamental rights of children and adolescents are not met, even with the constitutionally guaranteed priority. Thus, the study investigates the fundamentality rights for young people, enshrined in the Constitution of the Republic, as well as the ways of effectiveness of these rights through the actions of actors of the System Guaranteeing Rights, especially the judiciary. Focusing realized, studying theories of fundamental rights, especially Structuring a Theory of Law (Strukturiende Rechtslehre), Friedrich Müller, who emphasizes the need for analysis of social reality in the application of the rule of law. Study also the public budget and public policies concerning children and adolescents, with emphasis on preparation of budget laws and the process of discussion, deliberation, choice and implementation of public policies for children and teenagers. It then presents the typical functions of the members of System Guaranteeing Rights, as well as prepare a plan for optimum performance for each of the actors, with emphasis on analysis of the implementation of public policies at the municipal level. Finally, it analyzes the theory of separation of three powers, and discusses the positive and negative factors for judicial intervention, concluding that the Courts can consider the action activist, from finding the omission of the Executive and legislative branches, as regards the implementation of the rights of children and adolescents, as well as the rights of children and young people are not realized in most cases, due to the omission of actors of the System Guaranteeing Rights
