Début février, le peuple a accepté l'initiative « Contre l'immigration de masse », ce qui a été un des sujets les plus discutés lors des rencontres bilatérales avec les pays voisins et d'autres pays européens. - Lors de sa présidence de l'OSCE, Didier Burkhalter a mis l'accent sur le futur de la jeunesse, mais également sur la promotion de la paix dans l'Europe de l'Est. - Après de nombreuses divergences, les Chambres fédérales ont finalement adopté la nouvelle loi sur les Suisses de l'étranger. - Les compétences du Conseil fédéral en matière de conclusion de traités internationaux ont été restreintes. - Le parlement a voté en faveur de la réintroduction du contrôle aux frontières pour une durée de six mois. - Plusieurs arrêtés fédéraux ont été adoptés en vue d'améliorer et de développer l'acquis Schengen et celui de Dublin/Eurodac. - Après avoir été adopté par les deux chambres, l'accord de libre-échange avec la Chine est entré en vigueur le 1er juillet 2014. - Plusieurs conventions ont été signées en vue d'éviter les doubles impositions.

L'initiative « contre l'immigration de masse » a été acceptée en votation populaire. - La question de l'application de l'initiative « pour le renvoi des criminels étrangers » est toujours en négociation au parlement. - Le Conseil fédéral a adapté la révision de la loi sur les étrangers aux nouvelles dispositions découlant de l'acceptation de l'initiative « contre l'immigration de masse ». - Cette même initiative a suscité le dépôt de deux motions visant à lutter contre la pénurie de main d'ouvre qualifiée. - L'initiative visant à rayer l'interruption volontaire de grossesse du catalogue des prestations remboursées par l'assurance-maladie obligatoire a été refusée en votation populaire. - Suite à de longs débats, le parlement s'est accordé sur un projet de légalisation du diagnostic préimplantatoire, qui sera soumis au peuple en 2015.

Change Adaptation: Open or Closed? Paper read at the Second African International Economic Law Network Conference, 7-8 March 2013, Wits School of Law, Johannesburg, South Africa. In a time of rapid convergence of technologies, goods, services, hardware, software, the traditional classifications that informed past treaties fail to remove legal uncertainty, or advance welfare and innovation. As a result, we turn our attention to the role and needs of the public domain at the interface of existing intellectual property rights and new modes of creation, production and distribution of goods and services. The concept of open culture would have it that knowledge should be spread freely and its growth should come from further developing existing works on the basis of sharing and collaboration without the shackles of intellectual property. Intellectual property clauses find their way into regional, multilateral, bilateral and free trade agreements more often than not, and can cause public discontent and incite unrest. Many of these intellectual property clauses raise the bar on protection beyond the clauses found in the WTO Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS). In this paper we address the question of the protection and development of the public domain in service of open innovation in accord with Article 15 of the International Covenant on Economic, Social and Cultural Rights (ICESCR) in light of the Objectives (Article 7) and Principles (Article 8) set forth in TRIPS. Once areas of divergence and reinforcement between the intellectual property regime and human rights have been discussed, we will enter into options that allow for innovation and prosperity in the global south. We then conclude by discussing possible policy developments.

Les informations sensorielles sont traitées dans le cortex par des réseaux de neurones co-activés qui forment des assemblées neuronales fonctionnelles. Le traitement visuel dans le cortex est régit par différents aspects des caractéristiques neuronales tels que l’aspect anatomique, électrophysiologique et moléculaire. Au sein du cortex visuel primaire, les neurones sont sélectifs à divers attributs des stimuli tels que l’orientation, la direction, le mouvement et la fréquence spatiale. Chacun de ces attributs conduit à une activité de décharge maximale pour une population neuronale spécifique. Les neurones du cortex visuel ont cependant la capacité de changer leur sélectivité en réponse à une exposition prolongée d’un stimulus approprié appelée apprentissage visuel ou adaptation visuelle à un stimulus non préférentiel. De ce fait, l’objectif principal de cette thèse est d’investiguer les mécanismes neuronaux qui régissent le traitement visuel durant une plasticité induite par adaptation chez des animaux adultes. Ces mécanismes sont traités sous différents aspects : la connectivité neuronale, la sélectivité neuronale, les propriétés électrophysiologiques des neurones et les effets des drogues (sérotonine et fluoxétine). Le modèle testé se base sur les colonnes d’orientation du cortex visuel primaire. La présente thèse est subdivisée en quatre principaux chapitres. Le premier chapitre (A) traite de la réorganisation du cortex visuel primaire suite à une plasticité induite par adaptation visuelle. Le second chapitre (B) examine la connectivité neuronale fonctionnelle en se basant sur des corrélations croisées entre paires neuronales ainsi que sur des corrélations d’activités de populations neuronales. Le troisième chapitre (C) met en liaison les aspects cités précédemment (les effets de l’adaptation visuelle et la connectivité fonctionnelle) aux propriétés électrophysiologiques des neurones (deux classes de neurones sont traitées : les neurones à décharge régulière et les neurones à décharge rapide ou burst). Enfin, le dernier chapitre (D) a pour objectif l’étude de l’effet du couplage de l’adaptation visuelle à l’administration de certaines drogues, notamment la sérotonine et la fluoxétine (inhibiteur sélectif de recapture de la sérotonine). Méthodes En utilisant des enregistrements extracellulaires d’activités neuronales dans le cortex visuel primaire (V1) combinés à un processus d’imagerie cérébrale optique intrinsèque, nous enregistrons l’activité de décharge de populations neuronales et nous examinons l’activité de neurones individuels extraite des signaux multi-unitaires. L’analyse de l’activité cérébrale se base sur différents algorithmes : la distinction des propriétés électrophysiologiques des neurones se fait par calcul de l’intervalle de temps entre la vallée et le pic maximal du potentiel d’action (largeur du potentiel d’action), la sélectivité des neurones est basée sur leur taux de décharge à différents stimuli, et la connectivité fonctionnelle utilise des calculs de corrélations croisées. L’utilisation des drogues se fait par administration locale sur la surface du cortex (après une craniotomie et une durotomie). Résultats et conclusions Dans le premier chapitre, nous démontrons la capacité des neurones à modifier leur sélectivité après une période d’adaptation visuelle à un stimulus particulier, ces changements aboutissent à une réorganisation des cartes corticales suivant un patron spécifique. Nous attribuons ce résultat à la flexibilité de groupes fonctionnels de neurones qui étaient longtemps considérés comme des unités anatomiques rigides. En effet, nous observons une restructuration extensive des domaines d’orientation dans le but de remodeler les colonnes d’orientation où chaque stimulus est représenté de façon égale. Ceci est d’autant plus confirmé dans le second chapitre où dans ce cas, les cartes de connectivité fonctionnelle sont investiguées. En accord avec les résultats énumérés précédemment, les cartes de connectivité montrent également une restructuration massive mais de façon intéressante, les neurones utilisent une stratégie de sommation afin de stabiliser leurs poids de connectivité totaux. Ces dynamiques de connectivité sont examinées dans le troisième chapitre en relation avec les propriétés électrophysiologiques des neurones. En effet, deux modes de décharge neuronale permettent la distinction entre deux classes neuronales. Leurs dynamiques de corrélations distinctes suggèrent que ces deux classes jouent des rôles clés différents dans l’encodage et l’intégration des stimuli visuels au sein d’une population neuronale. Enfin, dans le dernier chapitre, l’adaptation visuelle est combinée avec l’administration de certaines substances, notamment la sérotonine (neurotransmetteur) et la fluoxétine (inhibiteur sélectif de recapture de la sérotonine). Ces deux substances produisent un effet similaire en facilitant l’acquisition des stimuli imposés par adaptation. Lorsqu’un stimulus non optimal est présenté en présence de l’une des deux substances, nous observons une augmentation du taux de décharge des neurones en présentant ce stimulus. Nous présentons un modèle neuronal basé sur cette recherche afin d’expliquer les fluctuations du taux de décharge neuronale en présence ou en absence des drogues. Cette thèse présente de nouvelles perspectives quant à la compréhension de l’adaptation des neurones du cortex visuel primaire adulte dans le but de changer leur sélectivité dans un environnement d’apprentissage. Nous montrons qu’il y a un parfait équilibre entre leurs habiletés plastiques et leur dynamique d’homéostasie.

Climate conditions in the westernmost Mediterranean (Alboran Sea basin) over the last two millennia have been reconstructed through integration of molecular proxies applied for the first time in this region at such high resolution. Two temperature proxies, one based on isoprenoid membrane lipids of marine Thaumarchaeota (TEXH86-tetraether index of compounds consisting of 86 carbons) and the other on alkenones produced by haptophytes (UK'37 ratio) were applied to reconstruct sea surface temperature (SST). Both records reveal a progressive long term decline in SST over the last two millennia and an increased rate of warming during the second half of the twentieth century. This is in accord with previous temperature reconstructions for the Northern Hemisphere. TEXH86 temperature values are higher than those inferred from UK'37, probably due to differences in the bloom season of haptophytes and Thaumarchaeota, and reflect summer SST. The branched vs. isoprenoid tetraether index (BIT index) suggests a low contribution of soil organic matter (OM) to the sedimentary OM. The stable carbon isotopic composition of long chain n-alkanes indicates a predominant C3 plant contribution, with no major change in vegetation over the last 2000 yr. The distribution of long chain 1,14-diols (most likely sourced by Proboscia species in this setting) provided insight into variation in upwelling conditions during the last 2000 yr and depicts a correlation with the North Atlantic Oscillation (NAO) index, providing evidence of enhanced wind induced upwelling during periods of a persistent positive mode of the NAO.

Among the five sites drilled during Ocean Drilling Program Leg 130, two deep holes (8O3D and 807C) penetrated Cretaceous sediments overlying the basaltic pillows, flows, and possibly basement rocks. Abundant, poorly preserved radiolarians with limited diversity were recovered from a few horizons within the sediments proximal to the basalt. At Site 803, three thin layers of radiolarites interbedded with claystone and clayey siltstone yielded radiolarian assemblages of late Albian age. At Site 807, several layers of radiolarian siltstones were recovered proximal to the basalt. Among them the most significant radiolarian assemblage is an Aptian fauna, located approximately 7 m above the basaltic flows. The Aptian radiolarian age for Site 807 is at least in accord with those suggested by planktonic foraminifer and paleomagnetic evidence. These Cretaceous radiolarians are the oldest assemblages recorded from the Ontong Java Plateau region.

Excavations were carried out in a Late Palaeolithic site in the community of Bad Buchau-Kappel between 2003 and 2007. Archaeological investigations covered a total of more than 200 m**2. This site is the product of what likely were multiple occupations that occurred during the Late Glacial on the Federsee shore in this location. The site is situated on a mineral ridge that projected into the former Late Glacial lake Federsee. This beach ridge consists of deposits of fine to coarse gravel and sand and was surrounded by open water, except for a connection to the solid shore on the south. A lagoon lay between the hook-shaped ridge and the shore of the Federsee. This exposed location provided optimal access to the water of the lake. In addition, the small lagoon may have served as a natural harbor for landing boats or canoes. Sedimentological and palynological investigations document the dynamic history of the location between 14,500 and 11,600 years before present (cal BP). Evidence of the deposition of sands, gravels and muds since the Bølling Interstadial is provided by stratigraphic and palynological analyses. The major occupation occurred in the second half of the Younger Dryas period. Most of the finds were located on or in the sediments of the ridge; fewer finds occurred in the surrounding mud, which was also deposited during the Younger Dryas. Direct dates on some bone fragments, however, demonstrate that intermittent sporadic occupations also took place during the two millennia of the Meiendorf, Bølling, and Allerød Interstadials. These bones were reworked during the Younger Dryas and redeposited in the mud. A 14C date from one bone of 11,600 years ago (cal BP) places the Late Palaeolithic occupation of the ridge at the very end of the Younger Dryas, which is in agreement with stratigraphic observations. Stone artifacts, numbering 3,281, comprise the majority of finds from the site. These include typical artifacts of the Late Palaeolithic, such as backed points, short scrapers, and small burins. There are no bipointes or Malaurie-Points, which is in accord with the absolute date of the occupation. A majority of the artifacts are made from a brown chert that is obtainable a few kilometers north of the site in sediments of the Graupensandrinne. Other raw materials include red and green radiolarite that occur in the fluvioglacial gravels of Oberschwaben, as well as quartzite and lydite. The only non-local material present is a few artifacts of tabular chert from the region near Kelheim in Bavaria. A unique find consists of two fragments of a double-barbed harpoon made of red deer antler, which was found in the Younger Dryas mud. It is likely, but not certain, that this find belongs to the same assemblage as the numerous stone artifacts. Although not numerous, animal bones were also found in the excavations. Most of them lay in sediments of the Younger Dryas, but several 14C dates place some of these bones in earlier periods, including the Meiendorf, Bølling, and Allerød Interstadials. These bones were reworked by water and redeposited in mud sediments during the Younger Dryas. As a result, it is difficult to attribute individual bones to particular chronological positions without exact dates. Species that could be identified include wild horse (Equus spec.), moose or elk (Alces alces), red deer (Cervus elaphus), roe deer (Capreolus capreolus), aurochs or bison (Bos spec.), wild boar (Sus scrofa), as well as birds and fish, including pike (Esox Lucius).

Fossil manganese nodules and encrustations from seamount' and basin' localities in the Transdanubian Central Mountains of Hungary are lithologically, mineralogically and chemically similar to some modern marine ferromanganese oxide deposits, and show no evidence of postdepositional changes other than cementation. Five groups of deposits were encountered: Fe/Mn nodules, encrusted shells, pavements, stains, and Fe oxide encrusted intraclasts, the first three of which are specific to the 'seamount' environment and the last to the basins'. Optical and electron microprobe investigation of the samples shows them to exhibit many similarities with modern ferromanganese oxide deposits, and that many of the nodules are surrounded by a halo of dispersed ferromanganese oxides, strongly suggesting that they continued to accrete metals through the pore waters of unlithified sediments for a period after burial. By contrast, pavements which appear to have grown on hardgrounds at the sea floor show little or no evidence of derivation of metals from underlying sediments. Geochemical investigations on the deposits show the seamount' varieties to be closer in composition to most modern nodules and crusts than the basin' varieties, and that the latter are essentially manganese and trace-element-poor ferruginous deposits. Nevertheless, all can be more or less compositionally equated with modern ferromanganese oxide deposits forming in marginal Atlantic environments, which would be in accord with the proposed depositional environment of the Transdanubian Central Mountains based on other evidence.

This paper presents an economic model to explain the behavior of life expectancy of both sexes. It explicitly examines the relationship between the gender gap in life expectancy and the gender gap in pay. It shows that as the latter narrows over the course of economic development, the former may initially expand but will eventually shrink. Silicified fragments of false-trunks of the fern, Tempskya judithae sp. nov., are described from lower Cretaceous (latest Albian) sediments near Winton, central-western Queensland. The species is characterised by a three-layered sclerenchymatous cortex and a two-layered pith of sclerenchyma cells. In possessing these characters, T judithae is more similar to T readii than to other species of Tempskya. However, the Australian species differs from T readii in the abaxial shape of the petiole xylem trace (concave in T judithae, convex in T readii) and in symmetry attributes of the leaf-bases within the false-trunk (random in T judithae and radially symmetrical in T readii). T judithae is the first record of Tempskya from Australia and the second from Gondwana; the known distribution range of the genus embraces a broad area in mid-high latitudinal regions of Laurasia and the Gondwana record now comprises Australia and Argentina. Ecological signals of plant fossil assemblages recorded from the Australian sediments are in accord with flood plain habitats and a temperate climatic regime. (c) 2004 Elsevier B.V. This paper examines the impact of multinational trade accords on the degree of stock market linkage using NAFTA as a case study. Besides liberalizing trade among the U.S., Canada and Mexico, NAFTA has also sought to strengthen linkage among stock markets of these countries. If successful, this could lessen the appeal of asset diversification across the North American region and promote a higher degree of market efficiency. We assess the possible impact of NAFTA on market linkage using cross-correlations, multivariate price cointegrating systems, speed of convergence, and generalized variance decompositions of unexpected stock returns. The evidence proves robust and consistently indicates intensified equity market linkage since the NAFTA accord. The results also suggest that interdependent goods markets in the region are a primary reason behind the stronger equity market linkage observed in the post-NAFTA period. (c) 2005 Elsevier Ltd. This article provides an analysis of the policy and practice of prisoner rehabilitation in Queensland, and the extent to which they accord with international best practice. Actual practice was identified through interviews and written submissions from 20 ex-prisoners and 18 prisoner service providers (including two past staff members from Queensland prisons), as well as through an examination of reported judicial review decisions and Department of Corrective Services statistics. The results demonstrate that although the legislation and procedures suggest that a best practice system of prisoner rehabilitation exists in Queensland, there is a significant gulf between policy and practice. Far from being sufficiently prepared for release, Queensland prisoners are generally released directly from high security facilities into a community which they have great difficulty reintegrating into. The results suggest that the corrective services system in Queensland is not succeeding in fulfilling its primary purpose, 'correction', or in meeting its well-publicised goal of ensuring community safety.
