Neste trabalho, analisamos a governança eleitoral exercida pelo TRE/PA, especialmente o seu nível de isenção no contencioso eleitoral (rule adjudication) concernente aos pleitos majoritários (governador e senador) de 1982 e 1986, com retrospecto no período de 1945 a 1965 - o primeiro momento de atuação contínua e prolongada da Justiça Eleitoral num contexto democrático, isto é, antes do Golpe Militar de 1964. Partimos do pressuposto segundo o qual, dada a peculiar composição da Justiça Eleitoral, que funciona tomando de empréstimo magistrados da justiça comum - sendo os TRE‟s compostos, em sua maioria, por membros dos tribunais de justiça estaduais -, somado ao padrão de relacionamento executivo-judiciário estadual, em que, historicamente, constatamos uma hipertrofia do primeiro em relação ao segundo poder, estimamos existir uma grande probabilidade de favorecimento do TRE aos candidatos majoritários do partido governamental. Esta circunstância seria agravada no período histórico em tela, em vista da enorme ingerência do executivo estadual sobre o respectivo poder judiciário, verificada anteriormente à promulgação da Constituição Federal de 1988. Com efeito, encontramos fortes indícios a corroborar esta hipótese no período 1945-65, mas não encontramos evidências suficientes para sustentá-la por ocasião dos pleitos de 1982 e 1986. No pleito de 1982, o TRE manifestou razoável grau de isenção e coerência em seus acórdãos, exceto em dois processos semelhantes: um deles provocado pelo PDS e o outro pelo PMDB, ambos envolvendo um número expressivo de votos. O PMDB, partido então patrocinado pelo governador, venceu a lide, enquanto o PDS, o partido oposicionista, foi derrotado. No tocante, ao pleito de 1986, observamos uma disposição da Corte para denegar os pedidos propostos pelas legendas oposicionistas, sobretudo o PT e o extinto PMB, ainda que não tenha sido possível demonstrar um claro favorecimento ao partido governamental.

O presente estudo tem como objeto analisar a efetividade do direito à educação na Constituição de 1988. Examina-se o conceito, a natureza, os custos (como a criação de reserva de fundos no FUNDEB e as designações sobre os percentuais a serem usados para a manutenção e desenvolvimento do ensino pelas entidades federativas), o papel do Estado e da sociedade e os princípios constitucionais que regulam a implementação do direito à educação na realidade brasileira. A partir do postulado de que o Estado Social e Democrático de Direito é protetor dos direitos sociais, foi relevante considerar que os argumentos sobre o mínimo existencial e a escassez de recursos devem ser apreciados com o máximo de cuidado. Além disso, são analisadas duas decisões judiciais proferidas em dois casos concretos que foram levados ao Supremo Tribunal Federal, fenômeno denominado por maior parte da doutrina de “judicialização de políticas públicas”, trata-se do caso Santo André/SP e do caso Queimados/RJ. Por fim, as referidas decisões são analisadas conforme os princípios e valores constitucionais tendo sido concluído que as demandas coletivas de satisfação do direito à educação são prioritárias em relação as demandas individuais, embora ambas sejam exigíveis.

A fuzzy ruled-based system was developed in this study and resulted in an index indicating the level of uncertainty related to commercial transactions between cassava growers and their dealers. The fuzzy system was developed based on Transaction Cost Economics approach. The fuzzy system was developed from input variables regarding information sharing between grower and dealer on “Demand/purchase Forecasting”, “Production Forecasting” and “Production Innovation”. The output variable is the level of uncertainty regarding the transaction between seller and buyer agent, which may serve as a system for detecting inefficiencies. Evidences from 27 cassava growers registered in the Regional Development Offices of Tupa and Assis, São Paulo, Brazil, and 48 of their dealers supported the development of the system. The mathematical model indicated that 55% of the growers present a Very High level of uncertainty, 33% present Medium or High. The others present Low or Very Low level of uncertainty. From the model, simulations of external interferences can be implemented in order to improve the degree of uncertainty and, thus, lower transaction costs.

Issues related to association mining have received attention, especially the ones aiming to discover and facilitate the search for interesting patterns. A promising approach, in this context, is the application of clustering in the pre-processing step. In this paper, eleven metrics are proposed to provide an assessment procedure in order to support the evaluation of this kind of approach. To propose the metrics, a subjective evaluation was done. The metrics are important since they provide criteria to: (a) analyze the methodologies, (b) identify their positive and negative aspects, (c) carry out comparisons among them and, therefore, (d) help the users to select the most suitable solution for their problems. Besides, the metrics do the users think about aspects related to the problems and provide a flexible way to solve them. Some experiments were done in order to present how the metrics can be used and their usefulness.

In this work we calculate the form factors of the Lambda(c) and Lambda(b) semileptonic decay using the QCD sum rules approach. We found that the form factors sum rules are more stable than the respective mass sum rules, and we get a decay rate for Lambda(c) compatible with experiment.

QCD sum rules are used to calculate the contribution of the short-distance single-quark transition s-->d gamma to the amplitudes of the hyperon radiative decay Omega(-)-->Xi(-) gamma. We reevaluate the Wilson coefficient of the effective operator responsible for this transition. We obtain a branching ratio which is comparable to the unitarity limit.

The aim of this paper is to present a historical review of the implementation process of the political pedagogical project (PPP) of Londrina (PR). The study used interviews with some agents who participated in the construction of the PPP (teachers, school, supervisors and employees of the Regional Education Center) and investigated the absorption of proposals from the base (school) for the offices of political power. The results showed that although the democratic discourse has always been present in official documents the construction of the PPP had discrete popular participation and projects, as a rule, incorporated the bureaucratic forms issued by official powers.

The family Phycodnaviridae encompasses a diverse and rapidly expanding collection of large icosahedral, dsDNA viruses that infect algae. These lytic and lysogenic viruses have genomes ranging from 160 to 560 kb. The family consists of six genera based initially on host range and supported by sequence comparisons. The family is monophyletic with branches for each genus, but the phycodnaviruses have evolutionary roots that connect them with several other families of large DNA viruses, referred to as the nucleocytoplasmic large DNA viruses (NCLDV).The phycodnaviruses have diverse genome structures, some with large regions of noncoding sequence and others with regions of ssDNA. The genomes of members in three genera in the Phycodnaviridae have been sequenced. The genome analyses have revealed more than 1000 unique genes, with only 14 homologous genes in common among the three genera of phycodnaviruses sequenced to date. Thus, their gene diversity far exceeds the number of so-called core genes. Not much is known about the replication of these viruses, but the consequences of these infections on phytoplankton have global affects, including influencing geochemical cycling and weather patterns.

Aim The study aimed to determine the value of postchemoradiation biopsies, performed after significant tumour downsizing following neoadjuvant therapy, in predicting complete tumour regression in patients with distal rectal cancer. Method A retrospective comparative study was performed in patients with rectal cancer who achieved an incomplete clinical response after neoadjuvant chemoradiotherapy. Patients with significant tumour downsizing (> 30% of the initial tumour size) were compared with controls (< 30% reduction of the initial tumour size). During flexible proctoscopy carried out postchemoradiation, biopsies were performed using 3-mm biopsy forceps. The biopsy results were compared with the histopathological findings of the resected specimen. UICC (Union for International Cancer Control) ypTNM classification, tumour differentiation and regression grade were evaluated. The main outcome measures were sensitivity and specificity, negative and positive predictive values, and accuracy of a simple forceps biopsy for predicting pathological response after neoadjuvant chemoradiotherapy. Results Of the 172 patients, 112 were considered to have had an incomplete clinical response and were included in the study. Thirty-nine patients achieved significant tumour downsizing and underwent postchemoradiation biopsies. Overall, 53 biopsies were carried out. Of the 39 patients who achieved significant tumour downsizing, the biopsy result was positive in 25 and negative in 14. Only three of the patients with a negative biopsy result were found to have had a complete pathological response (giving a negative predictive value of 21%). Considering all biopsies performed, only three of 28 negative biopsies were true negatives, giving a negative predictive value of 11%. Conclusion In patients with distal rectal cancer undergoing neoadjuvant chemoradiation, post-treatment biopsies are of limited clinical value in ruling out persisting cancer. A negative biopsy result after a near-complete clinical response should not be considered sufficient for avoiding a radical resection.
