Durante los últimos años, el papel de Brasil en el panorama global viene siendo cada vez más importante y se ha revelado como un interlocutor clave para la Unión Europea (UE). Sin embargo, hasta muy recientemente, no se ha aprovechado suficientemente el diálogo UE-Brasil, que ha tenido lugar sobre todo a través del diálogo UE-Mercado Común del Sur (MERCOSUR). Brasil será el último “BRICS”2 que se reúna con la UE en una cumbre. Ha llegado el momento de considerar este país socio estratégico e importante actor económico y líder regional latinoamericano.

Vivimos una época en la que la independencia judicial, interna y externa, se encuentra cada vez más amenazada, pues tanto las otras funciones del Estado, como el órgano encargado de asegurar el correcto, eficiente y coordinado funcionamiento de los órganos jurisdiccionales, han llevado a cabo frecuentes intentos para influir ilegítimamente en las actuaciones jurisdiccionales de los y las juezas, ocasionando de esta manera la pérdida de confianza y legitimidad de esta función. Por esta razón, el presente trabajo investigativo tiene como propósito estudiar el rol que cumple el Consejo de la Judicatura como órgano de gobierno judicial dentro de los modernos Estados constitucionales de derecho y su relación con el principio de independencia del Poder Judicial y de los jueces, con el fin de comprender la trascendencia, las ventajas e implicaciones del diseño de esta institución para la garantía de la independencia judicial. Para ello, inicio la investigación con un acercamiento teórico conceptual a la independencia del Poder Judicial y de los jueces. Estudio sus ámbitos y sus distintas concepciones en las diferentes etapas evolutivas del Estado de Derecho. Luego, analizo los modelos existentes de gobierno judicial y el origen europeo de los consejos de la judicatura o magistratura y su trasplante, en las últimas décadas, a Latinoamérica. Enseguida realizo un breve recuento histórico de las múltiples intervenciones ilegítimas en la Función Judicial vividas en nuestro país en su vida republicana y contextualizo la creación del Consejo Nacional de la Judicatura en los noventas del siglo pasado. Con estos conocimientos, en la última parte, estudio tres temas imprescindibles para comprender las ventajas y desventajas del actual diseño del Consejo: la forma de integrarlo y los mayores o menores vínculos y dependencias políticas que conserva; las atribuciones disciplinarias que ostenta sobre los jueces y su influencia sobre sus actos jurisdiccionales; y, la responsabilidad judicial como contrapartida de su independencia.

Tras analizar y evaluar la argumentación jurídica efectuada por el Tribunal del CIADI respecto del caso CMS vs. Argentina, se aprecia que tal argumentación descansa sobre la errada concepción de que en el caso no existían aspectos que afecten derechos humanos. En realidad se trataba de un caso difícil, en materia de derechos sociales, que no podía ser resuelto por la simple aplicación de las reglas específicas del sistema (subsunción), como erróneamente lo hizo el Tribunal del CIADI, pues necesariamente debía acudirse al procedimiento de la ponderación. Si se acude a la ponderación se podrá constatar que existen dos principios aplicables, cada uno de los cuales lleva a una solución incompatible con la del otro: por un lado, la protección del derecho a la seguridad jurídica del inversionista extranjero, que exige un respeto a los derechos pactados contractual y legalmente, y, por otro, el de la protección al derecho a la vivienda, que exige una congelación en las tarifas de servicios básicos esenciales, entre ellos del transporte y distribución del gas. En este caso el segundo prevalece sobre el primero.

Around 1930, Argentina was one of the richest, most dynamic and modern countries in Latin America and, at the same time, the only one on the continent that had not separated Church from State. This observation can be summed up and singled out among the many hypotheses during the last decades that have permitted the questioning of the most schematic, linear and teleological reports concerning the secularization process. This article puts forward a report concerning the double process of state and ecclesiastical construction in Argentina in the Nineteenth Century. Its purpose is to suggest keys for understanding said report that permit the comprehension of special features concerning the type of laicism that Argentina adopted at the beginning of the Twentieth Century.

The aim is to discuss the main legal criteria developed in Argentina in regard to cultural and architectural heritage protection through the analysis of five court decisions and their main protection techniques. The goal is to raise awareness about the critical role of civil society in the protection and promotion of heritage and cultural values. The attempt is to highlight the importance of judge’s active role as a major figure in the field.

This article examines the conceptual framework and the institutional context of the Geographical Indications and Social Management in Spain on the European Union space. Then, providing a comparative study, Argentina’s and Brazil’s cases are analyzed. The emphasis is on identity and territorial development, where family farming has a central role. Thereafter, public policy drawings and implementation are projected in order to strength concrete agenda and measures elaboration based on Spanish and European experiences’. In both the Argentinean and Brazilian cases, the conclusions point to the need of an adjustment on public policies to better situate and implement actions and objectives. In Brazil the disclosure, financing and strengthening of the Geographical Indications should be bounded to the Programa Territórios da Cidadania, linked to the Ministério do Desenvolvimento Agrário, which is the place of the family farming strengthening policies. In Argentina, with the same logic, the actions should be situated on the Programa Nacional de Apoyo al Desarrollo de los Territórios.

We present a catalogue of galaxy photometric redshifts and k-corrections for the Sloan Digital Sky Survey Data Release 7 (SDSS-DR7), available on the World Wide Web. The photometric redshifts were estimated with an artificial neural network using five ugriz bands, concentration indices and Petrosian radii in the g and r bands. We have explored our redshift estimates with different training sets, thus concluding that the best choice for improving redshift accuracy comprises the main galaxy sample (MGS), the luminous red galaxies and the galaxies of active galactic nuclei covering the redshift range 0 < z < 0.3. For the MGS, the photometric redshift estimates agree with the spectroscopic values within rms = 0.0227. The distribution of photometric redshifts derived in the range 0 < z(phot) < 0.6 agrees well with the model predictions. k-corrections were derived by calibration of the k-correct_v4.2 code results for the MGS with the reference-frame (z = 0.1) (g - r) colours. We adopt a linear dependence of k-corrections on redshift and (g - r) colours that provide suitable distributions of luminosity and colours for galaxies up to redshift z(phot) = 0.6 comparable to the results in the literature. Thus, our k-correction estimate procedure is a powerful, low computational time algorithm capable of reproducing suitable results that can be used for testing galaxy properties at intermediate redshifts using the large SDSS data base.

Since the advent of the postgenomic era, efforts have focused on the development of rapid strategies for annotating plant genes of unknown function. Given its simplicity and rapidity, virus-induced gene silencing (VIGS) has become one of the preeminent approaches for functional analyses. However, several problems remain intrinsic to the use of such a strategy in the study of both metabolic and developmental processes. The most prominent of these is the commonly observed phenomenon of ""sectoring"" the tissue regions that are not effectively targeted by VIGS. To better discriminate these sectors, an effective marker system displaying minimal secondary effects is a prerequisite. Utilizing a VIGS system based on the tobacco rattle virus vector, we here studied the effect of silencing the endogenous phytoene desaturase gene (pds) and the expression and subsequent silencing of the exogenous green fluorescence protein (gfp) on the metabolism of Arabidopsis (Arabidopsis thaliana) leaves and tomato (Solanum lycopersicum) fruits. In leaves, we observed dramatic effects on primary carbon and pigment metabolism associated with the photobleached phenotype following the silencing of the endogenous pds gene. However, relatively few pleiotropic effects on carbon metabolism were observed in tomato fruits when pds expression was inhibited. VIGS coupled to gfp constitutive expression revealed no significant metabolic alterations after triggering of silencing in Arabidopsis leaves and a mild effect in mature green tomato fruits. By contrast, a wider impact on metabolism was observed in ripe fruits. Silencing experiments with an endogenous target gene of interest clearly demonstrated the feasibility of cosilencing in this system; however, carefully constructed control experiments are a prerequisite to prevent erroneous interpretation.

Circadian rhythms are regarded as essentially ubiquitous features of animal behavior and are thought to confer important adaptive advantages. However, although circadian systems of rodents have been among the most extensively studied, most comparative biology is restricted to a few related species. In this study, the circadian organization of locomotor activity was studied in the subterranean, solitary north Argentinean rodent, Ctenomys knightii. The genus, Ctenomys, commonly known as Tuco-tucos, comprises more than 50 known species over a range that extends from 12S latitude into Patagonia, and includes at least one social species. The genus, therefore, is ideal for comparative and ecological studies of circadian rhythms. Ctenomys knightii is the first of these to be studied for its circadian behavior. All animals were wild caught but adapted quickly to laboratory conditions, with clear and precise activity-rest rhythms in a light-dark (LD) cycle and strongly nocturnal wheel running behavior. In constant dark (DD), the rhythm expression persisted with free-running periods always longer than 24h. Upon reinstatement of the LD cycle, rhythms resynchronized rapidly with large phase advances in 7/8 animals. In constant light (LL), six animals had free-running periods shorter than in DD, and 4/8 showed evidence of splitting. We conclude that under laboratory conditions, in wheel-running cages, this species shows a clear nocturnal rhythmic organization controlled by an endogenous circadian oscillator that is entrained to 24h LD cycles, predominantly by light-induced advances, and shows the same interindividual variable responses to constant light as reported in other non-subterranean species. These data are the first step toward understanding the chronobiology of the largest genus of subterranean rodents.

Based on 16 specimens from the Southwestern Atlantic coast (Argentina and Brazil) we reinterpret the taxonomic position of Tessera gemmaria Goy, 1979, a stauromedusa considered as incertae sedis for a long time. Using external morphology, histological preparations and molecular data (16S and COI) we conclude that T. gemmaria is an early stage of a cerinula, the long-lived planktonic larval stage of the Ceriantharia (Anthozoa).

Vegetables are critical for human health as they are a source of multiple vitamins including vitamin E (VTE). In plants, the synthesis of VTE compounds, tocopherol and tocotrienol, derives from precursors of the shikimate and methylerythritol phosphate pathways. Quantitative trait loci (QTL) for alpha-tocopherol content in ripe fruit have previously been determined in an Solanum pennellii tomato introgression line population. In this work, variations of tocopherol isoforms (alpha, beta, gamma, and delta) in ripe fruits of these lines were studied. In parallel all tomato genes structurally associated with VTE biosynthesis were identified and mapped. Previously identified VTE QTL on chromosomes 6 and 9 were confirmed whilst novel ones were identified on chromosomes 7 and 8. Integrated analysis at the metabolic, genetic and genomic levels allowed us to propose 16 candidate loci putatively affecting tocopherol content in tomato. A comparative analysis revealed polymorphisms at nucleotide and amino acid levels between Solanum lycopersicum and S. pennellii candidate alleles. Moreover, evolutionary analyses showed the presence of codons evolving under both neutral and positive selection, which may explain the phenotypic differences between species. These data represent an important step in understanding the genetic determinants of VTE natural variation in tomato fruit and as such in the ability to improve the content of this important nutriceutical.

The open vegetation corridor of South America is a region dominated by savanna biomes. It contains forests (i.e. riverine forests) that may act as corridors for rainforest specialists between the open vegetation corridor and its neighbouring biomes (i.e. the Amazonian and Atlantic forests). A prediction for this scenario is that populations of rainforest specialists in the open vegetation corridor and in the forested biomes show no significant genetic divergence. We addressed this hypothesis by studying plumage and genetic variation of the Planalto woodcreeper Dendrocolaptes platyrostris Spix (1824) (Aves: Furnariidae), a forest specialist that occurs in both open habitat and in the Atlantic forest. The study questions were: (1) is there any evidence of genetic continuity between populations of the open habitat and the Atlantic forest and (2) is plumage variation congruent with patterns of neutral genetic structure or with ecological factors related to habitat type? We used cytochrome b and mitochondrial DNA control region sequences to show that D. platyrostris is monophyletic and presents substantial intraspecific differentiation. We found two areas of plumage stability: one associated with Cerrado and the other associated with southern Atlantic Forest. Multiple Mantel tests showed that most of the plumage variation followed the transition of habitats but not phylogeographical gaps, suggesting that selection may be related to the evolution of the plumage of the species. The results were not compatible with the idea that forest specialists in the open vegetation corridor and in the Atlantic forest are linked at the population level because birds from each region were not part of the same genetic unit. Divergence in the presence of gene flow across the ecotone between both regions might explain our results. Also, our findings indicate that the southern Atlantic forest may have been significantly affected by Pleistocene climatic alteration, although such events did not cause local extinction of most taxa, as occurred in other regions of the globe where forests were significantly affected by global glaciations. To date, there has been only one in vitro study of the relationship between neuropeptide EI (NEI) and the hypothalamic-pituitary-thyroid (HPT) axis. To investigate the possible relationship between NEI and the HPT axis, we developed a rat model of hypothyroidism and hyperthyroidism that allows us to determine whether NEI content is altered in selected brain areas after treatment, as well as whether such alterations are related to the time of day. Hypothyroidism and hyperthyroidism, induced in male rats, with 6-propyl-1-thiouracil and L-thyroxine, respectively, were confirmed by determination of triiodothyronine, total thyroxine, and thyrotropin levels. All groups were studied at the morning and the afternoon. In rats with hypothyroidism, NEI concentration, evaluated on postinduction days 7 and 24, was unchanged or slightly elevated on day 7 but was decreased on day 24. In rats with hyperthyroidism, NEI content, which was evaluated after 4 days of L-thyroxine administration, was slightly elevated, principally in the preoptic area in the morning and in the median eminence-arcuate nucleus and pineal gland in the afternoon, the morning and afternoon NEI contents being similar in the controls. These results provide the bases to pursue the study of the interaction between NEI and the HPT axis. (C) 2011 Elsevier Inc. All rights reserved.
