O elevado custo da operação de recolha de resíduos urbanos e a necessidade de cumprir metas dispostas em instrumentos legais são duas motivações que conduzem à necessidade de otimizar o serviço da recolha de resíduos. A otimização da recolha de resíduos é um problema de elevada complexidade de resolução que envolve a análise de redes de transporte. O presente trabalho propõe soluções de otimização da recolha de resíduos urbanos indiferenciados, a partir de um caso de estudo: o percurso RSU I 06 do município de Aveiro. Para este efeito, recorreu-se a uma aplicação informática de representação e análise geográfica: software ArcGIS denominada ArcMap e sua extensão Network Analyst, desenvolvida para calcular circuitos otimizados entre pontos de interesse. O trabalho realizado de aplicação do Network Analyst inclui a apresentação de duas das suas funcionalidades (Route e Vehicle Routing Problem). Em relação ao atual circuito de recolha e com base nos ensaios efetuados, foi possível concluir que esta aplicação permite obter circuitos de recolha otimizados mais curtos ou com menor duração. Contudo, ao nível da gestão permitiu concluir que, com a atual capacidade de contentorização, seria viável reduzir a frequência de recolha de seis vezes por semana para metade, dividindo a área de recolha em duas áreas, de acordo com as necessidades de cada local, reduzindo ainda mais o esforço de recolha. A aplicação do Network Analyst ao caso de estudo, permitiu concluir que é um software com muito interesse no processo de gestão da recolha de resíduos urbanos, apesar de apresentar algumas restrições de aplicação e que a qualidade/eficácia do procedimento de otimização depende da qualidade dos dados de entrada, em particular do descritivo geográfico disponível para os arruamentos e, em larga medida, também depende do modelo de gestão considerado.

Value and reasons for action are often cited by rationalists and moral realists as providing a desire-independent foundation for normativity. Those maintaining instead that normativity is dependent upon motivation often deny that anything called '"value" or "reasons" exists. According to the interest-relational theory, something has value relative to some perspective of desire just in case it satisfies those desires, and a consideration is a reason for some action just in case it indicates that something of value will be accomplished by that action. Value judgements therefore describe real properties of objects and actions, but have no normative significance independent of desires. It is argued that only the interest-relational theory can account for the practical significance of value and reasons for action. Against the Kantian hypothesis of prescriptive rational norms, I attack the alleged instrumental norm or hypothetical imperative, showing that the normative force for taking the means to our ends is explicable in terms of our desire for the end, and not as a command of reason. This analysis also provides a solution to the puzzle concerning the connection between value judgement and motivation. While it is possible to hold value judgements without motivation, the connection is more than accidental. This is because value judgements are usually but not always made from the perspective of desires that actually motivate the speaker. In the normal case judgement entails motivation. But often we conversationally borrow external perspectives of desire, and subsequent judgements do not entail motivation. This analysis drives a critique of a common practice as a misuse of normative language. The "absolutist" attempts to use and, as philosopher, analyze normative language in such a way as to justify the imposition of certain interests over others. But these uses and analyses are incoherent - in denying relativity to particular desires they conflict with the actual meaning of these utterances, which is always indexed to some particular set of desires.

The objective of this study is to examine the relations of familismo to academic functioning and mental health among non-citizen Latina/o college students. The study utilizes both quantitative self-report surveys to explore attitudinal family obligations, and qualitative interviews to explore behavioral family obligations. One hundred and eighty citizen students (M = 21.30, SD = 2.92) and 84 non-citizen students (M = 21.13, SD = 2.98) completed surveys. Correlational analyses found that family obligation attitudes were linked to academic emotional engagement for non-citizen students only (r = .305, p = .005, n = 84). Cluster analyses revealed risk, resilience, and protected clusters from stress and family obligation groupings. Twenty-one non-citizen students also completed interviews. Narrative analysis of the interviews revealed that family obligation behaviors may be linked to motivation and stress. Overall, this study illustrates the complex nature of family obligations and achievement in the lives of non-citizen Latina/o college students.

Este trabalho teve como foco a presença da área de conhecimento música no curso Normal de duas escolas públicas do município de Pelotas/RS: O Instituto Estadual de Educação Assis Brasil e o Colégio Municipal Pelotense. Considerando que esta modalidade formativa habilita professores para o trabalho na educação infantil e anos iniciais do ensino fundamental, investigamos a educação musical que está sendo desenvolvida no curso Normal e em que concepções se apoia esta prática. Após seis anos de vigência da Lei 11.769/2008, que alterou o artigo 26 da Lei de Diretrizes e Bases de 1996 e incluiu a obrigatoriedade do ensino dos conteúdos de música dentro do componente curricular Arte, esta pesquisa compreendeu o processo de adaptação dos currículos escolares, as discussões em torno da atual legislação e as orientações por parte das mantenedoras, tendo em vista a referida Lei. Outra questão presente nesta pesquisa, refere-se à identificação do profissional responsável por trabalhar os conteúdos de música, já que a Lei 11.769/2008 excluiu, por meio de veto presidencial, o artigo que solicitava formação específica na área. Após o período do canto orfeônico no Brasil, as Leis de Diretrizes e Bases de 1961 e 1971, respectivamente, não ratificaram esta área de forma permanente nos currículos escolares. Em 1996, uma nova LDB, suscitaria novas esperanças aos professores de música e aos pesquisadores da área, no entanto, esta legislação não atendeu as expectativas dos profissionais ligados à música, permanecendo a educação musical ausente em muitos contextos educativos. A partir da Lei 11.769/2008, esta pesquisa objetivou identificar se a efetiva inclusão dos conteúdos de música na disciplina de Arte se concretizou, já que a LDB de 1996 não clarificou quais as áreas deveriam ser contempladas dentro deste componente curricular. Além desses aspectos, esta pesquisa também problematizou a atual situação do ensino de música no contexto geral das escolas estaduais e das instituições municipais de Pelotas/RS.

Cet essai est une analyse du régime juridique applicable aux accusés qui ont été reconnus non-responsables criminellement pour cause de troubles mentaux en vertu de l'article 16 du Code criminel. Nous exposons tout d'abord l'historique dudit verdict lequel mène à un suivi à double volets, soit juridique et médical, dont nous détaillons le cadre normatif dans une seconde partie. Le premier volet est assuré par une instance administrative alors que le second relève d'un hôpital. Le suivi à double volets sous-tend donc la cohabitation de deux domaines aux objectifs distincts, à savoir la protection de la société à l'égard d'un accusé ayant commis un acte criminel pour l'un et le traitement d'un patient psychiatrique pour l'autre. Les hôpitaux, et plus particulièrement les psychiatres, se retrouvent ainsi avec l'obligation de jongler avec le droit criminel, tout en poursuivant leur objectif principal, soit le traitement de leurs patients. Dans ce contexte, le présent essai tente d'étudier les conséquences potentielles de la rencontre de ces deux domaines sur les droits des accusés. En effet,la mise en place du suivi à double volets visait un respect plus adéquat des droits et libertés des accusés ainsi qu'une meilleure prise en charge médicale de leurs besoins aux fins de leur offrir un traitement approprié. Toutefois, les tensions existant entre le domaine juridique et celui de la santé permettent-elles vraiment d'atteindre de tels objectifs?

O presente estudo aborda a temática da educação escolar nas comunidades tradicionais. Essa abordagem ocorre a partir do estudo de caso da Ilha da Torotama, Rio Grande/RS. É reconhecido que as comunidades tradicionais sofrem uma intensa transformação a partir da lógica moderna do capital, no caso do município de Rio Grande, percebe-se o quanto os discursos em torno do Polo Naval, paralelamente com a crise da pesca artesanal, impulsionam o êxodo das comunidades pesqueiras que constituem a região, levando o pescador ao abandono do trabalho, bem como a uma drástica ruptura frente as formas de vida no espaço tradicional de pesca. A partir desse panorama cabe questionar os sentidos que a escolarização assume nesses espaços, portanto: Quais as contradições e possibilidades da educação escolar nas comunidades tradicionais? Além disso, é necessário questionar: É possível (re)pensar as formas de contemplar os anseios desses povos tradicionais? Nesse sentido, busca-se compreender e problematizar as contradições e possibilidades em torno da escolarização em um contexto do Campo, constituído por povos tradicionais. Para o enfrentamento da problemática, assume-se uma postura dialética a partir de Gadotti (2012) e Severino (2001); esse embasamento epistemológico sustenta o olhar e a escuta da pesquisadora frente aos processos presentes no estudo. Com efeito, por meio da utilização da História Oral na perspectiva assumida por Thompson (1992), encontra-se para maior organização do processo de construção dos dados, a História Oral Temática (MEIHY e HOLANDA, 2010) e (MEIHY, 1996). Nesse horizonte, realizam-se entrevistas com três educadores e quatro educandos do Projeto Educação para Pescadores, o qual ocorre enquanto um processo de escolarização na Ilha da Torotama. O estudo aponta para a necessidade de pensar a escola nas comunidades tradicionais a partir do horizonte da Educação do Campo. Essa compreensão ocorre a partir dos desafios encontrados com relação a escolarização das referidas comunidades; haja vista que o Estado não assume de forma efetiva a educação básica nesses contextos, tampouco aborda a possibilidade de retorno dos sujeitos que tiveram a escolarização negligenciada. A omissão do poder público frente as demandas da comunidade, junto as formas de incentivo e beneficiamento da pequena burguesia industrial pesqueira, por exemplo, são indicativos de que as comunidades tradicionais sofrem em seu contexto uma forte contradição, pois, muito embora o Estado tenha enquanto obrigação resguardar tais povos, as demandas do mercado prevalecem na dinâmica evidenciada. Assim, assumir as lutas lançadas pela 8 perspectiva da Educação do Campo, é uma pertinente possibilidade de ruptura com o sentido que a escola vem apresentando nesses espaços: a escola é vista como uma forma de saída da comunidade e do trabalho da pesca. Portanto, acredita-se que ao assumir o horizonte da Educação do Campo, o trabalho desses sujeitos pertencentes as comunidades tradicionais possa ser problematizado, fomentando a construção crítica frente aos desafios impostos pela lógica opressora.

Analysis of terms ‘social relationship’ and ‘legal relationship’ in the literature of legal theory and legal philosophy encounters many difficulties especially because of the ambiguity of such terms as ‘law’, ‘positive (statutory) law’, ‘rule’, ‘legal rule’, ‘norm’ and ‘legal norm’. Insight into the mentioned above literature points out that particularly the former pair of these notions have been so far wrongly considered as equivalent. It does not result a correct description of the relationship between different normative social systems such as statutory (positive) law, morality, religion and customs. Next it translates into a numbers of disputes about the content of positive law both in law-making’ and law-applying’s decisions.

Cette étude porte sur les chroniques d’Odette Oligny sur l’éducation des enfants publiées dans Le Canada de 1931 à 1936. Cette journaliste écrit à une époque durant laquelle l’éducation est influencée par la montée des experts, qui comme Oligny, conseillent les mères sur les comportements et les pratiques à adopter pour former les futurs citoyens. Dans le premier chapitre de ce mémoire, nous traitons des responsabilités, selon la journaliste, qu’ont les mères envers leurs enfants. La charge de les éduquer revient exclusivement aux femmes et elles sont sévèrement critiquées par les experts lorsqu’elles ne peuvent ou ne veulent pas se conformer à leurs normes. Le deuxième chapitre analyse la discipline familiale qui doit être mises en oeuvre par les mères. De l’avis d’Oligny, certaines d’entre elles utilisent de façon excessive les punitions corporelles alors que d’autres sont trop indulgentes avec leur progéniture. Enfin, le troisième chapitre de ce mémoire se consacre au discours sur l’éducation des filles et des garçons. Les mères ont le devoir de développer des qualités chez leurs enfants qui leur permettront de remplir leurs futurs rôles de citoyens. À travers l’analyse des chroniques d’Oligny, nous montrerons qu’elle agit, en vulgarisant les connaissances, comme un pont entre les experts et la population qui n’a pas nécessairement accès aux travaux de ces derniers.

Since the 1980s there have been three main attempts to ground citizenship upon the principles of duty, obligation and responsibility: conservative, communitarian and Third Way. Each of these are reviewed below. The principal task of this article, though, is to examine the emergence of a fourth attempt which, by relating duty to equality through the principle of reciprocity, represents a synthesis of traditional social democracy with the new politics of obligation. Our focus will be upon The Civic Minimum by Stuart White since this is arguably the most cogent expression of duty-based egalitarianism to have emerged in recent years. This study examines the pluralistic hypothesis advanced by the late Professor John Hick viz. that all religious faiths provide equally salvific pathways to God, irrespective of their theological and doctrinal differences. The central focus of the study is a critical examination of (a) the epistemology of religious experience as advanced by Professor Hick, (b) the ontological status of the being he understands to be God, and further asks (c) to what extent can the pluralistic view of religious experience be harmonised with the experience with which the Christian life is understood to begin viz. regeneration. Tracing the theological journey of Professor Hick from fundamentalist Christian to religious pluralist, the study notes the reasons given for Hick’s gradual disengagement from the Christian faith. In addition to his belief that the pre-scientific worldview of the Bible was obsolete and passé, Hick took the view that modern biblical scholarship could not accommodate traditionally held Christian beliefs. He conceded that the Incarnation, if true, would be decisive evidence for the uniqueness of Christianity, but rejected the same on the grounds of logical incoherence. This study affirms the view that the doctrine of the Incarnation occupies a place of crucial importance within world religion, but rejects the claim of incoherence. Professor Hick believed that God’s Spirit was at work in all religions, producing a common religious experience, or spiritual awakening to God. The soteriological dimension of this spiritual awakening, he suggests, finds expression as the worshipper turns away from self-centredness to the giving of themselves to God and others. At the level of epistemology he further argued that religious experience itself provided the rational basis for belief in God. The study supports the assertion by Professor Hick that religious experience itself ought to be trusted as a source of knowledge and this on the principle of credulity, which states that a person’s claim to perceive or experience something is prima facie justified, unless there are compelling reasons to the contrary. Hick’s argument has been extensively developed and defended by philosophers such as Alvin Plantinga and William Alston. This confirms the importance of Hick’s contribution to the philosophy of religion, and further establishes his reputation within the field as an original thinker. It is recognised in this thesis, however, that in affirming only the rationality of belief, but not the obligation to believe, Professor Hick’s epistemology is not fully consistent with a Christian theology of revelation. Christian theology views the created order as pre-interpreted and unambiguous in its testimony to God’s existence. To disbelieve in God’s existence is to violate one’s epistemic duty by suppressing the truth. Professor Hick’s critical realist principle, which he regards as the key to understanding what is happening in the different forms of religious experience, is examined within this thesis. According to the critical realist principle, there are realities external to us, yet we are never aware of them as they are in themselves, but only as they appear to us within our particular cognitive machinery and conceptual resources. All awareness of God is interpreted through the lens of pre-existing, culturally relative religious forms, which in turn explains the differing theologies within the world of religion. The critical realist principle views God as unknowable, in the sense that his inner nature is beyond the reach of human conceptual categories and linguistic systems. Professor Hick thus endorses and develops the view of God as ineffable, but employs the term transcategorial when speaking of God’s ineffability. The study takes the view that the notion of transcategoriality as developed by Professor Hick appears to deny any ontological status to God, effectively arguing him out of existence. Furthermore, in attributing the notion of transcategoriality to God, Professor Hick would appear to render incoherent his own fundamental assertion that we can know nothing of God that is either true or false. The claim that the experience of regeneration with which the Christian life begins can be classed as a mere species of the genus common throughout all faiths, is rejected within this thesis. Instead it is argued that Christian regeneration is a distinctive experience that cannot be reduced to a salvific experience, defined merely as an awareness of, or awakening to, God, followed by a turning away from self to others. Professor Hick argued against any notion that the Christian community was the social grouping through which God’s Spirit was working in an exclusively redemptive manner. He supported his view by drawing attention to (a) the presence, at times, of comparable or higher levels of morality in world religion, when contrasted with that evidenced by the followers of Christ, and (b) the presence, at times, of demonstrably lower levels of morality in the followers of Christ, when contrasted with the lives of other religious devotees. These observations are fully supported, but the conclusion reached is rejected, on the grounds that according to Christian theology the saving work of God’s Spirit is evidenced in a life that is changing from what it was before. Christian theology does not suggest or demand that such lives at every stage be demonstrably superior, when contrasted with other virtuous or morally upright members of society. The study concludes by paying tribute to the contribution Professor Hick has made to the field of the epistemology of religious experience.

Odpowiedzialność karną lekarza łączy się powszechnie z problematyką błędu medycznego, choć właściwie odpowiada on nie za sam błąd medyczny, jako że prawo karne nie zna przestępstwa polegającego na popełnieniu błędu medycznego, ale za ewentualne jego skutki, które mogą być kwalifikowane jako nieumyślne spowodowanie śmierci, nieumyślne spowodowanie ciężkiego, średniego albo lekkiego uszczerbku na zdrowiu bądź nieumyślne narażenie na niebezpieczeństwo utraty życia albo ciężkiego uszczerbku na zdrowiu. Nie można oczywiście wykluczyć wystąpienia sytuacji, w której lekarz swoim zachowaniem zrealizowałby znamiona typu umyślnego, jednakże na potrzeby niniejszej publikacji przyjęto, że co do zasady lekarz działa w celu ratowania dóbr prawnych, jakimi są życie i zdrowie pacjenta, nie zaś z zamiarem narażenia ich na niebezpieczeństwo bądź naruszenia, a ewentualne negatywne skutki dla życia i pacjenta, powstałe w miejsce lub obok zamierzonego stanu rzeczy, nie są przez niego objęte umyślnością. Kluczowym warunkiem uznania, że czyn popełniony został nieumyślnie jest ustalenie, że sprawca naruszył reguły ostrożnego postępowania, wymagane w danych okolicznościach. W odniesieniu do zawodu lekarza na pierwszy plan wysuwa się wśród nich wymóg stosowania się do wskazań aktualnej wiedzy medycznej. Autorka przekłada ten obowiązek na grunt realiów systemu ochrony zdrowia i rozważa, jaki wpływ na jego niedopełnienie mają okoliczności ograniczonej względami ekonomicznymi dostępności świadczeń zdrowotnych oraz w jaki sposób niedostatek środków finansowych może rzutować na naruszenie przez lekarza reguł ostrożnego postępowania, o których mowa w art. 9 § 2 Kodeksu karnego.

Przedmiotem artykułu jest problem ochrony prawa do prywatności w polskim procesie karnym w kontekście relacjonowania przebiegu rozprawy głównej przez media. Analizie zostały poddane zarówno warunki dopuszczalności relacjonowania rozprawy, przedmiot ingerencji, jak i podmioty, których prawo do prywatności może być naruszone w toku relacjonowania rozprawy głównej przez media. Prawo do prywatności jest współcześnie chronione nie tylko przez normy prawa cywilnego, ale również przez prawo konstytucyjne, stąd obowiązek przestrzegania i poszanowania prawa do prywatności ciąży także na organach prowadzących postępowanie karne. Jak wynika z zamieszonych w artykule rozważań, możliwe jest pogodzenie pozornie sprzecznych celów procesu karnego z koniecznością poszanowania prawa do prywatności, a sfera prywatna jednostek podlega ochronie również w procesie karnym. Wśród zagrożeń dla efektywnej ochrony prawa od prywatności należy jednak wskazać brak sankcji za złamanie zakazu publikacji danych osobowych czy wizerunku, którego nie przewidują ani normy prawa karnego ani prawa prasowego.

W artykule autorzy podejmują się dokonania analizy zagadnienia dotyczącego możliwości naruszenia umowy spółki lub statutu przez członków zarządu oraz wpływu takiego naruszenia na ważność podjętej czynności prawnej. Zagadnienie to wywołuje liczne problemy praktyczne, chociażby z uwagi na obowiązek każdorazowej weryfikacji przed zawarciem umowy listy czynności, na dokonanie których statut lub umowa spółki zastrzega sobie taki wymóg. Nie ma tu znaczenia dobra czy zła wiara kontrahenta, który ma świadomość o istnieniu takiego zapisu dla ważności danej czynności prawnej. Zgoła odmienna jest sytuacja członka zarządu, dla którego uzyskanie takiej zgody jest ważne, z uwagi na naruszenia umowy spółki albo statutu, a w konsekwencji jego odpowiedzialność odszkodowawczą do dochodzenia ewentualnego odszkodowania za szkodę wyrządzoną działaniem lub zaniechaniem. Pamiętać jednak należy, że do istnienia odpowiedzialności niezbędne jest wykazanie szkody. Jednakże biorąc pod uwagę uwarunkowania biznesowe niekiedy trudno uzyskać zgodę rady nadzorczej lub walnego zgromadzenia wspólników na taką zgodę. Powstaje wtedy pytanie, czy można ją uzyskać następczo. Autorzy w artykule dokonują analizy stawiając tezę, iż możliwe jest następcze wyrażenie zgody na dokonaną bez uprzedniej zgody czynność prawną. Dokonując wnioskowania a maiori ad minus można w ocenie autorów dopuścić potwierdzenie takiej czynności następczo i to nie tylko w wymaganym dwumiesięcznym terminie, ale nawet późniejszym, co może mieć wpływ na ich ewentualne wyłączenie odpowiedzialności z tytułu naruszenia postanowień umowy spółki (statutu). Całość rozważań ściśle oscyluje wokół praktycznych problemów pojawiających się funkcjonowaniu spółki.
