Under the Alien Tort Statute United States of America (“America”) Federal Courts have the jurisdiction to hear claims for civil wrongs, committed against non-American citizens, which were perpetrated outside America’s national borders. The operation of this law has confronted American Federal Courts with difficulties on how to manage conflicts between American executive foreign policy and judicial interpretations of international law. Courts began to pass judgment over conduct which was approved by foreign governments. Then in 2005 the American Supreme Court wound back the scope of the Alien Tort Statute. This article will review the problems with the expansion of the Alien Tort Statute and the reasons for its subsequent narrowing.

This study questions how the categories of security, education and literacy were brought together as related elements of a whole-of-government strategy in the production of civil society. Drawing on an analysis of key political texts, the study argues that the categories of education and literacy have been used in diverse ways in the production of national, social, economic and geopolitical security interests. As dialogue about security has intensified, rationalisations about the national interest have engaged notions of security leading to the legitimation of a diverse set of policy instruments, strategically used to contain the rise of complex social forces and protect homogenous cultural values.

This is pretty close.” David Fewer “While European and American IP maximalists have pushed for TRIPS-Plus provisions in FTAs and bilateral agreements, they are now pushing for TRIPS-Plus-Plus protections in these various forums.” Susan Sell “ACTA is a threat to the future of a free and open Internet.” Alexander Furnas “Implementing the agreement could open a Pandora's box of potential human rights violations.” Amnesty International. “I will not take part in this masquerade.” Kader Arif, Rapporteur for the Anti-Counterfeiting Trade Agreement 2011 in the European Parliament Executive Summary As an independent scholar and expert in intellectual property, I am of the view that the Australian Parliament should reject the adoption of the Anti-Counterfeiting Trade Agreement 2011. I would take issue with the Department of Foreign Affairs and Trade’s rather partisan account of the negotiations, the consultations, and the outcomes associated with the Anti-Counterfeiting Trade Agreement 2011. In my view, the negotiations were secretive and biased; the local consultations were sometimes farcical because of the lack of information about the draft texts of the agreement; and the final text of the Anti-Counterfeiting Trade Agreement 2011 is not in the best interests of Australia, particularly given that it is a net importer of copyright works and trade mark goods and services. I would also express grave reservations about the quality of the rather pitiful National Interest Analysis – and the lack of any regulatory impact statement – associated with the Anti-Counterfeiting Trade Agreement 2011. The assertion that the Anti-Counterfeiting Trade Agreement 2011 does not require legislative measures is questionable – especially given the United States Trade Representative has called the agreement ‘the highest-standard plurilateral agreement ever achieved concerning the enforcement of intellectual property rights.’ It is worthwhile reiterating that there has been much criticism of the secretive and partisan nature of the negotiations surrounding the Anti-Counterfeiting Trade Agreement 2011. Sean Flynn summarizes these concerns: "The negotiation process for ACTA has been a case study in establishing the conditions for effective industry capture of a lawmaking process. Instead of using the relatively transparent and inclusive multilateral processes, ACTA was launched through a closed and secretive “‘club approach’ in which like-minded jurisdictions define enforcement ‘membership’ rules and then invite other countries to join, presumably via other trade agreements.” The most influential developing countries, including Brazil, India, China and Russia, were excluded. Likewise, a series of manoeuvres ensured that public knowledge about the specifics of the agreement and opportunities for input into the process were severely limited. Negotiations were held with mere hours notice to the public as to when and where they would be convened, often in countries half away around the world from where public interest groups are housed. Once there, all negotiation processes were closed to the public. Draft texts were not released before or after most negotiating rounds, and meetings with stakeholders took place only behind closed doors and off the record. A public release of draft text, in April 2010, was followed by no public or on-the-record meetings with negotiators." Moreover, it is disturbing that the Anti-Counterfeiting Trade Agreement 2011 has been driven by ideology and faith, rather than by any evidence-based policy making Professor Duncan Matthews has raised significant questions about the quality of empirical evidence used to support the proposal of Anti-Counterfeiting Trade Agreement 2011: ‘There are concerns that statements about levels of counterfeiting and piracy are based either on customs seizures, with the actual quantities of infringing goods in free circulation in any particular market largely unknown, or on estimated losses derived from industry surveys.’ It is particularly disturbing that, in spite of past criticism, the Department of Foreign Affairs and Trade has supported the Anti-Counterfeiting Trade Agreement 2011, without engaging the Productivity Commission or the Treasury to do a proper economic analysis of the proposed treaty. Kader Arif, Rapporteur for the Anti-Counterfeiting Trade Agreement 2011 in the European Parliament, quit his position, and said of the process: "I want to denounce in the strongest possible manner the entire process that led to the signature of this agreement: no inclusion of civil society organisations, a lack of transparency from the start of the negotiations, repeated postponing of the signature of the text without an explanation being ever given, exclusion of the EU Parliament's demands that were expressed on several occasions in our assembly. As rapporteur of this text, I have faced never-before-seen manoeuvres from the right wing of this Parliament to impose a rushed calendar before public opinion could be alerted, thus depriving the Parliament of its right to expression and of the tools at its disposal to convey citizens' legitimate demands.” Everyone knows the ACTA agreement is problematic, whether it is its impact on civil liberties, the way it makes Internet access providers liable, its consequences on generic drugs manufacturing, or how little protection it gives to our geographical indications. This agreement might have major consequences on citizens' lives, and still, everything is being done to prevent the European Parliament from having its say in this matter. That is why today, as I release this report for which I was in charge, I want to send a strong signal and alert the public opinion about this unacceptable situation. I will not take part in this masquerade." There have been parallel concerns about the process and substance of the Anti-Counterfeiting Trade Agreement 2011 in the context of Australia. I have a number of concerns about the substance of the Anti-Counterfeiting Trade Agreement 2011. First, I am concerned that the Anti-Counterfeiting Trade Agreement 2011 fails to provide appropriate safeguards in respect of human rights, consumer protection, competition, and privacy laws. It is recommended that the new Joint Parliamentary Committee on Human Rights investigate this treaty. Second, I argue that there is a lack of balance to the copyright measures in the Anti-Counterfeiting Trade Agreement 2011 – the definition of piracy is overbroad; the suite of civil remedies, criminal offences, and border measures is excessive; and there is a lack of suitable protection for copyright exceptions, limitations, and remedies. Third, I discuss trade mark law, intermediary liability, and counterfeiting. I express my concerns, in this context, that the Anti-Counterfeiting Trade Agreement 2011 could have an adverse impact upon consumer interests, competition policy, and innovation in the digital economy. I also note, with concern, the lobbying by tobacco industries for the Anti-Counterfeiting Trade Agreement 2011 – and the lack of any recognition in the treaty for the capacity of countries to take measures of tobacco control under the World Health Organization Framework Convention on Tobacco Control. Fourth, I note that the Anti-Counterfeiting Trade Agreement 2011 provides no positive obligations to promote access to essential medicines. It is particularly lamentable that Australia and the United States of America have failed to implement the Doha Declaration on the TRIPS Agreement and Public Health 2001 and the WTO General Council Decision 2003. Fifth, I express concerns about the border measures in the Anti-Counterfeiting Trade Agreement 2011. Such measures lack balance – and unduly favour the interests of intellectual property owners over consumers, importers, and exporters. Moreover, such measures will be costly, as they involve shifting the burden of intellectual property enforcement to customs and border authorities. Interdicting, seizing, and destroying goods may also raise significant trade issues. Finally, I express concern that the Anti-Counterfeiting Trade Agreement 2011 undermines the role of existing international organisations, such as the United Nations, the World Intellectual Property Organization and the World Trade Organization, and subverts international initiatives such as the WIPO Development Agenda 2007. I also question the raison d'être, independence, transparency, and accountability of the proposed new ‘ACTA Committee’. In this context, I am concerned by the shift in the position of the Labor Party in its approach to international treaty-making in relation to intellectual property. The Australian Parliament adopted the Australia-United States Free Trade Agreement 2004, which included a large Chapter on intellectual property. The treaty was a ‘TRIPs-Plus’ agreement, because the obligations were much more extensive and prescriptive than those required under the multilateral framework established by the TRIPS Agreement 1994. During the debate over the Australia-United States Free Trade Agreement 2004, the Labor Party expressed the view that it would seek to mitigate the effects of the TRIPS-Plus Agreement, when at such time it gained power. Far from seeking to ameliorate the effects of the Australia-United States Free Trade Agreement 2004, the Labor Government would seek to lock Australia into a TRIPS-Double Plus Agreement – the Anti-Counterfeiting Trade Agreement 2011. There has not been a clear political explanation for this change in approach to international intellectual property. For both reasons of process and substance, I conclude that the Australian Parliament and the Australian Government should reject the Anti-Counterfeiting Trade Agreement 2011. The Australian Government would do better to endorse the Washington Declaration on Intellectual Property and the Public Interest 2011, and implement its outstanding obligations in respect of access to knowledge, access to essential medicines, and the WIPO Development Agenda 2007. The case study of the Anti-Counterfeiting Trade Agreement 2011 highlights the need for further reforms to the process by which Australia engages in international treaty-making.

Soon after the Bolshevik Revolution of 1917, a three-year civil war broke out in Russia. As in many other civil wars, foreign powers intervened in the conflict. Britain played a leading role in this intervention and had a significant effect on the course of the war. Without this intervention on the White side, the superiority of numbers in manpower and weaponry of the Bolsheviks would have quickly overwhelmed their opponents. The aim of this dissertation is to explain the nature and role of the British intervention on the southern, and most decisive, front of the Civil War. The political decision making in London is studied as a background, but the focus of the dissertation is on the actual implementation of the British policy in Russia. The British military mission arrived in South Russia in late 1918, and started to provide General Denikin s White army with ample supplies. General Denikin would have not been able to build his army of more than 200,000 men or to make his operation against Moscow without the British matériel. The British mission also organized the training and equipping of the Russian troops with British weapons. This made the material aid much more effective. Many of the British instructors took part in fighting the Bolsheviks despite the orders of their government. The study is based on primary sources produced by British departments of state and members of the British mission and military units in South Russia. Primary sources from the Whites, including the personal collections of several key figures of the White movement and official records of the Armed Forces of South Russia are also used to give a balanced picture of the course of events. It is possible to draw some general conclusions from the White movement and reasons for their defeat from the study of the British intervention. In purely material terms the British aid placed Denikin s army in a far more favourable position than the Bolsheviks in 1919, but other military defects in the White army were numerous. The White commanders were unimaginative, their military thinking was obsolete, and they were incapable of organizing the logistics of their army. There were also fundamental defects in the morale of the White troops. In addition to all political mistakes of Denikin s movement and a general inability to adjust to the complex situation in Revolutionary Russia, the Whites suffered a clear military defeat. In South Russia the Whites were defeated not because of the lack of British aid, but rather in spite of it.

Hard-line anti-communists in the United States recognised the potential for the Soviet invasion of Afghanistan in 1979 to embroil their super-power rival in a ‘Vietnam-like quagmire.’ Their covert operation to arm the mujahedeen is well documented. This dissertation argues that propaganda and public diplomacy were powerful and essential instruments of this campaign. It examines the protagonists of this strategy, their policies, initiatives and programmes offering a comprehensive analysis heretofore absent. It stretches from the dying days of the Carter administration when Zbigniew Brzezinski saw the ‘opportunity’ presented by the invasion to the Soviet’s withdrawal in 1989. The aim of these information strategies was to damage Soviet credibility and enhance that of the US, considered under threat from growing ‘moral equivalence’ amongst international publics. The conflict could help the US regain strategic advantage in South Asia undermined by the ‘loss’ of Iran. The Reagan administration used it to justify the projection of US military might that it believed was eviscerated under Carter and emasculated by the lingering legacy of Vietnam. The research engages with source material from the Reagan Presidential Library, the United States Information Agency archives and the Library of Congress as well as a number of online archives. The material is multi-archival and multi-media including documentaries, booklets, press conferences, summit programmes and news-clips as well as national security policy documents and contemporaneous media commentary. It concludes that propaganda and public diplomacy were integral to the Reagan administration and other mujahedeen supporters’ determination to challenge the USSR. It finds that the conflict was used to justify military rearmament, further strategic aims and reassert US power. These Cold War machinations had a considerable impact on the course of the conflict and undermined efforts at resolution and reconciliation with profound implications for the future stability of Afghanistan and the world.

In 1924 the Irish Free State government passed legislation to award pensions to veterans of the Irish revolution and Civil War. This article argues that the motivation for the pensions was the need to placate the national army after a failed mutiny in 1924 and that this explains their unusual nature in being based on service alone rather than disability. It will also explore the problems this created for defining service, examine the extension of eligibility to former republican enemies of the state and women revolutionaries in 1934, and describe the application and assessment procedure.

Cette thèse porte sur les conceptions d’Egon Bahr dans le domaine de la politique à l’Est (Ostpolitik) de la République fédérale d’Allemagne (RFA) entre 1945 et 1975. L’analyse se concentre sur le lien entre l’Ostpolitik et l’idée que Bahr se fait de la place et du rôle de l’Allemagne en Europe. Plus précisément, cette étude veut cerner les buts poursuivis par Bahr dans le cadre de la politique orientale. La première partie traite du développement conceptuel de l’Ostpolitik (1945-1969), tandis que la seconde examine sa mise en application entre l’élection de Willy Brandt comme chancelier de la RFA et la conclusion des accords d’Helsinki (1969-1975). Les principales sources utilisées sont les écrits de Bahr ainsi que des documents inédits se trouvant dans divers centres d’archives non seulement en Allemagne, mais aussi aux États-Unis, en France et en Grande-Bretagne. Pour Bahr, l’Ostpolitik ne saurait se résumer à l’élimination des obstacles qui gênent la diplomatie ouest-allemande durant la guerre froide. Bahr poursuit plutôt un projet nationaliste ambitieux dans le contexte des relations avec le bloc soviétique : créer les conditions d’une redéfinition de la place de l’Allemagne en Europe. Pour lui, l’Ostpolitik constitue un instrument idéal pour faire de l’Allemagne la puissance prépondérante dans un nouvel ordre de paix européen. Trois éléments complémentaires participent à l’accomplissement de cette vision : 1) la consolidation de la paix et de la sécurité continentales; 2) la réunification allemande et 3) l’émancipation de la politique étrangère (ouest-)allemande. Cette thèse éclaire la pensée politique de Bahr et contribue à une meilleure compréhension de la signification de l’Ostpolitik dans le contexte plus large de la politique étrangère de la RFA. Les conceptions de Bahr sont uniques dans l’Allemagne de la guerre froide parce qu’elles sont centrées sur les notions de puissance, d’intérêt national et de « normalité ». En même temps, Bahr comprend que la coopération doit toujours rester l’instrument diplomatique privilégié des Allemands vu leur position géographique centrale. À travers le prisme des conceptions de son « architecte », l’Ostpolitik apparaît comme un véritable effort de réconciliation entre la paix en Europe et l’affirmation de l’influence allemande sur la scène internationale.

Cette thèse porte sur le comportement des élites politiques durant les périodes de crise nationale et plus particulièrement sur leurs réactions aux attentats terroristes. Elle démontre que les crises terroristes sont tout comme les conflits militaires ou diplomatiques propices aux unions nationales et notamment aux ralliements des partis d’opposition auprès du gouvernement. L’analyse statistique d’actes terroristes s’étant produits dans cinq états démocratiques (Allemagne, Espagne, États-Unis d’Amérique, France et Royaume-Uni) entre 1990 et 2006 révèle que l’ampleur d’un attentat en termes de pertes humaines ainsi que la répétition de ces attentats influencent dans une large mesure la réaction des élites politiques. Ainsi plus l’ampleur d’un attentat est élevée, plus la probabilité d’un ralliement est grande. En revanche, la multiplication des attentats augmente la possibilité de dissension entre l’opposition et le gouvernement. Par ailleurs, l’opposition est plus susceptible de se rallier au gouvernement lorsque l’attentat est perpétré par des terroristes provenant de l’étranger. L’analyse quantitative indique également que l’existence d’un accord formel de coopération dans la lutte antiterroriste entre le gouvernement et l’opposition favorise l’union des élites. Enfin, les données analysées suggèrent que la proportion des ralliements dans les cinq pays est plus importante depuis les attentats du 11 septembre 2001. Une analyse qualitative portant exclusivement sur la France et couvrant la période 1980-2006 confirme la validité des variables identifiées dans la partie quantitative, mais suggère que les élites réagissent au nombre total de victimes (morts mais aussi blessés) et que la répétition des actes terroristes a moins d’impact lors des vagues d’attentats. Par ailleurs, les analyses de cas confirment que les élites politiques françaises sont plus susceptibles de se rallier quand un attentat vise un haut-fonctionnaire de l’État. Il apparaît également que les rivalités et rancœurs politiques propre à la France (notamment suite à l’arrivée de la gauche au pouvoir en 1981) ont parfois empêché le ralliement des élites. Enfin, cette analyse qualitative révèle que si l’extrême gauche française soutient généralement le gouvernement, qu’il soit de gauche ou de droite, en période de crise terroriste, l’extrême droite en revanche saisit quasi systématiquement l’opportunité offerte par l’acte terroriste pour critiquer le gouvernement ainsi que les partis de l’establishment. La thèse est divisée en sept chapitres. Le premier chapitre suggère que le comportement des élites politiques en période de crises internationales graves (guerres et conflits diplomatiques) est souvent influencé par la raison d’État et non par l’intérêt électoral qui prédomine lors des périodes plus paisibles. Le second chapitre discute du phénomène terroriste et de la littérature afférente. Le troisième chapitre analyse les causes du phénomène d’union nationale, soumet un cadre pour l’analyse de la réaction des élites aux actes terroristes, et présente une série d’hypothèses. Le quatrième chapitre détaille la méthodologie utilisée au cours de cette recherche. Les chapitres cinq et six présentent respectivement les résultats des analyses quantitatives et qualitatives. Enfin, le chapitre sept conclut cette thèse en résumant la contribution de l’auteur et en suggérant des pistes de recherche.

Ce mémoire part du constat que l’histoire et, a fortiori, la mémoire ont été largement sollicitées par le discours officiel français au moment et au lendemain de la réunification allemande. La fin définitive de l’après-guerre et le retour à la souveraineté diplomatique de l’Allemagne suscitent en France des questions qui inquiètent – en raison notamment du souvenir de l’histoire – et raniment la volonté d’encadrer la puissance allemande dans la communauté européenne. Pour comprendre le rôle que la mémoire a pu tenir dans la diplomatie française, l’étude tente d’analyser l’usage que les responsables français ont fait du passé en tant qu’instrument de la politique étrangère et le poids qu’il a représenté dans la vision française de l’unification allemande. Ce mémoire démontre que l’entendement du passé se conforme, sous toutes ses expressions, à la politique européenne de la France. Il atteste également que la France se saisit de ce moment charnière pour structurer un espace européen qui fait écho aux principes universalistes issus de la Révolution française, lesquels doivent être désormais portés par le binôme franco-allemand. L’invention de la tradition et l’usage métaphorique du passé répondent d’une préoccupation politique de réconciliation franco-allemande et accompagnent la mise en place d’un patriotisme historique sur lequel pourront s’établir les identités civique et juridique européennes. La mémoire officielle, qui est entièrement orientée vers la promotion et la justification de l’avenir communautaire, dénature certaines données historiques de manière à exorciser le présent d’un passé encombrant. Les limites de la mémoire officielle se trouvent donc dans cette représentation d’un passé aseptisé; un passé n’étant pas une finalité, mais un moyen déférant à l’intérêt national.

Se basa en algunas dimensiones de la democratización como son el Estado de Derecho, la democracia representativa, la preeminencia del poder civil, y el fortalecimiento de la cultura democrática. Así mismo, tiene en cuenta los elementos de la justicia transicional, a saber: verdad, justicia y reparación.
