Letters - Correspondence with John Diefenbaker, 1968

There is a telegram from John Diefenbaker congratulating Sean O'Sullivan on his recent election win as President of the Hamilton Young Progressive Conservatives. O'Sullivan was in Grade 11 at the time. The second correspondence is a reply from Sean O'Sullivan with appreciation to Diefenbaker for all his "encouragement and inspiration". The correspondence took place 19 March 1968 and 20 March 1968.

The letter begins by thanking J. Diefenbaker for a personal note and other mementos. O'Sullivan then begins to discuss Trudeau and his popularity, he remarks "If he calls an early election, he will sweep the Country. Truly he is a phenomenon, thanks to the press of Canada. However, the press are a fickle lot and could easily turn their marriage to him into a divorce under the new rules he had Parliament pass." He also discusses his opinion of how the provinces will vote in an upcoming election.

Evaporative respiratory cooling augments pit organ thermal detection in rattlesnakes

Rattlesnakes use their facial pit organs to sense external thermal fluctuations. A temperature decrease in the heat-sensing membrane of the pit organ has the potential to enhance heat flux between their endothermic prey and the thermal sensors, affect the optimal functioning of thermal sensors in the pit membrane and reduce the formation of thermal ‘‘afterimages’’, improving thermal detection. We examined the potential for respiratory cooling to improve strike behaviour, capture, and consumption of endothermic prey in the South American rattlesnake, as behavioural indicators of thermal detection. Snakes with a higher degree of rostral cooling were more accurate during the strike, attacking warmer regions of their prey, and relocated and consumed their prey faster. These findings reveal that by cooling their pit organs, rattlesnakes increase their ability to detect endothermic prey; disabling the pit organs caused these differences to disappear. Rattlesnakes also modify the degree of rostral cooling by altering their breathing pattern in response to biologically relevant stimuli, such as a mouse odour. Our findings reveal that low humidity increases their ability to detect endothermic prey, suggesting that habitat and ambush sites election in the wild may be influenced by external humidity levels as well as temperature.

Woodruff is also listed as an owner in St. Thomas' Ward (p.8). Richard Woodruff is listed as an owner in St. George's War (p.16). There is an extra front cover included which is badly wrinkled and stained. There is a handwritten list within the back of the book which tallies the number of people in each ward.

Directors Meeting November 28, 1896 and By-Law No. 14 & 15

The meeting included an election of officers which resulted as follows: John Reid, President; Geo Barnes, Vice President; Geo. Barnes, Man-Director; J. Evans, Secretary. There are also two more by-laws (14 and 15) signed by both G. Barnes and J. Evans.

A by-law "to fix the remuneration and expense allowances of directors". It reads "Be it enacted as a By-law of Barnes Wines Limited: 1. That each Director of the Company be paid the sum of Seventy-five ($75,00) Dollars annually in respect of general services rendered by the Director in his capacity as Director, such remuneration to accrue from the date of his election or appointment as a Director. 2. That each Director shall be paid and allowed travelling and other expenses properly incurred in connection with the affairs of the Company. 3. That this provision shall be and remain in force and effect in the fiscal years of the Company, 1971 to 1973 both inclusive. Enacted this 8th day of February, 1971."

Letter to H.H. Collier of Houston, Texas from J. M. Long and delivered by Captain Daniels. This is a friendly letter in which he mentions that General Edward Burleson has gone on an Indian campaign. Also mentioned are the Indian raid in Austin, the stealing of horses and candidates for the election. He also talks about a ball in Austin. This is actually quite a poetic letter in his description of how Austin used to be and what Austin has become (3 pages, handwritten), Aug. 26, 1842.

Candidate Stability and Nonbinary Social Choice

A desirable property of a voting procedure is that it be immune to the strategic withdrawal of a candidate for election. Dutta, Jackson, and Le Breton (Econometrica, 2001) have established a number of theorems that demonstrate that this condition is incompatible with some other desirable properties of voting procedures. This article shows that Grether and Plott's nonbinary generalization of Arrow's Theorem can be used to provide simple proofs of two of these impossibility theorems.

On the Manipulability of Proportional Representation

This paper presents a new model of voter behaviour under methods of proportional representation (PR). We abstract away from rounding, and assume that a party securing k percent of the vote wins exactly k percent of the available seats. Under this assumption PR is not manipulable by any voter aiming at maximisation of the number of seats in the parliament of her most preferred party. However in this paper we assume that voters are concerned, first and foremost, with the distribution of power in the post-election parliament. We show that, irrespective of which positional scoring rule is adopted, there will always exist circumstances where a voter would have an incentive to vote insincerely. We demonstrate that a voter’s attitude toward uncertainty can influence her incentives to make an insincere vote. Finally, we show that the introduction of a threshold - a rule that a party must secure at least a certain percentage of the vote in order to reach parliament - creates new opportunities for strategic voting. We use the model to explain voter behaviour at the most recent New Zealand general election.

Le nouvel article 14a-8(i)(8) du Securities Exchange Act de 1934 ou l’angoisse contemporaine de la démocratie actionnariale dans les entreprises nord-américaines

La Securities and Exchange Commission vient d’étendre la possibilité pour les sociétés américaines cotées de refuser d’inclure dans les sollicitations de procuration les propositions des actionnaires concernant l’élection des administrateurs. Alors que ce thème fait débat et que l’autorité américaine ne s’était que peu prononcée, celle-ci propose une rédaction nouvelle de l’article 14a-8(i)(8) applicable depuis le 10 janvier 2008. Cette prise de position de la Securities and Exchange Commission offre l’opportunité d’analyser l’état de la gouvernance des entreprises américaines en matière d’élection de la direction et de constater que le pouvoir des actionnaires, bien que restreint par cette modification règlementaire, est revigoré en parallèle par le développement du « majority vote system ». La confrontation de ces deux orientations fait apparaître leur complémentarité sous-jacente et le fait que les actionnaires sont, au final, loin d’être dépourvus de moyens efficaces pour mettre en œuvre un activisme. C’est autour des mutations profondes que subit le paysage juridique entourant le pouvoir des actionnaires au moment de l’élection du conseil d’administration que cet écrit est orienté.

Egon Bahr, l'Ostpolitik et la place de l'Allemagne dans un nouvel ordre européen, 1945-1975

Cette thèse porte sur les conceptions d’Egon Bahr dans le domaine de la politique à l’Est (Ostpolitik) de la République fédérale d’Allemagne (RFA) entre 1945 et 1975. L’analyse se concentre sur le lien entre l’Ostpolitik et l’idée que Bahr se fait de la place et du rôle de l’Allemagne en Europe. Plus précisément, cette étude veut cerner les buts poursuivis par Bahr dans le cadre de la politique orientale. La première partie traite du développement conceptuel de l’Ostpolitik (1945-1969), tandis que la seconde examine sa mise en application entre l’élection de Willy Brandt comme chancelier de la RFA et la conclusion des accords d’Helsinki (1969-1975). Les principales sources utilisées sont les écrits de Bahr ainsi que des documents inédits se trouvant dans divers centres d’archives non seulement en Allemagne, mais aussi aux États-Unis, en France et en Grande-Bretagne. Pour Bahr, l’Ostpolitik ne saurait se résumer à l’élimination des obstacles qui gênent la diplomatie ouest-allemande durant la guerre froide. Bahr poursuit plutôt un projet nationaliste ambitieux dans le contexte des relations avec le bloc soviétique : créer les conditions d’une redéfinition de la place de l’Allemagne en Europe. Pour lui, l’Ostpolitik constitue un instrument idéal pour faire de l’Allemagne la puissance prépondérante dans un nouvel ordre de paix européen. Trois éléments complémentaires participent à l’accomplissement de cette vision : 1) la consolidation de la paix et de la sécurité continentales; 2) la réunification allemande et 3) l’émancipation de la politique étrangère (ouest-)allemande. Cette thèse éclaire la pensée politique de Bahr et contribue à une meilleure compréhension de la signification de l’Ostpolitik dans le contexte plus large de la politique étrangère de la RFA. Les conceptions de Bahr sont uniques dans l’Allemagne de la guerre froide parce qu’elles sont centrées sur les notions de puissance, d’intérêt national et de « normalité ». En même temps, Bahr comprend que la coopération doit toujours rester l’instrument diplomatique privilégié des Allemands vu leur position géographique centrale. À travers le prisme des conceptions de son « architecte », l’Ostpolitik apparaît comme un véritable effort de réconciliation entre la paix en Europe et l’affirmation de l’influence allemande sur la scène internationale.

Nature et particularismes du contrat de progiciel

Le présent mémoire a pour ambition d'analyser la nature juridique et les particularismes du contrat de progiciel. Dans une première partie, nous examinerons les obligations mises à la charge des parties puis nous tenterons de qualifier le contrat de progiciel au regard du droit civil. Dans une seconde partie, nous examinerons la formation du contrat de progiciel dans un environnement traditionnel puis dans les environnements électroniques. Nous aborderons plus particulièrement deux nouveaux modes de formation des contrats, que sont les mécanismes du «shrink-wrap» et du «click-wrap». Nous analyserons ensuite les clauses limitatives ou exonératoire de garantie et de responsabilité, la clause d'élection de for et les clauses relatives à la propriété intellectuelle.
