La distinción entre argumentación y explicación es una tarea complicada pero necesaria por diversas razones. Una de ellas es la necesidad de incorporar la explicación en un movimiento del diálogo como resultado de una obligación dialéctica. Se propusieron distintos sistemas de diálogo que exploran la distinción enfatizando aspectos pragmáticos. En el presente trabajo me ocupo de aspectos estructurales de la explicación analizados en el marco de la lógica por defecto que permite caracterizar ciertas objeciones en el diálogo. Asimismo, considero que la versión operacional de la lógica por defecto constituye una aproximaciónadecuada en la construcción de la explicación y en la representación de la instancia de diálogo en el intercambio dialéctico

El presente trabajo propone problematizar las interpretaciones jurídicas en torno a la instancia privada así como a las posibilidades de actuación de la fiscalía una vez instada la acción en los delitos contra la honestidad. En este sentido, se busca mostrar cómo más allá del carácter "mixto" (combinación de instancia privada y acción pública) establecida por los códigos y sostenida por la doctrina, la cuestión se encontró controvertida en la práctica forense. Esta situación además, permite volver a debatir sobre los valores que entraron en juego a la hora de lidiar con estos crímenes, así como la pregunta sobre quién o quienes debían ser considerados víctimas de ellos así como explorar brevemente algunas relaciones entre derecho y género/sexualidad

This dissertation examines the origins of filial responsibility laws in Canada and the United States, laws which prescribe that adult children have an obligation of support which is owed to their parents. Filial responsibility laws enable an indigent parent, or an institution providing medical treatment and care to an indigent parent, to seek financial support from that parent’s adult children through the use of litigation. While those who favour these rarely-used laws claim that they bring many benefits to both the family and the state, there is little evidence to suggest that such benefits are actualized. The development and use of the laws in Canada and the United States make it clear that the limitation of the expenditure of government funds was the primary motive for these laws and the support of families a distant secondary motive.

Two types of health reforms in Latin America are analysed: one based on insurance and service commodification and the one referred to the unified public systems of progressive governments. Health insurance with explicit service packages has not fulfilled their purposes of universal coverage, equal access to necessary health services and improvement of health conditions but has opened health as a field of profit making for insurance companies and private health providers. The national health services as a state obligation have developed territorialized health services and widened substantially timely access to the majority of the population. The adoption of an integrated and wide social policy has an impact on population well fare. It faces some problems derived from the old health systems and the power of the insurance and medical complex.

International migration sets in motion a range of significant transnational processes that connect countries and people. How migration interacts with development and how policies might promote and enhance such interactions have, since the turn of the millennium, gained attention on the international agenda. The recognition that transnational practices connect migrants and their families across sending and receiving societies forms part of this debate. The ways in which policy debate employs and understands transnational family ties nevertheless remain underexplored. This article sets out to discern the understandings of the family in two (often intermingled) debates concerned with transnational interactions: The largely state and policydriven discourse on the potential benefits of migration on economic development, and the largely academic transnational family literature focusing on issues of care and the micro-politics of gender and generation. Emphasizing the relation between diverse migration-development dynamics and specific family positions, we ask whether an analytical point of departure in respective transnational motherhood, fatherhood or childhood is linked to emphasizing certain outcomes. We conclude by sketching important strands of inclusions and exclusions of family matters in policy discourse and suggest ways to better integrate a transnational family perspective in global migration-development policy.

El objetivo de este trabajo es explicar la conexión entre reglas discursivas y normas morales en el marco de la ética del discurso. El trabajo comienza con un análisis de la diferencia entre acción y operación y con una reconstrucción del concepto de discurso. Luego es presentada la diferencia y la relación entre ley y obligación. La conclusión es que la conexión entre acción y discurso posible está implícita en la noción de responsabilidad moral.

Case in which the Court of Common Pleas decided that the Crown did not have the authority to grant exclusive prerogative rights over the printing of almanacs, a monopoly which the Stationers' Company had enjoyed, uncontested, since the formation of the ‘English Stock' in the early seventeenth century.
The commentary describes the background to the litigation, as well as the various strategies that the Stationers' Company employed in their efforts to regain control of the almanac market in the wake of the decision. It also explores how the decision provided the springboard for the emergence of a more contemporary concept of prerogative copyright. It was no longer thought that the Crown could grant printing patents over certain classes of work as of right. Rather, it was the monarch's unique constitutional position as head of both church and state that imposed an obligation to ensure the dissemination of authentic and authoritative versions of both legal and religious materials, and, from this obligation, the right to print the same arose.

The ordinary principles of the law of negligence are applicable in the context of sport, including claims brought against volunteer and professional coaches. Adopting the perspective of the coach, this article intends to raise awareness of the emerging intersection between the law of negligence and sports coaching, by utilising an interdisciplinary analysis designed to better safeguard and reassure coaches mindful of legal liability. Detailed scrutiny of two cases concerning alleged negligent coaching, with complementary discussion of some of the ethical dilemmas facing modern coaches, reinforces the legal duty and obligation of all coaches to adopt objectively reasonable and justifiable coaching practices when interacting with athletes. Problematically, since research suggests that some coaching practice may be underpinned by “entrenched legitimacy” and “uncritical inertia”, it is argued that coach education and training should place a greater emphasis on developing a coach’s awareness and understanding of the evolving legal context in which they discharge the duty of care incumbent upon them.

Introduction
The intersection between the law of negligence and sport coaching in the UK is a developing area (Partington, 2014; Kevan, 2005). Crucially, since the law of negligence may be regarded as generally similar everywhere (Magnus, 2006), with the predominance of volunteer coaches in the UK reflective of the majority of countries in the world (Duffy et al., 2011), a detailed scrutiny of this relationship from the perspective of the coach uncovers important implications for coach education beyond this jurisdiction.  
Argumentation
Fulfilment of the legal duty of discharging reasonable care may be regarded as consistent with the ethical obligation not to expose athletes to unreasonable risks of injury (Mitten, 2013). More specifically, any ‘profession’ requiring ‘special skill or competence’ (Bolam v Friern Hospital Management Committee [1957] 1 WLR 582), including the coaching of sport (e.g., Davenport v Farrow [2010] EWHC 550), requires a higher standard of care to be displayed than would be expected of the ordinary reasonable person (Lunney & Oliphant, 2013; Jones & Dugdale, 2010). For instance, volunteer coaches with no formal qualifications (e.g., Fowles v Bedfordshire County Council [1996] ELR 51) would be judged by this benchmark of professional liability (Powell & Stewart, 2012). Further, as the principles of coaching are constantly assessed and revised (Cassidy et al., 2009; Taylor & Garratt, 2010), so too is the legal standard of care required of coaches (Powell & Stewart, 2012). Problematically, ethical concerns may include coaches being unwilling to increase knowledge, abusive treatment of players and incompetence/inexperience (Haney et al., 1998). These factors accentuate coaches’ exposure to civil liability.
Implications
It is imperative that coaches have an awareness of this emerging intersection and develop a ‘proactive risk assessment lens’ (Hartley, 2010). In addition to supporting the professionalisation of sport coaching, coach education/CPD focused on the legal and ethical aspects of coaching (Duffy et al., 2011; Telfer, 2010; Haney et al., 1998) would enhance the safety and welfare of performers, safeguard coaches from litigation risk, and potentially improve all levels of coaching (Partington, 2014). Interestingly, there is evidence to suggest a demand from coaches for more training on health and safety issues, including risk management and (ir)responsible coaching (Stirling et al., 2012). Accordingly, critical examination of the issue of negligent coaching would inform coach education by: enabling the modelling and sharing of best practice; unpacking important ethical concerns; and, further informing the classification of coaching as a ‘profession’.

In August, 1994, the Office of Local Systems, Project Development Division, Iowa Department of Transportation established a Quality Improvement Team to review and improve upon the federal-aid project development process. The mission was to communicate federal-aid project development procedures to local agencies, beginning with the approval of the Statewide Transportation Improvement Program (STIP) and ending with obligation of federal funds by the Federal Highway Administration (FHWA). In January 1997, another Team (Make it Better) began meeting to clarify, update, and streamline the federal-aid project process. This Project Development Packet is a compilation of these efforts. The packet includes Project Development timelines, flow charts, guidelines, design criteria, Instructional Memorandums and forms to assist in the federal-aid project development process. The main (fold out) flow chart directs to other sections of the packet when appropriate.

According to the Declaration of Helsinki, as well as the Statement on Public Disclosure of Clinical Trial Results of the World Health Organization, every researcher has the ethical obligation to publish research results on all trials with human participants in a complete and accurate way within 12 months after the end of the trial.1,2 Nevertheless, for several reasons, not all research results are published in an accurate way in case they are released at all. This phenomenon of publication bias may not only create a false impression on the reliability of clinical research business, but it may also affect the evidence of clinical conclusions about the best treatments, which are mostly based on published data and results.

Purpose – The purpose of this thesis is to investigate how mandatory obligation to follow the International <IR> Framework while producing the corporate reports influence the intellectual capital disclosures in the reports. Research design – The study uses a disclosure scoreboard to score a selected sample of annual reports depending on whether it disclose intellectual capital information or not. The sample consists of companies listed in South Africa were it is mandatory to follow the integrated reporting framework and companies listen in Sweden where it is not mandatory to produce an integrated report. Empirical results and conclusion – The results of this thesis indicates that the mandatory use of the International <IR> Framework have an impact on the amount of intellectual capital disclosures. Further it concludes that higher level of compliance with the framework further increases the intellectual capital disclosure. Contribution – This study has been an early step towards concluding whether the use of integrated reporting has any effect on the amount of intellectual capital information disclosed in companies’ annual report.

Comme les résultats obtenus relativement à la relation entre l'utilisation de la capitalisation et le niveau d'endettement de l'entreprise sont difficiles à généraliser, ils ne permettent pas de conclure à l'existence d'une telle relation. Or, il a été démontré dans la littérature comptable, qu'en absence de normalisation, les entreprises endettées favorisent la méthode de capitalisation. Cela suggère donc que les critères énoncés par l'ICCA limitent le recours à la capitalisation. Les résultats obtenus relativement à la proportion des frais de développement capitalisés suggèrent qu'aucune relation n'existe entre la proportion capitalisée et le niveau d'endettement de l'entreprise. Cela suggère que les critères énoncés limitent le montant des frais de développement capitalisés. Par ailleurs, une association négative a été observée entre le recours à l'imputation et la taille des entreprises. Ce résultat est surprenant car les grandes entreprises sont vraisemblablement fructueuses et ont de bonnes chances de satisfaire les critères énoncés par l'ICCA. Cela suggère que les grandes entreprises se soustraient à l'obligation de capitaliser leurs frais de développement et que cela est vraisemblablement toléré par l'ICCA.

De plus en plus, la capacité de justifier les investissements devient une obligation qui incombe aux gestionnaires responsables de la formation. Dans le domaine de l'informatique utilisateur, cette responsabilité revêt une grande importance puisque les sommes investies en formation sont considérables. La présente étude répond donc aux besoins de ces gestionnaires par le développement d'outils leur permettant d'évaluer l'impact de la formation sur le personnel. De nombreuses informations de gestion leur sont ainsi transmises afin de faciliter la prise de décision à un niveau organisationnel. Dans un premier temps, notre outil d'évaluation des apprentissages leur permet de mesurer les connaissances et habiletés des apprenants au terme de la formation. Par la suite, notre outil d'évaluation et de suivi du transfert des apprentissages leur permet à la fois de mesurer et de qualifier l'utilisation de ces connaissances et habilités dans le contexte de travail. De plus, il leur permet d'identifier les principales raisons qui viennent expliquer ce transfert. Finalement, il est à noter que les outils présentés dans cet ouvrage ont été développés à l'aide de l'approche par compétences et s'adressent spécifiquement à une formation portant sur l'utilisation d'un logiciel de traitement de texte par des secrétaires. Toutefois, ces outils peuvent être adaptés à tout autre type de formation.
