Court delays are consistently criticised as being inimical to social welfare. However, the theoretical basis for this assertion is not well established in the law and economics literature. As a first step, very little is known about the impact of court delay on the defendant's optimal plea decision. If the defendant is rational in the sense of inter temporally optimising, court delay may increase or decrease the probability of a trial depending on the defendant's bail status. Some empirical support for this theoretical proposition is found using data on plea behaviour for a selection of cases heard in NSW Australia.

The aim of this study was to determine whether the behavioral characteristics demonstrated by rapists clustered together into groups that were similar to the common rapist typology in the literature: anger, power exploitative, power reassurance, and sadistic. Two studies were conducted to examine the evidence for this typology. Study 1 involved the analysis of data from 130 men charged with sexual assault and Study 2 involved the analysis of court transcripts from 50 rape cases tried through the court system. The results of Study 1 revealed that there was some validity to the characteristics usually associated with each of the four types of rape, especially for the power reassurance and sadistic rapists. However, there were some unexpected outliers within both the anger and power exploitative types of rapists, which may suggest that there is more than one type of anger rapist and more than two types of power rapists. The results of Study 2 very closely replicated the results of Study 1. Future research needs to focus on the behavioral, motivational, and cognitive characteristics associated with each of the types of rapists and research them separately, so that it is possible to further evaluate the evidence for the typology identified in this study.

Criminal courts fundamentally provide a forum for conducting prosecutions with a guilty plea or a trial. At present, there is no generally accepted  methodology for estimating the monetary value of those services. The  purpose of this paper is to attempt to fill this gap by proposing a  methodology predicated on the joint optimising decisions of society and the defendant, who are the two stakeholders in any criminal case. The technique can also be potentially used to evaluate both theoretically and empirically the impact of court delay reduction programs on social welfare, and the specification of socially optimal court waiting times.

Aims: This paper critiques the deliberative processes used by the discipline panels of an Australian statutory nurse regulating authority when appraising the alleged unprofessional conduct of nurses and determining appropriate remedies.

Background: Little is known about the nature and effectiveness of the deliberative processes used by nurse regulating authorities (NRAs) disciplinary panels established to appraise and make determinations in response to allegations of unprofessional conduct by nurses.

Methods: A qualitative exploratory descriptive/pragmatic research approach was used. Data were obtained from two case-orientated sampling units: (1) 84 Reasons for Determination made between 1994 and 2000 and (2) a purposeful sample of 12 former and current nurse regulating authority members, nurse regulating authority staff and a nurse regulating authority representative who had experience of disciplinary proceedings and/or who had served on a formal hearing panel. Data were analysed using content and thematic analysis strategies.

Results: Attitudinal considerations (e.g. whether a nurse understood the 'wrongness' of his or her conduct; accepted responsibility for his or her conduct; exhibited contrition/shame during the hearing; was candid in his or her demeanour) emerged as the singularly most significant factor influencing discipline panel determinations. Disciplinary action is taken appropriately against nurses who have committed acts of deliberate malfeasance. NRAs may not, however, be dealing appropriately with nurses when disciplining them for making honest mistakes/genuine practice errors.

Conclusion: Traditional processes used for appraising and disciplining nurses who have made honest mistakes in the course of their work need to be substantially modified as they are at odds with the models of human error management that are currently being advocated and adopted globally to improve patient safety and quality of care in health care domains.

In advanced capitalist societies, intellectual property laws protecting such subject matter as copyright and patents are justified by a combination of theories, which include the provision of economic incentives to foster creativity and innovation and the prevention of unfair competition. IP academics and policy makers have differing views about the appropriate balance between these objectives and public interest considerations such as health, education and the protection of the environment. These different views entered the policy debate in Asian developing countries in connection with an unprecedented introduction and expansion of IP laws over the last 25 years. This paper will use case studies of law reform from Asia, in particular Southeast Asia, to show that the policy considerations of governments in reforming their laws were often quite different from the standard rationale mentioned above. As much of the IP was, at least initially, held by foreigners and introduced to attract foreign investment, national development considerations were joined with the more commonly quoted objectives to promote the rights, creativity and innovation of individuals. Such national development objectives at times coincided and at other times collided with official explanations and received wisdom about the effects of stronger IP rights.

Especially in the early postcolonial period, copyright laws and other IP laws were frequently restricted or simply not implemented, if they conflicted with development policies in areas such as education or public health. Such policies were slowly changing in the wake of WTO-TRIPS and other international agreements. Nevertheless, the implementation and enforcement of the IP laws has been uneven. Specialised institutions such as courts and IP administering agencies compete with other branches of government and administration for limited funding and a rich repertoire of informal dispute settlement procedures has kept the number of court cases relatively low. In some countries, censorship laws have influenced freedom of expression and led to quite idiosyncratic interpretations of intellectual property laws. Governments often also retain a role in the assessment of licensing and technology transfer contracts. And while there are many programs to foster individual creativity, in most cases R & D activities are still largely taking place in government institutions and this has influenced the thinking about intellectual property rights and creativity in the context of employment.

The paper uses a few case studies to examine the implementation of IP laws in selected Asian developing countries to point to the quite different institutional setting for IP law reform in comparison to European or American models. It reaches some tentative conclusions as to the likely effects on creativity and innovation under these different circumstances.

Purpose – The purpose of this paper is to identify and evaluate treatment for adult fire setters with an intellectual disability, given the specific risks they present, the complexities of criminal proceedings associated with their behaviour, and subsequent rehabilitation. However, the review also took into account programmes for fire setters in the wider population, including those for children and adolescents, given that such research might also inform the development of programmes for offenders with an intellectual disability.

Design/methodology/approach – A systematic review of the literature was undertaken.

Findings – Only four studies which evaluated treatment programmes specifically for arsonists with an intellectual disability were identified. Although each of these studies reported a reduction in fire-setting behaviour following programme completion, all employed relatively weak research designs. An additional 12 studies investigating programmes for arsonists without intellectual disability were also identified. It is concluded that there is a lack of evidence regarding treatment programme outcomes for arsonists with an intellectual disability. The extent to which such programmes can be adapted to suit adult offenders with an intellectual disability is discussed, with recommendations made for the design and evaluation of arson treatment programmes for offenders with intellectual disabilities.

Originality/value – Currently, minimal treatments programs exist for fire setting in offenders with intellectual disability. This review highlights the importance of further research into treatment programs for this specialised population.

Este texto analisa a arbitragem e suas relações com a jurisdição a partir do conceito de custo de transação. Seu objetivo é mostrar como a arbitragem é capaz de reduzir os custos de transação de um determinado ambiente normativo e contribuir para aperfeiçoar as instituições. Os custos relacionados ao uso da arbitragem e da jurisdição funcionam como um preço: quanto maior o custo, menor a procura por eles (e viceversa). potencialmente, a arbitragem pode permitir a redução dos custos de transação em razão (a) da relativa agilidade com que é concluída, (b) da relativa imparcialidade do árbitro e (c) da especialização dos árbitros. Além disso, a utilização da arbitragem pode criar melhores incentivos para o adimplemento das obrigações contratuais. Isso porque a inclusão da cláusula arbitral em um contrato dá às partes a possibilidade de regular o ambiente normativo a que se submeterão em caso de disputas. a falta de clareza sobre a legalidade dos procedimentos arbitrais aumenta os custos de transação impostos pelo ambiente normativo. Quanto maior o grau de incerteza, tanto maiores serão os incentivos para que os indivíduos alterem seus padrões negociais ou simplesmente reduzam sua participação em atividades econômicas, reduzindo-se, conseqüentemente, o potencial de geração de riqueza para a sociedade.

Este trabalho acadêmico é fruto da observação profissional cotidiana acerca da relação do Estado e de suas entidades de Direito Público com o particular. De modo algum propende a deslustrar teorias, opiniões e suporte jurídico favoráveis ao modelo diferenciado e casuisticamente pró-estatal vigente. Assim, na linha do eixo acadêmico-científico deste Mestrado, de caráter marcadamente profissional, buscou-se no campo do pluralismo de idéias descrever, num diapasão dialético, o contexto factual e jurídico-legal consoante os dois primeiros capítulos, para assim ensejar discussão e reflexão sobre matéria que se oferece relevante para a efetiva melhoria dos serviços jurisdicionais, submetendo-os, a seguir, a diretivas teóricas e, em particular, à compreensão contextual de nossa ordem constitucional. Partiu-se assim, de situações concretas vivenciadas no ambiente forense de uma unidade da Justiça Federal (2ª Vara da Justiça Federal de Petrópolis, da Seção Judiciária do Estado do Rio de Janeiro), sabidamente competente para as causas em que a União, entidades autárquicas ou empresa pública federal forem interessadas na condição de autoras, rés, assistentes ou opoentes1. O tema central do estudo são as prerrogativas processuais da Fazenda Pública. Vem de longe um conjunto de protetivo processual em seu favor. Para ficarmos no século XX, por exemplo, o art. 32 do Decreto-Lei nº 1.608, de 18 de setembro de 1939 (Código de Processo Civil) já explicitava: “Art. 32. Aos representantes da Fazenda Pública contar-se-ão em quádruplo os prazos para a contestação e em dobro para a interposição de recurso.” O Código de Processo Civil atual conforme destacado na parte descritiva do texto, cuidou de aperfeiçoar e ampliar esse suporte pró-fazendário, como exemplo, o dispositivo mais conhecido é, seguramente, o art. 188 do Código de Processo Civil. No entanto, a multiplicidade de avanços no seio da sociedade brasileira – basicamente nos planos político, constitucional, legal, social, econômico, cultural, global e tecnológico – trouxe como corolário o imperativo da otimização dos mecanismos voltados para o que denominamos no trabalho de acesso qualificado à Justiça. Esse conjunto de fatores, em realidade, acha-se forrado pelos princípios da igualdade e da isonomia que permeiam todo o arcabouço de conquistas asseguradas no corpo político-jurídico constitucional. Nas palavras do professor e atual Ministro do Supremo Tribunal Federal Luiz Fux2, a neutralidade, sobretudo do juiz, constitui fator impediente para o magistrado manter a igualdade das partes na relação jurídica processual. Claro, frise-se, tanto quanto possível, isto é, observando a lei que, ao eventualmente promover, pontualmente, certo grau distintivo, o faça comprometida com a efetiva correção de discrímen para assim encontrar e assegurar a igualdade. Deve fazêlo, na linha desse pensamento, de modo a impedir que o resultado da aplicação da norma não seja expressão da deficiência e do desmerecimento de uma das partes em juízo. Tudo considerado importa que o entendimento ora realçado não se destine apenas ao juiz, mas no caso, também ao legislador, fonte criadora da normatividade posta em evidência.

Esta monografia analisa as características do Termo de Ajustamento de Conduta, bem como demonstra os motivos pelos quais se apresenta como uma solução para a efetividade do princípio do acesso à justiça. Para demonstrar que o TAC é de fato uma alternativa à via judicial, foram obtidos dados nos sites do Tribunal de Justiça do Rio de Janeiro e do Conselho Nacional de Justiça que comprovaram a crise do sistema judiciário. Em seguida, foram expostas algumas características do ajustamento de conduta bem como sua evolução ao longo dos anos. A princípio, tais peculiaridades corroboram ainda mais a ideia de “substitutividade” ao procedimento judicial, uma vez que o instituto além de ser mais célere, não impõe as formalidades exigidas pelo poder judiciário. Por fim, foram apresentados dois termos de ajustamento de conduta, sendo primeiro firmado pelo Ministério Público Federal em conjunto com o Ministério Público Estadual, e o segundo pelo Ministério Público do Trabalho. A conclusão deste estudo é a de que TAC tem todo o potencial para tornar-se uma alternativa à solução de litígios, contudo, ainda precisa de certas adaptações para que seja plenamente eficaz.

This article examines the arising cross-border dispute resolution models (Cooperation and Competition among national Courts) from a critical perspective. Although they have been conceived to surpass the ordinary solution of a Modern paradigm (exclusive jurisdiction, choice of court, lis pendens, forum non conveniens, among others), they are insufficient to deal with problems raised with present globalization, as they do not abandon aspects of that paradigm, namely, (i) statebased Law; and (ii) standardization of cultural issues.

We use singularity theory to classify forced symmetry-breaking bifurcation problems f(z, λ, μ) = f1 (z, λ) + μf2(z, λ, μ) = 0, where f1 is double-struck O sign (2)-equivariant and f2 is double-struck D sign n-equivariant with the orthogonal group actions on z ∈ ℝ2. Forced symmetry breaking occurs when the symmetry of the equation changes when parameters are varied. We explicitly apply our results to the branching of subharmonic solutions in a model periodic perturbation of an autonomous equation and sketch further applications.
