INEX investigates focused retrieval from structured documents by providing large test collections of structured documents, uniform evaluation measures, and a forum for organizations to compare their results. This paper reports on the INEX 2014 evaluation campaign, which consisted of three tracks: The Interactive Social Book Search Track investigated user information seeking behavior when interacting with various sources of information, for realistic task scenarios, and how the user interface impacts search and the search experience. The Social Book Search Track investigated the relative value of authoritative metadata and user-generated content for search and recommendation using a test collection with data from Amazon and LibraryThing, including user profiles and personal catalogues. The Tweet Contextualization Track investigated tweet contextualization, helping a user to understand a tweet by providing him with a short background summary generated from relevant Wikipedia passages aggregated into a coherent summary. INEX 2014 was an exciting year for INEX in which we for the third time ran our workshop as part of the CLEF labs. This paper gives an overview of all the INEX 2014 tracks, their aims and task, the built test-collections, the participants, and gives an initial analysis of the results.

In an exploration of intellectual property and fashion, this article examines the question of the intermediary liability of online auction-houses for counterfeiting. In the United States, the illustrious jewellery store, Tiffany & Co, brought a legal action against eBay Inc, alleging direct trademark infringement, contributory trademark infringement, false advertising, unfair competition and trademark dilution. The luxury store depicted the online auction-house as a pirate bazaar, a flea-market and a haven for counterfeiting. During epic litigation, eBay Inc successfully defended itself against these allegations in a United States District Court and the United States Court of Appeals for the Second Circuit. Tiffany & Co made a desperate, unsuccessful effort to appeal the matter to the Supreme Court of the United States. The matter featured a number of interventions from amicus curiae — Tiffany was supported by Coty, the Fashion Designer's Guild, and the International Anticounterfeiting Coalition, while eBay was defended by publicly-spirited civil society groups such as Electronic Frontier Foundation, Public Citizen, and Public Knowledge as well as Yahoo!, Google Inc, Amazon.com, and associations representing telecommunications carriers and internet service providers. The litigation in the United States can be counterpointed with the fusillade of legal action against eBay in the European Union. In contrast to Tiffany & Co, Louis Vuitton triumphed over eBay in the French courts — claiming its victory as vindication of the need to protect the commercial interests and cultural heritage of France. However, eBay has fared somewhat better in a dispute with L’Oréal in Great Britain and the European Court of Justice. It is argued that, in a time of flux and uncertainty, Australia should follow the position of the United States courts in Tiffany & Co v eBay Inc. The final part examines the ramifications of this litigation over online auction-houses for trade mark law reform and consumer rights; parallel disputes over intermediary liability and safe harbours in the field of copyright law and the Anti-Counterfeiting Trade Agreement 2010. The conclusion calls for a revision of trade mark law, animated by a respect for consumers’ rights and interests in the electronic marketplace.

In his 1987 book, The Media Lab: Inventing the Future at MIT, Stewart Brand provides an insight into the visions of the future of the media in the 1970s and 1980s. 1 He notes that Nicolas Negroponte made a compelling case for the foundation of a media laboratory at MIT with diagrams detailing the convergence of three sectors of the media—the broadcast and motion picture industry; the print and publishing industry; and the computer industry. Stewart Brand commented: ‘If Negroponte was right and communications technologies really are converging, you would look for signs that technological homogenisation was dissolving old boundaries out of existence, and you would expect an explosion of new media where those boundaries used to be’. Two decades later, technology developers, media analysts and lawyers have become excited about the latest phase of media convergence. In 2006, the faddish Time Magazine heralded the arrival of various Web 2.0 social networking services: You can learn more about how Americans live just by looking at the backgrounds of YouTube videos—those rumpled bedrooms and toy‐strewn basement rec rooms—than you could from 1,000 hours of network television. And we didn’t just watch, we also worked. Like crazy. We made Facebook profiles and Second Life avatars and reviewed books at Amazon and recorded podcasts. We blogged about our candidates losing and wrote songs about getting dumped. We camcordered bombing runs and built open‐source software. America loves its solitary geniuses—its Einsteins, its Edisons, its Jobses—but those lonely dreamers may have to learn to play with others. Car companies are running open design contests. Reuters is carrying blog postings alongside its regular news feed. Microsoft is working overtime to fend off user‐created Linux. We’re looking at an explosion of productivity and innovation, and it’s just getting started, as millions of minds that would otherwise have drowned in obscurity get backhauled into the global intellectual economy. The magazine announced that Time’s Person of the Year was ‘You’, the everyman and everywoman consumer ‘for seizing the reins of the global media, for founding and framing the new digital democracy, for working for nothing and beating the pros at their own game’. This review essay considers three recent books, which have explored the legal dimensions of new media. In contrast to the unbridled exuberance of Time Magazine, this series of legal works displays an anxious trepidation about the legal ramifications associated with the rise of social networking services. In his tour de force, The Future of Reputation: Gossip, Rumor, and Privacy on the Internet, Daniel Solove considers the implications of social networking services, such as Facebook and YouTube, for the legal protection of reputation under privacy law and defamation law. Andrew Kenyon’s edited collection, TV Futures: Digital Television Policy in Australia, explores the intersection between media law and copyright law in the regulation of digital television and Internet videos. In The Future of the Internet and How to Stop It, Jonathan Zittrain explores the impact of ‘generative’ technologies and ‘tethered applications’—considering everything from the Apple Mac and the iPhone to the One Laptop per Child programme.

En route from Birmingham to Syria in 2013, British-Jihadi neophytes aged 22, Yusuf Sarwar and Mohammed Ahmed purchased two books via Amazon to prepare for their mission in Syria after joining ISIS: The Koran for Dummies and Islam for Dummies. Journalists were swift to disparage their reading. The book’s author, Princeton University campus imam, Sohaib Nazeer Sultan remarked “Even though they may have ordered it, I don't think they read it.” In 1933, aged 27, Adolf Eichmann moved to Berlin to join the Sicherheitsdienst SD whereupon he read Immanuel Kant’s book the Kritik der praktischen Vernunft (The Critique of Practical Reason) for the first time. After his trial in Jerusalem, Hannah Arendt of course dismissed Eichmann’s reading of the German philosopher as thoroughly vacuous. Ever since, writers have sought to undermine the veracity of Eichmann’s account. The global Jihadis are illiterate, a journalist recently commented: they’re not well read in the Qur’an, and if they have read it, they have thoroughly misunderstood it. He cited as evidence Abdul Raqib Amin’s YouTube rhetorical: Forget everyone. Read the Koran, read the instruction of life. Find out what is jihad. Eichmann on the other hand was not illiterate in his youth. Before Berlin, he had already read Kant’s Groundwork of the Metaphysics of Morals ; he would also re-read the Critique of Practical Reason, and from his testimony and terminology we can infer he was familiar with Kantian concepts that extend beyond both books...

Johdanto Työssä käsitellään sopimusten tekemistä internetissä. Tavoitteena on löytää mahdollisia nettisopimusten sopimussunnittelussa huomioon otettavia asioita. Näkökulmaksi on otettu sopimuskäytäntö. Sopimuskäytäntö lähtökohtana tutkimukselle Työssä esitellään sopimuskäytännön ja perinteisen analyyttisen sopimusoikeuden välinen ristiriita. Koska yritykset eivät halua ratkaista ongelmiaan tuomioistuimessa, tuomioistuimiin päätyy vain marginaalinen osa sopimuksista. Yritysten näkökulmasta tuomioistuimiin päätyneet sopimukset ovat olleet epäonnistuneita. Tämän takia pelkästään tuomioistuinratkaisuja tutkimalla ei tavoiteta käytännön sopimustoiminnan ongelmia ja ei pystytä tarjoamaan niihin ratkaisumalleja. Sama ongelma koskee myös kuluttajasopimuksia. Tässä työssä on tutkittu käytännön sopimustoimintaa eli sopimuskäytäntöä. Sopimusoikeuden tutkimukseen on tuotu uutta näkökulmaa. Sopimuksen syntyminen nettikaupassa Kirjoittaja esittää yleisen sopimusmallin nettisopimuksille. Sopimusmallin keskeisiä näkökohtia ovat sopimuksen prosessiluonne. Sopimusmallissa käydään läpi kaikkia niitä vaiheita, jotka voivat vaikuttaa päätökseen sitoutua sopimukseen. Työssä myös esitetään, että sopimukseen sisältö määräytyy näiden vaiheiden mukaisesti. Koska pitkällä tähtäimellä tehdyssä sopimustoiminnassa syntyy ajoittain ongelmia, työssä myös käsitellään yrityksen mahdollisuuksia hallita näitä sopimushäiriöitä. Arviot kahdesta avoimesta sopimusjärjestelmästä Tutkielmassa myös käydään läpi kaksi yleisölle avointa nettisopimusjärjestelmää. Toinen on tavarakauppa Amazon.com ja toinen Genetic Anomalies, Inc.:in tekemä tietokonepeli ChronX. Kumpaankin yritetään soveltaa esiteltyä yleistä sopimusmallia. Loppupäätelmät Keskeiseksi johtopäätökseksi tutkielmassa tulee, että yrityksen tulee pyrkiä tarjoamaan asiakkailleen mahdollisimaan hyvin tietoa heidän sopimusjärjestelmästään ja tuotteistaan. Tällä ei tarkoiteta valtavaa määrää epäselkeästi esitettyä tietoa. Tiedon jakaminen ja asiakaspalautteen hallinta ovat tutkimuksen mukaan yritysten suurin haaste nettikaupassa. Tutkielmassa myös esitetään, että näitä tuloksia saattaa voida soveltaa tavanomaiseenkin kaupankäyntiin.

Recommender systems assist users in finding what they want. The challenging issue is how to efficiently acquire user preferences or user information needs for building personalized recommender systems. This research explores the acquisition of user preferences using data taxonomy information to enhance personalized recommendations for alleviating cold-start problem. A concept hierarchy model is proposed, which provides a two-dimensional hierarchy for acquiring user preferences. The language model is also extended for the proposed hierarchy in order to generate an effective recommender algorithm. Both Amazon.com book and music datasets are used to evaluate the proposed approach, and the experimental results show that the proposed approach is promising.

Throughout the history of Linnean taxonomy, species have been described with varying degrees of justification. Many descriptions have been based on only a few ambiguous morphological characters. Moreover, species have been considered natural, well-defined units whereas higher taxa have been treated as disparate, non-existent creations. In the present thesis a few such cases were studied in detail. Often the species-level descriptions were based on only a few specimens and the variation previously thought to be interspecific was found to be intraspecific. In some cases morphological characters were sufficient to resolve the evolutionary relationships between the taxa, but generally more resolution was gained by the addition of molecular evidence. However, both morphological and molecular data were found to be deceptive in some cases. The DNA sequences of morphologically similar specimens were found to differ distinctly in some cases, whereas in other closely related species the morphology of specimens with identical DNA sequences differed substantially. This study counsels caution when evolutionary relationships are being studied utilizing only one source of evidence or a very limited number of characters (e.g. barcoding). Moreover, it emphasizes the importance of high quality data as well as the utilization of proper methods when making scientific inferences. Properly conducted analyses produce robust results that can be utilized in numerous interesting ways. The present thesis considered two such extensions of systematics. A novel hypothesis on the origin of bioluminescence in Elateriformia beetles is presented, tying it to the development of the clicking mechanism in the ancestors of these animals. An entirely different type of extension of systematics is the proposed high value of the white sand forests in maintaining the diversity of beetles in the Peruvian Amazon. White sand forests are under growing pressure from human activities that lead to deforestation. They were found to harbor an extremely diverse beetle fauna and many taxa were specialists living only in this unique habitat. In comparison to the predominant clay soil forests, considerably more elateroid beetles belonging to all studied taxonomic levels (species, genus, tribus, and subfamily) were collected in white sand forests. This evolutionary diversity is hypothesized to be due to a combination of factors: (1) the forest structure, which favors the fungus-plant interactions important for the elateroid beetles, (2) the old age of the forest type favoring survival of many evolutionary lineages and (3) the widespread distribution and fragmentation of the forests in the Miocene, favoring speciation.

This article will examine the legality of the digital rights management (‘DRM’) measures used by the major e-book publishers and device manufacturers in the United States, European Union and Australia not only to enforce their intellectual property rights but also to create monopolistic content silos, restrict interoperability and affect the ability for users to use the content they have bought in the way they wish. The analysis will then proceed to the recent competition investigations in the US and EU over price-fixing in e-book markets, and the current litigation against Amazon in the US for an alleged abuse of its dominant position. A final point will be made on possible responses in Australia to these issues taking into account the jurisprudence on DRM in other scenarios.

In this study, we analyze satellite-based daily rainfall observations to compare and contrast the wet and dry spell characteristics of tropical rainfall. Defining a wet (dry) spell as the number of consecutive rainy (nonrainy) days, we find that the distributions of wet spells appear to exhibit universality in the following sense. While both ocean and land regions with high seasonal rainfall accumulation (humid regions; e. g., India, Amazon, Pacific Ocean) show a predominance of 2-4 day wet spells, those regions with low seasonal rainfall accumulation (arid regions; e. g., South Atlantic, South Australia) exhibit a wet spell duration distribution that is essentially exponential in nature, with a peak at 1 day. The behavior that we observed for wet spells is reversed for the dry spell characteristics. In other words, the main contribution to the dry part of the season, in terms of the number of nonrainy days, appears to come from 3-4 day dry spells in the arid regions, as opposed to 1 day dry spells in the humid regions. The total rainfall accumulated in each wet spell has also been analyzed, and we find that the major contribution to seasonal rainfall for arid regions comes from 1-5 day wet spells; however, for humid regions, this contribution comes from wet spells of duration as long as 30 days. We also explore the role of chance as well as the influence of organized convection in determining some of the observed features.

Two atmospheric inversions (one fine-resolved and one process-discriminating) and a process-based model for land surface exchanges are brought together to analyse the variations of methane emissions from 1990 to 2009. A focus is put on the role of natural wetlands and on the years 2000-2006, a period of stable atmospheric concentrations. From 1990 to 2000, the top-down and bottom-up visions agree on the time-phasing of global total and wetland emission anomalies. The process-discriminating inversion indicates that wetlands dominate the time-variability of methane emissions (90% of the total variability). The contribution of tropical wetlands to the anomalies is found to be large, especially during the post-Pinatubo years (global negative anomalies with minima between -41 and -19 Tg yr(-1) in 1992) and during the alternate 1997-1998 El-Nino/1998-1999 La-Nina (maximal anomalies in tropical regions between +16 and +22 Tg yr(-1) for the inversions and anomalies due to tropical wetlands between +12 and +17 Tg yr(-1) for the process-based model). Between 2000 and 2006, during the stagnation of methane concentrations in the atmosphere, the top-down and bottom-up approaches agree on the fact that South America is the main region contributing to anomalies in natural wetland emissions, but they disagree on the sign and magnitude of the flux trend in the Amazon basin. A negative trend (-3.9 +/- 1.3 Tg yr(-1)) is inferred by the process-discriminating inversion whereas a positive trend (+1.3 +/- 0.3 Tg yr(-1)) is found by the process model. Although processed-based models have their own caveats and may not take into account all processes, the positive trend found by the B-U approach is considered more likely because it is a robust feature of the process-based model, consistent with analysed precipitations and the satellite-derived extent of inundated areas. On the contrary, the surface-data based inversions lack constraints for South America. This result suggests the need for a re-interpretation of the large increase found in anthropogenic methane inventories after 2000.

Scalable stream processing and continuous dataflow systems are gaining traction with the rise of big data due to the need for processing high velocity data in near real time. Unlike batch processing systems such as MapReduce and workflows, static scheduling strategies fall short for continuous dataflows due to the variations in the input data rates and the need for sustained throughput. The elastic resource provisioning of cloud infrastructure is valuable to meet the changing resource needs of such continuous applications. However, multi-tenant cloud resources introduce yet another dimension of performance variability that impacts the application's throughput. In this paper we propose PLAStiCC, an adaptive scheduling algorithm that balances resource cost and application throughput using a prediction-based lookahead approach. It not only addresses variations in the input data rates but also the underlying cloud infrastructure. In addition, we also propose several simpler static scheduling heuristics that operate in the absence of accurate performance prediction model. These static and adaptive heuristics are evaluated through extensive simulations using performance traces obtained from Amazon AWS IaaS public cloud. Our results show an improvement of up to 20% in the overall profit as compared to the reactive adaptation algorithm.

Un estudio de nueve híbridos comerciales de cebolla ( Allium cepa L.), y un testigo comercial, se realizó en el Centro Experimental del Valle de Sébaco del INTA, en San Isidro con el objetivo de evaluar el comportamiento agronómico , rendimiento de bulbo, así como por categoría de los mismos. El diseño experimental fue un BCA con cuatro repeticiones. Los datos obtenidos se analizaron con ANDEVA y prueba de rangos múltiples de Tuckey (p =0.05). Número de h ojas en 9 híbridos fueron significativos: Arad, Neptune, Martin, Noam. Amazone y Appolo = 6 Hojas respectivamente, y Russel, Equanex y Galil con = 5 hojas respectivamente . Altura de plantas en híbridos fueron significativos: Noam, Equane x, Martin y Arad = 60 cm respectivamente ; Neptune, Amazon, Appolo y Russel entre 55 cm - 60 cm , y Galil = 55 cm respectivamente . Mancha Púrpura: no hubo diferencias significativa s . Mayores rendimientos híbridos bulbos amarillo Amazon y Ap polo, con promedi os > 60 y 38 Tm ha - 1 de bulbos comerciales respectivamente. Mayor adaptación: Amazon (60.8 Tm ha - 1 ). Equanex, Appolo y Martin tuvieron rendimientos supe riores a las 39.5, 38.4, 36.6 Tm ha - 1 respectivamente . Arad, Galil, y Russel tuvieron rendimiento menores a los 29.0, 24.9, y 22.5 T m ha - 1 respectivamente . Noam y Neptune fueron los híbridos que no se adaptaron a las condiciones del CEVAS – INTA. Categorías de bulbo: Pre - pack fue superior co n 58.6 Tm ha - 1 a Large medium 26.1 Tm ha - 1 .
