O papel desempenhado pelo Poder Judiciário nos mais diversos Estados passa por sensível evolução ao longo do século XX, à medida que se desenvolveram os sistemas de controle de constitucionalidade. De um lado, os atores políticos assumem especial importância nesse processo. Os modelos de revisão judicial foram reforçados, no mais das vezes, em paralelo à positivação, em âmbito constitucional, de um amplo rol de direitos fundamentais e de princípios balizadores e limitadores do poder estatal. Com isso, os elementos cotejados no processo legislativo de tomada de decisões políticas são revestidos de status constitucional e transportados para o discurso argumentativo do Direito, o que leva a um processo de judicialização da Política que permite que a atividade legiferante seja passível de confronto perante instâncias judiciárias. Os instrumentos de controle de constitucionalidade assumem, assim, novos contornos, permitindo que o Judiciário interfira no conteúdo das escolhas políticas feitas pela maioria governante. De outro lado, o Poder Judiciário particularmente as Cortes Constitucionais passa a assumir a corresponsabilidade na efetivação das metas e compromissos estatais, com o que desenvolve uma política institucional mais proativa e comprometida com a concretização substancial de valores democráticos, interferindo, assim, de maneira mais incisiva e rígida no controle do processo político. A definição de políticas fundamentais e o processo legiferante passam a contar com constante participação do Judiciário. Na realidade brasileira, a Constituição de 1988 amplia as competência do Supremo Tribunal Federal em sede de controle de constitucionalidade, inserindo o órgão de maneira efetiva nesse contexto de intervenção judicial na Política. A última década, por sua vez, marcou uma perceptível mudança em sua atividade e em sua interferência no processo de tomada de decisões políticas pelos demais Poderes. Valendo-se dos diversos instrumentos de controle que lhe são disponibilizados, assumiu o compromisso de participar na efetivação dos preceitos constitucionais pátrios mediante a revisão do conteúdo normativo decorrente das escolhas políticas tomadas em outras instâncias. Desse modo, tornou-se verdadeiro copartícipe do processo de definição de políticas legislativas nacionais, seja rechaçando normas que repute inconstitucionais, seja proferindo decisões com claros efeitos normativos que buscam readequar e conformar as escolhas dos atores políticos. Nesse processo decisório, entra em jogo a intensidade com que a Corte busca impor sua visão e suas concepções no tocante à efetivação e concretização dos compromissos constitucionais. A sobreposição de ponderações judiciais e legislativas acarreta, a seu turno, importantes efeitos sistêmicos ao diálogo interinstitucional que se desenvolve entre os Poderes, em especial no que concerne à distribuição das funções estatais dentro das premissas democráticas e ao dimensionamento do papel que compete a cada um dos Poderes no processo de efetivação e proteção da Constituição.

The object of this doctoral thesis is the analysis of the political and administrative purpose that is given to the reform process of a vital sector of State powers within the framework of delegate democracy, such as the administration of Justice. The object is also to analyze if State reform in a diminished or non-liberal surrounding increase or improve conditions of democracy in a given situation, based on the constitutional “what should be”, or if what occurs is a process of “seizure” of the functions of State, which becomes an institutional risk. Finally, we will examine the real and effective existence of a horizontal accountability process through the use of institutional resources, which would evidence the existence of an incomplete model of democracy. This analysis implies the relationship between two institutions within public administration: State Reform, as an act of change in State structure in order to improve qualitatively the outcomes and outputs of public policies, and in sum, to make the system work better. This, as it will be examined later, is the case of Latin America as a response of the State to three processes in crisis: fiscal, as in government intervention or in the form of bureaucratic administration. In that scheme of things, this thesis examines the present state of the art in public administration science of this process to prove that in delegate democracy, this type of instruments disregard the constitutive elements of democracy and serve, especially in critical areas of the administration, allowing for Power to dismiss Law. This research seeks to contribute towards an area seldom analyzed regarding public administration doctrine under the light of the theory of law, which is the connection between previous conditions or principal inputs of an execution process of a democracy and, on the other hand, regarding the effects of introducing a reform within models of a changing democracy and new concepts of the rule of law. While reviewing writings regarding State reform, it is clear that no approximations have been previously made in reference to prior conditions of the political system in order to begin operating a reform which respects fundamental rights as an object of this procedure. Research focusing on mental toughness development and high risk sport is limited to one examination of elite gymnasts' perceptions. Coaches have acknowledged that mental toughness is important to performance success, while admitting they do not know effective development strategies. The aim of the current research is to address both these concerns by employing a grounded theory approach to ascertain elite diving coaches perceptions of mental toughness development and what mental toughness is. Seven diving coaches volunteered and were interviewed for an average of 49 minutes. They all coached an athlete that participated either in the world championships or Olympic games since 2008. Participants reported that mental toughness was the ability of a diver to perform a movement in a crucial moment that requires focus, extending beyond their comfort zone, overcoming fear, and never giving up. Mentaltoughness may not be the appropriate term due to its lack of multicultural sensitivity. Participants felt that dealing with adversity was something divers would have to constantly process. Mental toughness can be developed by the coach, the environment, or individual athlete. Unique attributes specific to divers were an awareness of self and a distinct level of knowing what the athlete was going to do. More research needs to be conducted to determine if these concepts can be generalized to other high risk sports. Future research could help establish a valid quantitative measure of mental toughness development.

Unripe banana flour (UBF) production employs bananas not submitted to maturation process, is an interesting alternative to minimize the fruit loss reduction related to inappropriate handling or fast ripening. The UBF is considered as a functional ingredient improving glycemic and plasma insulin levels in blood, have also shown efficacy on the control of satiety, insulin resistance. The aim of this work was to study the drying process of unripe banana slabs (Musa cavendishii, Nanicão) developing a transient drying model through mathematical modeling with simultaneous moisture and heat transfer. The raw material characterization was performed and afterwards the drying process was conducted at 40 ºC, 50 ºC e 60 ºC, the product temperature was recorded using thermocouples, the air velocity inside the chamber was 4 m·s-1. With the experimental data was possible to validate the diffusion model based on the Fick\'s second law and Fourier. For this purpose, the sorption isotherms were measured and fitted to the GAB model estimating the equilibrium moisture content (Xe), 1.76 [g H2O/100g d.b.] at 60 ºC and 10 % of relative humidity (RH), the thermophysical properties (k, Cp, ?) were also measured to be used in the model. Five cases were contemplated: i) Constant thermophysical properties; ii) Variable properties; iii) Mass (hm), heat transfer (h) coefficient and effective diffusivity (De) estimation 134 W·m-2·K-1, 4.91x10-5 m-2·s-1 and 3.278?10-10 m·s-2 at 60 ºC, respectively; iv) Variable De, it presented a third order polynomial behavior as function of moisture content; v) The shrinkage had an effect on the mathematical model, especially in the 3 first hours of process, the thickness experienced a contraction of about (30.34 ± 1.29) % out of the initial thickness, finding two decreasing drying rate periods (DDR I and DDR II), 3.28x10-10 m·s-2 and 1.77x10-10 m·s-2, respectively. COMSOL Multiphysics simulations were possible to perform through the heat and mass transfer coefficient estimated by the mathematical modeling.

This Article uses the example of BigLaw firms to explore the challenges that many elite organizations face in providing equal opportunity to their workers. Despite good intentions and the investment of significant resources, large law firms have been consistently unable to deliver diverse partnership structures - especially in more senior positions of power. Building on implicit and institutional bias scholarship and on successful approaches described in the organizational behavior literature, we argue that a significant barrier to systemic diversity at the law firm partnership level has been, paradoxically, the insistence on difference blindness standards that seek to evaluate each person on their individual merit. While powerful in dismantling intentional discrimination, these standards rely on an assumption that lawyers are, and have the power to act as, atomistic individuals - a dangerous assumption that has been disproven consistently by the literature establishing the continuing and powerful influence of implicit and institutional bias. Accordingly, difference blindness, which holds all lawyers accountable to seemingly neutral standards, disproportionately disadvantages diverse populations and normalizes the dominance of certain actors - here, white men - by creating the illusion that success or failure depends upon individual rather than structural constraints. In contrast, we argue that a bias awareness approach that encourages identity awareness and a relational framework is a more promising way to promote equality, equity, and inclusion.

One of the most important tenets of e-learning is that it bridges work and learning. A great e-learning experience brings learning into the work environment. This is a key point, the capacity to construct a work environment when the student can develop proper tasks to complete the learning process. This paper describes a work environment based on the development of two tools, an exercises editor and an exercises viewer. Both tools are able to manage color images where, because of the implementation of basic steganographic techniques, it is possible to add information, exercises, questions, and so on. The exercises editor allows to decide which information must be visible or remain hidden to the user, when the image is loaded in the exercises viewer. Therefore, it is possible to hide the solutions of the proposed tasks; this is very useful to complete a self-evaluation learning process. These tools constitute a learning architecture with the final objective that learners can apply and practice new concepts or skills.

El ámbito comunitario y de salud pública es probablemente el contexto donde las enfermeras han logrado mayores cotas de autonomía profesional y donde su contribución ha sido valorada en mayor medida. No obstante, todavía persisten grandes obstáculos para el pleno desarrollo, algunos de ellos vinculados a la variable género. Por ello, resulta relevante analizar, para el caso español, los antecedentes históricos de esta situación, en la medida que puede ayudar a entender muchos de los problemas y deficiencias que sigue mostrando la Enfermería Comunitaria en la actualidad. Las enfermeras comunitarias contribuyeron al desarrollo de la salud pública en la España contemporánea, proceso que se inició en los años 1920 y que culminó durante la Segunda República, pero el periodo franquista supuso un importante freno al proceso de profesionalización. A través del ejemplo del conflicto público entre enfermeras visitadoras y practicantes, que se gestó en la Segunda República, y se prolongó durante todo el periodo franquista, se analiza cómo el discurso de género estuvo presente, entre otros condicionantes, en la evolución de la Enfermería española y cómo ha venido contribuyendo, hasta nuestros días, en la estructuración de las competencias, y la distribución de responsabilidades y poder.

This paper describes the “Variation Guggenheim 3: Mirador de la palmera” project, situated in Daya Vieja (Alicante-Spain). This structure is inspired by the Guggenheim museum of New York and is designed to protect a land-mark palm-tree from wind loads. This six – trunk palm tree was declared monument by the Valencian government in 2012. The structure that now protect it appears to fly around de palm tree creating a helicoidally skywalk made of steel, while retrofitting the lateral trunks of the tree to protect them from collapse. An 18 m. long straight beam starts on the top of this helix, and stretches towards a lookout point that offers a view of the whole village and its surroundings. The reduction of the visual impact of the structure on the tree was a major aim for the project design. The structural elements are as slender as possible to avoid the visual obstruction of tree. They are painted white, while the walkway steel corrugated plate is painted green in order to highlight its neat shape among the blur created by the apparent mess of bars of the supporting structure. The two main piles of this pedestrian bridge were designed in steel and geometrically resemble trees. A Ground Penetrating Radar analysis was performed to detect the palm root location and to decide the best foundation system. Slender cast in-situ steel-concrete micropiles along with a concrete pile-cap, raised some centimeters above the ground level, were used to reduce the damage to the roots. The projected pile-cap is a slender, continuous, circular ring; which geometry resembles a concrete bench. This structure has been a finalist in the Architecture Awards for the 2010-2014 best construction projects, held by the Diputación de Alicante.

En este trabajo se describe el proceso llevado a cabo para analizar numéricamente mediante el método de los elementos finitos (MEF) el comportamiento vibratorio del conjunto móvil de un altavoz dinámico de bobina con doble suspensión inferior y en ausencia de la superior. El estudio se centra en el rango de baja frecuencia. El calibrado del modelo se realiza en base a medidas experimentales de la frecuencia de resonancia y desplazamiento del diafragma. Se hace énfasis en la importancia de los factores de participación asociados a la fuerza de excitación y en los cambios que se producen en estos al introducir fuerzas no equilibradas. Así mismo, el análisis proporciona datos para decidir sobre la distancia entre suspensiones, su número óptimo de pliegues y la ubicación de las trencillas, siendo estos parámetros de gran interés en el diseño de este tipo de altavoces.

En la literatura y el cine góticos clásicos, el vampiro se concebía como un monstruo al que cabía eliminar. Sin embargo, en los últimos cuarenta años, novelas, películas y series revelan una voluntad de asimilarlo a la sociedad humana, un proceso conocido como domesticación o regeneración. Como metáfora de la diferencia sexual, racial, de género o de clase, tal asimilación representa, de acuerdo con los postulados de Foucault, una operación que lleva a cabo el poder para someterlas, integrándolas en el orden social y cultural establecido. La serie estadounidense True Blood (2008-2014) refleja a la perfección este proceso dual de regeneración que implica, a su vez, sometimiento. Relacionado con los supuestos de la corrección política, el nuevo monstruo ya no simboliza al «perverso» sino al «diferente» que se debe proteger y aceptar en el seno de la sociedad, pese al riesgo de cohesión social y amenaza para la familia que comporta.

Two folio-sized leaves containing a handwritten copy of a June 29, 1722 report created by a Committee of the General Court responding to the June 13, 1722 memorial of the Board of Overseers. The report lists three points declaring that the Charter of 1650 intended the Tutors to be members of the Corporation "provided they exceed not five in number," that none of the Fellows be Overseers, and that the Charter of 1650 did not grant the Corporation the power to set salaries without the consent of the Overseers. The copy notes that the report was read and accepted on June 29, and signed by Governor Samuel Shute on July 2, 1722, with the stipulation that none of the current non-resident Fellows be removed from the Corporation.

Standards reduce production costs and increase products’ value to consumers. Standards however entail risks of anti-competitive abuse. After the adoption of a standard, the chosen technology normally lacks credible substitutes. The owner of the patented technology might thus have additional market power relative to locked-in licensees, and might exploit this power to charge higher access rates. In the economic literature this phenomenon is referred to as ‘hold-up’. To reduce the risk of hold-up, standard-setting organisations often require patent holders to disclose their standard-essential patents before the adoption of the standard and to commit to license on fair, reasonable and non-discriminatory (FRAND) terms. The European Commission normally investigates unfair pricing abuse in a standard-setting context if a patent holder who committed to FRAND ex-ante is suspected not to abide to it ex-post. However, this approach risks ignoring a number of potential abuses which are likely harmful for welfare. That can happen if, for example, ex-post a licensee is able to impose excessively low access rates (‘reverse hold-up’) or if a patent holder acquires additional market power thanks to the standard but its essential patents are not encumbered by FRAND commitments, for instance because the patent holder did not directly participate to the standard setting process and was therefore not required by the standard-setting organisations to commit to FRAND ex-ante. A consistent policy by the Commission capable of tackling all sources of harm should be enforced regardless of whether FRAND commitments are given. Antitrust enforcement should hinge on the identification of a distortion in the bargaining process around technology access prices, which is determined by the adoption of the standard and is not attributable to pro-competitive merits of any of the involved players.

A acção de condenação à prática de acto devido corresponde à concretização, com o Código de Processo nos Tribunais Administrativos, do princípio da tutela jurisdicional efectiva previsto no art. 268º/4 da Constituição da República Portuguesa, assegurando aos particulares a obtenção de uma pronúncia condenatória na prática do acto administrativo que tenha sido recusado ou omitido. Esta pronúncia sofre as limitações decorrentes do princípio da separação de poderes, entre o Administrativo e o Judicial, nos termos expressos no art. 71º/2 do Código de Processo, que determina que quando a emissão do acto pretendido envolva a formulação de valorações próprias do exercício da função administrativa (…) o tribunal não pode determinar o conteúdo do acto a praticar, mas deve explicitar as vinculações a observar (…) na emissão do acto devido. À limitação enunciada acresce outra, sem reflexo no texto do Código mas que se impõe por via do mesmo princípio, e que respeita aos poderes do tribunal no conhecimento e determinação dos pressupostos do acto devido, nos casos em que estes são questionados em juízo. A determinação dos pressupostos de facto do acto devido pelo tribunal está limitada pela natureza da actividade instrutória procedimental, pelo (in)cumprimento do ónus da prova no procedimento pelo interessado, nos casos limitados em que este tem relevância e pelo princípio da decisão prévia administrativa, nos termos do qual é à Administração que compete o conhecimento e decisão das pretensões que lhe são dirigidas e cuja competência que lhe foi determinada pela lei. Os limites enunciados não prejudicam a sindicabilidade, pelos tribunais, dos actos de recolha e valoração das provas pela Administração, que, nos casos em que configurem espaços de margem de livre decisão administrativa, são sindicáveis nos termos em que pode ser controlada a actividade autodeterminada da Administração, sem qualquer limitação quanto aos meios de prova.
