Resumo:
The study of service quality and its implication for transport contracts has several approaches in research and practical applications, where the main emphasis is the consideration of quality from the user's point of view, thus obtaining a customer satisfaction index as a measurement of the overall quality with no further implications for service providers. The main aim of this paper is to estimate the real economic impact of improving quality attributes for a bus operator. An application of the activity-based costing methodology is developed for a bus contract in Madrid, using quality data from surveys together with economic and performance information, and focusing on headway as a quality variable. Results show the consistency and practicality of this methodology, overcoming simplifications from traditional procedures. This method is a powerful tool in quality-based contracting as well as for effective investment in transport quality under poverty funding constraints

El estudio de la calidad de servicio en transporte público ha tenido distintos enfoques, tanto en la investigación como en sus aplicaciones prácticas, tales como el desarrollo del método SERVQUAL, los proyectos QUATTRO y EQUIP de la Comisión Europea, el Transit Capacity and Quality of Service Manual y finalmente el estándar EN 13816, siendo la consideración principal la calidad desde el punto de vista del usuario, es decir, la calidad percibida, cuyo objetivo en la práctica trata de obtener un Índice de Satisfacción del Cliente como medida de la calidad global. Esta aproximación deja de lado aspectos tanto sobre calidad suministrada como sobre los suministradores del servicio, las administraciones y los operadores, particularmente en cuanto a las implicaciones económicas. El objetivo principal de la presente tesis es la estimación del impacto económico real de la mejora de atributos de calidad para un operador de autobús urbano. En el capítulo 2, se lleva a cabo un análisis del estado del arte sobre el estudio de la calidad, tanto de los métodos de estudio, como de su aplicación al campo de transporte público, y, específicamente, del estudio de costes. En los capítulos 3 y 4 se propone la aplicación de la metodología ABC (Activity Based Costing) para el caso de un contrato de servicio de transporte público en autobús en la Comunidad de Madrid, concretamente la conexión de Tres Cantos. Para ello se utilizan datos de encuestas de calidad esperada y percibida por los usuarios, junto con información económica y de actividad, así como entrevistas a personal de la empresa, conformando todo ello una metodología compacta de investigación y análisis. Los resultados de las encuestas y los análisis posteriores identificaron la frecuencia de servicio, la puntualidad de los autobuses y la seguridad de la conducción como las tres variables mas importantes desde el punto de vista del usuario, y ha sido en referencia a estas tres variables sobre las que se ha desarrollado la aplicación del método ABC contenida en el capítulo 5. Los resultados descritos en el capítulo 6 muestran la consistencia y la aplicabilidad de esta metodología, superando las simplificaciones de los procedimientos tradicionales contables. En cuanto a los resultados obtenidos, se ha comprobado que una aproximación tradicional basada en costes por kilometro puede llegar a sobrevalorar los costes asociados a mejoras de calidad hasta tres veces los costes calculados según el método ABC. Finalmente en el capítulo 7 se recogen las principales conclusiones y se apuntan algunas líneas futuras de investigación basadas en mejoras sobre la aplicación y transferibilidad de los resultados. The study of service quality and its implication for transport contracts has several approaches in research and practical applications, such as the development of the SERVQUAL method, the UE QUATTRO and EQUIP research projects, the Transit Capacity and Quality of Service Manual and finally the EN 13816 standard. In all cases the main stream is the consideration of quality from the user’s point of view, thus obtaining a Customer Satisfaction Index as a measurement of the overall service quality. This approach ignores quality consequences for transport providers, authorities and operators, particularly economic implications. The main target of this thesis is to estimate the real economic impact of improving quality attributes for a bus operator. Chapter 2 includes a thorough analysis of the state of the art of general methodologies on service quality, their applications for public transport, and particularly for quality costing. In chapters 3 and 4, the Activity Based Costing (ABC) methodology is proposed for a suburban bus contract in Madrid, Tres Cantos. Perceived and expected quality surveys are used together with economic and performance information, as well as interviews with key staff from the operator. The whole set of surveys, interviews and ABC methodology puts together a comprehensive approach for analysis and research. Surveys and subsequent analysis shows service headway, punctuality and safety as the three most important service attributes from the user’s point of view. The proposed methodology has been applied to these three variables, as described in chapter 5. Results obtained in chapter 6 show the consistency and practicality of this methodology, overcoming simplifications from traditional accounting procedures. According to the latter, a calculation of costs based on mileage can overvalue quality improvements up to three times the results following ABC methodology. Finally, in chapter 7, the main conclusions are highlighted and some future research is suggested in terms of application improvements as well as results transferability.

El objetivo de esta tesis es la caracterización de la generación térmica representativa de la existente en la realidad, para posteriormente proceder a su modelización y simulación integrándolas en una red eléctrica tipo y llevar a cabo estudios de optimización multiobjetivo económico medioambiental. Para ello, en primera instancia se analiza el contexto energético y eléctrico actual, y más concretamente el peninsular, en el que habiendo desaparecido las centrales de fuelóleo, sólo quedan ciclos combinados y centrales de carbón de distinto rango. Seguidamente se lleva a cabo un análisis de los principales impactos medioambientales de las centrales eléctricas basadas en combustión, representados sobre todo por sus emisiones de CO2, SO2 y NOx, de las medidas de control y mitigación de las mismas y de la normativa que les aplica. A continuación, a partir de las características de los combustibles y de la información de los consumos específicos, se caracterizan los grupos térmicos frente a las funciones relevantes que definen su comportamiento energético, económico y medioambiental, en términos de funciones de salida horarias dependiendo de la carga. Se tiene en cuenta la posibilidad de desnitrificación y desulfuración. Dado que las funciones objetivo son múltiples, y que están en conflicto unas con otras, se ha optado por usar métodos multiobjetivo que son capaces de identificar el contorno de puntos óptimos o frente de Pareto, en los que tomando una solución no existe otra que lo mejore en alguna de las funciones objetivo sin empeorarlo en otra. Se analizaron varios métodos de optimización multiobjetivo y se seleccionó el de las ε constraint, capaz de encontrar frentes no convexos y cuya optimalidad estricta se puede comprobar. Se integró una representación equilibrada de centrales de antracita, hulla nacional e importada, lignito y ciclos combinados en la red tipo IEEE-57, en la que se puede trabajar con siete centrales sin distorsionar demasiado las potencias nominales reales de los grupos, y se programó en Matlab la resolución de flujos óptimos de carga en alterna con el método multiobjetivo integrado. Se identifican los frentes de Pareto de las combinaciones de coste y cada uno de los tres tipos de emisión, y también el de los cuatro objetivos juntos, obteniendo los resultados de costes óptimos del sistema para todo el rango de emisiones. Se valora cuánto le cuesta al sistema reducir una tonelada adicional de cualquier tipo de emisión a base de desplazarse a combinaciones de generación más limpias. Los puntos encontrados aseguran que bajo unas determinadas emisiones no pueden ser mejorados económicamente, o que atendiendo a ese coste no se puede reducir más allá el sistema en lo relativo a emisiones. También se indica cómo usar los frentes de Pareto para trazar estrategias óptimas de producción ante cambios horarios de carga. ABSTRACT The aim of this thesis is the characterization of electrical generation based on combustion processes representative of the actual power plants, for the latter modelling and simulation of an electrical grid and the development of economic- environmental multiobjective optimization studies. In this line, the first step taken is the analysis of the current energetic and electrical framework, focused on the peninsular one, where the fuel power plants have been shut down, and the only ones remaining are coal units of different types and combined cycle. Then it is carried out an analysis of the main environmental impacts of the thermal power plants, represented basically by the emissions of CO2, SO2 y NOx, their control and reduction measures and the applicable regulations. Next, based on the combustibles properties and the information about the units heat rates, the different power plants are characterized in relation to the outstanding functions that define their energy, economic and environmental behaviour, in terms of hourly output functions depending on their load. Optional denitrification and desulfurization is considered. Given that there are multiple objectives, and that they go in conflictive directions, it has been decided the use of multiobjective techniques, that have the ability of identifying the optimal points set, which is called the Pareto front, where taken a solution there will be no other point that can beat the former in an objective without worsening it in another objective. Several multiobjective optimization methods were analysed and pondered, selecting the ε constraint technique, which is able to find no convex fronts and it is opened to be tested to prove the strict Pareto optimality of the obtained solutions. A balanced representation of the thermal power plants, formed by anthracite, lignite, bituminous national and imported coals and combined cycle, was integrated in the IEEE-57 network case. This system was selected because it deals with a total power that will admit seven units without distorting significantly the actual size of the power plants. Next, an AC optimal power flow with the multiobjective method implemented in the routines was programmed. The Pareto fronts of the combination of operative costs with each of the three emissions functions were found, and also the front of all of them together. The optimal production costs of the system for all the emissions range were obtained. It is also evaluated the cost of reducing an additional emission ton of any of the emissions when the optimal production mix is displaced towards cleaner points. The obtained solutions assure that under a determined level of emissions they cannot be improved economically or, in the other way, at a determined cost it cannot be found points of lesser emissions. The Pareto fronts are also applied for the search of optimal strategic paths to follow the hourly load changes.

Pinus pinaster Ait. es la conífera con mayor área de distribución en la Península Ibérica y es, a día de hoy, la única especie resinada en nuestro país. La inducción del flujo de resina al exterior para su recolección a través de distintos tipos de heridas ha sido practicada desde hace miles de años por distintas culturas. En todos los casos, las técnicas desarrolladas se basan en la estimulación del característico sistema de defensa de las pináceas. En los últimos siete años se viene observando una tendencia de incremento sustancial de la superficie resinada en España, acompañada por avances tecnológicos dirigidos a la mecanización y mejora de estimulantes. El aprovechamiento resinero se perfila como un sector estratégico en la generación de empleo rural y la conservación de ecosistemas. La industria resinera demanda métodos de extracción más eficaces, una selvicultura adecuada y actualizada, y condiciones laborales de los resineros más dignas con objeto de llegar a ser competitiva en el mercado internacional. Este trabajo se centra en ampliar el conocimiento sobre el sistema de defensa de P. pinaster, concretamente sobre las estructuras y procesos que pueden afectar a la producción de resina. Se analizan las relaciones entre las características anatómicas del xilema, destacando las relacionadas con los canales resiníferos, las variables dendrométricas y dasométricas de la masa y el flujo de resina (objetivo 1). Se estudia cómo estas relaciones son moduladas por las heridas de resinación dependiendo de la técnica de resinación aplicada (objetivo 2), el clima y el balance hídrico del suelo (objetivo 3). El material vegetal, las muestras de suelo y los datos de producción de resina y climáticos usados en esta tesis han sido recogidos en tres montes de utilidad pública; MUP 101 en Armuña, MUP 108 en Melque de Cercos y MUP 117 en Nieva (en esta última solo se recogieron los datos de producciones), todos ellos pinares monoespecíficos de P. pinaster localizados en la denominada Tierra de Pinares Segoviana. En los árboles de nuestro estudio se han aplicado cuatro métodos de resinación: método de pica de corteza con estimulante y método mecanizado con estimulante, ambos en sentido ascendente y descendente. En los trabajos realizados para el análisis de la influencia de la anatomía constitutiva en la producción de resina (objetivo 1) y el efecto del clima (objetivo 3), se obtuvieron muestras del xilema de 26 árboles resinados en Melque de Cercos y Armuña y 12 árboles control sin resinar. Para caracterizar los pies estudiados, se midió la altura, diámetro normal y porcentaje de copa viva. Las muestras de tejido fueron recogidas en una zona del tronco a una distancia del límite de la herida considerada en la bibliografía como no afectada (anatomía constitutiva). Para el análisis de las alteraciones anatómicas inducidas por la herida (objetivo 2), se recogieron muestras en ocho de los individuos en los que se habían realizado los distintos métodos de resinación descritos y en cinco árboles control. Se obtuvieron ocho muestras de tejido distribuidas en la parte superior, inferior, lateral y centro de la herida de cada uno de los árboles resinados. Para establecer las diferencias en la producción de resina según el método de resinación, se analizaron las producciones de 561 árboles resinados en 2012 con estos cuatro métodos en Nieva. Los principales resultados de estos trabajos muestran que la producción de resina está ligada al volumen de canales (axiales y radiales) y a la frecuencia de canales radiales existentes en el árbol antes de efectuar ninguna herida (sistema constitutivo). De esta manera, los árboles grandes productores de resina mostraron una red de canales más densa que aquellos con producciones medias. Una vez realizada la herida de resinación, observamos una disminución del ancho del anillo de crecimiento y del tamaño medio de los canales axiales a la vez que se incrementaba la frecuencia y área ocupada por mm2 de anillo de estos canales. Estos cambios perduraron en el árbol durante al menos tres años y fueron distintos dependiendo de la localización en el entorno de la herida y del método de resinación. Las respuestas más intensas a la herida se observaron el año siguiente a la realización de la misma, en dirección axial, para las distancias más próximas al límite de la herida y para los métodos de resinación en sentido ascendente. Además, se ha constatado que como consecuencia de las heridas de resinación se produjeron cambios en la anatomía del xilema en zonas alejadas de la herida, tanto en el año de la herida como años posteriores. Es decir, se observó una respuesta sistémica del árbol. Respecto al papel del clima como regulador de la respuesta del árbol, se ha evidenciado que la temperatura, la radiación y la ETP influyeron en la producción de resina, no solo durante la campaña de resinación, sino también durante los meses anteriores. El déficit hídrico favoreció la producción y la formación de canales axiales pero, a partir de un determinado umbral, esa relación se invirtió y las lluvias estivales incrementaron la producción. Algunas de estas variables climáticas se asociaron a cambios en el tamaño y frecuencia de las estructuras secretoras, las cuales posiblemente modulan la respuesta defensiva de la planta. La dendrometría del árbol (evaluada a través del diámetro normal, altura y porcentaje de copa viva), la densidad de la masa y el tipo de suelo influyeron en el potencial de producción de resina de P. pinaster. Árboles más vigorosos, parcelas con menores densidades y suelos con más capacidad para la retención de agua y nutrientes presentaron producciones mayores. Estos trabajos se complementan en anexos con una caracterización del sistema socio-ecológico del pinar en resinación. En ese trabajo se identifican sus potenciales servicios ecosistémicos y se evalúa su grado de vinculación con el aprovechamiento resinero con objeto de valorar su funcionalidad y aproximar una valoración económica de modo que sea posible apreciar la importancia económica de los mismos. Para concluir, podemos resaltar que son necesarios más trabajos de carácter científico para avanzar en la comprensión de los procesos anatómicos y fisiológicos que regulan la secreción de resina en P. pinaster y sus interacciones con el medio. Esto permitiría avances certeros hacia el desarrollo de métodos de extracción más eficaces, una selvicultura óptima, el reconocimiento de los beneficios socio-ecológicos y económicos del aprovechamiento y, de manera general, una bibliografía amplia y fiable para la consulta y desarrollo de futuras mejoras que posibiliten la reactivación y conservación de la resinación como aprovechamiento rentable. ABSTRACT Pinus pinaster Ait. is the most widespread conifer in Spain and is now the only species tapped for its oleoresin. External induction of resin secretion, based on the defense system of Pinus trees, has been performed by humans since Classical times through various methods. The socio-economic implication of this practice in Spain justifies a new approach to improve tapping methodology and understand the effects of this activity on the tree. In the last five years, sharp increases in the price of natural resins, accompanied by technological advances directed toward mechanization, have made resin tapping a strategic activity for rural development and forest conservation. The resin industry demands more efficient tapping methods and forest management plans as a way to increase competitiveness in a global market. In this way, this work focuses on the study of the defense system of P. pinaster, with the aim to understand the effects of anatomical and physiological characteristics and environmental conditions on resin yield. The relationships between anatomical variables -with special focus on resin canals-, dendrometric and dasometric variables, and resin yield will be evaluated (objective 1). The tapping wound effects (objective 2) and the intra- and inter-annual variability of climate conditions and soil water availability influence (objective 3) on resin yield will be also studied. The plant and soil material and the resin yield and climatic data used in this thesis have been collected in stands of three public forests of P. pinaster; Armuña, Melque de Cercos and Nieva, located in Segovia (Central Spain). Trees were tapped using two different methods: mechanized or traditional tool, in both upwards and downwards direction. Twenty-six tapped trees of contrasting resin yield classes and twelve non-tapped (control) trees, growing in two locations (Armuña y Melque de Cercos) with the same climate but different stand density and soil characteristics, were selected for studying the role of tree size, xylem anatomy at distal parts aside from the tapping wound (objective 1) and climate influence (objective 3) on resin yield. Concerning the tree defenses induced by the tapping wound (objective 2), the xylem of eight trees, tapped with the two described methods in both upwards and downwards direction, were analyzed. From each tapped tree, eight cores were collected at different locations and varying distances from the tapping wound. In each core, a histological analysis was made. Growth ring width, earlywood and latewood width, and axial canal frequency, area, mean size and location were measured. The effect of the tapping method on resin yield was assessed in 561 P. pinaster tapped trees in a stand in Nieva. In tissues not affected by the tapping wound, the frequency of radial resin canals and the total volume of resin canals were related to resin yield. The frequency of radial canals and the resin yield were strongly related to tree diameter and percentage of live crown. High area of axial resin canals per mm2 was related to high yielding trees, but only in the location with higher plant density and poorer soil quality. In tapped trees, an increase in axial canal frequency and area was found during the three years following the start of tapping activity, suggesting that canal formation is a systemic induced response to wounding. The highest mean annual resin yield was found using the traditional tool in upwards direction, which also induced the highest increase in axial canal frequency and area. The lowest yield was found for mechanized tapping, which showed no differences between the upwards and downwards directions. The strongest induction of systemic induced responses in terms of resin canal frequency and area was detected one year after tapping for upwards tapping. This suggests the involvement of signaling processes that spread mainly upwards, and the importance of adaptive processes as a defense against periodic insect attacks. Intra-annual variation in resin yield was strongly correlated with temperature, solar radiation, potential evapotranspiration and soil water deficit. Inter-annual variation in resin yield and resin canal abundance were correlated with temperature and water deficit in spring, but above a certain threshold of cumulated water deficit in summer rainfall favored resin yield. Under adverse climate scenarios where resource optimization is desirable, a reduced tapping season during the warmest months (June–September) would be advisable, assuming a very small production loss relative to traditional tapping season. Similarly, in years with a rainy summer and/or dry spring, a slightly longer tapping season could be suggested, as resin yield increases after these events. Tree diameter and percentage of live crown, and radial resin canal frequency could be useful criteria for estimating resin yields in P. pinaster. Vigorous trees in lower density stands and growing up in good quality soils will be the most productive. These conclusions could be applied to improve tapping management and breeding programs. These works are complemented with socio-ecological characterization, the identification of the main ecosystem services and an assessment of the possible economic impact derived from the tapping practice. To conclude, more scientific studies are necessary for understanding the anatomical and physiological processes behind resin synthesis and their interactions with the environment. This would afford further progresses towards an extensive and reliable bibliography and improved tapping methods and optimal selvicultural guide lines.

Esta pesquisa propõe um estudo do Evangelho produzido pela comunidade de Mateus, mais especificamente, o trabalho consiste em demonstrar a possibilidade de leitura desse evangelho a partir de implicações econômicas no seio da comunidade que o produziu. Entendemos o Evangelho de Mateus como um dos diversos movimentos judaicos do período pós-destruição do templo em 70 d.C.. Por causa desse contexto percebemos que o Evangelho de Mateus, debate com uma realidade de disputas religiosas desse período. É importante frisar que essas questões possuem vertentes e não terminam no âmbito religioso. As disputas religiosas conseqüentemente têm relações com todas as dimensões da vida, entre elas a econômica. Mateus resignifica para seu grupo a questão das posses, das riquezas, em virtude de uma realidade de crise econômica. E em meio a essa crise o Evangelho de Mateus, a partir de um trabalho redacional, dá novos significados à vida de fé da comunidade à luz das histórias de Jesus recebidas das fontes Marcos e Lucas. Este estudo justifica-se pela lacuna existente no material produzido sobre o Evangelho de Mateus, uma vez que o que é produzido a respeito dessas narrativas quase sempre se preocupa em analisar o conflito entre a comunidade de Mateus e os Fariseus somente no campo religioso deixando de lado as demais possibilidades, entre elas as relações econômicas.(AU)

As the telecommunications industry evolves over the next decade to provide the products and services that people will desire, several key technologies will become commonplace. Two of these, automatic speech recognition and text-to-speech synthesis, will provide users with more freedom on when, where, and how they access information. While these technologies are currently in their infancy, their capabilities are rapidly increasing and their deployment in today's telephone network is expanding. The economic impact of just one application, the automation of operator services, is well over $100 million per year. Yet there still are many technical challenges that must be resolved before these technologies can be deployed ubiquitously in products and services throughout the worldwide telephone network. These challenges include: (i) High level of accuracy. The technology must be perceived by the user as highly accurate, robust, and reliable. (ii) Easy to use. Speech is only one of several possible input/output modalities for conveying information between a human and a machine, much like a computer terminal or Touch-Tone pad on a telephone. It is not the final product. Therefore, speech technologies must be hidden from the user. That is, the burden of using the technology must be on the technology itself. (iii) Quick prototyping and development of new products and services. The technology must support the creation of new products and services based on speech in an efficient and timely fashion. In this paper I present a vision of the voice-processing industry with a focus on the areas with the broadest base of user penetration: speech recognition, text-to-speech synthesis, natural language processing, and speaker recognition technologies. The current and future applications of these technologies in the telecommunications industry will be examined in terms of their strengths, limitations, and the degree to which user needs have been or have yet to be met. Although noteworthy gains have been made in areas with potentially small user bases and in the more mature speech-coding technologies, these subjects are outside the scope of this paper.

É reconhecida a importância da avicultura para o agronegócio e para o desenvolvimento do Brasil. Mas o País tem enfrentado grande concorrência internacional, que se traduz em barreiras sanitárias e exigências cada vez maiores de controle de seu rebanho por parte dos importadores. Neste sentido, o Ministério da Agricultura, Pecuária e Abastecimento (MAPA) publicou uma série de atos legais para viabilizar a organização dos programas de saúde animal, entre eles as Instruções Normativas n° 56/2007, n° 59/2009, n°36/2012 e n°10/2013, para estabelecer os procedimentos para registro e fiscalização de estabelecimentos avícolas comerciais e de reprodução, voltados à biosseguridade do sistema avícola. Como todos os setores produtivos, a avicultura é fortemente influenciada pela sua estrutura de custos, de modo que há um certo sentimento de que a adequação às medidas de biosseguridade, preconizadas pelas normativas, pode impactar a atividade de produção de ovos comerciais de modo a levar, eventualmente, alguns avicultores ao abandono da mesma. O objetivo deste trabalho foi analisar o impacto socioeconômico das políticas sanitárias para estabelecimentos avícolas comerciais de postura da regional agropecuária de Limeira, Estado de São Paulo, analisando o perfil socioeconômico da propriedade e do produtor e, estimando o custo de produção e seu impacto em atendimento às medidas de biosseguridade preconizadas pelas normativas. Para a análise do perfil das propriedades foram utilizados os dados dos 28 estabelecimentos avícolas, levantados por meio de documentação para registro. Para a análise do perfil do produtor e para estimar os custos de produção foram considerados dez estabelecimentos, voluntários à pesquisa, visitados entre os meses de junho e julho de 2013. O resultado do estudo sugere que as adequações à biosseguridade podem ser factíveis de serem realizadas economicamente, sendo o custo relativamente pequeno frente aos possíveis riscos de enfermidades, representando entre 1,61% e 2,09% do custo total de produção. No entanto, as sucessivas alterações nas legislações podem fazer com que o programa de sanidade avícola perca a credibilidade diante da sociedade e dos produtores que demonstram resistência às mudanças nos paradigmas zoosanitários

El turismo, objeto de diversas disciplinas, es uno de los sectores más relevantes de la economía mundial, siendo en España la primera industria nacional. En los últimos años el turismo cultural se ha revelado como un motor esencial de desarrollo para bastantes territorios. Un caso sobresaliente es el conocido como «efecto Guggenheim» que desde su creación en 1997 se ha configurado como un icono arquitectónico que ha remodelado la ciudad de Bilbao. El objeto del presente estudio ha sido reflexionar sobre las ventajas e inconvenientes desde el ámbito económico, social y medioambiental que ha tenido lugar en Bilbao desde la construcción de dicho museo.

Since May 2011, the EU has launched one of its most far reaching and sophisticated sanctions operations in support of the protests against the current regime in Syria. The present brief examines the measures wielded by the EU, its expected impact and its implications for the EU’s relations with its global partners. While seriously undermined by the lack of support of Russia, the sanctions are having a noticeable economic impact. Yet, the choice of measures is ill-suited to stop the bloodshed. The sanctions have also served to (re)define partnerships with other powers, both in the Middle-East and globally.

Three years ago, in May 2010, Greece became the first euro-area country to receive financial assistance from the European Union and the International Monetary Fund in exchange for implementing an economic programme designed by the Troika of the European Commission, the European Central Bank and the IMF. Within a year, Ireland and Portugal went down the same path. This study provides an early evaluation of these assistance programmes implemented by the Troika in these three countries. The study assesses the economic impact of the programmes and the consequences of their particular institutional set-up.

In light of the growing international competition among states and globally operating companies for limited natural resources, export restrictions on raw materials have become a popular means for governments to strive for various goals, including industrial development, natural resource conservation and environmental protection. For instance, China as a major supplier of many raw materials has been using its powerful position to both economic and political ends. The European Union (EU), alongside economic heavyweights such as the US, Japan and Mexico, launched two high-profile cases against such export restrictions by China at the WTO in 2009 and 2012. Against this background, this paper analyses the EU’s motivations in the initiation of trade disputes on export restrictions at WTO, particularly focusing on the two cases with China. It argues that the EU's WTO complaints against export restrictions on raw materials are to a large extent motivated by its economic and systemic interests rather than political interests. The EU is more likely to launch a WTO complaint, the stronger the potential and actual impact on its economy, the more ambiguous the WTO rules and the stronger the internal or external lobbying by member states or companies. This argumentation is based on the analysis of pertinent factors such as the economic impact, the ambiguity of WTO law on export restrictions and the pressure by individual member states on the EU as well as the role of joint complaints at the WTO and political considerations influencing the EU’s decision-making process.

Contexte: La régurgitation mitrale (RM) est une maladie valvulaire nécessitant une intervention dans les cas les plus grave. Une réparation percutanée de la valve mitrale avec le dispositif MitraClip est un traitement sécuritaire et efficace pour les patients à haut risque chirurgical. Nous voulons évaluer les résultats cliniques et l'impact économique de cette thérapie par rapport à la gestion médicale des patients en insuffisance cardiaque avec insuffisance mitrale symptomatique. Méthodes: L'étude a été composée de deux phases; une étude d'observation de patients souffrant d'insuffisance cardiaque et de régurgitation mitrale traitée avec une thérapie médicale ou le MitraClip, et un modèle économique. Les résultats de l'étude observationnelle ont été utilisés pour estimer les paramètres du modèle de décision, qui a estimé les coûts et les avantages d'une cohorte hypothétique de patients atteints d'insuffisance cardiaque et insuffisance mitrale sévère traitée avec soit un traitement médical standard ou MitraClip. Résultats: La cohorte de patients traités avec le système MitraClip était appariée par score de propension à une population de patients atteints d'insuffisance cardiaque, et leurs résultats ont été comparés. Avec un suivi moyen de 22 mois, la mortalité était de 21% dans la cohorte MitraClip et de 42% dans la cohorte de gestion médicale (p = 0,007). Le modèle de décision a démontré que MitraClip augmente l'espérance de vie de 1,87 à 3,60 années et des années de vie pondérées par la qualité (QALY) de 1,13 à 2,76 ans. Le coût marginal était 52.500 $ dollars canadiens, correspondant à un rapport coût-efficacité différentiel (RCED) de 32,300.00 $ par QALY gagné. Les résultats étaient sensibles à l'avantage de survie. Conclusion: Dans cette cohorte de patients atteints d'insuffisance cardiaque symptomatique et d insuffisance mitrale significative, la thérapie avec le MitraClip est associée à une survie supérieure et est rentable par rapport au traitement médical.

Competition law seeks to protect competition on the market as a means of enhancing consumer welfare and of ensuring an efficient allocation of resources. In order to be successful, therefore, competition authorities should be adequately equipped and have at their disposal all necessary enforcement tools. However, at the EU level the current enforcement system of competition rules allows only for the imposition of administrative fines by the European Commission to liable undertakings. The main objectives, in turn, of an enforcement policy based on financial penalties are two fold: to impose sanctions on infringing undertakings which reflect the seriousness of the violation, and to ensure that the risk of penalties will deter both the infringing undertakings (often referred to as 'specific deterrence') and other undertakings that may be considering anti-competitive activities from engaging in them (often referred to as 'general deterrence'). In all circumstances, it is important to ensure that pecuniary sanctions imposed on infringing undertakings are proportionate and not excessive. Although pecuniary sanctions against infringing undertakings are a crucial part of the arsenal needed to deter competition law violations, they may not be sufficient. One alternative option in that regard is the strategic use of sanctions against the individuals involved in, or responsible for, the infringements. Sanctions against individuals are documented to focus the minds of directors and employees to comply with competition rules as they themselves, in addition to the undertakings in which they are employed, are at risk of infringements. Individual criminal penalties, including custodial sanctions, have been in fact adopted by almost half of the EU Member States. This is a powerful tool but is also limited in scope and hard to implement in practice mostly due to the high standards of proof required and the political consensus that needs first to be built. Administrative sanctions for individuals, on the other hand, promise to deliver up to a certain extent the same beneficial results as criminal sanctions whilst at the same time their adoption is not likely to meet strong opposition and their implementation in practice can be both efficient and effective. Directors’ disqualification, in particular, provides a strong individual incentive for each member, or prospective member, of the Board as well as other senior executives, to take compliance with competition law seriously. It is a flexible and promising tool that if added to the arsenal of the European Commission could bring balance to the current sanctioning system and that, in turn, would in all likelihood make the enforcement of EU competition rules more effective. Therefore, it is submitted that a competition law regime in order to be effective should be able to deliver policy objectives through a variety of tools, not simply by imposing significant pecuniary sanctions to infringing undertakings. It is also clear that individual sanctions, mostly of an administrative nature, are likely to play an increasingly important role as they focus the minds of those in business who might otherwise be inclined to regard infringing the law as a matter of corporate risk rather than of personal risk. At the EU level, in particular, the adoption of directors’ disqualification promises to deliver more effective compliance and greater overall economic impact.
